family reported him missing when he did not show up for a funeral on thursday. san jose police detectives then found out from the chp that his truck had been in an accident. so the return to the scene, or one week later, and found him unconscious in the brush. one of the problems the chp said that they had initially identified that this was connected to this missing man case was that the vehicle was registered to a town outside of fresno. so they had trouble initially contacted his family. >> the street in east san jose shut down as police investigate a deadly shooting. it happened along walnut woods' drive. that is where officers found one man shot and one man badly beaten last night. and 80 year-old man later died at hospital. you're taking a live look right now. the man was beaten is expected to recover but you could see there is still a big police presence. they say it is too early in the investigation to determine a motive. the biggest copper theft in a couple of years in american canyon. fees told 1,500 ft. of water in from veterans memorial park. the vallejo times herald reports that police staked out the area but were not there when one was stolen. the good news [ male announcer ] send money from one bank account to another, with citibank popmoney. easier banking. every step of the way. >> >> you were watching cbs 5 eyewitness news in high definition. >> good morning everyone, it is thursday may 17th. >> nearly 6:30 a.m., cassandras a man is now recovering from one week alone it on the side of the road. >> detectives found in your is rent the truck off of 101 in south san jose, ann mackovic joins us now with what took so long to find him and how he is recovering. >> good morning, he is in critical but stable condition. police have not been able to interview him yet. he is at the regional medical center in san jose and they're hoping to talk to him later on today but even though he is unconscious, this is an amazing story of survival. we found his picture on facebook. 24 year-old michael sanchez, a graduate of andrew hill high school. he crashed 1:00 a.m. tuesday may 8th. exiting 101 in south san jose. the chp responded and found the truck but it was empty. when this is the report of the driver had gotten out and walked away. officers still searched the area for about an hour before they give up. >> we had every reason to believe that this person probably was not really hurt because, they walked away from the scene. also we did not find any blood in the vehicle. >> again that was tuesday may 8th, early in the morning. his family reported him missing when he did not show for a funeral that thursday, and san jose police detectives found out from the chp at his truck had been in an accident. they then returned to the scene this tuesday and found sanchez lying in the brush. the chp says one of the difficulties that they had been reporting this accident when they found the vehicle without any driver, and it was that was registered to a town outside of fresno. and sanchez lived here in san jose. so they had trouble locating his family. the investigation into how this happened continues. live in san jose, cbs 5. >> no lights at american canyon veteran parks. thieves stole 5,000 ft. of copper wiring so the park as been without power since monday. it is the largest such theft in more than a year. police staked out the area but were not there when the wiring was stolen. repairs will be made in time for their memorial day events. an update to the illegal marijuana bust in the east bay. federal agency the richmond warehouse was at the center of a major drug-trafficking operation. the owner of two northern california gardening stores and 17 other people now face drug charges. yesterday agents seized more than 3600 marijuana plants after exploring a fire there. it also found dozens of guns and a grenade launcher as well. >> a residential street shut down as san jose police look into a homicide on the city's east side. matt bigler joins us from the scene on what would strive, what can you tell us? >> i can tell you that the reason the police activity is still here is this is now a homicide. early reports indicated that there was a fight just after 8:00 last night and the fight resulted in one person being shot and another injured. we found out a few hours ago that that person has died at hospital. pierce was going on behind us. there's a crime scene investigation truck. we have seen the crime scene investigators walking through this apartment complex just next to what would strive. we're not sure if that is an area they are investigating. earlier we spoke with a lieutenant from the san jose police and he tells us how this all started last night. >> that is one of the things i'm sure detectives will look into but by and said it is early in the investigation so right now we do not want to speculate. >> obviously he is talking there about whether or that was gang affiliated, indications of any gang affiliations. they do not know what started the fight that broke out just after 8:00 p.m. last night. one person has been killed as a result of gunshots. another person injured. the person that was injured is expected to survive and that is pretty much all they know about the crime of this point. we believe that this is the city's 15th homicide of the year and that puts the city's homicide rate just about on par with what it was last year. that is the latest from the scene. back to you guys. >> ok, thank you so much. martina's police asking for the public help in catching a graffiti suspect. take a look of the photograph. officers say that this man may have been involved in a may 6th incident in which several downtown businesses were vandalized. take a close look. >> let's take a look of weather now. the weekend is approaching, maybe you can give us a clue as to what we have to look for too? we have allen brooks in mobile 5 this morning and he says that it is slow and go like this coming out of the altamont pass. we can give you a drive time for this stretch of road. that was down 580 commute is now 24 minutes at of the altamont pass. grayslake central all the way out to the dublin exchange. better news for this accident, 780 eastbound lanes. for while this exit was blocking women but it is clear to the right shoulder with in the last few minutes but we're still seeing some slower speeds heading to the bridge. but that should clear up very shortly. back to you guys. >> 60 6:00
