New allegations out today claiming that the oakland mayor shaft and the citys Police Department retaliated against an Oakland Police sergeant who was trying to reveal the truth in a Homicide Investigation involving another Police Officer. It was an investigation into the death of a woman named irma lopez who died in 2014. She was the wife of Oakland Police officer brendon obrien. 15 months later, officer obrien committed suicide. That sparked the investigation that has led to the sex is canned al surrounding the teen sex worker. Now, irma lopezs death was later declared a suicide. But the Police Sergeant believes she was killed by officer obrien. Now the sergeant at the center of the investigation says he was retaliated against when he tried to tell the mayor and his superiors. Investigative Crime Reporter henry lee was there. He has the latest. Reporter these are explosive allegations that the department covered up the death of that officers wife and made it sound like a suicide when in fact it was a murder. That lead investigator says he is being made an example by a department trying to deflect attention from scandal. Im just tired of being out to be the scapegoat. Reporter it all started with the mysterious deaths of oakland officer Brendan Obrien and his wife a year apart. Began told fellow officers that obrien had killed his wife. Then he was moved out of the homicide section because of harassment. It was later ruled that both deaths were suicides. And obrien left a note referring to a widespread sex scandal that has lead to terminations of officers. Began said he was placed on leave because of a domestic dispute with his wife. He was accused of allowing a mistress to transcribe notes. Began is now being unfairly linked to another case, racist Text Messages shared by black Oakland Police commanders. The texts were uncovered with the help of began himself who had a fallout with a lieutenant who is accused of sending the messages. Alive and well. Once you step over that line, you become an outcast. Reporter i asked gant specifically if he believes the officers wife was killed by the officers. He does. But he is the only person who believes that in homicide. I reached out to the Police Department for a response but have not heard back from them. Henry lee, ktvu fox 2 news. Retired Oakland PoliceSergeant Leroy johnson was in court to face his misdemeanor charge that he did not involve the child abuse charge involving jasmine. Johnson reportedly agreed not to tell anyone but the conversation was captured in a screen shot on a phone. Prosecutors say another screen shot was discovered when johnson told jasmine to say she was an adult and she responded, quote, i would be lying. Even without knowing who she is, she gained supporters and notoriety around the world for her statement in which she addressed the man who sexually assaulted her on the stanford campus while she was unconscious outside of a party nearly two years ago. Now Glamour Magazine has named emily doe one of their women of the year. Allie rasmus is live now with more of what the young woman is saying about her experience and why the editors at glamour decided to honor her. Reporter we spoke to the executive director this morning and she said that emilys words were, quote, heard around the world. It was a powerful moment in the courtroom when emily doe read her victim statement allowed. The full statement was printed online, viewed more than 11 million times. It was read on the floor of congress and national air waves and credited for Inspiring Women around the world to see themselves as survivors instead of victims of Sexual Assault. It allowed judges to give lighter sentences in cases where there was drinking involved. These things all happened because this woman told her story. Reporter now glamor magazine is naming her one of their women of the year. They asked doe to write this essay talking about her experiences. In it she describes what was going through her mind as she read her statement in court in june. I was excited to finally read my statement and declare i am here. I am not that floppy thing behind the garbage speaking melted words. Brock turner was sentenced to six months in prison for sexually assaulting doe. Her reaction to turners sentence, quote, immediately i felt embarrassed for trying, for being led to believe i had any influence. If this case was meant to state the bar, the bar had been set on the floor. The sentence was believed to be too lenient and led to a recall of the judge in the case. Having the Justice System treat felony Sexual Assault and felony Domestic Violence like misdemeanors, the equivalent of shoplifting or vandalism, really is just not acceptable anymore. Reporter in summary, doe strikes a defiant tone in her essay ending with victims are not victims not some sorrow oweful aftermath. Victims are survivors and survivors will be doing a hell of a lot more than surviving. The man is described as an indian man between 30 to 40 years old. About 56 with a thin build and a trimmed beard and wearing a black shirt, blue jeans and black shoes. Police say there were no children on the school bus at the time of this deadly crash. A bay area bishop is heading to standing rock, north dakota today to support protesters of the controversial pipeline. Members of the diocese plan to help keep the peace between activists and police. Opponents say the 3 billion project threatening Water Supplies for the tribe and artifacts. At least 1,000 people are camped out. Two men have been arrested in the deadly beating of a homeless man back two years ago. Tai lam was beaten to death while sleeping outside in San Francisco. This past september, Police Arrested 21yearold joseph stull who was in jail in idaho on an unrelated criminal offense. Investigators say a dna sample taken from stull during his idaho arrest matched dna from the beating scene. From there, police were able to identify 21yearold david peters who was arrested in stockton last week. Both men are being held on charges including murder, robbery and elder abuse. Meanwhile San Francisco police are searching for a bank robber theyre calling the head band bandit. Look at surveillance images from a bank holdup last thursday at a wells fargo. She is described as an African American woman about 57 with a medium build. She threatened tellers with a weapon. Coming up, there could be a new way to help children with peanut allergies. After the break, well tell you about the wearable skin patch just introduced. The 49ers are fighting allegations by an auditor that the team used taxpayer money to help pay for stadium maintenance. Ktvus Azenith Smith reports now in a memo to the auditor, the 49ers suggest that the audit was to politically motivated. Reporter the 49ers first ruffled feathers by takingor neighboring soccer fields. Now an audit suggests that taxpayers are footing the bill to operate levis stadium. The 49ers are going to pay it back to our community. Reporter an independent auditor claims general fund money is being used to help pay for security, mainly santa clara Police Officers and city funds may have been used to replace the stadiums sod seven times last year. According to the mayor, that violates measure j, passed by voters in 2010 that states not a cent of taxpayer dollars be used on levis stadium. The fact that we have two and a half years and they havent provided what theyre supposed to provide in their agreements or dealt with us in a professional and respectful manner, were standing up for ourselves and fighting for our city. Reporter the 49ers issued a memo to the auditor saying he is acting more as i consultant to the mayor, looking to give credence to unfounded allegations of financial malfeasance on the parts of 49ers to coincide perfectly with the mayor election season goals. It went on to say no general fund money or city funds have been used for Stadium Authority operations as the team is in the prosecute she is of sending and reformatting budget documents as requested. I think its just a matter of time before the whole thing was going to go up like this. The City Attorney agrees that the bail system is flawed, allowing people with money to walk free while those without the means to pay, they remain in jail until they can see a jail. That creates a two tiered system. One for those with money and another for those without. It doesnt make anyone safer, it is not right and not in keeping with the constitution. It is time for it to stop. Reporter San FranciscoCity AttorneyDennis Herrera held a News Conference at city hall to announce his decision on this issue. Under californias current bail system, people arrested on suspicion of a crime are generally held in jail until their arraignment unless they can pay a set amount of money. That amount is set by a bail schedule and doesnt take into account the severity of the charges or persons flight risk. Herrera believes the system is unconstitutessal because it allows the wealthy to go free before trial and the poor remain locked up oftentimes. The bail schedule that lifts the price of freedom without any consideration of individual circumstances does not serve the interest of the government or public. And it unfairly discriminates against the poor much reporter and herrera says keeping people locked up before trial has farreaching consequences. They can lose their homes, potentially their homes and on top of that taxpayers have to foot the bill to incarcerate them. While the City Attorney is refusing to defend the current bail system, he is calling on the state legislature to reform the system he says. By the way, i also did reach out to the Sheriffs Office this morning and i was told by a spokesperson that the sheriff plans to follow whatever the state law says. We will send it back to you. The Police Commission is expected to narrow down the list of finalists tonight. The search began back in may when the chief resigned following several controversial officerinvolved shootings with the people of color. There was a top to bottom review of the policies and procedures of the department and suggested hundreds of reforms. One former San Francisco police chief says discipline remains a critical requirement for the job. You can have all of the policies in the world, 270 recommendations, what does that actually mean to the officers working the streets . Well, it doesnt mean a whole lot if theres not a well disciplined organization. More than 60 people applied for the job, including the acting police chief, tony chaplain. In the meantime across the bay, city leaders in oakland continue a search for a new police chief. They have been getting input from the community in a series of public forums. The goal is to hire a Permanent Police chief next year. The Police Department is under federal oversight. It was rocked by a scandal involving sexual misconduct. For a with week or two there was a revolving door of police chiefs. We are learning the defense for a man accused of kidnapping and killing sierra lamar. Attorneys want to use the criminal record of sierras father during the trial. He was accused of amosting one of her friends during a sleepover at their house. He spent a year in jail and had to register as a sex offender. Now torres wants to use the information to convince the jury that sierra ran away from home and was not kidnapped and killed by torres. A man was hit by two cars, including a Clayton Police car. It happened about 2 30 yesterday morning. A driver called 911 saying that he had hit something. Investigators then learned prior to the 911 call, a clayton Police Officer reported that he had accidentally hit a man lying in the road. The man was pronounced dead at the scene. His name has not been released yet. Now to santa rosa where two little girls were hit by a pickup truck last night while trickortreating. It happened just before 7 00 near rain dance way. A 4yearold girl and a 9year old girl were crossing the street when they were hit by the truck. The 4yearold was not hurt but the 9yearold was taken to the hospital. The truck driver did stop and cooperated with the investigation. The owner of the Apartment Building under construction near lake merit that caught fire thinks that foul play was involved. The fire started just about 5 00 yesterday morning near lester avenue on a building that was under construction. More than 150 People Living nearby were forced to evacuate. No other homes were burned. The owner says furnaces were just installed but the gas was not on and only temporary electricity was set up for construction crews. Someone has done something here. You believe this was set on purpose . I think so. I think so. At this point, thats what i believe. There are people around who come over the last year and said things about infringement in the neighborhood. The actual cause is still under investigation. No one was seriously hurt. The owner says the building was about 80 complete and would have opened in four months. Near the south bay a beloved mom and pop shop will close after more than 70 years in business. Ktvus janine de la vega was at mel cottons this morning where customers stopped by before it closes its doors for good. Reporter mel cottons has been in san jose since 1946. Now word spread that it is closing. Customers are coming in here to shop and talk to employees. It is sad. It is part of san joses history. Reporter with the receipt owe sign, mel cottons is a familiar landmark in san jose. It opened up 70 years ago. He started selling tents, Fishing Equipment and hunting rifles. Over the years cotton expanded. Even with competition from big name retailers, mel cottons thrived. But cottons son decide today sell the land to a developer. The coowner couldnt afford to keep it open anymore or move it to a new location. We have been in the building for 60 years now. The building is older than that. Beyond its useful life. We tried to find a way to build a new location. Ultimately property is so valuable in Silicon Valley and rents are so high that this model doesnt work here. Reporter the decision disappointed customers. Many have shopped her since they were children. You looked forward going there with your dad and buying fishing gear. It is really sad. Claudine wong went to San Franciscos Mexican Museum at fort mason to learn more about the holiday, where it began and where it is being celebrated today. This one here is from our permanent collection. And it was actually made in the 1990s. And it is for dis de muertos. Walk into the Mexican Museum in San Francisco and you will find sugar skulls, masks, art and an alter all in celebration of dis de muertos. Weve celebrated it every year. Unfortunately our founder Peter Rodriguez passed away this july, right after his 90th birthday. More than ever this holiday is special to the museum. Reporter Vanessa Moreno is the Development Specialist at the museum. Every year the museum takes this opportunity to not only celebrate but educate. The belief is that at midnight on october 31st, the gates pretty much of heaven are open and the spirits are welcomed back to earth. So it is now two holidays. It is november 1st, which is actually just for children who have passed. And november 2nd is for adults. They go back to their hometowns and they can enjoy being back on earth for two days. Reporter take us through all of the different significant symbols in it. The marigolds are the starter to the whole celebration. Theyre bright and colorful. They were actually selected for this holiday because of their strong scent. They were meant to lead the deceased spirits to the homes of their loved ones. Usually its celebrated with marigolds being placed from the person who has passed at their gravesite. And the mav egolds are lined up to bring them back to the home. Reporter at home, tributes continue with an alter or a frenda. Each person gets their own alter. Its a shrine with a photo of them and their favorite food. Reporter its a tribute to them to welcome them back. Youre saying we missed and you were celebrating your memory. Yes. And we know that you like these things. Here they are. Exactly. Reporter then you build a table of food. Tell me about that. This is the signature food. It is a very large food in the form of a skeleton. It is set out at midnight on october 31st. Throughout november 1st and 2nd, it is placed for them to enjoy. Tell me the significance of the sugar skulls and the masks. Yeah. The sugar skulls are a special recipe. Actually they originated from italy and brought with the Catholic Priest to mexico. They were combined with recipes. Skulls are again a positive thing and presented as a thank you saying we know you appear like this now but we miss you and love you. Reporter every alter is personal. And the museums is no exception. Our alter was made by gloria. Reporter they are local artists who wanted to help honor the museums founder, a man who worked decades educating people about mexico. He traveled to mexico as a young man and learned about his own culture there and said, you know, why isnt there a spot in california where i live where people can experience this as well . So he founded the Mexican Museum in the Mission District in 1975. We have his photo there. And of course we have the lady of guadalupe. She is a significant symbol as well. She is a specific saint to mexico. Reporter rodriguezs work continues today here at fort mason. Its a perfect opportunity to visually see all that the museum has to offer. Reporter even now a bigger museum is being built. It will be four floors, brandnew building in the middle of downtown san fran. Reporter she says this is a chance for people to come here and ask questions and learn. Sometimes skulls can look scary but they added bright colors and beads. It is more approachable for children who are afraid of skulls or the holiday itself. Reporter its approaches she says has given her a new understand its a process she says has given her a new understanding. You used to be scared of it. Yes. Now i prefer it over halloween because of the personal connection that i have with it. I do think it is a very positive and, you know, again, educational holiday. Where it is very unique.
