>> reporter: chloe wiegland's mother kim did not hold back. right after the civil lawsuit was filed in federal court in miami this morning. >> royal caribbean police a major role in the death of our child. >> reporter: the wiegland family attorney is michael winkleman. >> it's our clear allegation in the complaint that they either knew about the window safety, window fall prevention codes or should have known about them because it's the industry standard. >> reporter: the lawsuit contains these revealing pictures, which show a wall of glass aboard royal caribbean's "freedom of the seas" cruise ship, which has been in operation for 13 years. chloe wiegland fell out of a middle window, which was open and is about chest height for most adults. surveillance video viewed by cbs news shows chloe wiegland standing in front of the lower window, which was closed. her grandfather, salvatore anello, stood over her, looking down. >> there is a railing, and there's a bottom glass that goes up. >> reporter: he picked chloe up and says he tried to stand her on that railing.
