I have been told by oakland fire chief that hole is five or six feet deep. The rescuer went down there in a harness and down there for about 15 minutes or so. And then he came back out. He got some more equipment and came back down in the hole 20 minutes ago and down there ever since. They have a giant vacuum sucking dirt. Oakland fire says the man is alert and has been talking. We dont know the extent of his injuries. Certainly he has to be uncomfortable in this situation. There is Oakland Fire Department gurney that has been pulled up next to the hole. We expect he is going to be popping out of the home at any minute. We have been fine tuning this. It started at 12 50 when oakland fire got the hole where this man was strapped on 23rd street above foothill boulevard in east oakland. Apparently there is some kind of sewer work that was being done on this house at the corner tapping into the main sewer line at the intersection. There was some support walls put up. 5foot walls to retain the dirt. They call it cribbing and that cribbing collapsed on the man while he was down in the hole. Five or six feet deep. So again a rescuer is down there. They have a vacuum that they are putting down there to free up the loose dirt on the sides of the hole and they have been successfully and slowly pulling all of that dirt out. In fact in front you can see this pile of dirt on the sidewalk. Thats a lot of walk they have been sucking out of the ground to clear the area to pull the man out. They just fired up the vacuum and pulling more dirt out. Trying to get it away from the man so that he can pull him out. The rescuer is down there in the hole and it is so deep we cant see the top of his head but he is down there working with the victim trying to free him from all of the dirt that collapsed on top of him so that they can pull him up and bring him to safety. We dont know why the wall collapsed. We dont know if it had to do with the recent rains and if the dirt was unstable down there or perhaps there wasnt a good enough job to put up the retaining wall to begin with but whatever the reason is the wall collapsed and dropped dirt down there on the man in whole and it is a long painstaking process to get it out. We have seen this rescue rope go up and down so at one point just a couple of minutes ago, we saw the rescuers head pop up and he was gesturing to the other workers here on the scene and then he went back down in the hole. So when they brought the gurney over we thought they were bringing the man out. They are still struggling to get the man out. You can see the firefighters working the pulleys and the line attached to the fire truck and they have put a light on top of the ladder to shine down so they can see the hole. I can see the top of the head of the rescuer, the white hardhat and wearing a blue jump suit and right there at the top of the street and he is looking down at where the man who is trapped is. We cant see the man yet. But it appears that he is very close. There is a second line so you can see the blue rope, that is attached to the rescuer and then next to that theres an orange rope which i believe is attached to the man who is trapped in the hole. So they are still trying to get him out. It looks like they get close and stop to vacuum and they do work down there and they fire up the vacuum again. It sounds like or it appears that some of the work, the dirt that they free from around the man is clear and then as they edge him up apparently more dirt may be collapsing back down there and then it is a struggle to get him out. But they are getting closer. Thats the good news. The first we have seen of the rescuer near the surface. Thats the latest right now. We will stay here until they get the man out. Keba, is that you . Yes. We are looking at images and looking at sky fox so we can see exactly what you are describing. It seems like they have been getting close and at this now since 12th 30 but the battalion chief that opened fire, the battalion chief says this will be a long process because we want to remove his very safely. Reporter correct. They dont want to rush and do anything for further jeopardize the man in the hole and they are being careful. This is a very involved process. We got this massive vacuum truck from the Sewer Division from oakland and the Oakland Fire Department ladder truck that has the pulleys and the ropes going in the hole. Now they are putting the vacuum down and feeding the vacuum lower in the ground and they will suck up more dirt and try to get him out. As i said it looked like within the last five or ten minutes they were very close to pulling him out. Now they are firing up the vacuum and sucking up the dirt and hopefully little by little they will get enough dirt. This thing is so loud i can hardly hear myself speak so i hope you can hear me. Let me ask you one more question. I know you said the mans condition is said to be okay. Have the firefighters and medics been able to give him some type of oxygen with all of that dirt coming down in his face . I dont know if they have a mask on him or able to get to him . Reporter hard to hear you, mike, but what i heard from the battalion chief the victim is alert and talking. Thats fantastic news but we dont know the extent of his injuries and what he has said to the rescuers down there. We dont know if he is suffering any broken bones or anything like that. So thats what well find out after he gets out. There is an ambulance. Actually there is two ambulances standing by and the gurney is right here, right next to the hole. So the moment he comes out of that hole they will put him on a gurney an ambulance and i take it they will take him to highland hospital, just a few blocks away and the trauma center. He will get very quick medical attention the moment he gets out of that hole. And i think its going to happen fairly soon. Because it seems like they are trying to finish up here getting the dirt out of the way. As i mentioned, the rescuer popped out of the hole just a couple of minutes ago and it looks like they are getting closer to getting the man out. He has been down there for three hours. Im sure he wants to get out. Ken, we will keep an eye on the images, if you can stay there for us. The rescue there is under way. The 2300 block of 21st avenue, a man stuck there in the sewer pipe and the rescue operation looks like it is getting close. Well keep an eye on the images. Another big story in the bay area involving the Oakland Raiders, voting is under way and it appears that the nfl is poised to move one team to los angeles. Could it be the raiders . Heather holmes joins us. I can only imagine a lot of anxious raider fans here and in the bay area. Reporter certainly are. They will have to wait just a little longer. The headline right now no decision. Owners did a vote on the two proposals but neither one of them got the needed 24 votes. What does this mean . It means that owners are on the 4th floor here and still at it. Nine hours after arriving here at the westin hotel. We caught up with raiders owner mark davis as he was entering the meeting at nine this morning. He was mum on the issue. It wasnt until a few hours ago that we first started getting an idea what was going on inside this closed door meeting. Thats when word started to trickle out, a powerful committee, a 6 Member Committee had recommended to the owners today that they backed the carson project. Now that of course is the project that would bring both the Oakland Raiders and the San Diego Chargers to a new stadium site there in carson. A few hours after that. We actually saw disney ceo and the man backer of the carson project, bob eert down to the 3rd floor and got a cup of coffee and we asked him questions. He made his presentation to the nfl owners and said it went very well and gave it his best shot. Keba and mike. He believes that owners will not leave houston until they have made a decision. As i said to the league, theres a great opportunity here in los angeles. The nfl should be in los angeles. One of the most vibrant market, large diverse market. A football market and we havent had a team in almost 20 years. To it is time and i think that there is some momentum. I think that there is a real genuine desire to get something done and im kind of encouraged by what i sense is at least a collective agreement or opinion that la should have an nfl team or teams. Now again despite that recommendation, by this powerful committee the owners did in the last vote did give more support to the englewood project. So it is political moving going on here mike and, kebe and the owners on the 4th floor trying to hash out an agreement. Some people are wondering is there a possibility that all three teams could end up there . Reporter the nfl has made that clear. This is a not an option. Two spots available in la. The nfl is not looking towards financing two stadiums in the same market. Two teams and it looks like the San Diego Chargers will definitely move to la. The question is will they be joining the st. Louis rams in englewood or joining the Oakland Raiders in carson. Heather, i know you saw the raiders owner this morning what about this afternoon or evening in houston. Has he popped out . This is very different from most meetings that i have covered you are on the same floor and interaction and see the owners when they are coming and going. Thats not the case. They are basically sequestered and the media is not allowed on the 4th floor. I did though as you kind of pass by, you can see the doors opening and closing and i did catch owners coming and going but none of them have come down to the 3rd floor and frankly we are not allowed to go up to where they are. I dont know if you can see behind me but there is a room set up right here, the podium is set, the nfl podium is set and they have a back drop ready to go when and if there is an announcement. I feel like the sense im getting is that there is not going to be announcement tonight and they will try to get as close as they can to an agreement and expecting some sort of announcement tomorrow. Raider fans the wait continues. And i heard earlier that cowboys owner jerry jones was pushing for not that the raiders and chargers but the rams. I dont know that the raiders would get left out but there would be some money you are not getting it but here is a few hundred thousand dollars. Fill the stadium. I think it is safe to say that oakland is not going to lose. Raider fans may not be happy about the prospect of moving to la but it is clear that the Oakland Raiders will get something out of this. It is just a matter of what that might be. But you are right. The word here is that support really is gaining for that chargers rams venture in englewood. A shooting that injured two people and a toddler on interstate 80 in richmond could be connected to four other shootings along 80. Behind me here and children were placed in danger. Authorities say that three kids were sitting in the backseat of a family car when a bullet slammed through the back window and hit the drivers headrest before exiting out the rear window on the other side. A 2yearold child was hurt by shattered glass and treated at the scene. This shooting happened on eastbound i80 near Richmond Park way 7 45 last night. The family pulled into the shell station on fitzgerald valley and asked for help. We caught up with the store clerk and here is what she had to say. The first thing i thought was that could have been me and my kids or me and my sisters or nephews or nieces or my friends. It was scary and im glad that everyone in that vehicle is okay. Reporter this gunfire was meant for another car. The intended victim, a teenage girl and a man in his 20s showed up in a hospital. Dropped off there and they suffered gunshot wounds non lifethreatening. There have been five shootings along i80 in berkeley and richmond and pinnal since november. Two have been fatal including one on Richmond City streets. Authorities say most of these victims were targeted but that of course doesnt say a lot about the incident people including children that are caught in the crossfire. C hp would not go on camera. Here is a look at the models 10 00, we have steady rain over the north bay beginning to see a few scattered showers over the east and central bay. Along the peninsula and along the coast line. For the overnight. It sweeps across the bay area. Tomorrow morning we wake up with scattered showers. I dont expect it to be a heavy rain but we will have the showers falling and wet roadway and definitely the possibility of slick roadways for the morning drive. Notice as it pulls in the sierra by tomorrow morning. In the afternoon we will have a slight possibility of a few scattered showers for the rest of your wednesday. The wind speeds right now not bad. Generally light winds but they will pick up in the overnight hours. And will continue as we get to your wednesday morning with winds expected to reach anywhere from 15 to 25 Miles Per Hour. Maybe even gusting to near 30 Miles Per Hour over portions of the coast as well as our hills. For the afternoon the winds will continue to die down. Now as far as what we are expecting, rainfall amounts looking at anywhere from a quarter inch to an inch of rain expected over portions of the north bay. Central and south bay. President obama is set to make his final state of the Union Address in just about two hours from now. I think the sailors will be released quickly. We have two versions ready, one if they are still being held and one if they are released, will they acknowledge it . He may mention it but it is not obviously going to be the key part of his speech tonight. What else do you expect to hear from the president tonight and how is he going to be optimistic especially with National Security and keeping americans safe and the terrorism that we have seen recently. How is he going to be optimistic . Remember that this is president Barack Obamas last state of the union speech. He is going to set a frame work for his legacy here. And so it has got to be upbeat and most of the speech will deal with accomplishments over his years in august. The fact that the future for the United States is great because he is working very hard now on what is going to come post presidency. The other thing to keep in mind we are in the middle of an election, election season. So he doesnt want to do anything that diminishes the chances of the democrats to take the presidency. Everything that you are going to hear tonight will be around positives. And thats going to be the theme of the speech. Well you brought up the election. Lets talk about that. Is he going to discuss it or talk about the candidates and what do you think he will say in regard to the candidates. I dont think much. The state of the union is a very special speech and if any american citizen can see that speech in person you see that its filled with pomp and circumstance. I have been to a state of the union speech. It is really a remarkable experience. What you see is that the president spend a lot of time crafting legacy or crafting what will happen in a year. They tend not to get too bogged down in the other issues. He will be a little partisan but not greatly partisan. All right. Brian, what do you expect to hear from South Carolina governor nikki haley, giving the republican response after the speech. She is said to be a rising star in the republican party. Possibly a Vice President ial candidate. She will try to craft the presidency and Barack Obamas legacy as one of not accomplishing a whole lot. So thats going to be her job this evening. And to point out that the republicans have a brighter future. I suspect that her speech will be much more political than the president s will be. Political analyst brian solva. Government never should have agreed to the prison swap because Bowe Bergdahl is a desserter and he should not face jail time. Supporters say he will face a life prison sentence. On the scene in oakland, ken, do the crews know if he is okay . The last report we have, we are looking at a live picture on the corner of 21st avenue and 23rd street. The man is alert and talking and according to an okay land fire chief about an hour ago. This is playing out for more than 4 hours. That man is about five or six feet under the surface of the sidewalk there. And rescuers are trying to get him out. One rescuer is in the hole with him. Attached to a harness and apparently they have been trying to attach a harness to the victim and there has been a lot of the activity trying to get dirt out of that hole. You see that big giant tube. That is a vacuum truck that is sucking the dirt out of the hole where theman is trapped trying to clear the area so that they can remove him. There were a couple of times in the last hour where the rescuer poked his head above the surface and was talking to the other workers here, the firefighters and the people from the city of oakland trying to get him out. They would go back in the hole and do more activity. The good news the vacuum has stopped operating so it sounds like all of the dirt is removed from the area and now they are trying to work on getting a harness around the victim and pulling him out. They have been trying to shore up the crumbled walls down below that apparently caved in on that man. The Fire Department says the victim is alert and talking. We dont know what kind of injuries he may have. There are two ambulances on the scene. And a gurney parked just out of view of the
