hayward today. we are getting reports that a bart train struck a tree or a tree branch that toppled due to the high winds. it's causing a major delay on the fremont line in both directions and there is no bart service south of hayward. no injuries have been reported but the train is stopped on the tracks. winds knocked down trees. there is a wind advisory through 6 p.m. tonight. crews worked on cutting this up tree in san francisco. it fell down by the intersection of geary and arguello. in sunnyvale, a driver collided head on into another downed tree on 101. the driver is okay, the car though not so much. that windy weather also being blamed for leaving thousands of people in the dark. 27,000 are without power in the santa cruz mountains as of 10 a.m. pg&e sent us this update on the outages in the south bay, nearly 1400. nearly 300 on the peninsula. and about 300 in the east bay. 4800 in the north bay. well, the notorious santa ana winds have prompted a local emergency in one southern california city. this massive tree fell down on a shell gas station in pasadena. look at that. that's where city leaders are urging people to stay home and keep their kids out of school today. many of the roads are littered with downed limbs and power lines, some of the wind gusts in the san gabriel mountains clocked at over 100 miles per hour. >> it is what it is. we'll see what happens. hopefully, everything will work out for the best. >> the national weather service issued a red flag warning for potential wildfires in the area in force until late tomorrow afternoon. just minutes ago, a jury cleared former bart officer johannes mehserle and four others of using excessive force while arresting an oakland man. kenneth carruthers claims mehserle and his fellow officers attacked him at the coliseum bart station in 2008. mehserle testified the plaintiff was about to attack the officers. the jury found the officers were not liable. mehserle was sentenced last year for involuntary manslaughter in connection with the shooting death of oscar grant. a san francisco firefighter used his own oxygen mask to save the life of another today. that as a two-alarm fire burned on 24th street near bartlett leaving four hurt, dozens homeless. anne makovec at the scene now with the clean-up efforts. anne, good afternoon. >> reporter: good afternoon. the building is still standing here behind me and some of the people who live there have been able to go in and get some of their things and bring them out because they are not going to be able to live there for some time. that is after a fire ripped through that top story early this morning. >> you think it only happens in the movies but it's really that vivid. so grab what you can, get out the door. >> reporter: this is cell phone video from the building across the street as flames shot from the roof of two apartment buildings on 24th and bartlett. these residents were evacuated at around 4:30 a.m. after the fire started on the top floor. >> filled with smoke, bright red. literally glass showering outside the front of the apartments from the windows popping. >> reporter: four people who lived here were injured. two were critically burned. firefighter bob coleman suffered smoke inhalation after rescuing a woman from this ledge. >> on the window and she was hanging out on the ledge of the window so i broke out the rest of the window so i could grab her and hold her so she wouldn't fall and gave her my mask so she could breathe. >> reporter: he handed her off to another firefighter who helped her down this ladder as coleman gasped for breath having given away his oxygen. >> part of the job. >> reporter: there is significant damage to the building where the fire started and some to the building next door. but with wood framed construction, and high winds this morning, it could have been much worse. >> we worked it for about an hour and then put it under control. crews did a phenomenal job in suppressing the fire. >> reporter: the building's owner is in shock. >> it's been through two major earthquakes. it's just -- this is just the worst disaster that can happen to it. >> reporter: and investigators have been in and out of building all morning. they have not made any sort of cause official just yet. frank and grace? >> okay, anne makovec live for us in san francisco, thank you. well, it looks like as though the "occupy sf" group is splitting up. the city offered to move them to a different location, but as gil diaz shows us, the protestors are divided and are now forming two "occupy" locations much to the dismay of city leaders. gil. >> reporter: hi, grace. good afternoon. and first of all, i want to clear the air that i just spoke with someone from the mayor ed lee's office. she says there is no official noon deadline for these "occupiers" behind me to vacate justin herman plaza. but as you mentioned, grace, yeah, they have now announced they could not come to a consensus to either stay here or go to the alternative site. now we have two camps, "occupy sf" and occupy mission. some "occupy" san francisco demonstrators aren't budging from justin herman plaza. >> if they come and raid our camp, the 99% will shut down every intersection on the street. >> reporter: contrary to what many have heard, there is no noon deadline to vacate the premises today. a spokesman for mayor lee's office says, the "occupiers" should plan on leaving soon. it's a public space that's become privatized. the city offered an alternative site and abandoned school in the mission district. this man is cleaning up and heading that way. he says it's a safer, secure location without any threat of a police raid. yesterday, police in los angeles raided its "occupy" camp the largest in the country. >> every night i go to sleep here, consistent rumor of police raid, police raid, police raid, you know? i want to get some rest. >> reporter: nick shaw says he does not like the alternative site because its parking lot only fits a maximum of 100 tents. mariah holmes says the new location defeats the purpose of protesting near big banks. >> i'm trying to make a point and this is the financial district like i don't want to move out of here where the people i'm trying to reach out and talk to are. >> reporter: and another reason a lot of them don't want the new site is because of a laundry list that the city has of what they can and cannot do at the new site. one of the things they don't like is the fact this they can't bring pets or animals at that new site. now, i talked to the mayor's office. they say that school is not open right now. they are waiting to see what the "occupiers" voted on. now they know. >> gil, they are divided. but did you get a sense that the majority want to stay at justin herman plaza? >> reporter: well, you know, the majority is that they are going to stay here. i would say maybe probably 70% of them are going to remain here. and about 25 to 30% are willing to go to mission and some of them are already headed there. grace? >> all right. thanks a lot, gil. in the meantime, protestors in santa cruz occupied a vacant bank building last night. officers say the protestors used couches, file cabinets and furniture to keep police out. protestors and police said the situation turned hostile and almost got out of control. bart directors are meeting right now to come up with a policy on disrupting cell phone signals. thish eye came up in august when -- the issue came out in august when bart blacked out cell phone service at four san francisco stations because of a protest. the new policybart is running through hayward now, by the way. the fremont line is open again. apparently they moved that branch or that tree that was blocking the tracks. the search continues for two people in connection with a home invasion robbery. this happened at stanford university. we have a sketch of one of the suspects armed with a handgun. a man and woman forced their way into a university apartment on tuesday. they bound the hands of a man who lives there. and then they stole his laptop as well as his wallet. in other bay area headlines now, the federal government will reimburse california nearly $21 million. this is for the highway 1 repair work at devil's slide. winter storms in 2005 damaged the area. part of a national push to fix roads and bridges damaged by severe weather. clorox will pay $200,000 to settle a lawsuit involving five bay area counties. the suit claims the oakland- based company sold customers bottles that were only filled up to 80% capacity. the bleach products were sold between 2008 and 2010. coming up, move over, mcdonald's. the other fast food chain that will now charge for toys. plus, slipping support. new poll numbers out for president obama here in the golden state. the good and the bad news for the commander-in-chief. and rolling deep... ♪ [ music ] >> in nominations. the major stars facing off for the most grammy nods. she won 'em. hi, i'm meteorologist lawrence karnow in the cbs 5 weather center. wind whipping up around the bay area today. hoping things calm down soon. sure looks good outside though. we'll talk about that coming up next. closed captioning of eyewitness news is brought to you by shreve & co. jewelers, a san francisco original. ,,,,,,,,,,,,,,,, let's go live to wall street. you can see the dow down about 23 points. stocks apparently pulling back one day after the market's best showing in 2.5 years. it was up about 500 points just yesterday. part of the reason for the low numbers today, discouraging news on jobs. the number of people applying for unemployment benefits rose for a second straight week. it is a sign that while the job market may be recovering, it's at a slow and uneven pace. tomorrow governor brown is expected to unveil a ballot measure that calls for and i crease in taxes. the plan includes a temporary increase in the state sales tax and a temporary income tax increase for people who earn more than a quarter million dollars a year. it would go on the ballot for the november 2012 general election. california's support for president obama is slipping. a new field poll shows only 45% of voters would reelect him at this point in time. many are disappointed with how he handle the economy. however, they would still choose him over the republican front-runners. the polls show the incumbent leading mitt romney and former house speaker newt gingrich. this year's hottest baby names and a popular movie is proving to be an inspiration. the names on top coming up next. >> a crazy scene on a dashcam. what happened to a police officer seconds after this. we'll show you. at least the fog is gone but the winds blowing very hard around parts of the bay area right now. when will that calm down? [ laughter ] around the bay area today, it is howlings across the mountaintops. still winds at 50 miles per hour, gusts to 70 at mount diablo. foster city gusts at 42. 46 in half moon bay. san jose gusting to 38 miles per hour sustained at 25. so yeah, a lot of wind around the bay area today. it looks like a wind advisory is continuing in the north and east bay hills. but i think you will see those winds just about everywhere you go today as the gusts continue outside. some of those gusts in the wind advisory area still up to 50 miles an hour maybe even higher than that across some of the mountains but boy, does it look good outside. clear skies forever over the bay right now. temperatures beginningwarm up. 64 degrees in concord. 64 in san jose. 66 in santa rosa. high pressure in control building into the bay area. the difference between these two is giving us all the gusty winds outside. but i think it will hold on. windy over the mountaintops but the winds, yeah, they are going to be kick up through the afternoon hours. this is a wind forecast for you seeing some of the stronger winds over the mountaintops. but toward tomorrow, the winds do begin to subside somewhat and calm down. still a little breeze on your friday, as well. with that in mind, temperatures for today mainly into the 60s outside. before 7 degrees in san jose. 69 in santa rosa and about 65 in san francisco. next couple of days, plenty of sunshine, a little less wind friday. a little breezy into saturday and over the weekend, but not bad. looks like a few clouds could return toward the middle of the week. by the way, snow report, heading to the high country, sunny and brisk, no new snow. we have a good couple of feet of base at boreal. looking good at heavenly heading in that direction but watch out for the winds. no fog to worry about. northstar looking good no new snow but they are making it, packed powder, get up there and do a little skiing. >> how cold is it up there? >> chilly with the wind but this weekend not bad. >> sunny? >> sunny and bright and brisk. >> and brisk. >> 60s. burger king will start charging parents for toys to comply with a new san francisco law. the city's ban on toys in kids' meals starts today and they are now prohibiting it in food with high salt and fat content. burger king will let parents shell out 10 cents for their toys. mcdonald's has a similar policy. no word on what burger king with do with the 10 cents made from toys. it seems there are a lot of aden and sofias running around. a list of popular baby names. sofia is followed by emma, isabella, olivia and ava. grace you're number 29. >> nice. >> okay. >> for the boys, aden still holds the top spot for the 7th year. jackson, mason, liam and jacob round out the top 5. the list comes from babycenter.com. i didn't look up frank. i'm sorry. survivors of domestic violence say they really need to feel love and support to move on. sharon chin reports that's what they get from this week's jefferson award winner. >> you are beautiful inside and out. >> reporter: toshonna ross helps build courage in women who survived domestic violence sexual assault and homelessness. >> you are worth everything. and if you don't see the importance in yourself, you are important to me. [ crying ] >> do you hear that? i believe in you. i love you. >> reporter: toshana ross founded the nonprofit to empower women in need. >> to me it's about being able to save someone's live through my own testimony. >> reporter: she herself lived through five years ago of domestic abuse including attempted murder. she sunk into depression and tried to commit suicide more than once. >> there was a point in my life where i couldn't even speak. i was so broken because of what i had endured with the abuse. >> thank you. >> you're welcome. >> reporter: toshonna journaled how caring friends lifted her out of depression. today she gives women journals to mark their own milestones. her triumph inspires survivors like lawanda. >> lets you know i can also be a survivor. i am a survivor. i am courageous and it's just -- it empowers me a lot to know that, okay, i'm not alone. >> that's what brings me joy to see that they are coming out with a new-found confidence, with hope. >> it's really impacted me. >> reporter: jenny helps coordinate some of the gatherings. >> toshonna creates a space for women to be blessed by other women for women to meet heroes. >> reporter: and once a year hundreds of women in need get a free shopping and pampering day. day. the executive coordinator says toshonna goes all out to make them feel like royalty. >> it has to be right. it can't be half. it has to be whole. she doesn't care if she spends the last dollar in her pocket. it has to be right. >> if i leave this world today, nothing else matters but to know...
