hijacked the transit system during rush hour and into the evening. good evenin evening. sky 7 hd with a view of some of the demonstrators marching down market street tonight. protest has been going on since 5:00 o'clock this afternoon and bart has closed and opened the powell and civic center station over and over again. lillian is live in san francisco at the civic center station. lillian are the bart stations back open there again? >>reporter: as far as we know all stations all downtown stations are back open. the station closure were not as extensive as they were last week but the protest still succeeded in disrupting the evening commute. it was a case of deja vu. same time. same place. protest started at 5:00 p.m. at the civic center platform. these protestors continue to be upset with bart which shut down underground cell phone service august 11th in an effort to prevent a protest from happening. today officers were more aggressive with the protestors as soon as anyone began chanting or displaying signs he or she was given a warning and if they didn't stop police moved in to arrest them. bart says protesting beyond the fair gate is not permitted and today they hauled away least 4 people from the platform. at 5:30 p.m. officers then issued an order to disburse and shut down the civic center station. protestors carried the demonstration on market street marching all the way from civic center to the ferry building and back again. bart closed powell street station few times as march was going on but unlike last week, montgomery and the embarcadero station never closed so the effect on bart riders tonight was much less than it was the week before. finally after hours of marching the san francisco police department corner the protestors near the library and then began argue them and put each protestor in police vehicle. no word on how many arrest tonight regardless it's a big change from last week when they made none. that is latest from civic center, abc 7 news. before you go let's talk about this opening and closing of stations on again and off again all evening long. presumably bart was training to minimize impact on computers. what are they saying comes and brings about this type of an event and it's our belief that we should recommend to the nfl that this game is at least postponed for some period of time. >>reporter: one fan called it a day of rolling fist fight. another said thug had hijacked the stadium. you tube video showed fans wearing forty-niner and raider gear exchanging punches in the stands. another showed women fighting outside the stadium. 2 people were shot in different areas of the parking lot. jack is the father of the 24-year-old forty-niner fan who was shot 4 times in the stomach. he doesn't want us to use his last name. jack spoke to us right after his son went through surgery. >> he can't eat. can't drink. so he's chewing on ice. >>reporter: jack said his son had just dropped a friend off in the parking lot. as he and 2 others in the pick up went to lack for parking, they saw a group wearing raider gear jump their friend. >> my son 2 friends got out to pull the other guys off and say stop stop stop. my son got out and whoever it was you know who you are you shot him 4 times for stepping 2 steps away from his truck. >>reporter: jack said his wounded son managed to drive his truck to a parking lot game. opened his truck and guys at the gate looked at him and he looked at the man whoever he was and he said help me i'm dying. that guy whoever you are pshtion i owe you. we owe you. thank you. >>reporter: jackson is listed in fair condition and so is the person who was brutally beaten in a restroom here on the third floor of can stick in the stadium. other shooting victim who was shot in the face was apparently treated and released so the hospital has no record of him. but again, the niners are recommending to the nfl to postpone indefinitely all pre-season games between them and the raiders. vick lee, 7 news. former forty-niner now sports commentator stokes said tension have always been high at forty-niner raider game. nature of the rivalry he says but he also says that times have clearly changed. stokes spoke today on 7 live. >> i can remember back to playing those games and then asking my family about it and they are saying you know what, that's the most emotional game that i have been through and emotions are so high even in a pre-season game because it's battle of the bay. you want to say your team is better. >> always talk about our parents and how if something happened there were enough people saying not to do it. >> people don't want to get in the middle of a fight anywhere. back in the day i felt like people would jump in and say look that's not the right fan violence is result of alcohol use binge drinking in particular but the experts that we spoke with today said there are ways to control that. mark matthews with that part of the story. >> alcohol is talking about his year as pasadena chief of police. overseeing college and superbowl games at the rose bowl. he does say that team share in the responsibility. >> a lot of it depends on the team and the team identity and what it is they encourage the fan base to did. >>reporter: back in 2008 the nfl own security advisors warn the teams that the fan base was starting to change in some of the stadiums. 21 to 35-year-old were coming to do nothing but just binge drink. former san francisco chief of police says football games are a particular problem. >> a lot of that has to do with the down in the sacramento county town on friday where the 66-year-old man now surrendered without incident. he was originally arrested for the 1966 murder of a bartender in san francisco. cal students getting in gear this week as school officially begins on thursday. but some are having a hard time registering for classes and university says it's not due to the state budget cuts. education reporter lee ann reports from uc berkeley. >>reporter: students arrive at cal over the weekend and today they were officially welcomed by the vice chancellor. these incoming students are seeing a university that is transforming itself because of severe budget cuts. for expect pel this is the first time income from their tuition will surpass state funding. the regent voted to increase tuition to more than 12,000 dollars this year. parents like frank say wearing the sweatshirt is a remaineder that callus no longer affordable to many families. >> i don't it say i'm starving hungry broke. that says it al all. >>reporter: students say a higher tuition should guarantee them the classes they need. but in fact cal says a portion of the money from this year tuition increase is being used to add courses. but not everyone says they are getting their required classes. >> that one class that she's on the waiting list for she can't take other classes until she has this class. >> definitely like a lot of wait listing going on but some people have back up classes. >> every year we have students on the wait list. that's a common process that we have for students. oftentimes wait list will settle out after week 1 or 2 as students dropping adding finalizeding the skishtiond many students have yet to experience that and are already thinking of summer school. >> i will graduate in four years may have to consider taking summer school in order to be able to graduate on time. >> which means then they can't work to get the money to help pay for the classes so yes. it's a concern. >>reporter: now the university acknowledges it had more student attending summer school than ever before record year 1 15,000 students takened cal alone. they have also been recuting more out of state students because of included money for john future medical expenses is gone. >> they just kept taking check checks. they knew this was coming down. like a house of cards. >>reporter: over the past 35 years walterening and son barney and kelly varsity volleyball coach at uc berkeley and pediatrician bruce horowitz ran a series of limited partnerships that made loans to developers. they told investors the properties were primarily in california. >> as it turned out most of the holdings were out of state. >>reporter: richard browned filed a class action lawsuit against them. >> they were very speculative. the classic desert land outside of utah or desert land in texas or swamp land in north carolin carolina. >>reporter: bruce recruited fellow doctors and friends at the road runner club to invest. walterening worked the country club in oakland and each year they rented out the restaurant for several nights of investor appreciation dinner. message always the same. >> it was safety first. safety second. safety third. l everything is going great. >>reporter: that message continued even during the real estate slump. walterening filed for chapter 11 bankruptcy nand response attorney richard brown filed that class action lawsuit accuses him of embezzlement violating federal security law lying to investors keep the money flowing into the latest fund re loan. >> they set up the second mortgage fund 08 and began to use part of that money to pay off investors in re loan and friends and family members. that is what made it a ponzi scheme. >>reporter: brown says walterening and partner took out 50 million dollar wells fargo line of credit. and continued the disbursement to family and friends. and they didn't disclose that the line of credit put the investors in a secondary position. bank will have to be paid before any investor see as dime this ace complex case and we confirmed a coordinated criminal investigation is fully under way with the fbi and sec and the department of labor. >> if the money it's money but main thing is justice. >>reporter: he's among the first investor to sue to get the money back. walterening and bruce answered the complaint by saying at all times they used the good faith business judgment in the conduct of the affair of re loan llc. walterening got out of the trial by declaring bankruptcy. but the jury found bruce horowitz failed to act as rae tired by law and breaches fiduciary did you tell and l require 150,000 dollars in damages. he's asking the trial to judge to increase the amount at a hearing this week. he's struck by the elderly investors. watching his case so closely. >> at the trial we had probably 10 to 12 investors tm i get choked up. you would hear the stories. of yes i mortgaged my house. and invested it with these people. i took out my retirement invested it with these people. they are older and captain get it back. >>reporter: i received an e-mail fromening criminal defense attorney saying he is distraught about the loss to investors. as investor himself he also sufferedlesss. tl he knows that many of his i hope investigators were even more devastated and hopes they will be able to recover their losses to sacramento state assembly today approved a measure making it illegal for authorities to search the contents of a cell phone without a search warrant. police will still be able to search a phone brown's desk. also in sacramento. besides the bill about the budget, state legislature is working on hotel betting. reporter nick has the story. >> we have seen our fair share of strange things at the
