Apple accusing samsung of stealing its ideas. And today, a jury agreed as our mark sayre reports, samsung now owes apple 900 million but jurors from the trial say its more than just the money. Reporter since the Legal Process does not move as fast as the pace of technology, this case surrounds some older products including the Samsung Galaxy s2. A previous jury found samsung did violate apples patents but this jury was tasked with deciding a big portion of the damages. Some jurors say they feel apple simply made a better case that it was harmed and samsung didnt put on enough evidence nor witnesses. We had way more information from apple. And i think we were left wondering why we hadnt gotten other information from samsung. We didnt have much to counter it with. Reporter this juror says while jurors considered only the facts of this case, there is no question the decision sends a larger message. If you invent something thats a valuable commodity and you get to you get to have the rewards of that invention. Reporter cnets Senior Writer sat in on the trial and agrees there is a takeaway for Silicon Valley as a whole. They felt that they wanted to protect patents and they wanted they wanted companies to keep making things, keep inventing things and to feel comes that the court system will protect them. Reporter and another juror says it was not lost on her that this was a case that could have a worldwide impact. I knew it was big but i didnt know how big. Reporter in a statement, apple says, for apple, this case has always been about more than patents and money. Its been about innovation and the hard work that goes into inventing products that people love. While its impossible to put a price tag on those values, we are grateful to the jury for showing samsung that copying has a cost. So todays jury here in san jose actually awarded 290 million of that 900 million total payment that samsung now owes to apple for its part though samsung issuing a statement this afternoon saying it is very disappointed in todays verdict and it does plan to appeal. Bart and its unions are facing a new fight after the bart board approved most but not all of the new contract with the unions. The sticking point, a family leave provision. The unions have already ratified the full contract but today, the bart board of supervisors voted to accept the contract without that provision. Its part of a deal that includes six weeks of paid leave for Union Workers to take care of a seriously ill Family Member or to bond with a new child. Bart management says its a mistake in the agreement and the unions are furious. This is a fair and equitable contract for our employees in my opinion and its a fordable and establishable for our writers. Were stunned. We think the board has taken an action that is not legally defensible. Reporter the unions can go back to their members to ratify the contract without the family leave provision renegotiate a new contract, take legal action against bart or strike. The unions are meeting with a legal team to decide what to do. First the rain now strong gusting winds are set to sweep across the bay area. Brian hackney is in for paul tonight on our high wind advisory. We have gusts already up to about 35 miles an hour in some of the windiest spots in the bay area. Its all happening because of that storm thats headed south. Building High Pressure in its wake combined with that low means we have gusts up to 45 miles an hour out of the north northeast and with the recent rains, the ground softening up a little bit, not like we got a huge gullywasher but nevertheless theres the threat of downed power lines and also downed tree limbs. And as you can see right now if you look at the hot colors, thats where the strongest winds are, they are expected to be at the Higher Elevations. So now we have calm winds in san jose. Its up to 15 miles an hour at sfo. But in the north bay, north bay hills and then extending to the east bay hills later, theres winds gusting up to 30 miles an hour at santa rosa and in the futurecast this is a model of how the winds should kick up tonight. Strongest will be in the north bay up to 30 to 40 miles an hour. You can feel that. So it will be windy enough to fly an iron kite tonight in the bay area. That could lead to some problems. Well monitor it and have the whole forecast in 10 minutes. Thank you. Californians who lost their Health Coverage because of obamacare are out of luck. Today covered california rejected a plea from president obama to extend those policies as his team works out the bugs in the Affordable Care act. Steve large is in sacramento. Now, steve, california is not going to help the white house. And this could affect hundreds of thousands of people. Reporter well, covered california essentially voted to stay the course. They are not going to allow those who are facing their policies to be terminated january 1 any type of extension. There was a chance of a one year extension. The vote was unanimously by the covered california board 50. And, of course, this comes as president obama has been facing backlash after telling americans they could keep their healthcare insurance if they wanted. It turns out thats not true. One of the critics of this vote today happened to be the state insurance commissioner dave jones who says that this is a disservice to policyholders. Now, bottom line here, after this vote today, i can tell you that there are 900,000 californians who have received cancellation notices. Some of those people will be able to get some type of subsidy to get them into a covered california policy. But the vast majority of them, 600,000 also not. Now, were going to hear in a moment from the executive director of covered california. But first, here is that state insurance commissioner dave jones. Jones covered california should have released Health Insurers from the contract provision and allowed them to renew their existing policyholders so Health Insurers can comply with the president s promise and so policyholders can derive the benefits from the promise. Preventing consumers from renewing their contracts is a disservice. 1 of californians will be faced with financial challenges. It means a lot if you are that 1 . The issue of relooking at subsidies is a important issue for congress to look at. Far too much attention is trying to destroy and undercut the Affordable Care act. Reporter covered california again voting 50 not to give any extensions to those policyholders whose policies were canceled as of january 1. 600,000 will not be eligible for subsidies. Covered california says so far, more than 360,000 people have signed up for accounts on its website. Eight armed robberies in just a few hours and tonight Vallejo Police are searching for a pair of gunmen involved in a crime spree that targeted victims one right after the other. Kpix 5s john ramos on the mini crime wave. Reporter the crime spree began here about 5 30 p. M. When a resident on the 100 block of olympic drive was robbed at gunpoint by two men. One wearing a mask and the other a bandana across his face. The next robbery happened a short time later in the busy parking lot of seafood city on sonoma boulevard. Which makes this even that much more brazen because the areas of these robberies very heavily populated areas. Reporter police say they got wallets and purses and then the thieves moved to the 400 block of louisiana street robbing someone in front of a house. The next stickup happened at the 7eleven on tennessee street but this is the one police arent sure about because the cashier was robbed by a single gunman after a group of young men had been ejected for causing a disturbance. But police say that because the 7eleven robbery was so close and so soon after the incident on louisiana, they will be reviewing any Surveillance Video to see if there is a connection. Next, people were robbed at houses on pueblo way and another road. Both victims had just returned home from shopping so police are considering they may have been followed home. Finally, around 9 p. M. , a holdup of a delivery truck driver in the costco parking lot on plaza drive. And another victim robbed near pep boys right next door. Thats 8 robberies in less than 4 hours. If the thieves were trying to get the attention of police, they succeeded. That tells me that these individuals really showed no regard whatsoever for either of them being caught and or them hurting someone in the commission of this crime. Ellis act evictions in the there is a downside to San Franciscos booming Real Estate Market. Ellis acts evictions in the city have jumped 45 in the last year allowing Apartment Building owners to evict tenants if they want to get out of the rental business. But city leaders say, thats got to end. Kpix 5 reporter linda yee says they are moving to change the law. Reporter ken, one idea is to ban or at least impose a moratorium on ellis act here in San Francisco but that will be a tough political sell in sacramento. So mayor lee is leading a coalition coming up with amendments to the ellis act making it tougher and more expensive for landlords to evict tenants. Reporter this elderly couple is one of eleven families being evicted from their north beach Apartment Building, victims of an epidemic of ellis act evictions. City records show 162 evictions in the 12 months before september. Randy shaw of the tenderloin housing clinic blames it on a hot Real Estate Market and speculators. They buy a building and then the next day they go out of the landlord business which they have never been in and its a way to preempt eviction laws for speculators. Reporter the ellis act allows apartment owners who want to get out of the rental business to evict tenants but state and local lawmakers are working to change that by imposing restrictions on how the ellis act is used. We need to shut down the incentives that they have used tow evict tenants. We have to make sure we make it harder for these repeat real estate speculators trying to flip properties. Reporter some suggestions include more permits or hearings before the resale of a property. Or require landlords own a building for at least five years before they can use the ellis act to evict tenants. If someone has to own the building for five years before they can ellis, that puts a speculator out of business. Reporter urban Green Investments bought the building that 92yearold man and his 88 yearold wife have lived in for 30 years. They have to move out by february. The real estate companys own website cites recent building purchases and its commitment to preserving the citys architectual and culture identity. Calls to the owners to get their take on the efforts to restrict the ellis act were not returned and no one at their offices in the citys Marina District would comment. I dont think theres anybody here thats going to want to make a comment. Reporter the California Apartment Owners Association told me late this afternoon they will oppose any efforts to change the ellis act. We have here behind us one of the lowest emitting locomotives in california. Its project the lowest emitting locomotive in the country and were excited to have it here in richmond. Reporter researchers in the university of washington, uc san diego and Rutgers University are looking into car hacking including the sensors in tires. The transmits wirelessly into the vehicle. Reporter a professor was able to remotely hack into tire pressure monitors that are required in most cars since 2008. They emit a signal allowing tire pressure to be checked electronically. We have 36 pounds of air in that tire. Reporter but using common Lab Equipment researchers were able to capture the tire monitor signal, rewrite it and send it back to the car triggering a dashboard warning light. And major the car think that and make the car think that its tires are flat while they are not. It is plausible that somebody uses this to stop you from the side of the road. Has its own investigation and san jose state officials are investigating why Campus Housing officials apparently knew about some of this harassment that was going on but apparently allowed it to continue. Reporter hundreds of students marched on the san jose state campus in protest over a series of alleged hate crimes against an African American student by his three white roommates in their shared campus dorm suite. Reporter the District Attorneys Office has issued arrest warrants for the three white students all 18 years old, Logan Beaschler of bakersfield, Joseph Bomgardner of clovis and colin warren of woodacre. This is a case about a 17 yearold boy who went to college and over a period of almost two months was harassed and bullied because of his race. Reporter Deputy District Attorney erin west says the white students hung a Confederate Flag in their shared living space and called the africanamerican students threefifths a slur dating back to slavery and allegedly forced him to wear a bike lock in the shape of a neck iron. Three roommates took a u shaped bicycle lock and the three of them forced it around his neck. And once they had it locked around his neck, they forced had i am to remain in it saying that they didnt know where the key was. Reporter the case only came to light after the boys parents visited his dorm room and saw the Confederate Flag and the n word written on a white board and reported it to housing officials. Students called it hard to believe. The chain around the young mans neck, thats something thats thats not forgivable to me because that represents the oppression that our people have gone through. Campus administrators are scrambling to find out how this could go on for months without housing officials or resident advisors being aware and or taking action. Distressing. Its more than embarrassing. And sad and shocking to see it happen. Reporter the president of san joses chapter of the naacp says he will be contacting federal authorities to look into possible civil rights violations. They have issues and we need to really start addressing the racial tension on this campus. Reporter the black student was 17 when the incidents started. Because he was a minor he is not being named by the Police Department here on the campus police. As for the three other students, they have been suspended by the university. And the students charged in that case are not expected to appear in court until next month. The owner of a Chinese Restaurant in oakland has been charged with more than a dozen labor violations. According to the Alameda County d. A. s office, the man turned himself in and is now in custody. He owns century buffet in the fruitvale district. He is accused of failing to pay minimum wages and committing fraud. If convicted, he faces up to 15 years in prison. An International Effort is under way to bring home an 85 yearold palo alto man detained in north korea. Merrill newman was pulled off a plane heading back to the u. S. Three weeks ago. Checking bay area headlines, at the richmond harbor authorities pulled a car out of the water with a body inside. The car is registered to a man who lives aboard a boat nearby. And that was a driver of a utility truck speeding away from the chp down southbound 101 early this morning. The man took off when Rohnert Park Police tried to pull him over. The federal Communications Commission just recently said its safe to use electronics during an entire airplane flight. They are now considering letting people make phone calls. The fcc says its considering a proposal that would let passengers make phone calls, text and use cellular data during the flight. But not during takeoff and landing. If approved, planes would have to be fitted with special antennae in order for phones to work in the air. Senate democrats today went nuclear making the biggest change to the senate rules in decades. Senate democrats voted to change the number of votes needed to break a filibuster from 60 down to 51, a simple majority. The issue is this, stormwater runoff flows into the reservoir when it rains. It flows from places like this cattle grazing field to a stream, then to the reservoir.
