A federal court judge wants americas selfproclaimed toughest sheriff to Face Criminal Charges for violating his orders. This is connected to the racial profiling case with Sheriff Joe Arpaio. Maryellen resendez is following this case this morning. Whats next for the sheriff. This could be a game changer. Reporter it really could be. But it all depends on the u. S. Attorney. It is in his hands right now whether or not to actually go forward with the recommendation to federal court judge murray snow feels that there is enough evidence to hold sheriff arpaio in contempt of court which could lead to a huge fine and possible jail time. First the u. S. Attorneys office will look at this case and determine whether or not to charge the sheriff with criminal contempt. Arpaios attorney telling us that if charges are filed, despite arpaios age and the ongoing legal issues, his plea bargain. Even if arpaio is successful in his Current Campaign for reelection, putting it simply, the sheriff will fight this to the very end. You plea if you violated contempt yowsly and willfully the order of the court. If you havent done there, theres no basis. This is why the sheriff is fighting it all the way because quite simply we judge is wrong. Reporter now, we did ask the sheriffs attorney if theres a possibility the sheriff will step down, and he replied, no, absolutely no. I was in court last year when the judge said he wanted to see part of the sheriffs skin as he called it, in the game. Coming up at 5 30. A massacre, and the woman who witnessed the serial street shooters deadliest attack is speaking for the first time hoping to catch the killer. 12yearold and her mom and friend were shot sitting in their car back on june 12th. According to their friend, sharon layton, malia and stephanie had both been in the house just moments before, but malia followed her mom out to the car where the three were listening to music. When the shots rang out, layton tried to save little malia. Im just like, malia, its okay. Breathe, were here. But the bullet, i seen it went straight in her neck. I tried putting a finger in the hole, but it didnt work. There was too much blood. The serial shooter has killed 7 people in 9 attacks since march. Silent witness is offering a reward of 50,000. This starts a start at at 6 00 tonight. Police have not stopped looking for this teen accused of shooting a 40yearold woman at an apartment complex thursday afternoon. Hes 19yearold Malik Thompson and escaped through a back well the 19yearold had a romantic relationship with the woman. Shes now in extremely critical condition. This morning, this guy is sitting in a valley jail days after police say he shot three people, ran over one of them and took off for winslow. Adram blomdale arrived in the valley yesterday,. This morning, flowers are on the door steps of an 84year old man stabbed and killed in chandler. Silent witness offering a 1000 reward for more information about the murder of hosaco, found dead in his car at la fitness. His neighbors say they are shocked. Its a situation where, you know, a nice guy that he would do anything for anybody, and if anybody would say, hey, i need some money, whatever, he would give it to them just because thats the way he was. Now, police are telling us trying to look for any clues into this murder. We know so many of you are thinking about the little girl hit by a Police Cruiser earlier this week. She is still in the hospital. We checked in on the 3yearold and were told she is still in critical condition. Police say she ran out in the street while she was just trying to get a popsicle from the ice cream man near 75th avenue and camelback. A brief moment of hope that one of americas most wanted was captured in arizona. His name, robert fisher, man accused of killing his entire family and burning down a scottsdale house back in 2010. Now, sources tell us that sheriffs deputies got a tip about a man there that fit fishers profile. They brought him in, finger printed him and found out it wasnt their guy. It has been so long since anybody has seen fisher that nobody really knows what he looks like. This is a case that has been going on 15 years, and people bars where he belongs. They have been waiting a very long time for this ruling. In fact, they have attended every court case. They will wait once again while the u. S. Attorney los the case and decides whether or not to go forward with the criminal contempt charges. In a 32page report, judge murray snow lists the evidence against Sheriff Joe Arpaio including the orders he says Sheriff Joe Arpaio and top level depp tips have violated deputies have violated. And for the very first time, he is ordering Sheriff Joe Arpaio himself to put out 300,000 of termed to the sheriff in a Court Hearing as putting his own skin in the game. This is like poetic justice. You thought you could ride the backs of taxpayers forever. And do what you wanted to do forever. But now its on your shoulders. He makes it very clear that sheriff arpaio needs to have skin in the game. He needs to be held personally accountable for his wrong doing. Reporter now, arpaios attorney medical mcdonald told abc15 in an interview that the sheriff is not guilty of these charges and there will be no plea bargain, and no resignation. Now, we also called the u. S. Attorneys office, and they told abc15 that they are currently reviewing this case. But they did not say when theyll have a decision. Back to you. Heres the big headline for us. This search happened just down the street from an unsolved killing. A Convenience Store clerk gunned down at a 7eleven earlier this month. These two are accused of causing trouble in their own neighborhood. They are two people busted in a major pot growing operation in the west valley this week. In all, 3 homes were raided in surprise and peoria. Seized. Deputies say the couple had been running the operation for four years, producing a Million Dollars worth of drugs each year. In glendale, these two guys got away, and they could put you in danger. The two masked men held up a Convenience Store near 47th 47th avenue and bethany home. Reporter it all depends on the u. S. Attorney. It is now in his hands. Judge murray snow handed in his recommendation from federal court here and he feels theres enough to hold Sheriff Joe Arpaio in criminal contempt of court which huge fine and possibly jail time. As i said, first the u. S. Attorneys office will look at the case and decide whether or not to charge Sheriff Joe Arpaio in criminal contempt of court. Arpaios attorney telling us if those charges are filed, despite arpaios age and the ongoing legal issues, his client will not take a plea bargain even if arpaio is successful in his Current Campaign for reelection. He put it simply that sheriff arpaio is going to fight this you plea if youve violated contemptuously and willfully the order of the court. Wasnt done that, theres did when you havent when you havent done that theres no basis for saying that you have done it. This is why the sheriff is fighting it all the way because quite simply we believe the judge is wrong. According to their friend, sharon layton, malia and stephanie had both been in the house moments before. Malia followed her mom out to the car where the three were listening to music. Reporter in handcuffs and stripes, shes a woman fighting drug addiction, detoxing behind bars. Sober for the first time in 13 years, Natalie Russell is finally realizing her baby girl is gone. It kills me. It breaks my heart. I love my children so much. I love them. I did everything they asked me to do and then some. In a 32 page report, judge against Sheriff Joe Arpaio including the orders he says sheriff and deputies violated and recommends the county put aside 500,000 to compensate the racial profiling victims and for the very first time in the sheriffs career, he is ordering the sheriff to pay out 300,000 of his very own money out of his very own bank account in what he termed to the sheriff in a Court Hearing as quote putting his own skin into the game. This is like poetic justice. You thought you could ride the backs of taxpayers forever, and do what you wanted to do forever. But now its on your shoulders. He makes it very clear that sheriff arpaio needs to have skin in the game. He needs to be held personally accountable for his wrong doing.
