Kpix 5s reporter ryan takeo joins us from the newsroom and ryan, her family is now suing safeway. Reporter suing safeway in a wrongful death lawsuit. In it, the victims family blames her death on contaminated caramel apples. Shirlee frey bought a popular treat a few days before halloween. Over the next week, began to feel very, very sick. Nobody buys a package of wrapped caramel apples and expects to die from that. Reporter the complaint states that on november 6th, due to weakness and instability related to her illness, mrs. Frey fell and hit her head. Doctors thought it was a brain bleed and she had surgery at stanford hospital and was discharged the next week. She recovered at a Rehabilitation Center but by thanksgiving, she could not be awakened. On december 2nd, doctors determined that she had been infected with listeria. She died the same day. This is someone who lived a long productive life and had a very closeknit family and theyre absolutely devastated. Meanwhile a San Jose Fire Department has shut down one of its stations because of mold. In the building. Yesterday evening crews moving equipment out of station 16 on south king road on the citys east side. Station 16 firefighters will work out of other stations for the time being until that building is cleaned up and finally declared safe. The governor has declared a state of emergency for four counties hammered by this months storms. Including san mateo and marin in the bay area. These dogs were extremely vicious. Its not it was like some dog that just randomly bit somebody. These dogs were actually kind of like they were out hunting. Reporter when they sniffed out larry and his dogs, they charged. Had my little dog in its mouth and was shaking it like a rag doll. And it was blood going everywhere. Reporter larry tried to fight the dogs off. Even as he tumbled down these rocks and into the water. I punched the pit bull as many times as i could in the face. Until i couldnt punch him anymore and im laying down at this time. Reporter the dogs finally backed off and police cornered them hours later nearby. They became very hostile and aggressive towards our officers. And unfortunately the officers to protect themselves and also to protect the public had to shoot the pit bulls. This right here is looking a little bitter, this is for teenaged girls and whats concerning is that teenagers are just hard to shop for and they people just dont tend to think about them when it comes to give giving donations and expecting 1,000 of them to come through the doors today. Were seeing a higher volume of traffic now just in that westbound direction. But no major brake lights yet. Just a brief delay hitting mid fan. And span. And heading for the 080 commute. Thats cleared out only going to be slow for you for westbound 580 as you approach North Livermore avenue. Now heading for the rest of the drive, 680 has been looking good. No major delays as you make that southbound drive leaving highway 4, 242 just a brief delay getting to the walnut creek interchange from about north main. A bay area family lost their loved one to a listeria outbreak blamed her death on caramel apples she ate. Now the family is suing safeway. Thats where the family says shirlee frey bought the prepackaged apples and died earlier this month. Doctors determined shed been imfected with listeria. Five people in total died from the contamination all link to the same strain. Cdc investigators found 87 of listeria patients across the country say they ate prepackaged caramel apples before getting sick.
