in both directions. >> yes, it is. this crash first started on northbound 101 but then the car flipped and ended up on southbound 101. the three lanes are blocked before the airport exit. northbound 101 is also affected. this is in front of the airport. if you were making a movie about get away day, seems like it would be fix. we don't have them that often but both directions of the freeway are slow. news chopper 2 is giving us a look at the traffic. you can see how traffic up the peninsula is slow. southbound 101 is slow now. you may want to consider using bart. bart is not affected by this. san francisco airport, looks like there is more slow traffic down getting up to the airport. san francisco airport is accessible by some of the side roads but those will be crowded as well. give yourself extra time. if you add another 30 to 45 minutes it may be okay for your drive. we are hearing someone was hurt. it is not a fatality, at least not yet. that would be better for the person but for us who are trying to get to the airport. let's go to claudine wong who is at the san francisco terminal. >> we have been watching how the accident could affect people heading to the airport. you can get stuck in traffic but that's not the only thing that could change your plans today. mike mckaren joins us live. you say it's not just the passengers but the crews. >> a lot of them stay in hotels downtown. fortunately we got through the morning rush okay but we haved mid-morning bank of flights. that could be an impact. we don't see an impact but we have to watch the next several minutes as the traffic builds. >> they will probably be calling in as soon as they realize, we have an issue. it's a domino affect. it could affect people later in the day when the accident is cleared up. >> hopefully we can get the crews in quickly enough. it could have lingering effects throughout the day. maybe they will find out early enough and take 280 or another route to the airport. >> reporter: that will be something we are watching. we are watching the monitors, too for everything on the east coast. everything is on time. mike said he checked with the airlines and no major problems to report. we have been taking a look in the airport and things are looking good. i want to take you outside. you talk about how difficult it is to get to the airport and looking outside and looking at the traffic moving in and out of the airport, it's very, very low. i don't know if that is because of the accident. it seems to be people are trying to get here and can't get off the freeway it will be quieter. some of the traffic is moving smoothly through here the taxis and airport shuttles. not a lot of cars. we will monitor the situation out here and see if the people that are pulling up here did have a lot of trouble getting to the airport today and check back with you later on mornings on 2. claudine wong, ktvu. the landslide that damaged several homes is the focus of a lawsuit. tara moriarty has more with damage in question. >> reporter: this landslide that happened in march has created a slew of problems for homeowners. you can see this is a makeshift drainage pipe. it snakes all the way up through the backyard and you can barely make out back there where the tarps are and the sandbags. that's where the landslide hit. it damaged seven homes. last month three homeowners filed a lawsuit against the city accusing it of improper dine and maintenance of drainage over the years. the group is suing their neighbors whose houses are at the top of the slide. they say those homeowners did not care for the drainage system the way they should have. it's not uncommon for neighbors to sue neighbors but initially neighbors put up a united front against the city. they were flabbergasted that a mudslide happened in 1958. they say the city should have informed them. since it happened on public property it will fix the surrounding property but it needs funds to do so. tara moriarty, ktvu news. the occupy sf camp what maybe moving to a new location in time for the holidays. 400 protestors are camped out at justin herman plaza. many businesses are frustrated as the holiday season gets under way. they say this tent city will kill their business unless the city takes immediate action. san francisco mayor ed lee is talking to the protestors about moving the came -- camp to an old high school campus. many protestors say they have no plans to move out of justin herman plaza. oakland police booted oakland demonstrators out of their camp. police officers were watching as they peacefully packed up the tents and left the new camp al 18th and linden. most left voluntarily after getting word the owner of the property wanted them to move. however, at least 50 occupy protestors came back a couple of hours later. they seemed determined that they will stay there. it's not clear how oakland police will respond. it is black wednesday. the california highway patrol is gearing up for one of the worst nights for excessive drinking. mothers against drunk driving say tonight is when people begin celebrating the holidays. they say this is when college students are returning home and parents became more relaxed about under-age drinking. the holiday begins tonight at 6:00 and lasts until midnight sunday. if you are looking for a way to stay off the roads, amtrak is extending the service. the train that usually stops at oakland's geek lemon station will continue to san jose. amtrak will add extra trains through sunday to deal with the crowds. it expects today and sunday to be their busiest travel days. we have a traffic mess this morning near sfo. sal, what is happening? >> we have the crash and just to update you in case you are joining us, a car driving on northbound 101 near the airport lost control, flipped over in the southbound lanes. that is why the police, when they arrived, the chp when they arrived saw activity on both sides. the crash ended up southbound on 101 in front of the airport. but, again, northbound 101, those lanes are blocked as well because that's where the car ended up driving -- essentially driving through that center median and flipping over. so, now, it looks like the car has been righted by tow trucks. one person was taken away. they are making progress in the crash but on the top of your screen that is northbound 101. that is backed up to burlingame. southbound 101 is backed up into south san francisco. bart is a good option or leave the house super early, even earlier than you were planning to to get here. let's take a look at the bay bridge toll plaza. not a regular commute day. there is slow traffic -- there was. now it seems to be dissipating. the crash on 101 at sfo. let's move the maps to the south bay. 101 near the capital expressway there is a crash on the shoulder. it doesn't appear to be a normal commute day with traffic lighter than normal almost everywhere you look including contra costa county at 680. highway 4 slow traffic westbound through the construction zone. >> good morning. a lot of cloud cover over us. fog out to the valley and interstate 80. the wind is a bigger newt gingrich said he did not believe millions of illegal immigrants that have been here for years should be deported. critics say it amounts to amnesty. >> the party that says it's the party of the family is going to adopt an immigration policy which destroys families that have been here a quarter century. >> the right course is to say we welcome people who want to come here legally. >> reporter: rick santorum made headlines saying he supports racial profiling of muslims at airports. it's a position ron paul challenged asking for an example where profiling actually helped catch anyone. carol hahn, ktvu news. the famous navy blue angels may became victims of budget cuts. supporters are even saying the $37 million a year that the pentagon spends on the blue angels could be better used elsewhere. automatic spending cuts triggered by the failure of the super committee will mean 1 trillion in defense spending cuts the next 10 years. the commander of the blue angels says their goal is to inspire people to enlist. he says it's tough to put a price tag on that. well, there is movement in congress toward killing federal funding for california's high- speed rail project. california's republican members of congress say the project has become too expensive. $3.3billion in federal grants have been approved to begin construction next year. however, some say the money should be used for highway construction instead. this morning, president obama is using his executive powers to spare the lives of two turkeys at the white house. here is a live look of at least one of the turkeys a waiting the good news. at 7:30, the process this year's birds went through to prepare them for the white house appearance. also there are interesting names. we will go live to the think fans from taking up the -- young fans from taking up the habit. the "sacramento bee" reports that george demanded that students take turns bringing snacks to his class. he said it was his way of to develop renewable energy cheaper than coal. these the third spring cleaning announcement since larry page took over as the ceo. he said other companies are in about r a better position to take -- in a better position to take renewable energy to another level. this is not the fish story that got away but taken away. a massachusetts fisherman captured this 881-pound blue fin tuna in his nets earlier this month. the rules state blue fin can only be caught with a rod or reel. that fish probably would have broken it. federal officials seized the tuna but the fisherman is not expected to get a cut. a 754-pound tuna sold for almost $400,000. the national park service wants to turn an oyster farm in point reyes national seashore into a wild derness area to protect harbor seals. they recommend more scientific studies before concluding the operation harms harbor seals there. the interior department will ultimately decide if the drakes bay oyster company can stay at the location. she was alive for hours in the water before being carried out to sea. an investigation into her death was reopened last week. police in santa rosa say a man in custody may be responsible for holding have evidence he is responsible for two other recent holdups in the area. san francisco mayor ed lee has signed legislation designed to close a loophole in the city's health care program. businesses will have to put money aside for employee health care costs for two years. in the past, money not used went back to the employers at the end of the year. however, supervisor compos says the law didn't blocking both directions of the freeway. now it's only blocking southbound. we will go to news chopper 2. you can see southbound 101, one lane is getting by at the san francisco airport. this flipped over s.u.v., they have righted it and are putting it on a flatbed tow truck. southbound 101 is closed. the car came across the center divide. southbound 101 big delays out of san francisco. if you don't have to go to the airport today and you are just driving down the peninsula, use 280 instead. northbound 101 traffic is recovering because the lanes are closed there. if you are driving from san mateo or burlingame -- i just saw a fender bender that one of the engineers pointed out, there it is. there is a little fender bender northbound 101 with this big rig and car getting too ambitious trying to get in the way of a truck that did not stop. this is the kind of morning we are having at san francisco airport. let's move to the san mateo bridge. not a bad drive. the bay bridge toll plaza is lighter than usual. >> a lot of cloud cover. the wind has picked up, not only here but north. range at -- raining at mount shasta. the main rain band is off the coast. it will get here late tonight into tomorrow. if you are heading to the sierra, the fog in the valley will be a bigger story than anything else. gusts up to 30 last i saw. increasing clouds. the system has a lot going for it but it's crawling along. temperatures have been going up due to the cloud cover coming in and the wind in the higher elevations turning southerly. we will have a cloudy to breezy day. upper 50s, 60s. the front will weaken, align itself north to south then the southern end will split. some of the rain may not make it until tomorrow morning. mostly cloudy, highs in the 60s for some. upper 50s, mid-50s north, especially up to mendocino county. i think the rain will be gone by thursday afternoon. partly sunny friday. for the weekend, dry and warmer but thick fog. developing news on this holiday get away day. a crash, this one near sfo. a lot of people may miss their flights. we have developing news. this crash at san francisco international airport is now beginning to be cleared up. you can see the tow truck there has the vehicle on its flatbed. we have add least four lanes on southbound 101 closed heading down to the san francisco airport. northbound 101, those lanes have been reopened. there was a fender bender there but that was cleared off to the side. look at the backup on southbound 101. we are in very slow traffic southbound 101 extending out to south san francisco. this may or may not affect crews coming to the san francisco airport. claudine wong is checking that. >> reporter: i want to take you to the entrance to the airport. we have been monitoring the traffic in and out of here. it has been very light. it leads us to believe that some people could be having a lot of trouble getting here to the airport because of this accident. that is certainly not good news for people trying to fly out today. everyone who is flying out the day before thanksgiving doesn't have a lot of wiggle room to get where they need to go and flights are expected to be full. 135,000 people are expected to fly out just today. we have been talking to people out here. most of the people we talked to said we just missed that accident. we are so glad we missed it including a bus driver that got a phone call that allowed him to go around. >> 101 southbound flipped over coming north. >> you knew about it and went around. >> yeah, someone call me. >> otherwise you would have a lot of unhappy people. >> we would. >> so, he had a lot of relieved people. taking a live look back outside of sfo international airport, cars are making their way in. as far as on the east coast, for now things are looking good. we checked with the airport spokesman and things are looking good. you talk about crews and the backup, crews are supposed to be here two hours before the flight. if they get stuck in the backup, that could cause a backup for midday flights. there should be enough warning for people to go around but it doesn't take much to cause a miss on the freeways. we will reporter: good morning. this story comes from a fox sports writer on the web site. i said in the tease that major league baseball commented. they commented that they are not commenting yet. major league baseball commissioner bud selig and members of the blue ribbon commission met with a's executives to talk about a proposed san jose ballpark. that was a couple of weeks ago. at the meeting they asked the a's to increase seating capacity by 4,000 seats. the report said selig scheduled a meeting with the giants officials in the next two weeks. the meeting is supposed to take place in december. it's unclear if selig will come twisting arms or bearing gifts. the giants granted territorial rights for san jose by major league baseball, something that has been there since they moved here and reaffirmed in 2,000 when they built at&t park. it's more than that because the giants have a minor league team in san jose. in addition to that, any major league move down here, stadium would require voter approval. they are talking about having something agreed upon in january then getting something put on the ballot by april because there is an 88-day period between proposals, by the time it gets on the ballot. there are a lot of issues, not the least of which is that this is giants territory. it's unclear how much fan sport the a's would have moving to san jose anyway if they got a deal done. as craig mentioned, we have been asking facebook users whether they think the a's should move to san jose. art wrote the giants did not sell out every game until they got their new stadium. it would be great if they build a new stadium in oakland and a new location like geek lennon square. christina says the a's leaving oakland won't do anything for attendance. if they invested more money incident at uc davis could lead to changes for the entire uc system. uc president mark udall says the office is taking a look look at this incident during an occupy protest last friday. he is launching a systemwide investigation into the way uc police responded at the campused. former los angeles police chief will head up the investigation. and the occupy protestors, they are still camped out on the uc davis campus. you are looking at new video. we shot this this morning on the encampment. they say they are not going anywhere. >> it's comforting that people will be here over the bleak and as long as they possibly can. >> we are not going away. we feel that there are many wrongs that need to be corrected. that's what we are here standing for. >> the university has not said if it will allow the tents to remain. occupy protests across the country are taking a huge toll on american taxpayers. an associated press survey shows the occupy movement cost taxpayers nationwide $13 million. those numbers come from 18 cities including san francisco and oakland. they reflect costs run up through november 15th, the day occupy wall street protestors were kicked out of their camp in at the white house, president obama is scheduled to use his executive powers to spare the lives of two turkeys. here is a live picture of one of the turkeys. we get a close up of its feet. the president will pardon the two turkeys in the traditional ceremony. this is the 64th year. the main turkey is named liberty. the alternate is peace. they were tamed in preparation for this white house appearance by four teenagers who are members of future farmers of america in minnesota. the teenagers worked with the birds getting them used to being handled and exposing them to cames, flashes and loud noise. after the pardoning they will go to george washington's mount vernon estate to live out the rest of their years. >> great pictures. we will come back to the story when the president comes back so you won't miss anything. good looking turkey. the power is out for hundreds of residents near the santa cruz santa clara border. the power went out before 3:00 a.m. for 1100 customers. around 4:15, 572 homes were still without power. there are crews on the scene but they are not sure when the power will be fully restored. they don't know what caused the power outage. last night in danville hundreds of people paid tribute at a candlelight vigil for a fallen young u.s. marine. >> that was the voice of a friend of lance corporal joshua singing amazing grease. the defense department said he was killed in afghanistan. his cousin said dealing with the loss is harder because it's the holidays. >> it hits our family so hard. he is a huge inspiration. he is a huge aspect of all of our lives, wanting to see everyone smile. that was his goal. >> his family is busy finalizing plans for a memorial. the city of berkeley is trying to speed up the rebuilding process for two downtown businesses destroyed by last week's fire. the bar and grill were on the ground floor of the apartment complex that burned. the city council is considering waving permitting fees for the businesses. it could range from 80 to tens of thousands of dollars. the businesses would still have to get state required permits. several drivers in concord are complaining about rock attacks on their cars. they have been happening at two locations. one is ignacio valley road and the other on treat near belleair drive. this has been going on for a month. there is no word who may be behind the attacks. sal is back. we know we have a traffic mess at sfo. but we have the president here. he is about to pardon the turkeys. >> we spend time with the once we loved and enjoy good food and great company. it's one of the worst days of the year to be a turkey. they don't have it so good. the rare exception of course are the two birds who join me today. is peace here or liberty -- just peace. some of you may know that recently i have been taking a series of executive actions that don't require congressional approval. well, here is another one. we can't wait to pardon these turkeys. literally, otherwise they would end up next to the mashed potatoes and stuffing. i want to thank richard, the chairman of the national turkey federation and his wonderful family for donating the turkey from his farm in minnesota. the turkey's name is liberty. there he is. along with his under study, he has the distinction of being the luckiest bird on the face of the earth. right now he is probably one of the most confused. liberty was chosen from a flock of about 30 other contestants for the honor of being here today. for the first time in history, these two turkeys were raised by four students. i am told that in order to prepare liberty and peace for the big day, the students exposed them to loud noises and flash bulbs so they would be ready to face the white house press corps. this is actually true. they received the most important part of their media training which involves learning how to gobble without saying anything. so liberty is ready for his turn in the spotlight. after he finishes a round of cable hits and a few sunday shows he will retire to a life of leisure at mount vernon, the same place where george washington spent his golden years. >> you have been watching live at the white house. well. traffic is beginning to recover at the san francisco airport. it's not nearly as bad as it was. that is good because it was a huge mess. but now things have lightened up. on the roads, it's a little lighter than usual. about the only crowds we had are people trying to get to the airports today. things have improved quite a bit now that they cleared the crashes from 101 near the airport. mostly cloudy skies. cloudy skies to the north bay then a few breaks. mostly cloudy day. fog down lob. some of the fog can be thick as well. about a quarter mile visibility or an eighth of a mile. south bay has the best opportunity for sun but the system is inching closer. the system hasn't done much yet. i heard from ronald thompson in crescent city. he has about .2 of an inch of rain. but there are predictions for two plus. it has two speeds right now, slow and stop. evening rain north bay but more likely overnight into tomorrow morning the system will weaken considerably. we will get rain thanksgiving morning then by the afternoon most of it will be gone as the system stretches it out, the southern end will separate. this is a cloud and rain forecast. clouds no problem. clouds most of the day. they will thicken up and get closer and closer. tonight rain moves in to mendocino county. tonight the system -- when they alive themselves north to south that is not good for rain. you will get rain but it takes a lot of the energy out of it. by tomorrow morning the system slides through and it split so it will lose a lot. in the sierra there won't be much left. then a weak system may brush is late thursday into friday, especially the north bay. then things look good. there is the system just getting to the north coast. we have a long way before this happens. the wind has picked up in higher elevations and on the coast. that may be a factor if you are traveling this morning. the system is far off and it will move in very slowly. mostly cloudy today. the wind picks economic growth. the survey showed manufacturing slowing in china, a day after the u.s. government lowered the estimate of third quarter growth. the dow is down 168. nasdaq down 48 and s&p is down 19. bank of america started trading as the lowest priced stock on the dow industrials. it was at 5.37 a share when the opening bell rang. it's trading now at 5.17 down 3.5%. they proposed then dropped a >> reporter: we're certainly keeping an eye on things here at the airport. obviously this is gonna be a busy day. i want to show you the traffic moving in the airport at this hour. it's actually been fairly light coming in. not sure if that's because people are having trouble getting to the airport now that it is getting cleared up. maybe it will get easier. as you can see, not a lot of cars rolling through the airport. this is gonna be a very busy travel day. 135,000 people expected to come to the airport. still not sure if this will affect your travel today. any time there is a problem at any airport across the country, it can have a domino affect and really affect where people are going and back up airport traffic. fortunately, we're not seeing that this morning. wife's been keep -- we've been keeping an eye on the situation. midday, that's when things get really busy out here. that's the second wave of things coming through here. so the main thing is, like anything, people are seasoned travelers. they've done this before. leave yourself extra time, make sure you have everything ready to go so you can skate through that security line. we'll keep an eye on this and the travel times and the airline times and we'll keep you updated here on "mornings on 2." claudine wong, ktvu channel 2 news. >> thank you, claudine. 8:03. firefighters are busy investigating another suspicious fire at a strip mall in hayward. the second one there just this month. the most recent one happened at freda's market. firefighters say they became suspicious because they could smell gasoline at the scene. about two weeks ago, a fire damaged at least three businesses in that very same strip mall. that fire is still under investigation. antioch police, they are investigating an apparent drive- by shooting that injured one man. it happened shortly before 10:30 last night. witnesses say he was shot as he was standing on the sidewalk. the victim showed you at the hospital with a noun life- threatening gunshot wound to his stomach. so far no arrests have been made. 8:04. the landslide that damaged several homes in march has slid its way into court. tara moriarty has more on why that lawsuit is not the only problem residents face. >> reporter: every time it means, the residents look out their windows with the sense of dread. you can see why. take a look at what's -- at what's in their back yard. there are just yards and yards of tarp, all of these sandbags and then at the base of this hill you can see this house here where the mud was pushing up against it and how these windows have been boarded up. equipment has been now brought in to dredge up some trees and to make this area safer. we've just learned that last month three homeowners on hillcrest road that were affected by the slide filed a lawsuit against the city. they august accused -- they are accusing and suing. group is suing their neighbors at the top of the street son wineman. they say those homeowners didn't take care of the drainage system the way they should have. both neighbors put up a united front against the city. they said they had no idea that the mudslide happened in the same spot in 1958. they feel like the city should have let them know. if they had, any say -- they say -- they say they would not have bought here. tara moriarty, ktvu channel 2 news. >> thank you. the occupy sf camp may be moving to a new location just in time for the holidays. about 400 protesters are still camped out at san francisco's justin herman plaza. many nearby business owners are frustrated as the holiday season gets underway. they say that the tent city will kill their business -- business if the city does not take action. mayor lee is talking about moving their camp to a high school campus. it's on mission street between 15th and 16th. some protesters think another location would be better. >> i really think an offer would be civic center. it's closer to social services and we would be able to direct the people there who need the services. >> many other protesters say they have no plans to move from justin herman plaza. 8:07. well, how are the bank fees that your bank charges compared to other banks? >> reporter: dave, it was the 11th time that the republican candidates have debated publicly. this time they clashed over things like the patriot act which made it easier for authorities to monitor our phones and traffic. rick santorum took it further, making headlines with this comment, saying that must littles should be targeted for add -- muslims should be targeted for additional screening at airports to prevent terror attacks. >> those are the folks that are committing these crimes, that we, by and large, as well as younger males. these are things -- not exclusively but these are things you profile to find your best -- the most likely candidate. >> reporter: ron paul challenged him, asking for an example where profiling helped catch anyone. but the biggest headline of the night came when newt gingrich said he does not believe millions of illegal immigrants who have been here for years should be deported. we'll see if both men get backlash on the campaign trail today. live in washington, carol han, ktvu channel 2 news. 8:15. the new greek prime minister has promised to push ahead with financial reforms that will keep greece in the 17-nation alliance known as the eurozone. but the prime minister still faces opposition from greek unions and only has lukewarm support from the main political parties. the bank of greece says if those agreements fail, the country will have used up its last chance to stay a member of the eurozone. los angeles city officials are pulling back on their offer to provide the occupy movement with office space. the city had told protesters they could lease a 10,000- square foot space for a dollar a year. after some negative media attention, protesters were told the deal is off. city officials say they are now looking for another way to negotiate an end to the protest. 8:16. many occupy protesters are making plans for black friday. they plan to protest against the big stores that they think have strong ties to wall street. their targets include neiman marcus, home depot and walmart. the occupy demonstrators have also created a special facebook page to help organize their black friday demonstration. the city of oakland is encouraging shoppers to spend their black friday money at its "in the black festival. it starts friday in oakland from 11:00 a.m. to 6:00 p.m. there will be live muse in, food and popup shops. some hope this will encourage giving back to the city. 8:17. ktvu news crunched the numbers to see how all of those rising bank fees are adding up and we compared what ten bay area banks charge for monthly fees, debit card charges, fees for using another facility. the lowest fees were at bank of the west and charles schwab. one banking analyst said the fees are prompting some customers to walk away from their banks. >> consumers are finally in larger numbers looking to leave large remember banks. and often going to smaller community-based banks. >> the chairman of the california bankers association says the banks he represents end up putting money into local businesses and home loans. some hard-core shoppers are lining up to take advantage of black friday's best deals. >> a 42-inch sharp for $199. >> tv, maybe a laptop. >> tv, for sure. >> these people are waiting outside a roseville best buy for the doors to open tomorrow at midnight. they -- but they faced some trouble when a private security guard told them they had to leave when the stores closed. they do not want them camping out. >> i think it's olympic -- i think it's ridiculous. we're occupying the line. >> now the property management group is allowing people to stay overnight but they are not allowed to set up tents or other camping equipment. a truck failed to yield while turning left at an intersection. the students were on their way home from a basketball game. police say the driver of the truck was intoxicated and has been charged with dui. 8:23. some small amount of bay area cities have a high-tech tool to combat blight. it's called the c-report and click app. they use it to report everything from potholes, graffiti. residents of san francisco, oakland, walnut creek, they are using it to snap photos of problems and send it right to the officials. a walnut creek code enforcement officer told ktvu news, it's chaining how he does his job -- changing how he does his job. >> prior to this, you had to phone in, come and and now you can just do it from the street. >> there's reports online with maps, reports, updates and a picture. walnut creek's code enforcement says it's already closed several cases this year. the city of oakland is planning to expand the use of the program next year. the posted speed limit is going up along 5 roads. the changes are part of a plan to help police officers better clock speeding drivers. they will be able to use radar because the new speed limits are based on recent surveys of -- of how house drivers typically go. the changes take effect january 1st. parts of commerce boulevard will be affected along with golf course on redwood drive. sal has been busy trying to get people out the door on the road for holiday travel. it's been a busy morning. >> we've had some trouble spots. we're looking at marin county now. northbound 101 at 37. there is an overturned vehicle there. it's sentencing last year. in a few minutes, the jury will hear the hear -- will hear the first full day of testimony. we just talked to an attorney representing those officers. >> the jury's gonna make a decision based upon what they are hearing. we are bringing forward all of our evidence and the jury will have to make a determination. >> now, also this morning, we took this video. this is kenneth carruthers. he's the man who claimed the officers punched and kicked him during an arrest at a b.a.r.t. station. officer also claiming they only used the force necessary to carry out the arrest. this incident happened six weeks before the fatal shooting of oscar grant. new this morning, rincon county fire inspectors are still at the scene of a gas station explosion. this happened in east, right near molita road, about 4:00 in the morning. when firefighters arrived, they found a van, gas pumps and an overhead awning on fire. time is now 8:30. major league baseball appears to be finally taking a closer look at the oakland as san jose stadium proposal. ktvu's kraig debro live in san jose right now. he's been out there all morning. kraig? >> reporter: there's moi men tum building but there are a lot of steps -- there's momentum building but there are a lot of steps that have to be taken first. the biggest obstacle may be the as for the as moving to san jose is municipal stadium right here. not only is there a stadium here, but the team who plays here are the san jose giants and they would need the san francisco giants' cooperation. according to bud zee leg, they met -- the commission and the panel asked the as to increase the seating capacity from 32,000 to 36,000. the report also says the commission is planning to meet with the commission -- the commissioner is planning to meet with the giants executives in two weeks. now, mlb already recognizes san jose as giants territory. mlb may try to change that. now, earlier this month, san jose city council agreed to give the as exclusive rights to buy land for almost $7 million but only if the team agrees to build this stadium on the site. this is a rendering of a proposed as stadium. the vote was 10-1. it granted as a two-year option for 50 grand. that could be ex-- extended for a third year at 25 grand. after the expectatives meeting with -- executives meet with bud selig, they will decide. there are traffic consultants are recommending crosswalk signs, pavement markings and parking restrictions at bay road and gloria way in east palo alto. the intersection has been the scene of several accidents including one in september that killed a 6-year-old girl on her way to school. traffic consultants stopped short of recommending a stop sign, which residents are demanding. the city council will continue safety discussions next tuesday. 8:34. walnut creek police are saying a 23-year-old old clayton man confessed to vandalizing banks all over contra costa county. police say this surveillance photo of jared bedahar released yesterday hitched them solve the case. police say he admitted being active in the okay.movement and writing the words "foreclosed" and other things on at least four banks. police did not arrest him but they did send his case along to the district attorney's office. twin city police are investigating the attempted robbery of a 15-year-old girl on a bike path. police say the girl told him she used her martial art skill to fight off a man who punched her in the face. she said it happened monday evening on the bike pack adjacent to ward and larkspur. she ran off after another man appeared. this morning, police are telling us no one has been arrested. 8:36. people at a marin county nursing home imay -- home may be able to see their family on thanksgiving afterall if no new cases of norovirus are reported. the facility has been under a quarantine for the past week because of an outbreak. so far, 80 people have been sickened. the most reason person on monday. another marin county nursing home has an outgoing outbrake. norovirus is very dangerous. it can cause dehydration, vomiting and sometimes death. the navy blue angels may become victims of cuts. with deep cuts looming, even supporters of the $37 machine the pentagon spends each year on the blue angels say it could be bettered elsewhere. automatic spending cuts triggered by the failure of the super committee will mean almost $1 trillion in defense spending cuts over the next ten years. but they say their goal is to inspire people to enlist and it's tough to put a price on that. there is a movement for killing california's high speed rail project. california republican members of congress say the project has become too expensive. 3.3billion in federal grants are already approved for the start of construction next year. but some say the money should be used for highway construction instead. google is pulling the plug on its plan to develop renew an energy that's cheeper than -- that's cheaper than coal. this is the third spring cleaning announcement. google says other companies are better positioned to take renewable energy to the next level. some have wedding anniversary on friday. major league baseball and its players are agreeing to keep chewing tobacco out of site. the newly approved union contract calls for chewing tobacco products to be [ male announcer ] another reason more people stay with state farm. get to a better state. ♪ let's bring you up to date on some of the top stories -- former b.a.r.t. police officer, johannes mehserle, is now inside a san francisco courtroom. this is exclusive ktvu video you are watching of mehserle when he arrived about 45 minutes ago, getting out of his car, going through courthouse security. he did not want to answer any questions. this is the first time we've seep johannes mehserle since his sentencing in november of last year. well, some good news, if you have to head to sfo on this holiday getaway day, the chp has reopened all of the lanes of highway 101 in san bruno. a rollover crash earlier this morning blocked the traffic and really backed things up in both directions near sfo. that crash happened shortly after 6:00 a.m. floor interstate 380. it's a busy day at sfo, at all of the airports. a lot of people traveling to the highway and rushing to catch their flights. claudine wong has been at sfo all morning. she's back with us live. hey, claudine, is the bad weather back east causing delays here at home. >> reporter: it doesn't look like it. a lot of people walking up to the board and kind of staring at it. you take a look at new york and d.c., everything is on -- they are on time. in fact, everyone is on time. that's the way it's been most of the morning. we just talked with people going to chicago, and they said they hadn't checked the weather but they are nervous. we just talked to someone who said they went through the security and they had no problems. you are taking a look at security lines. things moving smoothly. they are going smoothly through here better than they were earlier today when we watched it. there seems to be a morning rush and then the midday rush. the midday rush will back things up. the most concern is getting through the security line and just the travel of the day. right now if you are headed out here, things look good. but this is a very busy day. 135,000 people expected to travel through sfo today alone. the best advice, obviously, get yourself here early. one couple of got here two and a half hours earlier. they got here just fine. they did hear about the accident and that gave them extra room. the situation at sfo, things look fantastic coming through here. people hoping to get to their destination in time for turkey. live here at sfo, claudine wong, ktvu channel 2 news. >> thank you. 8:46. a funeral service will be held one week from today for a slained vallejo police officer, james capotot. he was honorrd -- james capoot. he was honored last night for the community he served. ♪ ♪ >> now, mourners filled this downtown vallejo church last night remembering capoot. he was shot while chasing a bank robbery suspect last week and his death sent shock waves through the community. >> our city is in crisis. but we're going to make it through this tragedy. >> yeah! >> we're going to honor this man that has given his life for the well being for this entire city. >> the officer is survived by his wife and three daughters. two of his daughters are in college, the other is in high school. a trust fund has been september up for them at the bank of the west. in march, a heavy rain in san pablo triggered a landslide that damaged several homes and now there is a lot. ktvu's tara moriarty is at one of the homes where work is underway to prevent even more damage as rain is moving in. >> that's right. a couple of minutes ago, crews showed up, and they started to remove some of the debrae. they are -- debris. they are actually removing the things, putting them in trash bags. they said they will be laying down more sandbags as well as tarp. you can seat huge amount of traffic they've already laid here in the back yards of these homes completory -- completely covered here. there are also makeshift drain taj pipes and equipment brought in to remove trees. we just learned that last month, three homeowners off hillcrest road affected by the slide filed a lawsuit against the city. they accuse the city of improper design and improper maintenance over the years. seven houses were damaged by the march landslide. the group is also suing their neighbors whose houses are at the top of the slide on wymeen street. they say those homeowners didn't take care of the damage the way they should have. initially, the neighbors have joined together against the city because of this, pictures taken of a mudslide in the same spot in 1958. neighbors say they never knew about that when they bought the homes and felt the city should have informed them. the city said they would repair the area around the neighbors but it needs funding to do so. live in san pablo, i'm tara moriarty, ktvu channel 2 news. >> thank you. 8:49. just about an hour ago, at the white house, president obama used his executive powers to spare the life of a thanksgiving turkey. >> you are hereby pardoned! [ laughter ] >> a round of applause. [ applause ] >> you see the president, he pardoned that turkey. that's liberty, along with miss understudy named peace. they were prepared for their white house appearance by four teenagers who happened to be members of future farmers. the president's daughters sasha and malia there. those teenagers worked with the turkeys getting them used to being handled, exposed to cameras, flashes and loud noises. >> they also received the most important part of their training which is learning how to gobble without really saying anything. [ laughter ] >> the turkeys will go to george washington's estate and will happily live out the rest of their lives. prodemocracy protesters are battling in egypt with security forces again today. push pretty wild scene there. the protesters threw rocks at riot splice who protected themselves -- police who protected themselves with their shields. some of the officers responded with tear gas. the protesters are demanding the council it in egypt immediately hand over and there was a rejection for that to speed up the elections -- elections. egyptian television has been running this video, there are the three us students lined up there, prosecutors say they were throwing molotov cocktails during prodemocracy protests. the parents of 19-year-old derrick sweeney told reporters their son probably got swept up in all of the excitement. >> he's a very passionate person. he believes in democracy. he believes in standing up for what you believe in, standing up for what you believe is right. >> the three are studying in cairo. 21-year-old luke gates and 19- year-old gregory porter are also under arrest. well, the trustee who is trying to get money for the victims of bernie madoff has reached an agreement to recover $326 million that was transferred to the irs. that money will be distributed to madoff's customers would valid claims for it. the trust ehas filed more than 1,000 lawsuits seeking more than $100, primarily from banks and other firms. bernie madoff is southerning a 15-year prison sentence. well, the country music band sugarland is being sued over that dead lay state collapse at the indiana state fair. the band was just about to perform, when this happened -- a severe storm knocked down the stage. this is october 13. seven people were killed, more than 40 others were hurt. the lawsuit was filed by the victims' families and dozens of survivors. it also blames the producers of the show and those who set up the stage. 8:52. new this morning, the fbi says it arrested seven members of an amish group during a raid that happened before dawn in eastern ohio. federal authorities plan to bring hate crime charges again the men for their alleged involvement in the forced hair- cutting attacks on amish men and women. the group's leader, sam mullott, he was arrested. last month he sold "the associated press." that he did not order the -- press "that he did not order the haircutting but he didn't stop. bad news. we're getting word this morning that thousands of job cuts were announced. we'll give you the details. also, the spirit of giving is alive in the bay area this holiday season. volunteers are getting ready for a big event tomorrow.
