hot. >> and all the signs are there, too. we have no wind around san francisco, obviously, fog free. things will be warming up quickly through lunchtime. 90s through the day. on our way to upper 90s inland. heat, one part of the story. the other part, the air quality. laura, you have more on that. >> that's right. it's leading to the first spare the air day. nbc's kimberly terry is live this morning with what you can and cannot do today. good morning. >> good morning, laura. there's also a no-wood burning ban in place today. the air quality district really wants you to be careful about what you do today. cool inside, not out of the grill and avoid using aerosol spray cleaners, paint, air spray, stuff like this. air quality primarily in the south bay is expected to be on the unhealthy side today. this summer, that cool weather has helped key air quality good for the most part, but it's expected to heat up today, and that means some unhealthy smog. so in addition to modifying some of your choices today, watch your health. ground level ozone can cause throw irritation, congestion, chest pain and it can trigger asthma. so if you're planning on exercising today, it might be a good idea to get started when those ozone concentrations are lower than they will be a little bit later on today when it starts to heat up. and i should mention because of budget cuts, this is not a free transit day as some days are when it's spare the air day. you're still recommended to car pool or take mass transit today, as well. the bay area could lose another high profile murder case. the chauncey bailey trial could be move to another condition. christie smith is live now in oakland with more on the arguments for and against. >> good morning to you. journalist chauncey bailey was killed just a few blocks from the courthouse where we're standing. he was gunned down in broad daylight on his way to work. we were among the first news crews on the scene and there was plenty of news coverage afterwards because of the brutality of the killing. he was a working journalist at the time. today, defense attorneys for two defendants are expected to argue that there was, quote, massive and pervasive news coverage that's has jeopardized their clients' right to a fair trial. bay is accused of ordering a killing because he was working on a story about the financial struggles for the bakery. defense attorneys say a survey of potential jurors in alameda county, that of those mott involved in the debate, ironically, the judge who is providing over there is the same one who order today trial of b.a.r.t. r a b.a.r.t. police officer. >> thanks for the update there, christine. right now, san francisco police are looking for a 14-year-old girl who could be with a man she met on the internet. tiffany alvarez's parents reportsed her missing saturday. police think she may have left with a man in his 30s known as geno whom she met on mispace a few months ago. the 14-year-old girl is 5'10", 180 pounds with green eyes and brown hair. she was last seen wearing gray velvet pa janl jam mas and a black purse. students who skip school in richmond may face a new law this year. a new daytime curfew is in effect. students will be ticketed and taken to a community center for counseling. officials help the new law will help students and the community. developing news on a massive egg recall everyone is talking about. in fact, egg recall is the top ten search of both google and yahoo!. >> yeah. in fact, scott has new information on it. who is in charge, brent, the commissioner of the food and drug administration appeared on the "today" show this morning and told matt lauer her agency is taking this seriously, but needs more enforcement power. >> we need greater abilities to trace back products to their source so that we can identify how the contamination occurred and what products are at risk. we need better ability to hold companies accountable and we need to be able to more routinely review and work with companies to make sure that the food fly is safe. >> two of the companies involved had violations dating back 15 years. at 7:00 on the "today" show hear what the commissioner has to say about this company. >> thanks for the update. san francisco city leader ves put together a plan to fix erosion on the cliffs. this year's el nino weather pattern took a toll on the cliffs along the highway, causing a lot of street closures. the plans outlines the exposure for the most critical areas south of slope boulevard and the great highway. some fixes include contracting a buried sea wall using rocks for erosion control or even building concrete pilings. the california costal submission still needs to approve the plan. a big subway project is underway in san francisco. it's going to cost more than $1.5 billion. muni says that the central subway is going to save passengers who take the stockton street butts about 11 minutes. save muni says they added up the walk, travel and line time. if the central subway is built, the group estimates the total travel time will be about 24.7 minutes. muni says its data is flawed because that doesn't take into account the frequency between trains or the distance between transfers. travel time today could be slowing down. let's check in with mike. let's encourage mass transit of all sorts because it is a spare the air day. right now, no slowing on the vta system, but 101 northbound from 680, we see that slowdown. that's a typical slow spot that shows up about now during the typical fall months. summer vacation is over for the xlut, folks. there you see the slowing off of 680 as well as highway 87 coming down past the airport. your 6:00 hour, we're off and seeing a heavier volume coming out of the altimont pass. we see this continuing to come towards the dublin interchange and that will continue over the next couple of weeks ago we adjust folks back from cool through this area. no changes out of antioch and in towards pittsburgh and bay point. the upper deck shot shows you the volume moving steadily into stran. we have talked about that spare the air day. we're trying to reduce the number francisco, 57 and just a trickle of a sea breeze this morning. we have some air quality unhealthy and it's our first spare the air day this summer and we'll see round two tomorrow and round three coming up on wednesday. inland, 90s around san jose. should be places like fairfield and morgan hill, upper 90s and low 90s around petaluma tomorrow. an excessive bay area around for tuesday and we'll check on that coming up in a few more minutes. there's a new service on facebook getting mixed reviews from users. some companies already due this, but on facebook, there's a hitch. >> if you want your friend to see where you are in a particular place, you have to also let strangers see where you are. >> like many things on facebook, unless you change your privacy settings to prevent it, anyone can see your posts. facebook has made places an opt-in offering. >> well, today, after the start of the great crush for winemakers, there's a on the of the most dress job. >> farming. the bureau of labor statistics says farmer is in the top five. but the very top, as any discovery channel viewer will tell you, is professional fisherman. 200 fatalities per 100,000 fishermen. you've got heavy machinery, cables and ropes and, of course, water. fisherman followed by logger and then pilot. there's farmer and finally, roofer in the top five. investors, that is a pretty safe job, although credit limit cannot exceed the amount of overspending. and your bank or credit card company cannot arbitrately raise your interest rates. experts say the old rules are why a lot of people started throwing out their credit card. well, it appears that their leads are doing that. in atlanta, san franciscans have the lowest monthly balance. overall, instances are down 3% from what they were modern areas ago. john mcklusky and his girlfriend who helped him escape were caught in the forest. >> i just put down john mckluskey, myself and two other operators were coming around. she reach back and pulled out a gun and she did it in a manner and i could tell there was a little bit of hesitation by her. she was trying to make the decision whether to shoot it out or put it down and thank goodness she put it down. >> the sheriff says that the two were talkative after the arrest and they even made a couple of big confessions. you can hear more about them coming up appear 7:00 on the "today" show. >> the california black tailed deer buck population seems to be disappearing and the state wants to know why. the state department of fishing games is looking at the annual hunting numbers. the deer population number has dropped 27% over the last two decades. hundred either likes both the meet and the and lers. hunters target the strongest, biggest bucks, leaving behind less appealing mates for female deer. you say tomato and i say toe mateo. the nevada version, it's the spanish pronunciation and it should be recognized just as much as nevada. the 9ers don't have to travel far to their that means return of the fall traffic. that means a lot of folks are still working. that's good news, folks. we're looking at that at an 18-minute drive now. we continue to see the slowdown build. every ten minutes i check, we see another slowdown occurring here. maysville, the build up is slow. so a little coming out of the warren. coming through oakland and berkeley, no major issues here. down the east shore freeway, still about 19 minutes off the bridge and hurricane eercules t. the cash lanes are holding up pretty well here. we should see the metering lights turning on any minute now. we always encourage the diamond lane car pool, if you can. now coming into the city via the bridge, no major issues except for nevada. watch those surface streets and a lot of congestion. peninsula drive, no problem. you're still at the limit there. the slowdown should occur there later on about 8:30, 9:00 in the commute. no problems as far as the drive. in fact, you can make out those peninsula hills. despite this look, rob is going to tell you what that means. a lot warmer for him. we just got back from the glacier. >> a new source of income for mama grizzly's daughter. how much bristol palin is set to make at a new fund-raiser. a big shark caught out in the bay is swimming and under view. biologyist gists caught the shark and it's now on display at peer 39. the shark at the largest one ever on display at that aquarium. biologists say it's probably going to be there about a year and then they'll release it back to t the heat is on. you know what that means later on today. today's hearing. christy. good morning to you. defense attorneys are expected to talk about news coverage following the killing and what they described as a prolonged media blitz. but they're expected to talk about a juror survey done here in alameda county on potential jurors that frankly doesn't look really good for their clients. yusef bay iv is accused of killing the journalist chauncey bailey in august 2007 because bailey was working on the story of your black muslim bakery. his codefendant, they're accused in two other murders, as well. we were among the first news crews at the scene the morning that bailey was shot and killed here in broad daylight. the survey, though, conducted for the defense shows that 70% of those in alameda county polled know about the case and they think that bay is guilty. prosecutors believe that the media coverage issue, though, is being way overstated. still, one opening could be moving the entire trial down to los angeles. the judge in the hearing is the same one who ordered the trial of then b.a.r.t. police officer johannes mehserle to los angeles, as well. this venue change hearing is expected to last after the at least two days. reporting live in oakland, christie smith. >> thanks, christy sdmroop 6:32 right now. a controversial church trial involving a press ba tier ya reverend from napa is expected to start this week. the reverend spar is being put on trial for marrying 16 same-sex couples in 2008. it was during the time same-sex marriage was legal in california. the church says despite the fact that the marriages were legal, spar's actions violated church laws. on his on are scheduled to begin at the covenant presbyterian church tomorrow in napa. we'll have a special report on the church trial of rev regard spar tomorrow night at 11:00. this week marks the third anniversary of adjacentsy dugard. a year later, dugard still lives in seclusion somewhere else in northern california. the home in antioch is boarded up, but still listed as belonging to dugard's mother. corrects officers now say police are now notified in a sex offender lives within a mile of where a call originates. they also say information about sex offenders is shared more effectively between agencies and a new task force reviews the gps monitoring of sex offender pes. and an american fighting in afghanistan is dead this morning. nato says the american was killed in a roadside bombing. another nano service member was killed in a separate attack. that brings the number of.troops killed in afghanistan to 44 this month, 29 of those were americans. the u.s. commander in afghanistan says he talked about the future draw down of troops. general david petraeus says it needs to be done gradually and there should not be a sudden exodus of troops. meanwhile, an ed tollal in the "new york times" says controversy over the islamic cultural center that is planned to be near the world trade center could hurt general petraeus and scott joins us to explain how. >> good morning. general petraeus like general mcchrystal who went before us is trying to convince the muslim world to work with american forces trying to build up allies. the journal reported how fox betrayed petraeus says the sudden anti-mosque coverage on the news hurts the general's military strategy in iraq and afghanistan. meanwhile, msnbc anchor keith ol berman, who tends to lean the opposite way of fox, unleashed a 12-minute invektive in support of religious freedom. that special commentary posted repeatedly to the internet. in the editorialal, the internet points out there is a mosque closer to the world trade center site and no one seems to care much about it. lost in this is an announcement of iran. it has a new destroyer that can carry four missiles. iran has unveiled a number of weather systems in the past. not all of them are quite as effective as they pretend. in one recent test, iran got caught photocopies the system to make the system look peek at your monday morning compute. >> good morning, guys. talking about nobody through oakland, we'll take a live look up there. we did see slowing through the last few minutes. reports of a table in the lane around 23rd. now, that may very well have cleared. we saw the slowdown clear up here and further south along the coliseum. you started to see the fill in again, but there was about a five-minute break of traffic through the area. that might have been enough to give them enough time to clear that table from the roadway. so the volume holding steady, travel time about 16 minutes coming off of 238 238 heading through this area up toward the toll plaza. a wider look at the bay area toll plaza shows us, as well, the metering lights may have been turned on in fact in the last two minutes. but right now, the east shore freeway moves smoothly. as you see some debris reported westbound 80 around university avenue. that is where speed dipped down suddenly to about 35 been 40 miles an hour. smooth drive off the karkinas bridge. slow across the upper deck. it will be a look out there from the golden gauge bridge. traffic is back, you guys. traffic is back because a lot of summer vacations are over. so that will be for the kids. we said a lot more workers on the road. >> thanks. >> i guess they're going to hope that their school air-conditioning. >> you'll want to be out near the coast. there is a nice view of san francisco. i want to show you what was spotted off the coast of australia. let's head to another coastline and you will see video, i believe, and we're queueing 08,000 pounds, will 50 feet long. vaulting its entire body out of the water. there's a lot of controversy as to whether they do this, but man, that is amazing stuff. you can see that into our news will be treated to a tropical oasis as summer temperatures reach pretty much all-time highs for the summer. we'll check your forecast, coming up all i know is mike was trying to start a congo line. more teen drivers on the roads with back to school. however, a new study shows california is the safest state for teens behind the wheels. tracy potts is here with more. >> brent, good morning. washington, d.c. ranked first in this u.s. news and world report survey. but washington is not a state, the district of columbia, that is. so california is the safest state for teen drivers. here is why. first of all, they took a broad look, not only at how do teens drive, but what are the conditions under which they're driving? what are the laws like in this states inspect they found that first of all, there are not as much teen drivers on the roads in california as other states, less than one in three are licensed. and also some of the law necessary california are quite strict, helmet laws, distracted driver laws, like cutting down on using cell phones and texting while driving. those law res strong in california and that bumped california up to that number two spot. now, there are a couple of areas where according to "u.s. news and world report." the state could use some work. one of them, dui laws and teen licensing laws. they took a lows look at what are the roads like that these teenagers are driving on? are they good? less than one in five roads in california ranked as good or very good. that's an area to work on. but number two, pretty good according to this latest survey of teen driving just as school gets under way. >> thanks, tracy. a moment ago, we showed smu of the pet peeves from a new road show poll on driving. we have a few more of them for you. some of the top peefs include texting or cell phone use drive while driving, tossing cigarette butts out the window, and car pool cheats and bicyclests who achieve the stop sign. some of those things are pet peeves. some of them are not safe and illegal. >> and we're seeing more and more cars out there on the roads as the morning progresses. >> that's right, you guys. >> local universities, we're looking here at the continuing slowdown as you're coming out of the altamont pass. right around here, we see speeds below 20 miles per hour. holding up in the 40s, some places closer to 50 as you get in through livermore. a burst of a traffic flow coming around the boulevard. there's your 21-minute drive continuing up through this portion of the east bay. folks at 680, we don't see any slowdown coming through the construction zone. this is where they continue to work on the h.o.t. lane, the toll lane, as many folks call it. the earliest slowdown we saw on 101 sorted itself out. there's 87 slowing at downtown and the bay bridge, the metering looints lights are on. look at that sun, guys. that sun is there. back to you. >> and the sun glasses. >> exactly. and leaders are asking for your help to try to keep the air clean. >> checking in with kimberly terry, watching how people can cut back on their movie which will help with the fair air day. some drivers here admit that they don't know what a share the air day alert means while others say that regardless, they're going either worker and that's one of the things about share the air. consider car pooling or taking public transit. also, no barbecuing and you avoid using aerosol of any kind, hairspray, paint, cleanings of any kind. with temperatures expected to heat up, especially in the south bay, the air quality is expected to get worse which, of course, prompted this alert. >> what are your thoughts? first share the air day of the summer. are you going to change any of your habits? >> well, i didn't know it was a day for the air. and if i would have known, i would have ride a bicycle, maybe. but it was too early in the morning and i need to get there on time, and so i didn't change my habit. >> in addition to modifying your habits if possible, keep an eye on your health today, ground level ozone or smog can cause throat irritation, congestion of chest pain and can be harmful to those with bronchitis or emphysema and asthma. >> thanks, kimberly. >> a lot of people say it seems late in the summer to have the first share the air day. >> normally this time of year we would have almost a dozen or so. we've had strong sea breeze and that's the reason the air quality has been good and mild. not the case today. the santa clara al valley sees the first spare the air day today. this area brought around by high pressure. when you get that chemical suit that is the smog you see in the skies reactsing to that sunlight. the ozone starts to form. it's a photochemical reaction. that is invisible gas. right at ground level, the ground level ozone is expected to be an irritant for your lugs lungs and this pattern is not going away. through the middle part of the week, what does this means in terms of temperatures? 90s inland. some of the hotter places are out towards fairville tomorrow. things will cool off as the sea breeze comes back and air quality improves later on this week. back to you. "the expendables" made twice that. in fact, both of these movies, switch and nanny mcphee. there you go. interesting development in the business side on wall street this morning, a bidding war over a fremont company. hewlett packard and palo alto just outbid to buy dell. hp wants to pay $1.6 billion. so lots of guys from fremont this morning are watching the bidding war. it will get richer and richer as it goes back and forth. >> what did they do, name the company after their favorite past time, golf or something? >> want. an important day ahead in the killing of chauncey bailey and the murder trial there. how a judge's decision this week could affect who decides the fate of the men who cuesed of the oakland journalist's killing. big changes could be ahead in the chauncey bailey murder case. the defend is hoping to move the high profile murder trial out of alameda county. christie smith has a possible new location for the trial. >> good morning. defense attorneys are suggesting one possibility is to move the trying trial down to las vegas where a survey of potential jurors shows down there only about 20% of them have heard about the trial compared with about 83% of potential jurors here in alameda county. the defense represents yusef bay iv and codefense antwaan mackey. they say massive news coverage has prevented a fair murder trial here locally. prosecutors are saying that the change of venue issue is really premature and the media coverage angle is being overstated. regardless, the judge who will decide is the same one that decided if the trial of b.a.r.t. officer mehserle moved. with just 71 days to go until election day, polls show california proposition 19, the movement to legalize marijuana is gaining momentum. in july, a sales poll showed voters split on the issue. but a new poll from the survey showed 50% of likely voters in favor of allowing anyone to cultivate a small argument of marijuana for personal use. we have new information this morning on that nationwide egg recall. on the "today" show this morning, the commissioner of the food & drug administration says her agency needs more power. dr. margaret hamburg says the fda needs more resources and authority to make sure another recall doesn't happen like this one. the agency is still trying to track down the source of salmonella. we have more information on the company behind the recall. it reportedly has a long history of violations. wright county egg has violations dating back to 1998. big baby doesn't even begin to describe this next 10-month-old. weighing in at just 7 pounds, 11 ounces when he was born. however, he now weighs a whopping 44 pounds, twice what normal babies his age would weigh. he weighs about as much as a 6-year-old should weigh. check out how big he is. he is in a chinese hospital. doctors there are trying to figure out exactly what it is that is causing him to gain so much weight in such a short period of time. kind of amazing there. i don't know what they'll find. >> big baby. thanks for joining us this morning. is soft on cats.
