New this morning, apple puts its foot down defying a judges order that is a case of a matter of security versus privacy. Apple says it is going to fight a court order to help the feds hack the iphone of one of the San Bernardino shooters. Ktvu fox 2 janine della vega, you are at apples headquarters in cupertino now. Well, tim cook says that by Building Software that breaks into an iphone, it would create a master key that would unlock hundreds of millions of locks, and he says that that is dangerous. Now, in a statement on apples web site this morning, cook explains his stance. Cook says he believes the fbis intentions are good. But what they are asking for would undermine encryption. And set a dangerous precedent. The fbi has been unable to access data on syed farooks iphone, because it is pass code protected. Farook and his wife killed 14 people in San Bernardino last december. And agents want to know if he was communicating with terrorist groups overseas. Yesterday, a federal judge ordered apple to build software that would help the government get access. Cook says, quote, in the wrong hands, this software, which does not exist today, would have the potential to unlock any iphone in someones physical possession. While the government may argue that it is use that would be limited to this case, there is no way to guarantee such control. The order by the judge is the first of its kind ruling. And it opens up a whole debate about privacy in a digital world. And national security. Cook says this moment calls for a public discussion. A Sonoma High School is in the headlines for all of the wrong reasons after a fight on campus was captured on video tape and went viral. Alex savage joins us now from sonoma with that video, and how the school is reactioning, alex. Reporter well, good morning to you. This assault happened here, at sonoma vally high school. Last thursday. A girl from a neighboring Alternative High School came here, and beat up the boy who attends this school. Now, the boy was not seriously hurt. At least it wouldnt appear that way. He was checked out by emts but of the attack has drawn quite a bit of attention online. Here is the video shared on facebook. And now viewed by millions of people all around the world. You can see the girl drops the boy to the ground, knees him in the face, twice. And this video went truly viral over the weekend. After it was posted on the Facebook Page of mma fighter kit dale. Now, after the assault, the girl who attends Creekside High School can be seen running off, a teacher chases after her. And the district has asked facebook to remove this video, because of the violent content. But according to the district, facebook has declined. Now, in a statement, the superintendent said, in part, quote, we hope that you as parents take this incident as an opportunity to remind your children about the acceptable use of social media and the responsibility that goes with it. And obviously, the district says that this kind of behavior is unacceptable. Some people commenting on the Facebook Posting, by the way, have mentioned that they believe that this girl targeted that boy, because he had been bullying other students. That is not confirmed though, pam. And the district has said that many of the comments that they have seen online are inaccurate. So it remains to be seen exactly what prompted this assault. All right. Hopefully we will hear more about that. Thank you, alex. Three teenagers are in the hospital, this morning, after they were shot last night, while sitting in a parked car in berkeley. That happened at about 7 30 on Parker Street near the marina. The shooter approached and opened fire. The investigators are trying to determine if the person was in another car or walked up to them. It is believed the victims range in age from 16 to 19. Coming up at 5 30, a live report about the shooting, and the conditions this morning, of the three victims. Time is now ash 07. The man accused of killing an offduty Richmond Police officer last week is due in a fairfield courtroom this afternoon. 30yearold robert vega is held in the Solano County jail on suspicion of murder. And accused in the Fatal Shooting of the veteran Police Officer gus vegas in the vallejo home during an apparent family dispute. Robert vega is the father of gus vegas 6yearold grandson. A Memorial Service for gus vegas will be held on friday at the richmond Memorial Auditorium at Civic Center Plaza at 10 00 a. M. Open to the public. However the burial and the reception afterwards, that will be just for family, friends, and fellow Police Officers. Well, the search has been suspended for a prominent santa rosa attorney. Reported missing along the Sonoma County coast. 56yearold Steven Mitchell went missing on saturday. His car, his cell phone, and some of his clothing, turned up the next day, in a coastal area near jenner. Yesterday Authorities Say they are suspending the search, pending new information. Now, they didnt provide any more details, but they did say, there is no evidence that mitchell was a victd victim of a foul play. Mitchell was involved in several high profile cases including the shooting death of 13yearold andy lopez in santa rosa in 2013. At about 2 30 this morning, after a contentious meeting with more than 100 speaker, the almeda City Council Gave preliminary control to a rent control measure. It has been the subject of heated meeting in almeda for months now. The measure that was approved doesnt make renters or landlords completely happy but strengthens the citys process for reviewing rent increases of more than 5 and limits evictions and it requires landlords to help pay a tenants moving costs for some evictions. We need very fair strict guidelines that are actually monitored and enforced. To be able to make renters feel safe in their own homes again. That they are not going to come home to a 60 day notice. It is about time landlords and Property Owners are not demonized. The City Council Gave plim mare approval to the measure and preliminary approval to the measure and there will be a second reading of the ordinance at the next meeting. Danville last night adopted a crackdown on what are commonly called air b b rentals. The meeting was packed with people who wanted to speak about the ban. Supporters say that rentals create traffic and parking problem, as well as cut into scries visitors spending money in hotels and restaurants and opponentses say they should allow people to do what they want with their property. There was a 41 vote. And danville will have an agency set up to enforce the ban and handle violations. A man suspected of a triple shooting on San Franciscos twin peaks may be in court later today. Fema says camsens are buying flood californians are buying Flood Insurance at a near record raet since it started issuing warnings about flooding danger. And fema is at a greater risk because of the recent drought and recent wildfires. Victims of the fire in lake county, some pee say they cant afford to replace what they have had and moved out of town but others are starting to rebuild the homes they lost last summer. The first step is cleaning up what was left behind which includes toxic metal, broken septic tanks and debris from burned buildings, and trees. And local Authorities Say all of those things create risk, along the biggest creek that runs through middletown. And crews have put hydro seeding blankets on some of the hills that are most at risk. This morning, apple ceo tim cook says his company will resist a federal judges order to help the fbi break into an iphone belonging to one of the shooters in the deadly San Bernardino terror attacks. In a statement posted early this morning apples web site, cook argued that it would create a back door that could use be used on future devices. The ruling yesterday was a first of its kind. Investigators want to know if the shooter was communicating with terrorist groups overseas, and so far, they have been unable to access data on his iphone because it is pass code protected. Thats why the judge ordered apple to help the government get access. But cook said, quote, this moment calls for public discussion, and we want our customers and people around the country to understand what is at stake. Now, ktvus janine della vega will have more on the story coming up at 6 00. Three teenagers were shot in berkeley. They are in the hospital right now. And police are looking for witnesses. Ktvu fox 2ali ras muss is joining us from Berkeley Police headquarters. What is the latest, what do we know . Well, one of the things investigators are trying to figure out is whether the teens lived in the area, where they were shot, or if they were just visiting. You a three young men were sitting in a parked car on a residential street in Southwest Berkeley when they were shot at 7 30 last night. Thats when are the residents on Parker Street near san pablo reported hearing gunfire. And there were teens on the side of the street suffering from gunshot wounds when Police Arrived two. Were rushed to the hospital in serious condition. A third went to the hospital with what was described as nonlifethreatening injuries. Now, the teens range in age from 16 to 19 years old. Berkeley police say it is pretty clear this was not a random attack. Although they are not sure whether one or all of the teens was the target of the shooter. As of last night, investigators were still trying to find out what the teens were doing in the area when the shooting happened. Trying to find out if anybody lived in the area or if they just happened to be hanging out or you know, basically, you know, why would somebody specifically target these three individuals. So those are all things that we are going to have to try to answer. Now, investigators are not certain whether the shooter was in another car, or on foot. Berkeley police canvassed the area, talked to witnesses, and they were hoping and asking anyone who saw or heard what happened to give them a call. Later this morning, we are going to be checking in with Berkeley Police, to get an update on the investigation, and also find out if anyone has been arrested, as of 10 30 last night. Well, the man suspected of a triple shooting at a Popular San Francisco tourist spot could be charged as early as today. 26yearold Richard Contreras faces charges including two counts of murder and one count of attempted murder. If prosecutors add in special circumstances, such as multiple murders, they could seek the death penalty. Now, he is accused of opening fire at the scenic Twin Peaks Lookout last sunday morning, killing 21yearold julio peraza and 19yearold renee mora and critically wounding an 18yearold man. We believe the three victims were targeted by the suspect, and what the connection was, we dont know. We are trying to figure that out and the motive for the shooting is still yet to be determined. Sources tell us here at ktvu news, that contreras has a long criminal record which includes auto theft, evading police, and weapons violations. And police say in 2014, he was driving a stolen honda that crashed into a transit bus in richmond and slammed into a house. That bus narrowly missed a 3 monthold boy inside the home. Well, as Police Search for a motive in the twin peaks shooting, the father of one of the young men killed is sharing his heart break. He wanted to join the army. He wanted to go to school. He had his life in front of him. It is such a change. It is such a terrible thing. Renee mora senior says his son loved basketball, soccer, and rap music. He says he is trying to stay strong for his wife and two other children. But he has never heard of the suspect, Richard Contreras, and has no idea why he would want to harm his son. I heard on the news that it was a targeted situation, that they were targeted. And i would like to know more about what is going on right now. I dont have time, i dont have i mean i dont even feel like doing anything about it right now. But i would like to know more about how this when down. Morris says his son liked to visit the twin peaks look outbecause of the view and he said even though police have a suspect in custody, it does not give him much comfort, because it wont bring his son back. Time now is 5 36. Mental Health Experts from the centers for disease control, they are now in palo alto, investigating a trend of teenaged suicides. Now, since 2009, nine teenagers have committed suicide on the train tracks, near palo altos gun high school. And that has prompted the investigation into what the Santa Clara County Health Department calls a rash of suicide clusters. And for the next two weeks, members from the cdc will meet privately, for the Health Department, the School District, and community organizations. One of the reasons that we invited the cdc to come and look at this, is we wanted to look at it, through a Public Health frame. The purpose of the cdcs visit is really just to help us look at patterns and trends, in suicides across the county. Particularly among youth. The cdc will report to the county Health Department, after their twoweek visit. The San Francisco District Attorneys Office and the fbi, they are teaming up in an effort to end public corruption. Public corruption is a cancer that must be rooted out and extinguished. District attorney George Gascon says the joint criminal task force will target corruption in San Francisco. And that announcement follows the arrest of former city officials, zula jones, bazla margeer and former political consultant Keith Jackson and all are facing charges including bribery and money laundering. The good old boys, the pay to play system that has worked in San Francisco so well, for so long, has to end. And we believe that this is a beginning of that process. Now District Attorney gascon says the task force is a way to use federal resources and investigators to look into possible wrongdoing by city officials. The San Francisco public defender told the croon kal chronicle says he is worried the Traffic Force wont be transparent. Overtime the a the San Francisco Sheriffs Department is on the rise. According to the chronicle, overtime went from 12 million in 2012 to 16 million last year. The paper says this comes even as the number of jail inmates is on the decline. The Department Says it is short staffed due to unexpected retirements and says it is working to replace those retirees. There are also 40 people out on disability. With the rain headed into the bay area tonight, San Francisco city leaders are hoping more Homeless People will take advantage of a new shelter that is set up on pier 80. Last week, we reported that the city said the shelter was not getting much use. Possibly because of the warmer weather. But tonight, rain is expected to fall and the city is encouraging the homeless to take advantage of the new dry place to stay. The temporary shelter opened at the beginning of the month. And according to the San Francisco examiner, as of yesterday, the shelter has only been about half full. Time now is 5 39. A charity in concord, they are asking for help this morning, and they want to get a stolen pickup truck back. The Monument Crisis Center says that truck is crucial to their work, they help feed the hungry. They use it to carry donation barrels and also food to and from the center. And monday night, someone stole the truck from outside the facility. Just before the theft, a camera caught a man walking up to the front of the building, and looking inside. Then you can see the Truck Driving out of the Market Street parking lot. I want to find the truck. I want to hope that it is in one piece. So that we can go back to doing the work that we are doing. The district has tried unsuccess tally to have this online video taken down. And it shows an assault that happened last thursday. Here at Sonoma Valley high school, during the lunch break. It is unclear exactly what prompted that attack. But you can clearly see a girl who is from a neighboring Alternative High School beating up a boy who goes to this school. Here is the video, posted on facebook, and now, viewed by more than 13 million people. You can see the girl drops the boy to the ground, and then knees him in the face. Twice. And the video went truly viral over this past weekend, after it was posted on the Facebook Page of popular mma fighter kit dale. Now, following the assault the girl who attends Creekside High School runs off, a teacher chases after her, and it is unclear if she caught up to her. The district did ask facebook to remove this video, because of its violent content. But according to the district, facebook has declined. Now, some people commenting on that Facebook Post suggests that the boy who was being attacked there had been bullying other students. But the district says that many of the comments they have seen associated with the Facebook Post are inaccurate. So it remains to be seen exactly what prompted this assault here on campus. Especially south bay, and parts of the peninsula, i have seen gusts about 25 to 35. Right around Mountain View and palo alto. And even over to hayward and oakland. So other locations, what wind .
