falcon were shot at different times because they were discovered 10 days apart. when healthy the falcons nest by the fruitvale draw bridge. there is 1,000 dollar reward in this case. big rig driver who slammed into an amtrak passenger train on friday with deadly consequences had received his license to drive truck in nevada just one month ago. records also show that 43-year-old lawrence valley was cited three times for speeding while driving school buses in california in 2008 and 2009. valley crashed that a westbound amtrak train headed for emeryville at controlled railroad crossing about 70 miles east of nevada. valley apparently tried to brake before slamming into the train. investigators found his cell phone amidst the wreckage at least they think it is hs his. it will be tested to see if he was using it at the time. crash killed valley and at least 5 other people. 2 people are unidentified. 5 people are still unaccounted for. if education news. cost of college education has risen dramatically over the past several years. according to a report from our media partner california watch one reason for the spiraling cost is the amount that many university spend on research. story tonight from education reporter lee ann. >> public university have tried almost everything to cut cost. some have imposed furlough da days. eliminated staff position. and done away with sports programs. but the american enterprise institute based in washington dc suggest other strategies such as route routesing the amount of funding for research. ericka is with california watch. non-profit center for investigative reporting. >> finding was really tevshl talks about football. everybody talks about the gourmet fad served in the dining hall. that's not really the way the colleges will cut cost. they need to target the core academic stuff which includes research. >>reporter: the study acknowledges research is essential at some top university such as stanford and uc berkeley. fleming is the vice chancellor of research at cal. >> certainly true that public universities in the u.s. are under great deal of stress but the country can not afford to back away from under fundamental research. >>reporter: uc berkeley spend more than 700 million dollars one third of its budget on research. if the study found teachers at other less reputable university are spending too much time doing research and less time in the class room. >> one of the things they were looking at is the fact that the typical course load for fact ill ty used to be 12 units and now it is more like 6 units moving towards eureka a.moderate to heavy rain just off the coast line here and this is what is going to head down towards the bay area late tonighand heading into tomorrow morning. temperatures right now mainly 50's and 60's. antioch 70 degrees. our highlights rain in the north bay tomorrow morning. showers spreading south in the afternoon. we look at slight possibility of thunder tomorro tomorrow. in the morning do look for quite a bit of cloud cover. temperatures remain on the comfortable side with the cloud around in the 50's except in the north bay that's where you will see more than clouds. pet wait a minute -- wet pavement beginning to appear and here's a storm that will bring us the wet weather. it is unusual but right here. holding together pretty well. unusual summer rain gets in here first thing in the morning beginning during the morning commute. tonight clouds a little bit of drizzle possible near the coast and then as the cold front approaches 5:00 a.m. you start to see the damp roadway in the north bay. but as the front continues to mav south you will see moderate heavy rain beginning to move in and the rain line will spread during the evening hours many of you will be having to contend with some wet weather. except in the inland east bay and the south bay. later on in the night cold front starts to fall apart but likely get some showers even in those 2 locations where you will remain dray for part of the day. so rainfall totals look like this. pretty impressive for summer. we are talking up to an inch in the north bay mountains. 4 tenths to 8 tenths of an inch in the north bay. quite a bit up to the north but drops off as we head down to the south. trace amounts to about quarter inch in the east bay. and the south bay may escape with zero to about 5 hundredths of an inch of rape. like i said the front falls apart so not much left to the system by the time it gets in the south bay. temperatures tomorrow with the south bay getting the rain last in the low to mid 70's. inland east bay in the mid 70's. rest of the bay area upper 50's to upper 60's. carry umbrella to. monteray bay rainfall arriving at nature time. temperatures mid exactly how to deal with those situations. >>reporter: one year after the deer and dog incident the east bay spca developed a course on animal encounter and oakland police chief just launched the department first training class. >> if if you come upon a deer or anything else if it can get up and go, let it goyshtion officers are learning to use the baton. pepper spray. fire extinguisher and in some case even taser. >> you can see it's aagreesing toward the fence. if that's a dog that you don't want to mess with. >>reporter: most of the course teaches officers how to deal with dogs. >> not backing up. it's a dog that is not going to bite you. it will bank. >>reporter: east bay spca found that most police officers who use unnecessary lethal force did not have pet as children and were uncomfortable around animals as adults. if officers are taught that dog speak with their body. most will growl at intruder but will eventually back down. however as you can see in this spca training video offensive dog will stiffen up and give a hard stare. >> that would have been a bite right there. not just the snarling but rolling the lip back as well and the ears. >>reporter: in some case a police encounter with a pet led to legal fight. >> lawsuit more prevalent but folk that have had their pet shot by officers and they are being won. da really start to take a look at pets as family members. >>reporter: city of richmond recently paid out more than 700,000 dollars in wrongful pet death settlement. that's why the east bay spca says police department across the country are asking instrumental in solving old cases over turning wrongful conviction and determining pa tevrnlt you may not know the dna is also being used now to bust dog owners. some apartment complexes have taken to things change asc things occur that affect our driving. >>reporter: such as hearing. eyesight. reflection. in california there are more than 320,000 license drivers 65 an older. biggest percentage of those are between the ages of 65 and 70 with number dropping significantly for older age groups. there are fewer than 16,000 in the 86 to 89 age bracket and slightly more than 7000 who are 90 and older. when a person is 70 and older and license expires the dmv requires that they renew it in person and take a written and vision test. age however doesn't automatically trigger a behind the wheel test which is why 80-year-old ann scales is a firm believer in mature driving courses like the ones offered by the aarp. >> when you take the course it has a whole section or evaluation whether you up flying into what he says was a big trap. it changed his son's future, too. tl michael tonight with their heart breaking story l. >> dominic was thrilled to be accepted to st. john's university in new york. but he had never been there. so his father planned a two day visit. then searched for airfare he could afor. >> three days before we are leaving i still couldn't find something so i jumped on craigslist. >>reporter: this ad caught his eye. airline tickets for low prices. he e mailed the certainly. right away he heard back. the seller said he was duane pack. he would use his frequent flier mile to purchase 2 round trip tickets on american air lanes for just 130 dollars each and sell them to cyrus for 280 a piece. >> it was a better fly. non-stop flight. it was cheaper. >>reporter: so the seller booked reservation and cyrus received this itinerary directly from american airlines. tickets had to be purchased by midnight.so cyrus went to this bank of america branch and deposited cash directly into duane's kichlt i e mailed confirm the ticket up at midnight waiting for it and midnight rolled by and nothing happened. >>reporter: he called the airline. no one had paid for those tickets. >> i told my son you know what we have to have faith. got to have faith t.somebody wouldn't do that to me. you know. and he did. >>reporter: cyrus told police he had been swindled. it worked like this. if pack reserved the seat which generated this itinerary. however there was no ticket until someone paid for them. cyrus told police pack never did buy those tickets. he just took the money. >> really i felt sick to my stomach. >>reporter: more than money the incident changed their lives. dominic never got to visit st. john's and commitment was due. so he decided not to go to school there after all. >> i really wouldn't want to go all the way across country to a place i have never been before to school i have never seen. >>reporter: as for sires he became obsessed with bringing down the man he says stole his money. he launched duane pack.com exposing his name. driver's license. accusing him of ongoing scam. he found other victims and web site warning about pack. he e mailed pack repeatedly. pleading with him to return the money. he filed complaints with the american airlines and bank of america and he called me at 7 on your side. fichlt can actually get the word out to the banks. banks see it's a big problem. >>reporter: we asked bank of america why pack account remain open despite prior complaints about him. the bank told us we do not typically close accounts based solely on an cushion by a third party. we cooperate fully with law enforcement. american airlines tells us we first learned of his scam late last year when other passengers called thinking they had tickets, too. however american said it shut down pack frequent flier account in december. and bank of america shut down pack bank account after cyrus!cyru complaint. >> that was crazy paying. i didn't stop everybody in the world but i did stop him. >>reporter: san francisco police are investigate thanksgiving case as financial crime and they want you to be warned. so if you
