. this is kpex 5 news. we're going to go bye bye for a little bit, and you are going to get the best treatment ever. >> this bay area two-year-old has been waiting more than a year for someone to save his life, and it's happening right now. gooevending. i'm elizabeth cook. >> i'm ken. the surgeons at utsf are performing a double transplant tonight. little matthew is well known by everyone in the hospital because of what he and his whole family have been going through for nearly two years. joe vasquez spoke with matthew's parents tonight and has the latest. joe. >> well known because this little boy has spent practically his whole life here at ucsf medical center weight for this moment. >> ow. >> look, mommy has one. >> ow. >> i'm sorry. you just don't like it. >> little matthew we met is only two years old, but he's having the surgery of a lifetime. matthew has a require disease called primary hyperox lure ra type 1. his kidneys failed so his family is driving in from antioch six days a week for 23 months. that's because the little boy has had to be an dialysis on a nearly constant basis. last night his family got the call that some organs were donated, and they were a match so now matthew is in the midst of a 12-hour surgery. >> very scared. i mean, as a mother, as a father, it's very scared because you're handing your child over for a very, very serious surgery, and it comes with its risks. >> matthew is having his kidneys replaced as well as a liver. the family doesn't know who donated the organs, but they were told it was a young man who died in a car crash. >> it's -- you know like you said, it's fear, but it's gratitude. it's -- you know, your thoughts are with our son and with the surgeons, but a whole lot of our heart and soul is with the donor family and just really thankful. their sacrifice and their gift is going to give our son a chance to live, and we are very humble with that. >> the bay area news group is documenting the surgery. his family hopes matthew's struggle will save even more lives. >> we want people to see matthew. we want people to know his story, and we want people to see that little face and to know that, you know, there's a reason for this and there's a need for this and then once they can get involved, personally involved, maybe everybody can make that choice. >> the surgery has been underway for about five hours now. as far as we've heard, it's going well. there are many from antioch throughout the region who have raised money and raised awareness and have said prayers hoping for the best. reporting live, i'm joe vasquez, kpix 5. >> this is the fourth time that matthew's family has received a call about available overgans. the other three times, the doctors determined that those organs would be rejected. the fbi raided the office of state senator ron calderon today but so far no one will say why. agents were at the capitol well into the evening, and at this point, it's unclear what, if anything, they took. the l. a. county democrat was not there during the raid. so who is ron calderon? well, he was first elected to the state senate back in 2006. he chairs the senate insurance committee, and he's a member of the legislature's latino caucus. that office was also searched tonight. >> hi, guys. are you with the fbi? are you investigating something? sir, are you with the fbi? can somebody tell us what's going on. >> right now, the fbi says it's investigating quote allegations of criminal activity, and no arrests are planned. the senator is not commenting, but his high-profile attorney is. garragos told the l. a. times that his client has done nothing wrong, and the feds are, quote, out of control and should be ashamed of themselves. well, it's the end of anner ra. for 22-year-old, the susan g. komen race for the cure in san francisco has raised money for breast cancer cure but calling it quitings. cancelled because of low participation. all this, of course, after many people were furious with komen's decision last year to stop funding planned parenthood. jewel yet talked to one advocate who said it's about time to take a whole new approach any way. >> ken, you know, this cancellation comes as a shock to many supporters. they said this was a way to raise awareness, but was it a good way to raise money? some cancer groups say no. >> my mom is a breast cancer survivor. >> karen young says the race for a cure was more about raising money. it was about raising awareness. >> any time there's something people can do to help bring a change for something that's going to keep us el healthy, it's sad it's not going to happen. >> the organization said economic uncertainty and low participation over the years could not financially sustain the event in 14 cities including san francisco. >> many people have had concerns about some of these walks and runs. >> jaerg, executive director of breast cancer action, says these events are expensive to run and don't generate the research dollars desperately needed. >> billions of dollars have been raised in the name of pres cancer, and we feel that we have for that. >> she says there are many direct ways to support breast cancer research. >> i encourage people to think about what's most important to them. is it emergency services, is it research, is it primary prevention and donate directly to the organizations doing that work. >> but to chelsea who has walked for the cure in the past, the meaning of the event is priceless to her. >> it was a great sense of community. it was a dpraet sense of sister hood. it's good to put a face to the problems around you by having these public events. >> now, the race for the cure in san francisco is still set for this september, and the boston race for the cure will be in july. if the races in 2014 that will be cancelled. on treasure island, kpix 5. >> and we understand seven of the komen three-day walks are still on for next year including in san diego. candles are burning in fremont for a toddler killed in a terrible crash, the impact so severe it split the car in half. the front of the car was crushed. the back end where the child was sitting ended up in someone's front yard. witnesses say the driver was flying down paseo padre parkway when he suddenly slammed into a tree. >> looked like they were going 95 to a hundred. they were speeding by me like crazy. >> the impact was so hard, the toddler flew out still strapped into her safety seat. she died at the scene. a woman in the car is in the hospital with life-threatening injure ris. the driver was also badly hurt but will survive. it's still unclear why he was going so fast, but police say there's no evidence any other cars were involved. we have late news tonight coming in from santa clara county. results from today's special and very expensive election to replace former supervisor george shirakawa. so far cindy chavez has 40% of the votes. the runner up, theresa -- since neither has over 50% it looks like they will be headed for a runoff. . is -- senators dpriled and openly mocked america's military leaders today. they have a lot of explaining to do about how they handled or didn't handle sexual assaults of women in uniform. >> with one exception, the senior officers who marched into the committee room were all men and all objected to legislation to take the decision to prosecute sexual assault away from commanders in the field but committee members, including seven women, were ready to take them on. >> not every single commander can distinguish between a slap on the [ bleep ] and a rape. >> referring to the mishandling of sexual assault cases which has left nearly two-thirds of the victims feeling they were being retaliated against. >> you have lost the trust of the men and women who rely on you, that you will actually bring justice in these cases. they're afraid to report. they think their careers will be over. >> one of the most controversial cases is that of lieutenant colonel james will ker son convicted by a military jury of molesting a female guest in his home. he was kicked out of the air force and sentenced to prison, but his commander lieutenant general craig franklin threw out the verdict using a line of reasoning which incensed senator claire. >> it was astoundingly ignorant. she didn't get a ride home when she had a chance. are you frieking kidding me? francisco. when the bus finally showed up over an hour late, cell phone video shows it was dirty and cramped. >> does anybody see a massive of course pansy sign anywhere. >> without enough seats from the 50 teens, some were pulled off by nervous parents while others were forced to stand for the ride in the city. >> also on the bus. >> beer, hard liquor. >> and these photos show it was all accessible to the teens. >> the motor carrier unit for the chp. she says while overloading the bus and allowing minors access to alcohol are bad enough, party bus wasn't legally authorized to transport the teens to begin with. >> if children are being transported to or from a school or school-related activity, the law indicates if a parent contracts with the motor carrier, that service can only be done in a vehicle up to 25-passenger capacity. >> she explains bus companies can only contract with the school itself to transport more than 25 kids to any school-related event. derek's mom signs a contract for this bus. and even to transport more than ten kids to prom, must have a special certification. this one does not. >> so this party bus company is breaking the law. >> yes. in -- in a couple of different ways. >> the owner of starlight party bus, which operates a variety of companies under various names, tells us in spite of the formal attire, he didn't know the students were going to prom, but his web site clearly advertises buss for school-related events even though he's not certified to transport students. >> nirm one area of concern would be that a driver is properly trained that has background in fingerprint checks. >> this video shows starlight driver talking on his phone while crossing the bay bridge, just one of the safety concerns for derek and his friends. derek says while he did research starlight, he didn't know about the required certification. he hopes his story saves others from a similar fate or worse. >> i just don't want someone else's night to
