One of the parks patrons who was walking in the area described smoke coming from an area that would be described as like a fire pit, a very large stone fire pit. Authorities say its too early to tell the race or the gender of the body. Police also say they suspect it was the person committing suicide. We are learning new details about the death of is a young mother of two. Police now say they have a is in custody for the murder of Stacey Aguilar. Police say aguilar was killed in hayward and her body was dumped in fremont. The chp said today that roland zany of pittsburgh was behind the wheel when it slammed into a taxi and burst into flames on february 6th. Zaney and his passengers were killed. Officers say zany was driving recklessly and sped away. They say hit the taxi after running two red lights. The taxi driver only suffered minor injuries. Police later found two guns and ammunition in the suspects car. They also found a large amount of money and a white plastic mask. San Francisco Police released new information on a deadly shooting that happened right outside a mcdonalds restaurant. It happened just before 3 00 yesterday afternoon as the car was pulling out of the mcdonalds drivethrough on fillmore and golden gate. Investigators say the shooter walked up to the car and opened fire, killing the passenger. He was identified today as 23 yearold curtis kay. Police say is he was targeted. We have developing news tonight on a story that two investigators have been following for months. A mother is now just hours away from filing a lawsuit in the wake of her sons jailhouse death. It all happened at the Alameda County jail in dublin. Investigative reporter ross palombo joins us with the latest. Just about everyone has been named in this new lawsuit. The Alameda County sheriff, the county itself, and its Healthcare Provider are all named. Weve obtained an exclusive copy a day before it will be filed officially. Now all of this is coming after the jailhouse death of mario martinez. Our investigation uncovered that he died while under the care of Corizon Correctional Health at the santa rita jail this after a judge ordered that he receive treatment for nasal polyps that were making it hard for him to breath. He later died during a respiratory attack. The lawsuit cites corizons, quote, failure to recentliably train their medical staff, failure to implement generally accepted landfall policies at the jail, and deliberate indifference to the serious medical needs of patients. Martinezs mother has been blaming corizon and the board of supervisors for months. Everyone just failed him. And he suffered and dade an ugly death. And that probably is the worst part for me. The Sheriffs Department is responsible because they didnt provide the medical care, they didnt provide the proper housing, and of course corizon is responsible because they had a duty to provide the medical care and they didnt do it. Now the mother is seeking damages from all of this. Again the attorneys will file that lawsuit first thing tomorrow morning. This is not the first time consider ryeson has had legal issues as weve been telling you. Other lawsuits across the country have resulted in settlements worth tens of millions of dollars. And if this case right here is successful against the county it will be tax pay theres pay for any possible damages, that money coming right from the tax base. Reporter though the tunnel is 80 years old the root of this problem appears to go back 52 years when the deck that holds the westbound traffic was rebuilt. Decades of leaking water have attacked the masonite faber board pads laining the tunnel causing expansion and corrosion of the steel and concrete underneath. But caltrans says for now all is safe. The concrete is very sound. We just to have make sure we know what factor or factors caused it to split in the first place. Reporter that would be one thing if it were just this tunnel ahead of us. But the problem is this is just one of many, many structures needing billions and billions of dollars worth of repairs. We clearly do not commit the funds that are necessary to take care of age infrastructure. Ands not just that we are not now committing the funds to take care of age infrastructure. It makes me worried a little bit, if the werent for this el nino what would we be . This is one of the strongest el ninos in history, and weve been seeing increased rainfall but the pattern shift is whats woring me. The fact that weve gone dry so quickly. No matter what happens in march were still going to be 100 or under. I dont think were going to have that opportunity to be 130 or 140 . And what happens next year . There wont be any el nino next year. It rained every day in january, then it just stopped. Its weird to seat stop like this. I was looking at some of the models, long range stuff, and it was a little bit eerie today. Is there any explanation why it all of a sudden just can stop . No, it really isnt, other than theres some Climate Change things in store, possibly occurring that were seeing. And for february to shut down like this its really unusual. Its unusual in a drought year to have february be so dry. And in this el nino year where its one of the strongest el anyone yows on record, and we are seeing the moisture, the large surf along the coast, were seeing all the caightszs there, but were not stege rain. This week is going to be no different. On the east coast theyve had plenty of rain and snow. Were tracking. Theres a great example. That is a very powerful storm. El nino has helped to create that, with that storm system, as powerful as it is, its taken all its energy, all its moisture, its going north what. We see from this and what we will see is large surf emanating from the center out of the wind field. Well see large surf over the next three or four days but were not going to see the rain. Its not great. I guess what i was thinking, if we look at current temperatures, how warm it is, with the fact that we have this massive el nino this year, were pretty lucky were having this. What if we didnt have in the what if we stayed at a year like this without an el nino, were talking 20 of rainfall, the fifth year of a drought. Even with el nino were looking at some pretty okay numbers, but not great numbers. Not what we need. So i hate to be a downer, but as i look at the long range models it gets eerie. Tomorrow morning partly cloudy. Tomorrow is going to be another nice day. I dont want to bum your high, because its going to be a beautiful week, even though its still february. Were looking at temperatures that are easily dog to make it into the mid 70s, even upper 70s. So forecast highs tomorrow, 76 in brentwood, 75 in antioctober. We wont know whats happening until we look back on this five years or three years from now. Its weird. Thats what climate is. You have to look back and do the numbers. But this whole february is a bust for el nino. March will be fine. Well probably get plenty of rain, but we needed this february. Based on january, and even december, we were all thinking, hey, its exactly what we all thought this big el nino, tons of rain, and it just stopped. Thats the eerie thing. Even though the moisture is still out there the energy is still out there, were seeing it on satellite, its not coming here. Hopefully march and april will make up a little. Im sure we will. They had just climbed castle peak. They ran into someone in dire need of help. There was a News Conference to talk about this rescue. They say once they found the people in need they identified themselves and determined while the family from folsom had been snow shooting a 10yearold girl named samantha had fallen through the snow. Her family tried to pull her to safety but they realized they couldnt because the hole was too small and there was danger of the hole collapsing. The team had to rig a special rope system. They showed how they did it with a drawing. The marin search and rescue Team Appeared at just the right time because hypothermia was beginning to set in for 10year old sammy, as she goes by. The family were grateful for that perfect timing. We had to be very improv improvisational. He was very confused, because who would have expected 14 members of a rescue team to show up when your daughter falls into a crevasse. When we pulled her out, and she fell on robert, and scott, im glad i had goggles on, because i had tears. It was very emotional. Reporter you can tell just watching him there that he was getting emotional just talking about what he went through, what all these folks went through. Aside there being wet and cold, samantha was okay. They got some dry clothes on her, and then hiked her around a little bit to make sure that she warmed up and got back to normal. I did talk to her mother minutes ago, and she told me that samantha is perfect, not injured at all. Amazing when you consider that she fell 10 feet through the snow down into a creek below, was that in icy water for quite awhile before being rescued. But they are extremely thankful that this marin county search and rescue team was there at the right time. John this story is just incredible. Is it fair to say that had they not been there, the marin county Sheriffs Department, had they not been there, that this little 10yearold might have died . Reporter well, im not sure we can really go quite that far, but when they rolled up on the scene, the dad was on the phone with the truckee fire department, and it was going to be at least an hour, possibly more before they were able to get there to the scene because it was so far out tin wilderness. Sitting in 32degree water inside a snow cave with no help to get you out, you can imagine it would have been a much worse situation. Im not going to say she would have died but it certainly would have been a lot more challenging for her and the family to wait that extra hour. Congratulations to that rescue team. A woman and a nineyearold boy inside the home were also struck by bullets but they are expected to survive. Police are still searching for a motive. No arrests have been made. Another new express lane opened up for the first time in the east bay today. The new commuter lane is in the westbound lanes of interstate 580 through the livermore valley. The express lanes run 14 miles to dublin to eastbound lanes opened up on friday. The express lanes are expected to help keep traffic moving. Solo drivers can use the lanes but they will be charged a toll based on the traffic flow with a maximum fee of 11. The lanes are free for car pools, motorcycles, buses, and eligible clean air vehicles. Those drivers, though, need an adjustable fast track flex tag. Ktvus ken wayne tells us why theyre struggling with an oversupply of water. Reporter we showed you the giant billion dollar Desalination Plant in carlsbad last fall. It pumps seawater from the ocean and turns it into drink water for 3. 2 million residents. But the San Diego CountyWater Authority still gets most of its water from the metropolitan Water District in los angeles. That agency has continued to send millions of gallons to san diego, even though the county says it doesnt need it right now. This is not a longterm situation. This is a very transitory short term issue. Reporter half of it is being diverted to a reservoir and will have to be retreated before it can be sent to homes. That could cost 400,000. Some of the diverted water is coming from the new Desalination Plant. Because it just started its commercial operation, there was a heed to run that plant for a period of about 60 days. Reporter san diego wants l. A. To deliver less water for now. Metropolitan says it doesnt have the capability to reduce the flow. So the extra water continues to be diverted. San diego officials are locked into a 30year contract in which they must buy a portion of their water from the poseidon plant. A spokesman tells ktvu thats not a mistake and shouldnt detract other california communities from considering their own desalination projects. Desalination, seawater desalination is part of an overall strategy, longterm strategy to diversify our water supply, and provide that anchor reliability that comes from a drought proof supply like desalination. From a missing persons case to a homicide investigation, tonight we are learning more about the death a young mother of two as Police Announce they have someone in custody. Police say 22yearold Stacey Aguilar of san jose was shot multiple times before her body was then dumped in a rural part of the east bay. Gang. Im julie haener. Im frank somerville. Aguilar was last seen with her boyfriend at a party, but authorities wont say if that boyfriend is the perp of interest. Her body was found in fremont on saturday nearly a week after she was last seen in hayward. Ktvus Paul Chambers with more on these new developments. She was a young mother of two. Stacey aguilar was missing for a week before her body was found in a rural area of fremont. The boyfriend was arrested for Domestic Violence. And he is one of the persons that was questioned. Reporter police say 22year old aguilar was last seen leaving a party in hayward valentines day morning with her boyfriend. The next day aguilars family reported her missing. Police say they did question several people about aguilars whereabouts including her boyfriend. Saturday investigators found the body in a rural area of fremont off Morrison Canyon road. Police say aguilar was killed in hayward and her body was dumped in fremont.
