>> let's get a first look at your sunday morning forecast with rosemary. >> good morning. sun is on the way, another 20 minutes or so. we can see mostly clear skies. a few high clouds. temperatures warm up once again, although not as warm along the coast line. and for portions of the day, we may see a few degrees of cooling, but another sunny day. temperatures above normal. a cooling trend is more notable tomorrow. we will talk more about that and show you the numbers for today coming up. >> would start with overnight news from san jose where dozens of people are out of their homes after an apartment building fire. al erastus joins us live from the scene with the details. >> john, the latest estimates is as many as 100 people are displaced by this fire. it started just after 1:00 this morning and started in this apartment building behind us or you do the damage to that particular apartment is very visible. smoke and fire damage and windows blown out. what the chief says is just about every other unit in this long rectangular building also has him smoke, fire, or water damage. she explained that that it was all 32 units share a common hallway that runs right down the center of the building. >> affair bread -- the fire spread a bit more. it is on the inside. in several places, the floor burnt through. >> at 1 k for this was a three alarm fire. at least one of the residents tried jumping off of their second- floor balcony to escape the fire. firefighters provided that person with a ladder and they were able to climb down to safety. two residents went to the hospital. we don't know the extent of their injuries. we are also told a firefighter suffered minor turns to his face. later this morning with some buses were called to this apartment complex to give some people displaced a place to sit and rest while the red cross, who is already out here, is working to open a shelter for some of the residents displaced. back out here live, there's a crew getting ready to board up some of the apartments. the battalion chief says they don't need to investigate what caused the fire. they say they know how it started. someone in the apartment building was cooking on the stove and left a pan on attended. live in santa fe. >> also from overnight, san jose police are investigating their 37 homicide. a man's status after 1:30 this morning and near virginia street. officers were called to that area for a report of a fight. they found the victim unconscious on virginia street. he was pronounced dead at hospital. police have no suspects or motive this time. >> a pedestrian hit and killed this morning in san mateo. it happened just before 4:30. an suv was heading south on when it slammed into the man walking on the shoulder. the driver immediately stopped and is cooperating with highway patrol. a single cell phone lane was shut down for about 90 minutes. >> the east only to interstate 580 are back open. the highway patrol closed to the lanes near 150th avenue last night after what investigators say was likely a deadly road rage incident involving a member of the hells angels. six to eight motorcyclists were traveling in for mission around 4:00 yesterday afternoon. they then came up alongside a transit bus driver who was headed back to the yard at the end of his route. >> it sounds like the van was moving over to get into a lane that maybe the motorcycle was in. i don't know if there was any communication between the two that is unknown at this point. suddenly, the van turned. >> the impact knocked the motorcyclist off his bike and under the bus. authorities say the van drives a motorcycle for about a mile. the van then pulled over and try to run away. check the beauties arrested him on a felony hit and run charge. police have identified him as eddie hall of oakland. the victims may have not been released. no one else was on that bus. hall had a clean record since being hired in february. stomach reopening is only in around 2:00. that was 10 hours after the crash. ktvu news chopper took this video of that massive backup. look at that mass. some drivers tired of waiting for their cars in reverse to try to get off the freeway. that congestion led to traffic jams on many side streets as well. >> the search continues for a san jose man. police fired tear gas into a house yesterday. they received a tip that the 38-year-old suspect was hiding out there. authorities locked on the area for some 12 hours and forced residents to stay indoors. >> they went in there with a slot car. 30 minutes later. they came back out. >> he suspected of shooting steve tomlin at a funeral last weekend. investigators believe he suffered black eyes and other injuries in a fight that led up to that shooting. >> police have captured a man suspected of shooting a police officer. lease cars surrounded a home in el paso heights neighborhood. officers arrested tyrone smith. you can see them taking him to the ground. he's accused of shooting several officer several times. the 25-year-old officer is listed in critical but stable condition. doctors say paramedics who just happen to be in that area likely saved his life. >> new this morning. more than 100 occupied protesters were arrested in chicago. demonstrators did their ground and would not leave a closed session of grant park area policewomen to leave or risk getting arrested. many protesters on locked arms before officers moved in. they hope to make this the movement permanent chicago home. san francisco's occupied movement is still going strong. hundreds of protesters rallied outside the federal reserve bank and marched down market street. some held signs bonuses, not teachers. police officers walked with a group to make sure there were no problems. >> and occupy protest caused traffic jams and forced the bank to close early. at least a thousand people gathered yesterday. they marched to lake merritt and some people wearing masks sat down on the road. at one point the demonstrators were blocked and some protesters stormed that leaving a mess inside and smashing an atm outside. >> i don't see how that's going to help anything. >> i love what they are trying to a published. i don't think it was necessary to vandalize the bank machine. >> the branch had to close early because of the damage. police say despite that acts of vandalism, it was mostly a peaceful march. officers appear to be cracking down on parking and traffic offenses. a protesters as leaves are issuing tickets to motorists on 14th street. the city has yet to enforce a -- this court can be ordered to patient be medicated. the medication order can be forced for up to 21 days. after that and then mr. dubois judge reviewed the medication orders. the law is set to go freeway. welcome back. time now is 7:29. >> and i am claudine wong. we have more on that closure in just a moment. first, we want to start with overnight news from san jose where dozens of people are out of their homes after an apartment complex fire. live from the scene this morning with continuing coverage. in it hi, claudine. there is a crew in front of the apartment building where this started. they are boarding up the apartment unit where the fire began just after 1:00 this morning. firefighters say a resident was inside his apartment cooking on the stove and left a pan unattended. as a result of that fire, there's an estimated 100 people who are displaced. the battalion chief explained why so many people were affected by this fire in this one apartment. she explains that this apartment is a long rectangular building with 32 units are you that you can get an idea of just how big and long this building is. the entire building shares a common open hallway. just about every unit in this building had either smoke, fire, or water damage. >> once the fire that started on that side of the building, the smoke fred -- the smoke spread. a initial crews had fire upstairs in that room. they had several occupants hanging in the balconies. >> at one point this was a three alarm fire before it was under control around 3:00. at least one resident tried jumping off the second floor balcony to escape the fire. firefighters give that person a letter and he was able to come down safely. two people went to the hospital. we don't know the extent of their injuries, but we are told they are not life-threatening. a firefighter suffered minor burns to his face in trying to battle this fire. the buses were called to the apartment complex called out by firefighters to give these people a place to sit and rest. the red cross is trying to find a temporary shelter for the estimated 100 people displaced. representatives say they don't know where the shelter will be, but because there are potentially so many people affected by this fire, they are going to try to open one big shelter for all the people displaced instead of finding individual housing. ktvu, channel 2 news. >> interstate 580 was reopened after what police believe was a deadly road rage incident. the eastbound lanes were closed from 4:00 yesterday afternoon to just before 2:00 this morning. chopper 2 took this video. police say the driver of an anti-paratransit boss brand into a member of the hells angels. eddie hall has been arrested on a felony hit-and-run charge. the victim's name has not been released. we now know the name of the good samaritan killed in hayward. valenta kate got out of her vehicle to help people involved in an earlier accident when she was hit. it started a chain reaction involving six other vehicles. the section of 88 was closed for about three hours. police investigating a double shooting. it happened on land road and airport drive. it's not clear what led up to the shooting. both the people shot are expected to survive. right now police don't have any suspects. >> a jet skier recovering after being rescued north of grisly day. the 40-year-old man was found floating in the slough yesterday afternoon. a helicopter rescued a man and he was taken to the hospital with nonlife threatening injuries. >> a former worker at san quitman -- robert alyosha is scheduled to be arraigned on charges tomorrow. he was not a sworn in crutch officer but worked as a warehouse supervisor. prison officials say he was fired from his job after being arrested earlier this month. a louisiana man has proved his innocence and is free after serving nearly 30 years for a crime he did not commit. henry james was convicted of raping the wife of an acquaintance. she said she didn't know who attacked her but later picked james out of a lineup. for decades he said he was innocent but wasn't able to prove it until now. dna testing proved he was not the rapist. we knew he was innocent. his case at all the signs that it was just screaming that he was an innocent man wrongly convicted. >> he's a 12 person in the state to be exonerated by dna evidence since 1999. he's eligible to get up to a quarter of $9 as compensation for his unjust prison time. >> and advertising company in missouri is hoping billboards will help police find a missing 11 month old. they really sad and missing since october 4th. and advertising company donated several billboards for the missing baby. the company hopes the billboard would generate tips. much of the investigation has focused on lisa's parents. they have denied any role in her disappearance. in arizona more than 100 friends and family showed up to hold a vigil for a missing five-year-old girl. her parents used to live in the layout but relocated to arizona. her grandfather has been handing out flyers where she was last seen. he said she's hopeful she will return home. >> i am thankful that everybody came out to support us. >> we are going to stay positive and do what we have to do. >> police do not have any new leads in the case. reward money is being offered for any information. >> the sole survivor of a salon shooting massacre. public for the first time at her daughter's hero. paddy strip celebrated the life of her daughter yesterday. webb was an employee at the salon where last week's shooting happened. she was doing her mother's hair last week when the gunmen opened fire and killed her along with seven others. he struck with a cause of first-degree murder and one felony count of attempted murder. >> time now is 7:35. police in los angeles investigate an unusual incident outside a taco truck. police say a man attacked another man with a machete. it happened around 4:00 yesterday morning. police say the attacker dragged the victim in the taco truck and took off. by that time police were on the scene. >> at that point, they saw a man armed with a bloody machete in the doorway of the food truck. the officers ordered that individual to drop the knife numerous times. however, he refused to do so. >> officers used a paper on the man. when that didn't work, officer shot him. the victim is in serious condition. police say they still don't know why the victim was attacked. >> more than two dozen advocates were armed with guns. members of the group are upset that -- they say if they can't carry a handgun, they will carry so- called long guns such as rifles and shotguns. >> they are basically telling us that they don't respect us. we will find a way to stay within the law and continue to defend ourselves. >> california is the fifth state to outlaw opening -- openly carrying handguns. >> a scam that targets overly. police say the grandson scam works over the phone and can cost the victims thousands of dollars. the scammers call overly people claiming to be the grandchild or their grandchild attorney. the scammer then says the child was arrested. police believe the calls are coming from overseas. spirit firefighters, residents, and firefighters gathered to remember the lives lost 20 years ago. people showed up for a disaster preparedness fair. thursday's 20th day. we break down that forecast coming up. spent time now is 7:40. a red tail hawk spotted with a nail in its head has finally been captured. that hawk looted rescuers for more than a week. around 5:00 last night members of wild rescue say they captured the injured bird near the botanical gardens. they took it to the wildlife center in san jose where specialists are treating it. authorities believe the hot was intentionally put shot with a nail gun and there is now $10,000 per word in that case. >> is a site people in the pacific northwest are far from accustomed to. an alligator swimming around the pond. the gator was spotted in oregon. animal control officers were notified immediately. they set a trap yesterday but the gator is refusing to take the bait. >> it is rather we are live at the pinewood apartments where some residents had to be rescued from the flames. >> we just got an update from the red cross representative who says 30 people were displaced, 22 adults, seven children all because of this apartment fire that happened just after 1:00 this morning. this apartment unit behind a come of the one that you can see partially boarded up, is where the fire started. the fire chief says a resident in that apartment was cooking on the stove and left a pan unattended. but the apartment you see here is in a long rectangular building that has a common hallway. the building stretches down almost a link of a half block. that building has a common hallway. even though it is not visible from the outside, other units have smoke of a fire, and water damage because of the fire in a single apartment. >> the fire spread more than it looks. you can't see it from here. it is on the inside and through the interior walls. in several places, the floor is burnt through. >> now, this displaced resident describes some of the commotion. she says she lost her team hq that home while she went to the store. she came back and her kids were out safely, but she says there was a lot of neighbors in their slippers and robe trying to get out. she said neighbors were knocking on doors warning people to get out. she saw some residents try to jump off their second-floor balconies to get out. firefighters provided letters so some of the residents were able to do so safely. two people went to the hospital with nonlife-threatening injuries and a firefighter suffered minor burns to his face while tackling this fire. both as were called to the apartment complex and were called up i firefighters in order to give some of the people displaced a place to sit and rest. the red cross is trying to find alternate housing. earlier this morning the red cross said they were possibly opening a shelter for all the people displaced. they expect more people to be in this place because there are 32 units in this long rectangular building. however, they recently revised the numbers. red cross to -- red cross says there are a total of nine families looking for a new home. >> also overnight, a pedestrian was hit and killed on highway 101 in san mateo. it happened just 44:30 this morning. an suv was heading south on when it crashed into the man walking on the shoulder. the driver immediately stop and is cooperating with the highway patrol. a single thought bombing was shut down for about 90 minutes. >> up to 1000 people are feared dead after a large earthquake overnight in turkey. a 7.2 magnitude quake struck at about -- struck at about four and a half hours ago. 10 minutes ago sturkie's television reported 30 death. scientists estimate a tough stove and that's how the fire started. this apartment unit is part of a long rectangular building in this complex with 31 other apartment units in that building. they all share a common hallway. even though it's not visible from the outside, other units are damaged. >> there may be water damage, smoke damage, holes in the walls, and so forth. right now we have determined about nine families need assistance. however, there may be other families serious. >> now, this displaced resident describes some of the commotion area she told us in spanish that she came back to see neighbors running out of the building in their robes and slippers. other neighbors were knocking on doors warning people to get out. some residents tried jumping off their second-floor balconies to escape. firefighters say they had to go into rescue mode and provide letters for people to get out of their second story apartments. two people went to the hospital with nonlife-threatening injuries. one firefighter suffered minor burns to his face. the battalion chief told us they will be looking into whether the building smoke alarms were working properly because she's a lot of residents and realize that their building was on fire. firefighters later this morning called some buses to this apartment complex to give the people displaced a place to sit and rest while the red cross tried to find alternate housing. earlier this morning the red cross said it was thinking about opening a shelter because they were told as many as 80 to 100 people might be displaced. again, they have revised that number. 29 people are now looking for homes people killed after a 7.2 magnitude earthquake in turkey. scientists estimate up to 1000 people could be dead because of low housing standards. dozens of buildings in several cities did collapse, and rescuers are right now searching for survivors. >> police investigating a double shooting overnight. it happened on line road and airport dr. it's not clear what led to the shooting. both victims are expected to survive, but police have no suspects right now. try police investigate their 37th homicide of the year. a man must have just after 1:30 this morning near sacramento area officers arrested 32-year- old tyrone smith. he's accused of shooting the officer several times during a traffic stop yesterday afternoon. the 25-year-old officer is listed in critical but stable conditions. doctors say paramedics who happen to be in the area like he saved his life. >> today marks 1 year since a hospital worker was strangled to death or your family members of donna
