The suspect is described as an indian man between 30 and 40 years old. He was driving a volkswagen sedan with tinted windows and a texas license plate. This morning, two Armed Robbery suspects head to Alameda County superior court. They say 24yearold bradley gentry and 18yearold Latisha Lewis were behind robberies near fremont bart in the last two months. The first incident happened in late september. Police say that one suspect stuck a handgun at the back of the 35yearold man before take the victims phone and wallet. There could be changes in san jose ahead of next weeks marijuana vote. Its agreed to pay 50 million in a new settlement. Authorities say the bank charged customers nearly 3 times the amount of what the fees should have cost. With election just one week away another email scandal looms over Hillary Clintons campaign. Justice Department Officials are now poring over thousands of messages to gauge clintons use of a private email server. For what this investigation means with the clock winding down, we turn to our washington insider Marc Sandalow. Good morning, marc. Well, trump calls these emails the mother lode. Clinton says theres nothing there. Why is this dominating the final week of the campaign . Reporter michelle, its because ignorance allows people to say or believe whatever they want. And the problem with what the fbi has done is they said we have a trove of enough evidence. We dont know whats in it. We dont even know if its important and we wont find out before the election but there it is. When donald trump says that there is criminal activity here and its the mother lode and guarantees an investigation into a Clinton Presidency if she were to win, he is basing that not on any evidence. Basically, this is an effort to buy time until the city can figure out the Legal Framework for a new industry. If prop 64 passes next week, anybody over age 21 will be able to smoke marijuana but cities will still have local control over licensing and regulations for commercial uses. Now, the San Jose City council also going to discuss some of their proposals for medical marijuana businesses today if they are able to make deliveries to patients. So that would be once the delivery people pass Police Background checks. She is ahead of Republican Donald Trump by only 3 points. Last week, she had a fivepoint edge. The latest clinton email probe stems from an investigation of anthony weiner, the estranged husband of clinton aide huma abedin. Democrats are criticizing fbi director james comey for revealing the reopened investigation so close to election without giving details. Even republican Alberto Gonzalez a former u. S. Attorney general is puzzled by comeys timing. I didnt understand the purpose of the letter. All of us are somewhat perplexed about what, you know, the director was trying to accomplish here. But you have to sign up for the option. Today is the deadline. If you want to volunteer on election day, Election Officials are still looking to fill some spots. Officials in Santa Clara County say that they are looking for about 200 more volunteers. They are expecting a very busy election day. We have been seeing over 200 voters a day. We had over 1500 voters visit our early voting site this last weekend and were looking forward to seeing more voters this coming weekend at our early voting sites. The registrar of voters is also looking for volunteers. They are looking for people who can speak spanish and english. Four richmond cops fired each accused of having sex with an underaged prostitute. But the womans Attorney Says the layoffs arent enough. John burris says his client Jasmine Abuslin was victimized by officers from other bay area departments and these men should also be fired. Abuslin is preparing to file a multimillion dollar lawsuit against a number of local Law Enforcement agencies. Richmond city manager says the officer layoffs stemming from this case will send an important message. Community trust is essential. And this conduct really violated that trust. And it has no place in the department. Five other richmond Police Officers received reprimands. Two men accused of brutally attacking a homeless man are now behind bars. Surveillance video shows a group kicking the 67yearold as he was sleeping on a sidewalk in San Francisco in 2014. He did not survive the attack. Police say that they used dna evidence to track the two suspects down. They are each being held on a 5 million bond. Investigators believe that a third attacker is still on the run. The San Francisco division of the fbi suspects that this would be robbed a wells fargo in Laurel Heights last thursday. She is dubbed the headband bandit. Investigators need your help. The suspect is 57 and was seen wearing a black hoodie and black sweat band. Rain and low visibility are likely the cause of a crash involving trick or treaters in santa rosa. The crash happened on raindance way. Two little girls ages 9 and 4 were trick or treating when they were hit by the pickup. The 9yearold was taken to the hospital but was conscious and talking. The other little girl is okay. Police dont believe drugs or alcohol were involved in the accident. Anybody in the bay area taking a vole by the beach should be extra a stroll by the beach should be extra cautious with waves as tall as threestory buildings. It says powerful storms from the Northern Pacific could spark 27foot waves, sneaker waves particularly of concern. Officials worry that dry weather will inspire beach goers to walk right by the water. The largest waves are set to roll in between thursday afternoon and friday night. So watch out watch out. What if we get the green light for mavericks. I have never seen it happen so early in the season but well have the blue skies out there making for pictureperfect swells. But if you are going to be heading to the coastline again you do have that advisory in effect for all of our beaches for very strong swells up to 27 feet, also some very dangerous rip currents and sneaker waves. Right now a little bit of lingering activity in the form of very light rain showers to a pretty moderate downpour around the hayward area. We have some rain showers around the highlands. Also backing through san mateo bridge you see all this activity lifting up. It will be raining hard in hayward within the next few minutes and well see if it makes it out to the 580 680 corridor but this is just kind of like the backwash with the passage of the area of low pressure. Well dry out later today. Well become party cloudy. But right now with the cloud cover, temperatures are into the 50s. Winds are under 10 Miles Per Hour. It will increase about 10 to 15 during the afternoon hours. Temperatures slightly below average or spot on with the clearing of the skies, temperatures at the coast into the 60s. Moving over now to the Altamont Pass traffic that you would be avoiding if you were using ace train, tracy off 205 slow, 9 miles an hour into livermore at north flynn road. North tracy boulevard to the pass will take you up to 50 minutes. So very heavy conditions. Heres a look at the slow conditions along the dublin interchange, Altamont Pass to 680 will take about 20 minutes. And a new crash here pacheco boulevard the onramp to southbound 680, its a disabled big rig not a crash, and its blocking the onramp so that could take a while to clear. This years average premium hike is about 13 . Price growth for next years premiums is driven by Rising Health costs for a population that has turned out to be more expensive to insure than anticipated. Officials also blame rising Prescription Drug costs and people who hold off buying coverage until they get sick. This spike was denounced by a group that backs a failed 2014 ballot measure to give regulators more power over insurance rates and United Healthcare is officially leaving the exchange with only 1200 enrollees in the golden state. Its expected to have a minimal inpacket. Open enrollment ends january impact. Open enrollment ends january 31. Jackie ward, kpix 5. Theres a lot of buzz about the Affordable Care act this season. Cbs News Business analyst Jill Schlesinger is here to break down even more of the changes that we can expect for the coming year. So jill, if you are one of the 11 million who are covered or plan to purchase coverage, what do you need to know . Reporter as you just heard in that packages the enrollment is open through january 31. But if you want your coverage to begin on the first of the year you have to enroll by december 15. Now, if you do miss the january 31 deadline, you can actually enroll or even change your plans later. You just have to qualify for a special enrollment period. Remember if you dont have healthcare our dont qualify for an exemption, you are subjected to the individual mandated, the higher of 2. 5 of your income or 695 tax per adult. We have a maximum cap at 2,805 per family. It will stay at 2. 5 going forward. The flat fee will be adjusted for inflation. You pay the penalty on the federal income tax return you file for the year you do not have coverage. It seems like we revisit this question every year. We heard about the big price increases in the plan. Why have they gone up so much this year . Reporter you know, look, first of all, let me just say one thing about those price increases. We are seeing national increases for a midlevel obamacare plan popping by 22 but like you say in california, its less than that, some places more. The thing thats very important, these increases should not significantly affect more than 80 of the folks who were enrolled in obamacare. Thats because they qualify for premium tax credits which makes their coverage more affordable. In fact, government says that a lot more people are going to qualify for help so be sure to check that out and three reasons the premiums have gone up, not enough Young Healthy people have enrolled, we need more 18 to 35yearolds to keep the premiums down, by the way, a lot of experts say the penalty is not high enough because that a lot of young people would rather pay the fee than pay for the cost of insurance. Those who do enroll need more care than anticipated. A lot of the insurers underprice their plans. We have traffic and weather in less than 4 minutes. A gas fire is burning in eastern alabama after a pipeline explosion sparked wildfires and prompted evacuations. At least one person was killed. Several others were injured yesterday during the blast in shelby county. Investigators say it happens when crews using heavy equipment hit a petroleum pipeline. This scene is not far from where another line ruptured in september leading to fuel shortages and gasoline price increases in several southern states. This with now two lines being shut down could have a Ripple Effect further into the northeast thinking new england and perhaps as far as canada, as well. Colonial pipeline is responsible for supplying about onethird of gasoline used on the east coast every day. Halloween festivities turned tragic last night in mississippi. Three people on a hayride were killed when the trailer was rearended by a car in newton county. Two of those victims were children. The mississippi Highway Patrol says several other people were hurt. The cause of the crash is under investigation. A new International Airline will soon be flying in and out of Oakland International airport. We do not know which one it is yet. But details about these new flights include the locations will be announced in three hours. A United Airlines flight had to turn back to sfo. Passenger had an eighthour delay last night and took off around 11 00. Authorities say the boeing dreamliner had to make a uturn in the air because of some sort of mechanical issue. You can see the purple line showing the flight turning around near boise, idaho. There are 230 people on board. They are scheduled to land later this morning. Could the future of flight be going vertical . Boeing just released new designs for a plane that doesnt need a landing strip. This is the video they just released that shows a plane, they say, can take off and land vertically. Moving over to the golden gate bridge, if you are heading from marin into San Francisco, 580 to golden gate toll plaza should just take 15 minutes so a quick commute in either direction. Reporter yeah. They are talking about an urgency ordinance to ban the sale of Recreational Marijuana. Of course, thats already illegal here across california. But this ban would be in place even if prop 64 passes next week. It is really an effort to buy time until the city can construct a Legal Framework for a brandnew industry because even if californians legalize nonmedical pot, cities would still have local control over licensing and regulations for sale.
