Again, we are in the remote hills of the town of gonzales where based on a tip from a Passerby Police tracked down the stolen black honda accord. Inside that shed with the young boy locked inside the vehicle. Right now police call it an inadvertent kidnapping. Soledad police say the suspected abduction took place at the home of jose vargas on head street just before 7 00 this morning. Police say the father claims he left his 2yearold son who he called jacob in a running car warming up on the driveway. Investigators say when he came back out, the car was gone. The mother who is divorced from jose, the father, and jacobs stepfather, rushed to soledad from salinas after being told by police about the possible kidnaping. The mother who asked us not to show her face was worried and angry. Im upset. Im nervous. Im heartbroken. Im wondering how my child is doing. Reporter after almost eight tense hours, the police said the car had been spotted in a shed off river road in gonzales. Officers broke into the car and retrieved the boy who was rushed to the hospital to be checked. It did appear that finding the car where it is in the proximity that its i believe its consistent with what we initially thought, somebody was an opportunist saw the running vehicle unattended, jumped in and lo and behold discovered he had a child inside. Nbc bay areas Christie Smith joins us from San Francisco. Christie, the sheriff is now taking action over these bullet holes. Reporter yes, thats right. We spoke with the sheriff. She said there will be two separate inquiries into this. Shes also talking about additional training for those deputies. She sent out a bullet bulletin to the department to make sure it doesnt happen again. I was relieved nobody was hurt was my first reaction. My second reaction what were they thinking. Reporter San Francisco sheriff Vickie Hennessey says an investigation began immediately after she received word that a deputy accidentally discharged a nonduty firearm at the hall of justice. In the meantime, what we have done is were organizing oneonone training for them, both on safety procedures. Weve put out a departmentwide bulletin for the department about gun safety. This is that bulletin. As we reported exclusively last night a bailiff who doesnt carry a weapon in their current role showed it to another deputy in a bailiffs office. It went off around 7 00 a. M. Both are still on duty. As far as policy, she says its not entirely clear but there are certain circumstances. Deputies are allowed to have a concealed weapon. But not while theyre on duty unless its approved by the department and that they have qualified with that particular weapon. For a deputy to bring in his own weapon and for somehow it to be accidentally discharged is pretty scary. Reporter public defender jeff adachi says hes concerned. I think that the situation should be thoroughly investigated. There needs to be transparency so we understand what happened and to make sure that this wont happen again. Today an Appeals Court threw out a Lower Court Ruling that would have radically altered public education. At issue job protection like tenure and layoff laws that may cause less experienced teachers to lose their jobs during downturns regardless of what they do in the classroom. A lower court judge had said that those job protections are unconstitutional. Today, though, a reversal. A threejudge Appeals Court said some School Administrators make bad staffing decisions but the evidence doesnt floouft laws are unconstitutional. The lawsuit was actually brought by a nonprofit. The nine plaintiffs in the case which include some students from the bay area said they do intend to appeal the ruling to the california Supreme Court.
