An inmate pulled from his jail cell is taking Santa Clara County to courts. He claims his rights were violated under the americans with disabilities act. The deputies went into the inmates cell and forcibly remove him. This is a video showing some of that extraction. There are moans and screams coming from the inmate as the guards try to get him to stand up. Miller. Reporter this is exclusive video of the jail extraction in july of last year. Were blurring faces of the correctional deputies as they are not charged with any wrong doing. Stand up. After several warnings, the guards ultimately pepper spray the inmate before strapping him down to a wheelchair to take him to what they call decontamination. This is the inmate today. He doesnt want us to use his first name. When we went to speak with him mr. Wheeler was wheeled into the Interview Room by deputies. He was awaiting charge for domestic violence, murder and witness intimidation. The attorney wrote this letter the same day as the extraction stating his client need a wheelchair because he suffers from epilepsy. His lawyer says the inmate is no longer sto stand following a says your and fall in jail of march of last year prior to the extraction and had the medical records to back the claim. The i mate is now suing the county and the deputies for allegedly violating his rights as a disabled person. Millers personal situation, those decisions are made in consultation with medical staff based on whats necessary for the inmate. We believe that mr. Miller received care consistent with his medical needs. The Sheriffs Office says in reviewing their internal videos they believe the inmate was moved in accordance with their policies.
