good morning, tracy. >> hey, good morning, juliette and sydnie. we are coming off a wet weekend especially yesterday. boy, it was coming down in buckets across the san francisco area. let's take a look. we are dealing with light showers. so fremont and livermore in the east bay looking at some light rainfall for the morning from fremont, pleasanton, livermore and also moving into the danville area. we'll now move up a bit to the northeast. we'll move up to the north bay and they are also still looking at light showers, as well. not coming down heavy but it will keep the roads wet and considering what we picked up yesterday, there could be still quite a bit of standing water out there so you will have to contend with that north of santa rosa looking at light activity as well as vacaville and fairfield. so your forecast for the morning, no big surprise there. showers are expected. gusty winds up to 20 or 30 miles an hour across the bay area and temperatures from the lower to the upper 50s. showers won'tbe sticking around all day. for your traffic, here's elizabeth. >> thank you. even light rain showers as you said maybe reports of standing water in some areas because we have already seen a lot of different spinouts across the bay area so again, this would be the morning. give yourself some extra time. we have a wind advisory for the bay bridge. we have chain requirements if you plan on heading out of town. chains required between nyack and donner lake on i-80. here's truckee. you can see the big rigs just off to the shoulder just waiting it out. chains are also required on highway 50 and 88. let's go closer to home. slick roads. you can see the glistening off of the bay bridge toll plaza camera. and right now they do have that high wind advisory. chp issued that just after midnight on the upper deck. no huge hot spots even though we have seen a lot of solo car accidents. nothing blocking lanes or causing big delays. back to you. >> thank you. a chase for a stolen car suspect puts a bartz police officer in the hospital. the officer hit wasn't involved in the case. >> reporter: good morning. [ signal breakup ] it happened just after 11:50 p.m. here at the intersection of grand and beech street in hayward. what we are learning is that after 11:47 last night alameda county deputies were patrolling castro valley when they pulled over the driver of a 1994 honda civic that they matched a stolen car description. that car was stolen last friday. the driver threw the car into reverse when stopped, slammed into the officer's car and took off. the police chase ensued through the city of castro valley into hayward at speeds up to 60 miles an hour. when the suspect got to this intersection here at hayward and grand street, the suspect ran a red light where a bart cop was driving through. the suspect slammed his car into the cop car, possibly at 60 miles an hour. that according to jd nelson of alameda county's sheriff's office who we spoke with earlier this morning. the office of the bart cop who was hit in the intersection, he is in the hospital with nonlife- threatening injuries. the suspect is in the hospital as well with severe head injuries. we'll learn more about his condition coming up in the next hit. live in hayward, unser [ indiscernible ] , cbs 5. thank you. budget cutbacks forced vallejo police to call in reinforcements from several other cities to investigate two homicides this weekend two men were killed within hours 6 each other in separate incidents. they are the 15th and sixth homicides this year. one man was shot in an apartment building near marin and pennsylvania streets close to mid night on saturday. less than three hours later officers responded to a stabbing near marina parkway liquor on marine world parkway. vallejo slashed its police force to 90 this year from 155 officers in 2003. the parents of an antioch toddler shot and killed on his second birthday will face a judge. they are facing charges of child endangerment. their son and his 4-year-old brother were alone in a bedroom when the boy was shot in the head. it's unclear who pulled the trigger. police say modique just bought a gun and the father a convicted felon had loaded it and put it in a drawer. also in court this morning, the registered sex offender accused of sexually assaulting a 2-year-old girl in a union city dollar store. 36-year-old eugene ramos is being held without bail. police say he attacked the toddler when she wandered away from her grandmother and aunt. he has yet to enter a plea. the showdown over prop 8 takes center stage in san francisco today. a federal appeals court will hear two hours of arguments. mark sayre has more on what the judges will be considering. good morning to you, mark. >> reporter: good morning. just a few hours from now attorneys on both sides of this debate will meet here at the u.s. court of appeals. that's where a panel of three judges will hear arguments on the constitutionality proposition 8. it was 2 years ago that california voters approved that same-sex marriage ban. but earlier this year, a federal judge struck down the measure as unconstitutional saying it amounted to state sponsored discrimination. the appeals court will have to decide if that lower court ruling will be allowed to stand or should be overturned. >> twice now the people of california have voted to preserve and protect marriage as the union of a man and a woman. and that decision of the people of california is a legitimate and constitutional act. >> honestly it makes me feel like the people of my state hate me and i don't count as a full citizen and shouldn't have the same rights as they have. >> reporter: in the first hour of the hearing the three-judge panel will consider if the group who put prop 8 on the ballot has legal standing to appeal since it's not responsible for en forces the state's marriage laws and in the second hour the court will actually get right to the centerpiece issue here which is is proposition 8 constitutional at all? you. a hiker lost in the santa cruz mountains for nearly a week is now recovering. 58-year-old debra collins was found safe on saturday afternoon. she went hiking in a state park near fall creek on november 28. that's when kneel off the trail and hurt -- when she fell off the trail and hurt her ankle. she scooped water from a creek with a plastic bag to survive. search efforts came up empty until she was found saturday on an unmarked trail by two hikers. they say a psychic told them where she was. >> my neighbor has a friend who is psychic so she calls our friend, crazy, but she calls our friend. and her psychic friend says i don't see any violence involved. and i see her leaning against a tree. >> that's where they found her. collins has been treated for frostbite and exhaustion. she is expected to be released from the hospital today. a sick sea lion in contra costa county is under observation this morning at the marine mammal center in sausalito. she was found near an elementary school. this is the third time rescuers have been called about her. vets say she appears to be sick from eating toxic algae but right now she is doing fine eating and swimming around her livermore, pleasanton and san leandro. these showers are moving off to the northeast and that's going to be the trend for the morning. also still looking at some light activity in the north bay so guerneville, healdsburg, also just to the north of santa rosa, pushing into calistoga and the st. helena area that's the drill for the morning. let's look at the forecast out the door. showers expected and gusty winds as high as 30 to 35 miles an hour this morning and temperatures ranging from the lower to the upper 50s. rainfall will be in the forecast for the morning. by the afternoon, everything will have cleared out. partly cloudy conditions are expected. and temperatures will range from the mid- to upper 50s along the coast, the upper 50s to the lower 60s around the bay, as well as inland. so here's a look at what's going on. had a frontal system along with a low pressure system moving through the bay area and that's why you got dumped on yesterday evening across much of the san francisco area. currently, you can see some minor clearing building in back behind it once you get rid of the morning showers. after that we are expecting sunshine. so again for today leftover showers for the morning, windy conditions through the day and back behind that another storm system approaching and that's going to give us another chance of rainfall midweek around wednesday and thursday. seven-day forecast, leftover showers for the morning, sunshine with some clouds expected for the afternoon, a mix of sun and clouds tuesday, more showers back in the forecast wednesday and thursday, but look at what happens after that, friday, saturday and sunday. great weekend to do some holiday shopping both days in the upper 60s well inland, near 60 along the coastline with plenty of still moving well towards downtown oakland. but again, 15 different incidents at chp is working. so particular it slow. we had one earlier in san jose. this was just cleared northbound 85 approaching bart patrol car in hayward. minutes earlier, sheriff's deputies stopped the suspect but then he rammed their car and sped off. the suspect is also hospitalized. california's battle over same-sex marriage heading back to court today. federal appeals court judges will hear arguments about whether proposition 8 is constitutional. a lower court judge overturned the gay marriage ban in august saying it violates civil rights. today lawmakers will be getting down business during an emergency budget session. they will try to agree on how to close the $6 billion deficit. a spokesman for the governor says to expect, quote, ugly cuts in state spending. tomorrow san francisco's board of supervisors will vote on whether to use eminent domain to take over four buildings standing in the way of the transbay terminal project. demolition work is in progress on the old terminal. but the city needs to take possession of four buildings that are blocking a path for rail tunnels. the building owners are holding out for more money. a judge may end upsetting a final price. tomorrow the san jose city council will consider whether to lower the living wage for workers at mineta san jose international airport. officials are concerned about the airport's ability to stay afloat. airlines and other businesses say the current living wage law adds too much to their operating cost and the airport has lost a third its scheduled flights since 2007. free parking at broken meters around san francisco could soon come to an end. the city parking agency is proposing a one-hour cap on the time that cars can stay at a broken meter. right now drivers can park in the spots for free as long as they don't overstay the time limit. transportation agency says it's pushing for the change because it reporter: good morning. that's right. the bart cop is in the hospital this morning with nonlife- threatening injuries. it happened here at the intersection of grand and b street in hayward. the cop was patrolling the area. i spoke to sergeant nelson this morning. he says just after 11:47 alameda county sheriff's deputies pulled over a '94 honda civic that matched the description of a stolen car. when the deputies began to get drive he threw his car into reverse and slammed into the deputy's car and took o the deputies chased him through castro valley speeds up to 60 miles an hour. when they reached grand and b street the suspect drove through a red light and hit the bart cop who was patrolling the area. the bart station is at the same intersection. the cop is in the hospital with nonlife-threatening injuries. the bart officer's name is not being released except he has been with the hayward bart since 2001. now, the suspect different story. story. he is in the hospital with schwarzenegger called the emergency session so lawmakers can try to figure out how to close a $6.1 billion deficit. the governor's spokesman warns ugly cuts are coming and it's only going to get worse. governor-elect jerry brown takes over next month facing a $19 billion deficit for the next fiscal year. public schools bracing for new cuts it state funding. the "mercury news" reports school official across the state are bracing for a possible shortening of the school year by another week. plus layoffs of counselors librarians and also coaches. 5734. a wet and windy start to your monday. let's go to tracy with a look at your forecast. >> good morning. we are still looking at some showers out there this morning. they are scattered. you can see that. they are not widespread. and they are still fairly light in nature so we are going to move into parts of the east bay. livermore still looking at light rainfall as well as the danville area and pleasanton. we are also seeing some light showers just near the san rafael and hercules area and also just outside of richmond. as we move up to the north bay outside of santa rosa, to the north of santa rosa, we do see showers well north of guerneville and more showers moving into the calistoga area. with showers in the forecast we also have something else to contend with this morning and that's some windy conditions. here's a look at a couple of locations we have picked out. some of the highest wind gusts around midnight. sfo at 40 miles an hour. daly city 37, foster city 35, san francisco ocean beach at 33. those are the highest wind gusts since midnight. the first column is current winds we are seeing out around 10 miles an hour. we'll look at your afternoon forecast. looks like we'll squeeze out some sunshine. five current and former new orleans police officers. they are charged in connects with the fatal shooting of a man just after hurricane katrina five years ago. the jury heard 12 days of testimony about the death of 31- year-old henry glover. one of the officers is charged with shooting glover without justification. two others are charged with burning glover's body and the other two are accused [ laughter ] a live look at the bay bridge toll plaza a wet start to the morning commute as well as a windy start. chp issued a high wind advisory early this morning still in effect for the bay bridge. it's our only one. we have been seeing several spinouts across the bay bridge, westbound 580 approaching greenville. speeds are slow, everything in the center divide. your drive time now 17 minutes so a little slow out of the altamont pass. it slows again at hopyard towards the dublin interchange. typical start on highway 4, off the bridge okay. a street speeds slow to under 25 miles per hour. like i said earlier this morning, chp was working about 15 different fender-benders, nothing causing any huge delays. but it is and i want to quickly mention this new one that popped up before we came on air. fairfield westbound 80 around the 680 interchange sounds like another solo car crash. back to you. >> thank you. checking today's top stories, a chase reaching speeds of 60 miles an hour ends after a suspect in a stolen car rammed a bart patrol car in hayward. the officer inside is now in the hospital and minutes earlier, sheriff's deputies stopped suspect but he rammed their car and sped off. the suspect was also injured. california's battle over same-sex marriage heads back to court today. a three-judge panel will hear arguments about proposition 8 the voter-approved measure that limit marriage to male-female couples. a trial judge overturned prop 8 in august saying it violates civil rights of gay californians. tomorrow san francisco's board of supervisors will vote on whether to use eminent domain to take over four buildings standing in the way of the transbay transit center project. the buildings are blocking a path for rail tunnels but the building owners are holding out for more money. a judge may set the final price. new this morning, a twist in google's efforts to bit coupon website groupon. efforts have failed because groupon wants to stay independent for now. the chicago tribune reports the website may look into an initial public offering of stocks. this would have been google's largest acquisition yet worth about $6 billion. today people will notice changes to facebook. they are redesigning the profile pages of 500 million users. you're looking at the founder mark zuckerberg's page there. pages begin with basic information like where you live, wore or go to school. they are also emphasizing photos. users can list their closest friends and share activities and interests. >> you can see all the things that you have in common with that person. it's just like it gives you this amazing connection with that person. and the current version of the profile that we have today just doesn't do it. >> the new layout does not change privacy settings. but some users are still concerned because the new profile pages do highlight a lot more personal information. users won't see all these changes, though, until early next year. all right. so we have been asking you on our cbs 5 facebook pages are the changes too much?
