involving contra costa sheriff. we are looking at a deadly crash in san jose. when the fire department arrived they had to get someone out of this vehicle. a 40-year-old man. unfortunately that man did not survive. other people in the car suffered nonlife threatening injuries. this happened near the corner of hillsborough avenue and pearl avenue in san jose. that intersection will be blocked for several hours. they are gathering new information on this deadly crash. she'll have a report coming up on the scene. let's go back to the desk. in other news police released a sketch of a man who tried to kidnap a young girl. this man approached a ten-year- old girl. he reportedly tried to grab her but she punched him and ran away. he is described as a white man, six feet tall with a stalky build and light complex. look at that sketch. if you have any information call pacifica police. this morning park police in the livermore area will search again for a missing kayaker. now he's believed to have drowned while boating yesterday afternoon. the sister of the missing man says the brother vanished after taking off his life jacket so he could swim to shore about 75 feet away. >> water. he tried to get get the life jacket back. >> the divers from the county sheriffs office searched that water for several hours. at least until sunset. they will go back into the water later this morning for what is now believed to be a recovery effort. four children are injured and a driver is facing drunk driving charges. two of these hurt are the drivers own stepchildren. tara moriarty joins us now from children's hospital in oakland. tara. >> reporter: three of the four children are here at the hospital in oakland. one is is in critical. there was also another child that was in critical taken to eden hospital. it happened around 10:00 last night. highway patrol says the driver who is the stepfather of two of the children, may have been driving drunk. >> he lost control. partially clipped another pickup truck. continued to the right side of the freeway where he struck a large pole. vehicle suffered significant damage. almost split in half. >> the chp arrested the stepfather on suspicion of dui. an investigation is under way because two of those children were not seat belted. we have put in a call to a hayward police and we will keep you updated. live from oakland i'm tara moriarty. back to our breaking news in san jose. where police are investigating a fatal crash ktvu janine de la vega is at the scene. that is pearl avenue where a driver plowed into several parked cars. janine. >> reporter: pam, the accident investigation team just arrived in the last 20 minutes. and you can see they are behind me here at the intersection of pearl avenue and hills dale. police just blocked off pearl avenue at capital expressway. you can see here on the scene there is still a bunch of mangled cars and the body of the passenger laying on the sidewalk. the driver of a toyota avlon was speeding along pearl avenue and lost control and plowed into a row of five parked cars. two of them were totaled. the 18-year-old male driver was rushed to the hospital with nonlife threatening injuries. police say what they found in the car gave them a clue as to what the man in the car was doing right before the crash. >> based on the speed of the vehicle and the fact we found numerous beer cans inside the vehicle we believe alcohol is a factor in this one. in a traffic investigation you have to sort this one out. i'm at the scene i can barely figure out what happened. >> reporter: police have identified that driver as 18- year-old martin acosta of san jose. it's possible the driver could be arrested for dui depending on his blood alcohol level and he could be arrested for manslaughter charges but it's still too early in the investigation. police are still waiting to interview him at the hospital. believe these two men were coworkers at the restaurant. the reason why they were both wearing the same uniform. back out here live you can see again it's blocked at pearl and hillsdale. it will be like this for the next three to four hours. traffic jam. also the morning commute is right. let's go back to the desk. we are continuing to follow breaking news of a fatal crash in san jose. ktvu channel 2 reporter janine de la vega has been on the scene at pearl avenue. you just spoke with a witness. >> yeah i spoke with him off camera. he heard the crash and ran outside. he saw the driver stumble out of the car. that driver started asking what happened. he didn't realize what he was doing. that witness told us it was obvious he was drunk. police expected the same thing. here's a pile of mangled cars a dead passenger. this accident happened at 2:00 this morning. the driver of that avlon was driving at a high rate of speed. lost control and crashed into five parked cars. the 18-year-old driver died but rushed to the hospital. he has official injuries. the passenger had to use the jaws of life to free him. but it's too late he died at the scene. >> the vehicle had to be traveling at a very high rate of speed. hit a parked vehicle and hit a third parked vehicle. a total of five were damaged >> reporter: police say they found several beer cans. they believe alcohol may have played a part in this accident. the driver has been writed after 18-year-old martin acosta. police believe the two men were coworkers at a restaurant. possibly leaving work because they were both wearing the same uniform. police tell us they will be out here for the next three to four hours. they have pearl avenue blocked off. as well as capitol expressway. reporting live from san jose janine de la vega ktvu channel 2 news. police shooting has left a mentally ill man dead and put two free hasn't officers on administrative leave. that shooting happened yesterday morning. offices were called to help a woman who said her 53-year-old son was armed with a knife. and out of control. as two officers entered the families home they were confronted by the suspect and fired shots. there are no details yet on exactly how the man threatened the officers. an 11-year-old boy is recovering after being grazed by a bullet while he was sleeping at his home in oakland. someone started shooting at 5:00 yesterday morning. that bullet came through the wall, right next to the pillow where tran was resting his head. tran's brothers were also in the bed but they were not hurt. >> this is not the first time. they have done it before. they almost hit my dad. last time they shot in my backyard and hit my window. >> there is noover motive for the shooting pap white car was seen driving away. investigators are looking to see if it is involved. the boy's restaurant friday night shortly after closing time. they were forced to shoot and kill a man who pointed a gun at him after a robbery attempt. moments earlier a very alert employee lunged at that early morning crash where a car slammed into several parked cars. it appears the driver was speeding. alcohol may have been involved opinion another driver facing possible dui charges after a freeway crash in hayward that injured four children. this one happened at 10:00 last night. on northbound 880. two of the sicks were the drivers own stepchildren. and this morning park police in the livermore area will be searching. a natural gas leak tied up traffic and forced several hundred people to evacuate. it happened around noon yesterday when construction workers hit a pg&e line at fourth and folsom streets. police had to shut down several blocks in the area while utilities shut off the gas. muni buses helped move seniors to a nearby church but fortunately no one was hurt. a woman apparently intentionally lifted the lid off a concord storm drain and jumped in. witnesses called police after watching the woman jump -- that is when firefighter james. the bans will take effect at 8:00 today in napa, mendocino, lake, solano, and sonoma counties. cal fire may issue special permits for agricultural work. campfires are allowed in designated comp grounds. one brush fire burned about 45 acres near the carquinez bridge. it started yesterday afternoon on interstate 80 in crockett. several homes were threatened at one point but not damaged. happening now people in colorado now being allowed to go back home as firefighters get ahead of a deadly fire there. crews have been working around the clock trying to get it all out. it has burned 16,000 acres. destroyed hundreds of homes. and two people have been killed. last night those who's homes were saved personally thanked firefighters for their service. >> we went in the house and grabbed a bag of goodies and said thank you. >> the fire is considered a crime scene now. there is dozens of people that won't be able to get home for several more weeks. right now it's 5:45. >> we're looking at interstate 880 and traffic is getting busier. one of the things we are hoping for in june we usually have lighter than usual conditions. june and july as people take time off. there is no major problems if you are driving into
