You will see the traffic is backed up for a 15minute delay. No major problems driving into the city. Also looking at the commute here on interstate 880 in both directions. Traffic is moving well. Starts to get a little bit slow towards fremont, but its not all that bad. I want to show you a live picture of San Francisco. Southbound lake merced, as you come around the corner near clearfield drive, this is a couple of blocks away from Lowell High School and some of the other schools there. A car went off the road. All you can see is the tire tracks, but there is a car in the marshy area. A couple of Police Officers there. Apparently, they did not find anyone in the car. The Fire Department left. That car is still there and they need a tow truck to get it out. The tow truck we were showing is not big enough. They need more cable. Just a bigger truck. That Ford Super Duty onetonto truck is not going to do it. They are going to bring in another one. A developing story in berkeley where an Early Morning shooting left two people in critical condition. An update from police. Reporter gasia, good morning to you. We got an update from a Berkeley Police sergeant and he told us this was not random shooting that happened overnight in this residential neighborhood. What remains unclear though is why this man and woman were targeted. The streets are still blocked off with crime scene tape. Investigators are continuing to gather evidence here in this South Berkeley neighborhood as they try to identify the shooter who was involved here. Now, take a look at the scene. This was just about 1 00 this morning. Police got calls about gunfire from a number of people who live nearby. When officers got here, thats when they found those two victims. This is on tremont street near prince street. Its just about a block away from the ashby bart station. The man and woman were apparently sitting in a white car you see there in the video. They were both shot. Both have lifethreatening injuries this morning. Police cant say much about the victims, how old they are or where theyre from. This overnight shooting happened hours after there was another shooting in a different part of town on the northside of berkeley near san pablo avenue that left a man wounded. We talked with the sergeant this morning who says that neighbors in this area should not be concerned about their safety. It does not appear to have been a random incident. This is our seventh shooting for the year. Not counting yesterdays. No homicides this year. One last year. Berkeley is still a very safe place to live. Again, our thoughts go out to the family of the victims from both yesterday and todays shootings. Reporter and the sergeant also did tell us that it does not appear as though that shooting in the during the day yesterday along san pablo near delaware street has any connection to this shooting that happened overnight here near the ashby bart station. We are still waiting to find out if police have any more information on the shooter they are searching for. They are not put out any description thus far what the shooter may look like or what their getaway car may look like. We will look for more information through the morning. Gasia, i am told that tremont street near prince street close to the ashby smart station should remain shut down for several more hours through the morning as they continue this investigation. Eventually he headed south on interstate 880. Police put down spike strips near the high street exit. They had to use a taser on him. Uber says it suspended his uber account and that they are working closely with investigators. 7 06. The Political Landscape has changed in the wake of yesterdays primaries. Hillary clinton and donald trump have picked up more delegates. Marco rubio is out. Doug luzader reports from washington on whats next. Reporter these were the states in play yesterday, and for democrats good night for Hillary Clinton for picked up at least four states. The jury is still out in missouri. But she may wind up running the table on Bernie Sanders. For republicans, its a much more complicated picture. Donald trump picked up florida, north carolina, and illinois. He was blocked in ohio. Ohio Governor John Kasich breathing a big sigh of relief and for good reason. He delivered his win or take all home state. The group is said to be looking at a contested convention if trump is not able to win the delegates he needs to take the nomination outright. Governor brown said monday if donald trump is elected president , california might have to build a wall to, quote, defend ourselves from the rest of this country. Sacramento bee reports brown followed that up by saying his remarks were a joke. He said we dont like walls. We like bridges. Welcome back to mornings on 2. 7 13. The chp investigating yet another shooting on interstate 80. It happened last night in pinole about 5 45. The chp says a woman was driving on interstate 80. Someone drove up next to her, pointed a gun at her, and then fired several rounds. No one was hurt. This is the latest in a string of freeway shootings along interstate 80 since november. There have been eight similar incidents between pinole and berkeley. Two were deadly. Richmond police said the shootings are between feuding gang members from richmond. Well, police havent said whether these shootings are linked to an attack against a party bus that is coming off the bay bridge last weekend. Investigators say two men drove up, opened fire as that bus was going from San Francisco to the east bay. Four people were hurt. The bus driver was able to pull into oakland and get some help from chp officers. Time is 7 14. A San Francisco nightclub where an apple analyst was recently stabbed to death is temporarily shut down. The cellar on sutter street voluntarily surrendered their liquor and entertainment permits. Joseph roz a was stabbed by a mob outside the door. He mobbed. Police arrested a 22yearold San Francisco man in connection with roz os death. Police say the temporary closure will make for a safer environment. 7 14. Police in vacaville want the publics help. They want to find whoever is causing thousands of dollars in damage to dozens of cars. Now, police say someone shot out the windows of at least 48 cars since friday night. They say there are probably two people involved. One person driving. The other using a bbgun as they go by. Most of the cases have happened on the south side of town. One victim says he taped his window together until he could get it repaired. It comes with a bill for 600. We go out and try to earning a living. We dont expect our stuff to get vandalized. Police say the best way to avoid becoming a victim put your car inside a garage until the vandals ever captured. Also people who have surveillance videos, check the video. It may be used as evidence. And police in nearby fairfield, they are looking for any connections between the vacaville vandalism and similar cases in their city. A county in the northside continues to be the healthiest in california. Marin county ranks number one for the seventh year in a row. The list comes from the Robert Wood Johnson foundation and the university of wisconsin. Factors that influence the list include length and quality of life as well as access to healthcare. There is another list out this morning of the happiest countries in the world, and denmark topped that list followed by switzerland, iceland, norway, finland and canada. The suspect is described as a white man between 25 and 30 years old with a skinny build and black wavy hair to his neck. A san jose couple has quite the story about their plans for a short camping trip in the sierra, but they needed to be rescued. Eli nunez and Patricia Rodriguez had enough food and clothing for a week, even though they planned to be there for a couple of days. After they saw how much snow fell overnight, they decided to go home on sunday. But high winds, zero visibility and tons of snow made that impossible. Eli is an experienced camper, but for patricia, this was a new experience. I trusted him. After the second day when i seen the snow up to his chest when he was walking, i was like, um, call search and rescue. He was like not yet, not yet. Well, when they did decide to call 911 they told dispatchers their proximate location. A chp helicopter found them in five minutes. The snow was so deep, it took the helicopter three attempts just to land. Rescue crews say the couple did the right thing to call for help when they did. But with republicans vowing to block any hearing on a Supreme Court justice replacement, the question is, will the candidates or nominees be appealing enough for both parties . One nominee being considered is sri srinivasan. He currently serves as a u. S. Court of appeals judge. Born in india. Raise inside kansas. He was appointed by president obama in 2013. He has a bachelors law degree and mba from stanford. His father was a full bright scholar at uc berkeley. Paul watford is on the u. S. Court of appeals in San Francisco. He would be the third africanamerican to sit on the high court. He has degrees from uc berkeley and ucla law school. According to congressional sources who spoke to the Associated Press, it appears that federal Appeals CourtMerrick Garland is likely to be the nominee. He is said to have a mod lit record as judge with a history of getting support from republicans. Garland was educated at harvard university. While the announcement is expected soon, will the republicans even hold confirmation hearings . Thats the question. Mitch mcconnell said he will block a hearing until the next president is elected. Today marks a painful anniversary for the family of sierra lamar. 15yearold sierra lamar disappeared on her way to school in morgan hills four years ago today. She left her them catch a bus. Police have not found a body. They arrested a man on murder charges based on dna evidence. Sierras father says the family is filled with sorrow, pain, and unanswered questions. Just really, really kills me, you know, that all the things shes she havent known the family hasnt seen her go through, Like High School graduation, college. Sierras family says they have pleaded with Garcia Torres to Say Something that would lead investigators to sierra. So far he has not said anything. His trial is set to begin next month. A San Francisco federal Appeals Court has dismissed a lawsuit filed by kidnapping victim jaycee dugard. She accused federal parole officers of failing to properly supervise Phillip Garrido in the years before she was abducted. In 1991, he and his wife abducted jaycee dugard. She was held for 18 years. She was sexually abused and gave birth to two daughters. The Appeals Court ruled she cannot sue over what parole officers did or did not do in the years before she was kidnapped because she wasnt gored os victim at the time. Time is 7 35. Tonight san jose residents, you have a chance to speak your minds about the future of medical marijuana dispensaries in the city. Ktvu fox 2s allie rasmus live in san jose to tell us whats at stake for the meeting tonight and why the issue is coming up now. Reporter some members of the city council back in december pointed out that the medical Marijuana Industry is changing and state laws may be changing along with it. Especially if california eventually decides to legal Recreational Marijuana use as other states have done in recent years. So the council pointed out it might be a good idea for the city to get out ahead of some of those changes in state laws. Some of the specific issues that are going to be discussed at a medical marijuana stakeholders meeting tonight include rules about how dispensaries grow and manufacture medical pot. Should dispensaries be allowed to grow it in one county and transport it to san jose . Also rules about dispensaries growing medical marijuana in greenhouses. How to regulate the transport and delivery of medical marijuana between the different cultivation and manufacturing sites through the state. San jose mayor sam liccardo spoke to ktvu about this yesterday. He said he doesnt believe the number of dispensaries will grow. Right now san jose has 16 medical marijuana dispensaries. That is a much more manageable number than the over 120 dispensaries we had a couple of years ago. We have got a set of regulations that we think are working based on neighbors that were concerned about redskins being closed to schools and sensitive areas where kids might congregate. Reporter changing the existing rules about where medical marijuana dispensaries can operate, that is not on the agenda tonight. The majority of the items they are taking up have to do with what are we going to do to regulate the industry in the future should some of these changes come down the pike. The Oakland City Council gave approval to selling a prime piece of property near lake merit, but not before protesters forced Council Members to get up and leave the room. Now, the protesters, they dont like the citys plan to build a new tower on east 12th street that includes housing for low and highincome residents. Critics say the whole building should be affordable housing. Last time it came up noisy protests shut down the building. This time the city council was ready to move to a smaller room to finish their room. It wasnt going to be hijacked this evening. We were going to do the business of the city. To sequester themselves and to have Police Officers guarding where they are and not allow the public in is a violation of the law. The city says it piped out audio of that meeting out to the public and recorded it. So anyone can find out what was said. City leaders say the next step in the project working out a Sales Agreement that could be worth about 5 million. After that deal is reached the actual work on the tower project could start as soon as early next year. There is a new revelation seeing the lack of cooperation between federal agencies in the wake of the Santa Barbara mass shooting last year. Administrators in the immigration and Customs Enforcement agency appeared before a Senate Committee yesterday. They acknowledged that one day after the terrorist attack, heavily armed Homeland Security team tried to intercept Enrique Marquez and his russian born wife at citizen ship and immigration office. Marquez is a friend of the Santa Barbara attackers. A worker at the Citizenship Office wouldnt allow the Security Team to enter the building. He wanted to check with his boss first. Do we need to look at our protocols to make sure those misunderstands dont occur . There was never an actual attempt to prevent them from doing a what they needed to do. They are also claiming they werent paid for all the hours they worked or paid my overtime, and that time clocks and time sheets were manipulated. The chefs lawyers say he is upette. Trouble for chickfila and the battles and the effects of two big health scares. Wall street is getting surprising news about the companys stock. Metro system is closed until tomorrow morning while a safety inspection, the whole system, is taking place. People who usually ride the subway in from maryland or virginia, they are scrambling to find buses or carpools to get where they need to go. The shutdown comes after a subway tunnel fire on monday. D. C. Metro says it was a tough decision to shut down the whole system on a weekday, but they say safety is the priority. A plea this morning for the return of stolen items. They are described as priceless by the victim, though they are probably meaningless to whoever took them. Someone stole a moving van. His mother is asking whoever stole the items to return them. The rental truck was stolen in oaklands rock ridge outside outside a friends home. That friend was driving the van to portland which included a vintage jewelry collection and family photos. My grandmothers picture when she was 21 years old. Its been in my family since the second world war. Her son, 50yearold michael moore, is blind and disabled from diabetes. She estimates 50,000 worth of items were stolen. The truck was recovered last week but ransacked and abandoned in east oakland. Major changes may be coming to the santa clara jail. New recommendations will be presented today. Now, sheriff lori smith wants to beef up the training of personnel and also increase minimum education qualifications for prospective guards. Also, she wants to upgrade background checks by having applicants take two polygraph tests instead of one. A homeless map from San Francisco will be getting a huge reward for helping the Police Capture two escaped inmates. That man, matthew chapman, will get 100,000. The two prisoners broke out of a jail in Southern California and made their way to the bay area back in january. Chapman spotted them in a stolen van near a Whole Foods Market in the haightashbury neighborhood. He pointed them out to the police and both were arrested. Three other people who helped in the capture, they will be splitting 50,000. San jose Police Officers are really going above and beyond the call of duty in helping a young shooting victim now in a wheelchair and cant walk. Nineyearold alexis was sleeping in his apartment when his neighbor fired a gun last october. The bullet went through the floor and hit his legs. Because he loves soccer, police arranged a visit with a player from the san jose earthquakes. He faces a number of surgeries and suffers from ptsd. They had some trouble getting the tow truck, the original tow truck that showed up was not big enough. Now theyve gotten this tow truck. They are going to have to shut down lake merced southbound near clearfield to get that tow truck into position. Lets go to some of the other commutes here. The bay bridge toll plaza you will see the traffic is moving along okay. No major problems here. Also looking at the commute on 80 westbound. Got a lot of slow traffic here to the macarthur maze. No major problems on 680. Its still backed up from 242 all the way down into danville. We had a couple of issues there. 8 02. Back to the desk. Back to that story sal was telling us about. Crews getting ready to pull a car out of the marsh at lake merced. Witnesses reported seeing a car go off the road at lake merced boulevard near clearfield drive about 5 00 this morning. San francisco fire crews came out, found the car. No one was inside or in the area, but here we are three hours later. The car is still in the water. Crews had to call for a bigger tow truck to get the car out. Thats the bigger tow truck that arrived on the righthand side of your screen. Neighbors say they see drivers speeding in this area all the time. You can go any neighborhood here in the sunset. 60, 70, 80 Miles Per Hour the cars are going. They are going way too fast. I am surprised nobody died here. The southbound lane of lake merced boulevard is closed in the area while crews try to get that car out. Keep that in mind this morning. 8 03. New this morning president obama is just set to announce his nominee for the next Supreme Court justice. The president is about to make the announcement from the white house. Heres what we know so far. A number of unnamed sources already they expect the nominee to be Merrick Garland. 63 years old. He was confirmed to the washington, d. C. Circuit court of appeals in 1997. At that time garland had backing from majority of both parties, including seven current republican senators. Now, remember republicans have been saying almost since Antonin Scalias death they will block anyone the president tries to nominate in this hotly contested election year. It remains to be scene what republicans have to say in direct response to what we expect to be the nomination of Merrick Garland by president obama in just minutes this morning. What we know about mr. Garland, if he is that person, he is a longtime washington, d. C. Lawyer, a jurist. Two people were shot and critically wounded overnight. They were a man and woman sitting in a car when the shooting happened. Alex savidge is live at the scene with what police are telling you about a motive, alex . Reporter good morning to both of you. Berkeley police cant say exactly why this man and woman were targeted in this Early Morning shooting, but what they will say is that they have evidence to suggest that this was not a random shooting. Investigators are still here at this scene in this South Berkeley neighborhood. Crime scene tape still blocking off the area. You can see a tow truck has just arrived here. In all likelihood, to tow away the car at the center of the investigation. Thats the car the victims were sitting or standing next to when they were shot. Investigators again are working to try to identify the shooter in this case. That person remains at large. Now, heres a video of the scene from earlier this morning. Police got called about gunfire in this neighborhood from quite a few neighbors after 1 a. M. They responded to tremont street near prince street. And this is just about a block away from the ashby bart station. The man and woman who were shot while in or near that car both were taken to the hospital with lifethreatening injuries. And a sergeant talked with us this morning about the investigation. He told us its clear the victims were targeted for some reason. That evidence would come from Eyewitness News accounts. Any information may be from the victims themselves. But at this point it doesnt appear as though the shooting was random. Reporter and i also asked the sergeant if he had any information on these two victims. Told me that he cannot say where these victims are from, how old they are. But again both of them are at the hospitals here in the bay area. Both of them in the east bay, i should say. Both of them have lifethreatening injuries. We have, of course, will work to get more information through the day on their respective conditions. Investigators have not put out any sort of description on the shooter. If they have that information, they have not put it out yet to the public. We will wait and see whether they do that at some point later on today. Again the scene here in this neighborhood is blocked off with tape. It looks as though they are in all likelihood about to tow away and the car and maybe get the streets back open. Police say residents shouldnt be worried. I am sure it is unnerving skiing crime scene tape up in your neighborhood . Reporter right. A number of people were frankly walked through this neighborhood trying to get over to the bart station, which again is just about a block way from here, and having this area blocked off, block their path trying to get to the bart station and many people wondered what was going on. Some people did hear the gunfire. And certainly it was unnerving for them and put them on edge. But the police, you know, want to put it in some context here and thats why they are emphasizing that they dont think this was some sort of a random attack on this man and woman. They believe they were targeted for some reason and they are hoping that puts the public at ease. Alex, thank you. In berkeley, that was the second shooting in berkeley in the past 24 hours. There was one reported at about 11 30 yesterday morning at san pablo avenue and delaware street. Police say a 28yearold man was shot at least once and has lifethreatening injuries. The berkeley s. W. A. T. Team shut down the neighborhood to search for the gunman and people were asked to shelter in place. The shooter remains on the loose this morning. Time is 8 15. Ohio Governor John Kasich breathing a big sigh of relief and for good reason. He delivered his winner take all home state and brushed back donald trump. We will beat Hillary Clinton and i will become the president of the United States. Reporter big talk, but this is kasichs first and only win so far. Still, it makes it much more difficult for trump to win the nomination outright, making a contested convention this summer more likely. Florida senator marco rubio. Despite pledging to keep running no matter what, he suspended his campaign after a trump trounceing in his home state. The fact that i have even come this far is evidence of how special america truly is. Hillary clinton went a long way to locking down the democratic nomination and made a confident pivot attacking republicans. Our commander in chief has to be able to defend our country. Look at all the road sensors firing up red from san leandro and 580 is also pretty slow getting up to downtown oakland. 680 as you come down from concord to walnut creek is slow. Steve mentioned lake merced. They have closed southbound lake merced boulevard to get the tow truck into position. They will be pulling out this car that went into the water early this morning. San francisco Truck Company has ride just to make sure that everything stays under control really as a precaution. But they are going to be pulling a car out of the water at lake merced. You can kind of see that the area, kind of a steep area down there. People are watching. Again, southbound lake merced near clearfield is close. The president says he went through a process with both republicans and democrats and garland is the choice for this position. These qualities and his long commitment to Public Service have earned him the respect and admiration from leaders from both sides of the aisles. He will ultimately bring that same character to bear on the Supreme Court. An institution in which he is uniquely prepared to serve immediately. Senate Majority Leader Mitch Mcconnell says he will block any hearing until the next president is nominated. Garland was educated from harvard university. Grew up in chicago. Reporter part of it has to do with the fact that there will likely be a referendum on the ballot in california later this year to legalize recreational american use. Some of the city Council Members thought it would be a good idea for the city to take a look how it regulates medical marijuana dispensaries with the idea of changing those regulations ahead of any changes in state law later this year. They want the public to give them input tonight. Rules about how dispensaries grow and manufacture medical pot and transport those goods from multiple locations within the city and possibly through the state. Rules about dispensaries growing marijuana in greenhouses in san jose. And also how to regulate the transport and delivery of marijuana between different cultivation and manufacturing sites. If marijuana is legalized in november, we have to be prepared. I think we are in a much better position than opposed to cities that are just outright banning it. We in a much better position to be prepared for recreational sales, just like we monitor alcohol, cigarette sales. Reporter san jose has 16 medical marijuana dispensaries in the state right now. They say that the number is not expected to grow. They point out the existing rules about where medical marijuana dispensaries are allowed to operate here in san jose in relation to schools and kidfriendly zones, that is not expected to change. That is not up for discussion at this meeting tonight. The chp investigating another shooting on interstate 80. It happened last night about 5 45 near appian way in pinole. A woman was driving on interstate 80. Someone drove up next to her, pointed a gun at her, and then fired several rounds. No one was hurt. Now, this is just the latest in the string of freeway shootings along interstate 80. There have been at least eight similar incidents between pinole and berkeley in november, and two were deadly. Police say its between feuding gang members from richland. Police havent said whether these shootings were linked to an take on a party bus last week. Investigators say two men drove up, opened fire as the bus was going from francisco so the east bay. Four people were hurt in that attack. The bus driver pulled into oakland and got help from chp officers. A well known chef is being sued by two former employees for Sexual Harassment and labor violations. The women say michael charello made crude comments and home phonic and homophobic slurs. They say they werent paid for the hours they worked or paid overtime and time clocks and time sheets were manipulated. Chars manipulated. A van was stolen last week. Now that mans mother is asking for whoever stole the items to return them. The rental truck was stolen in oaklands rock ridge neighborhood from outside of a friends home. That friend was going to drive the truck to portland and deliver the belongings which included irreplaceable items such as vintage jewelry and family photos. Time is 8 39. Police in richmond searching for the driver who lost control of a car yesterday afternoon and crashed right into a house. It happened afternoon 1 00 at sweet wood and morning side drives. Police were called to the area about a report of a suspicious vehicle and say two people in that car ran away from the crash. A perimeter was set up nearby Deanza High School was put on iowa. Police arrested the passenger, an 18yearold man from oakland, but the driver is still on the loose. A man who lives in the home with his wife for the past 40 years was pretty shaken up about what happened. You know, why it happen to us . Why . You know, we dont do any damage to anybody, try to help everybody. So i dont know. We were at the front door. Now, no one was hurt. Police found stolen electronics in that car. They are trying to figure out if those items were stolen from that neighborhood. The Oakland City Council approved selling a prime piece of property near lake merritt, but not before protesters forced the Council Members to get up and leave the room. Protesters dont like the citys plan to build a new tower on east 12th street that includes housing for low and high income residents. Critics say the entire building should be affordable housing. This time the city council was ready to move into a smaller room to finish its work. It wasnt going to be hijacked this evening. We were going to do the business that the voters of the city required and except for us to do. For them to sequester themselves and have Police Officers guarding where they are and not allow the public in is actually a violation of the law. The city says it did pipe out audio of the meeting out to the public and recorded it as well. So anyone could find out what was said. The city leaders say the next step in the project is to work out a Sales Agreement that could be worth 5 million. Actual work could start as early as next year. There is a new revelation showing the lack of cooperation between federal agencies after that Santa Barbara mass shooting last year. Administrators in the immigration and Customs Enforcement agency appeared yesterday before a Senate Committee. They admitted that a day after the terrorist attack a heavily armed Homeland Security team tried to intercept Enrique Marquez and his wife at citizen ship office. Marquez was a friend of the Santa Barbara shooters, but a worker at the Citizenship Office wouldnt allow the Security Team to go into that building. He wanted to check with his boss first. There was never an intent to prevent them from doing what they needed do. Now, marquez and his wife, they never showed up for the meeting. Apple filed a brief claiming the governments actions would apaul the nations Founding Fathers. A short of bus drivers in marin county is creating frustration for users. Its causing an unusual number of delayed or canceled buses. More trouble for chipolte battling the effect of two big health scares. Now the companys stock is disappointing investors. Pam cook back in the studio with more on the future of chipolte. Reporter yeah, the stock dropped 20 a share or 4 shortly after the opening bell. It has come back a bit now. Still down 11 a share. Wall street is reacting to chipoltes filing with the sec stateing that it expects a loss for the First Quarter of 1 a share. Analysts were expecting a gain of ten cents a share. Thats a huge discrepancy. Part of the reason sales at its restaurants dropped 26 in february. 36 in january from the previous year. And that is after the two outbreaks we have been reporting. E. Coli and then also separate norovirus outbreaks. Chipolte is based in denver. Management says it has implemented many changes since the health scares, including dna testing of its ingredients and then precooking some of the meat in its central kitchens. The company now warning investors it will have to spend money on a federal investigation into food practices which will make things hopefully safer. The Fire Department came and figured out there was no one from it at the time. They didnt find Anyone Around it. Now they are pulling the car out of the water with this super long tow truck. The Fire Department is there as a precaution. But this is a tricky operation as they try to slowly pull this car out of lake merced. Meanwhile, southbound lake merced boulevard is shut down. You can see the thick brush and some of the marshy area. Not sure what happened here. But again we dont know of anyone who was injured because the Fire Department did not find anyone when they arrived. Police are on the scene and this is going to be going on for a little bit.
