jones obviously very emotional and now theçó+oz:ñ3 march began at e shop on bancroft avenue. pretty long distance from there to the fruitvale bart station where grant was killed by a bart police officer on january 1st of 2009. the people came to honor the lives of both jones and grant and to protest against oakland police. as the march continued police began blocking self streets while keeping an eye on the protestors who, by the way, i have to say kept it very peaceful. when they arrived at the fruitvale station bart decided to close the station. the reason they say was his to ensure the safety of every passenger and safety of the protestors. so at that point there was no service to and from that station until shortly after 6:00 p.m. when protesttors left and it was reopened. now the investigation into the shooting of derek jones is ongoing. the names of the officers involved in that shooting has not been given out and that is something that bothers this community. his fat frank jones senior was at this evening's demonstration. >> hope that their lives, the death are not in vain. from this we should make a difference with those who are still alive. shouldn't have to call death for a change. >>reporter: now the 2 officers involved in that shooting say jones was reaching for his waist bad several times and that they saw a shiney object and that they say was the reason why they shot him. now police told me tonight and this is a quote out of the respect of the family of mr. jones we are not going to release, again tonight, what the shiney object is. but police tell me they will hopefully in a couple of days. live in oakla oakland, abc 7 news. >> okay thanks a lot. there were no arrest and no vandalism reported today. not the case with the bart somewhating protest which have cost the city of oakland more than 1 million dollars money it simply doesn't have. now some officials calling on bart to pick up at least some of that tab. here's laugher a -- laura anthony. >> but for a bart police officer shooting oscar grant we would not have any of these demonstrations. oakland city council president want bart to pay up for the protest related to the shooting of unarmed oscar grant by messerly. >> traceable to the action of a bart police officer so they should take responsibility. >>reporter: city administrator dan estimates oakland spent between 1 and two million dollars on police over time alone on major demonstration. so far there has been no formal request for bart to pay but several council members think there should be. >> this council has been pretty consistent including me that we feel that bart should pay for part of that. >> bart has extra money. bart was thinking about returning money to ridership. >> bart spokesman told 7 news any cost oaklanden occurred should fall unthe heading of mutual aid where agency provide support to 1 another in times of need. police chief tony agreed. >> you could use the same argument that the federal government would be responsible for anti-war demonstrations. you know. you are responsible for security in your community. >>reporter: at least one bart director lynette sweet thinks the transit district should pay something. this is our responsibility and we need to own up to it. our officer killed our passenger. oakland had nothing to do with it. we may not have caused the damage wu we were certainly the catalyst for it. >> to do damage in the city at the time the city is struggling the resident are struggling just up fair. >>reporter: who should pay for it should bart pitch in. >> that's above my pay grade. >>reporter: facing a 31 million dollar deficit oakland laid off 80 police officers in june. bruno says if the city could rae coupe even 1 million dollars from bart it would be enough to rehire 6 of those officers for a year. in oakland, abc 7 news. law enforcement panel says a key come point of jessica law should be changed. the law bans sex offender from living withinp 2000 feet of school or park but the panel of experts says the residencey requirement are too strict forcing many offenders to become transient. there by making it difficult for agent to track their whereabouts. the panel if says that high risk child molestors should remain under heavy restriction but parole agent should have discretion to restrict where others can live. morning commute that most will not forget being blamed on a troubled driver. the man claimed to have explosive and gun on him when he stopped his suv on the upper deck. here you see his arrest by highway patrol officers about an hour later. so who is this man and why was he there? here's vick lee. >> 51-year-old the valentino is a security guard and reportedly an army veteran. he called 911 l just before 7 holiday commute began. he was obviously agitated. and said he had a gun as well as explosives in his ford explorer and he had just stopped on the bay bridge. >> thinks also similar to the handgun that he threw into the water. >>reporter: the sergeant says the gun would turn out to be a toy pistol but at the time it looked real to the responding officers. the valentino had left his antioch home this morning with 16-year-old daughter. he told her they were going to breakfast. >> she noticed he was acting a little unusual or agent out of character. he was shaking. so she was very surprised by his actions. >>reporter: once he stopped his car on the bridge valentino told her to leave saying he didn't want anything to happen to her. police quickly whisked her away. san francisco police negotiator began talking to carlos valentino on the cell. >> he seemed very agitated. very upset. very angry. >>reporter: he said he had been married for 20 years and that he thought his wife was cheating on him. now he was at his wit end. >> had he handgun similar to this one and waving it in the air. this kind of motion. >>reporter: carlos then threw the toy pistol that the water. at one point he climbed over the bridge railing and threatened to jump. around 8:00 a.m. just over an hour after the drama began polices were able to talk him into surrendering. the negotiator convinced carlos valentino to go back on to the roadway and into a waiting squad car. by the way police found no explosives in his car. he has been charged with brandishing a firearm, making criminal threats and endangering a child. vick lee abc 7 news. well as you can immanuel it was a long frustrating morning for bay bridge commuters because of this. traffic was backed up all the way across the bridge to the toll plaza. here's how it looked on the span during this mess. 7 live post over on abc 7 jennifer took the cell phone video. most commuters waited it out in the car but looking for an alternate way into the city even so many were at least an hour late to work. >> had my daughter come pick me back up and take me to bart. i asked the bart attendant is it cool? he said yes. everything is fine. you can take the bart. that's fine. so now i have to call my would and tell him why i'm late. >>reporter: a lot of people had to make the call. bart says there were roughly 10,000 more rider this morning compared to veterans day last year. governor elect jerry brown and governor schwarzenegger discussed the state new about a looping budget crisis today. and tonight brown says he is on board with schwarzenegger call for special legislative session to deal witness. session will start meadly after the newly elected lawmakers are sworn into office on december 6. state now facing a 25 billion dollar deficit including a 6 billion dollar short fall in the budget that washington just signed last month. and california next governor was elected only 9 days ago and already he's taking flack before rolling up his sleeves to work on the transition into office. jerry brown is taking a week off. as annette reports it is not that he's taking a vacation that is drawing heat but where. about. >> after a long hard fought campaign governor elect jerry brown said would he take a vacation before tackling the enormous job of fixing the state problem. >> i'm going to take starting si expect to be in sacramento. >>reporter: sacramento bee is reporting brown took his vacation in arizona. the state that passed continual immigration law seen by many especially latino as racist. numerous california community voted to boycott arizona until it was the the if rescind the law. the staff is refusing to confirm or deny that the governor is vacationing in arizona. he said throughout the campaign he opposes the arizona law. if at mexican-american veterans day celebration near the capitol there were many brown supporters. some thought it was a slap in the face for the closed. that is where oscar grant was shot and killed last year by a bart police officer. tonight's protest was supposed to be directed at oakland police who shot and killed another unarmed man derek jones monday night. antioch man at the center of the morning bridge bay bridge stand off in custody now. 51-year-old craig valentino forced traffic to stop after 7 when he parked the suv right there on the upper deck. flashed a fake gun and said he had a bomb. he did not. he said he was despondent over marital problems. >> forthcoming study on impact of repealing don't ask don't tell shows that most service members would not care if they had to live and work alongside openly gay and lesbian peer but 40 percent of marines disagree. in the aftermath of the san bruno pipeline explosion 9 weeks ago today in fact officials work on what they call after action reports. the goal is to learn what they can in time for the next disaster. 7 news i team has also been reviewing what happened and what moments after the blast. an off duty san francisco firefighters who lives in san bruno called in to the department command center on turk street. >> i see intense flames and heard large impact. >>reporter: with homes on fire a wide debris field and huge persistent flame. the firefighters believes it could be only one thing. >> it must have been a jet. it went down so. >> did it go down in the street. >> in a residential area. >>reporter: remember the firefighters didn't say he saw a plane go down. but that quickly becomes the story line from san francisco fire command staff. >> mikey called up and said he saw a plane go down in san bruno. l. >> i don't think it's an aircraft. >> it is totally confounded. it's a plane crash. >>reporter: they pass on the false report to the san mateo county command center. about where the busy dealing with the disaster. >> yes. we had off duty fireman that said he saw a plane go down. >> yes. no confirmation of that yet but we get reports of that as well. we don't have any confirmation. huge fire. >> i'm telling tu off duty san francisco fireman said he saw a plane go down. >> stress makes you stupid. pichlt says confusion is common in the early stages of most any incident. but dispatchers and first responders should be accurate. >> accurate information is certainly one of the most important things because that helps you determine where and how much resources you aplay to the event. >>reporter: san francisco fire deputy chief of operation defend his command staff. >> lieutenant was passing along information the way that it was worded wouldn't have changed the story but i think that the lieutenant is a good lieutenant up there has a lot of experience on radio. >>reporter: pat gardener tells us communication is the major issue as the department prepares the san bruno after action report. fire chief hays white declined to be interviewed about this and other issues raised by the dispatch recordings citing a busy schedule. >> we have several calls here people say we are trapped in our house help help help. >> you are kidding. >> no i'm not kidding. >> terrible. >> okay. >>reporter: alameda was the first county fire department to provide mutual aid. more than half hour after the blast san francisco tells san mateo they are sending what they call an airport. >> 3 engine. 2 truck. police chief. and we'll send medicare in two. >>reporter: then pat decides to strip away the medical part of the response. 3 ambulances and rescue captain and no one tells san mateo county. >> yes this is deputy chief gardener i don't want to send ambulance into the box. >> don't weren't to send ambulances or an rc. >> right i want fire fighting equipment. >> medic 83 and 96 you can cancel response to the airport and amr 6 cancel response to the airport. >> we didn't know what the medical needs were at the time t.so i pulled those off to keep those resources here. >> reporter: san mateo emergency official didn't know san francisco recalled the ambulances until i told the them. >> those are things that we are going to have to try to work out as we go through the after action component of this all sort of things that came up in this and we are going to look at all aspect of how to make it better. >> concern is if i think that i have a certain resource coming to me i'm not going to request that resource to another system. when it doesn't show up i may be in trouble because i was counting on the resource arriving. >>reporter: several members of the command staff called in to question gardener handling of the incident. >> we trade to send a couple ambulance down there and garnder said no. >>reporter: from the size and speed of the department response to the decision to pull back the ambulances. >> pulled off the medical rae sources because this is the if item not an ambulance service. you got it. >> i hear you. >> all right. >> if it's a mess. >> i'm asking you about this in the context of lesson learn to apply to the future. do you think there was a hiccup here. >> if there was a hiccup it was mine. it was mine for not clearly defining what i wanted to go on the airport box originally. >>reporter: san francisco fire also had to radio issue during the incident. >> this is for fuel unit one. be advised that san mateo county calling on your cell phone. >>reporter: firefighters had to uses his personal cell phone because the field truck he was driving out of the bureau of equipment on evans street didn't have a mutual aid radio. radio that san francisco gave bayshore ambulance didn't work during the disaster. >> can you tell me if you can hear me i'll transmit real quick. >> okay go ahead. if did you hear me. >> nothing. >>reporter: dispatcher has no idea. >> i don't know what to tell you. i wish i had better information for you. >> yes, i have a san francisco program radio. >> what's going on chief. >>reporter: finally there's the case of the battalion chief calling the command center and apparently talking about his social life in the middle of an emergency. >> ool see you tomorrow night gang bust, dude. any idea what the the gang bus is. >> i have no idea. >>reporter: deputy chief gardener says he's adding that to his list of issues to investigate. after action report. >> we were not only sending people down to san bruno but we also had to have all the other unit in the city that we had to still protect san francisco. so if the focus was his taken away from the person's work that's something that we have to look into. >>reporter: cal fire and the local fire department san mateo county played a major role in the blast. san francisco had a strike team standing by but it wasn't needed. we'll get back to you when the after action reports are done
