Something much more serious is being stolen, guns. The city has seen a dramatic spike in car break ins, the number up 50 compared to last year. Headlines from just the past few months. Loaded gun that was reported stolen from a chp officer. High profile crime. Investigators say the gun use today kill a hiker using guns stolen from cars. What was ones a bad car burglary program has become an epidemic. Anybody that breaks into a car and finds a firearm in that car is now a criminal. Police say the break in problem is most prolific here at the palace of fine arts. During an undercover sting they target the rental cars. We set up on the back side of the building in a tight spot. The vehicle thats parked is the third from the end. It only takes an hour. Black shoes with white pants. Watched a man smash the black suv in just seconds. Hes now putting it back into the vehicle. The rest of the unit swoops in. Within minutes he and his driver are handcuffed. The victim a math teacher from arizona. This one actually make me think twice now about my impression. According to police, peter is just one of 67 people in San Francisco whose car will get broken into today. It skyrocketed over the last few years. From 6,200 in 2012 to up to 14,000 through the seven months of 2015. A lot of these guys are career criminals. Police say its not just laptops, suitcases and personal items that are being nabbed. Thieves are making off with guns fl the gun used in the murder of kate steinle and weapon after weapon, all leading back to a growing problem with car burglaries. A lot of these auto burglaries involve gang members and either they have guns or were finding guns. Each year nearly 200,000 guns are stolen nationwide from homes and cars. Just last month, Police Arrested 24yearold sean gibson, who she say is responsible for 22 auto burglaries. We found that theyre out there doing crimes of opportunity. They might do a robbery in the middle of auto burglaries. So whats keeping San Francisco from getting car burglars off the street. Theyre not getting any time. Going straight to probation. The majority of first time offenders receive no jail time and three years probation. Our courts view these cases as the lowest priority. District Attorney Says his office prosecutes about 80 of the auto burglary cases its given. The reality is that we have a problem thats increased tremendously in the last year. There is there has not been a Significant Police action on it. With 2 of the cases result in the arrest. Chief says his officers are cracking down. The captain at northern station says in just the first nine and a half months of the year, his district sent cases for 177 arrests to the das office for prosecution. The da challenges those numbers, saying that because of duplicate incident numbers, cases being discharged and other reasons, that number is actually 78. He says his offices role is just one part of the picture. Prosecutors do not determine what the sentence is going to be. The level of negligence goes across the board sometimes. It requires the community to be more thoughtful about what they leave in their cars and requires everybody to do their work well. A big part of the problem is repeat offenders. All of these 50 suspects have been arrested in San Francisco for car burglary at least five times since 2012. Police say the two suspects are 34yearold ricky and 28yearold aris. Investigators say they arrested sor el 6 times over the past four years for breaking into cars. These repeat guys need to stay in jail. If we can put them in jail and have them there for a while. It sends a really clear mess ablg to the rest of them. The da says more jail time is not necessarily the solution. There is evidence that indicates that incarcerating people for low level offenses actually makes them worse. There is evidence that says that even 24 hours in jail is enough sometimes to create a problem for rehabilitation for the rest of your life. As the number of break ins continues to go up, so does frustration. The public needs relief. Chief has created a special auto burglary unit and dedicating more resources to fingerprint processing. The da assigned one prosecutor solely to car burglaries. In the meantime, thieves continue to smash, grab, and make off with whatever they can get their hands on. This is a statewide problem. Many in Law Enforcement have blamed ab 109 or prison realignment and others prop 47, which was authored by george gascon. Others way its too early to tell and too difficult to attribute a change in law to a change in crime rate. Thats going to be an issue we explore further. Terry, your car has been broken into twice. This morning a federal Appeals Court reversed the ruling that declared californias Capital Punishment unconstitutional on the grounds that appeals took too long. We got off the phone with legal analyst who told us this ruling doesnt necessarily open the door to resuming executions in in california. Its a narrow ruling that decides one issue, that the long delays that prisoners face on death row face do not constitute cruel and unusual punishment. No one has been executed in california since 2006 after a federal judge ordered an overhaul of the states lethal injection procedure. Take a look at this home video.
