Reporter well, raj, alex picklemans sudden change in pleas led to a lighter sentence from the judge that many people expected but this was no plea deal. Both the defense and prosecution say the images were much different than many people had said. 27yearold alex pickleman had a small smile as she walked into the Santa Cruz County courtroom today. It was quite a change in demeanor from last july when the alleged prostitute pled not guilty in the death of hightech executive, 51yearold forest hayes. Hayes was found dead of a heroin overdose on his yacht in november, 2013. Pickleman was arrested eight months later after police said she was seen on the yacht surveillance camera injecting hayes and herself with heroin. Today she pled guilty to numerous charges, including involuntary manslaughter. The judge then dropped the great bodily harm enhancement that would have required prison time and sentenced pickelman to six years, all served in county jail. There was panic and a failure to call 911, but there was never an intent to harm much less kill mr. Hayes. Reporter the prosecutor acknowledged he didnt know pickleman was going to change her pleas. He said the charges are appropriate, but did respectfully disagree with the sentence since a person died partly due to her actions. Whether its her action or inaction, those types of circumstances in my opinion warrant the service of time in the state penitentiary. Not in the local county jail. Reporter now, under the terms of the sentencing, pickleman could be free in three years or less. The hayes family su sportspports both the charges and the sentencing. Well it has happened for the third time in two months. A dead whale has washed up on the san mateo coast. This one was found near kelly beach in Half Moon Bay. Marianne favro joins us live from there. It looks like this whale may have been dead for a few days before it washed onshore. Reporter yes scientists believe it has been dead at least four to five days. People here are very concerned. All afternoon they have been coming out here to check out the whale. Scientists say its an adult female gray whale, and you can see how big she is about 40 feet. The big question now is how did she die. Today people were lured to poplar beach in Half Moon Bay to watch waves crash over a 40foot gray whale. Scientists say its an adult female. This is the third dead whale to wash up along this coastline in just over a month. The other two were found in pacifica. Both the mammals there were buried today. Thats a lot of concern. Its just too many to happen in such a short period of time in such a small area between pacifica and Half Moon Bay, so im wondering if theres something with the ship traffic or sonar or exactly what it is thats causing so many in such a short period of time. Reporter one marine biologist says it appeared to have died four or five days ago of natural causes. If you were to go down and look at the tail or the fin, you would see bite marks about this big and that is about the size of about a 10 to 12foot white shark. So it is fairly common after whales die to see sharks scavenge off the remains. Reporter they plan to examine the whale early tomorrow morning to learn more about how it died. We also found a dead seal out here on this beach. Tomorrow Scientists Say when they perform the necropsy theyll focus on the whales bones to see if she suffered any trauma. Thank you. Four weeks ago steven stock found 472 bridges in our area rated by engineers as structurally deficient. Today in washington the Road Information Program said the problem is even worse in rural areas. California ranked sixth in the country for deaths on rural roads and 20th when it comes to problematic bridges. The executive director wants congress to step up and do something. If congress doesnt act to pass longterm adequately funded transportation, were going to see rural roads and bridges get in much worse shape and its also going to impact the safety of drivers on rural roads. Some bay area lawmakers on both sides of the political aisle agree but congress cant come up with a longterm fix. A big announcement guilty. That was the verdict in the case of a bay area developer prosecuted for the death of one of his workers at his job site. This happened a few years ago. His workers were building a luxury home in the milpitas foothills. The worker killed was an undocumentedienan trujillo joins us with more. Reporter the jury convicted the Construction Company and the supervisor of involuntary manslaughter. Raul sapata was working on this job site when a wall of dirt and rock came crashing down on hill. That was in 2012. His brother, also a worker tried frantically but unsuccessfully to rescue him. He tried to dig his brother out from under the dirt but it was after ten minutes of digging, they founding his body and it was obvious he had been killed instantly. Reporter just three days before the deadly accident milpitas inspectors had given them an order to stop work for safety reasons, but the work continued. Today the jury said the developer and his project manager were guilty of involuntary manslaughter. They gambled with the idea that they could build a house without any protection for worker safety. They gambled with the lives of other human beings. Reporter the lawyer for the developer told me over the phone he was disappointed with the conviction and might seek an appeal perhaps even a new trial. The victim raul sapata left behind a wife and three daughters. Raul and the other workers from mexico were treated like their lives didnt matter. But their lives mattered because theyre human beings. San francisco is getting the most sunshine youve seen all day long as you can see on our Weather Underground camera here from the castro looking right back towards downtown. But if youre to look the other way, back to the west at the immediate coastline, that fog is still in place and thats whats heching helping to keep our temperatures down. Most areas in the 60s. 63 in the south bay, trivalley at 64. But that fog cleared out quicker today in the north bay and thats because we had drier, warmer air helping to evaporate that fog. Tomorrow we are going to start off with fog in the morning and by the afternoon well see a few areas warm up but its not going to be warm by any means. 70 in the north bay will be one of the warmest, 66 in the peninsula and were looking at 68 back here across the south bay. Now, this most recent weather from this weekend right in today probably felt so cool because we started off the year so warm. The heat in san jose happened so early. In february we had upper 70s. Warmest day so far of 2015 happened on march the 14th and that was 89 degrees. So where do we go from here . Still going to have some cool weather as i mentioned for wednesday. Notice thursday. The chance of showers thursday and friday for the south bay. But on saturday is when numbers begin to warm up. Well see the same trend for the peninsula, possible showers on thursday and friday and a smidge warmer in saturdays forecast. San francisco weve seen numbers go up but not a whole lot. I cant fluff this over particularly in light of the states incredible ethnic diversity. Look, chances are that people in groups other than native americans are going to feel equally insulted because an ethnic slur hurts anyone who has felt discriminated or type cast. Heres some good news. As the field poll notes, nearly 60 of those surveyed havent tuned into the u. S. Senate race so sanchez may have that rare opportunity at a Second Chance to make a good First Impression downstream. Another fact the poll ended last saturday. Now, thats the day of the gaffe. So sanchezs behavior it wasnt accounted, for the results that is. So that said you can bet Kamala Harris, that team has tucked away that beauty for later in the campaign when people will be tuned in. Oh, well be seeing that clip again for sure theres no denying that. Now, it is super early, so how do you look at this poll and take anything away from it . There are a few nuggets to dr consider. When asked about their first or second choice democrats select harris and sanchez increasing numbers to 22 for harris 14 for sanchez. Other candidates are far behind them at least for now, at least for now. Thats important because in the states primary, jessica, the top two finishers compete in november, regardless of their political party. Another thing, in terms of region, harris has a commanding lead in northern california. We would expect that. But most of the voters are in Southern California where sanchez runs neck in neck with harris. With respect to race well harris does well with whites and africanamericans but sanchez carries more latinos. And lets remember thats the fastestgrowing group of voters in the state. So at this point would you say theyre kind of even where they stand . Even lets put it wide open more than even. Look the fact of the matter is with so many voters having no preference whatsoever there is plenty of room for another candidate, maybe two candidates. So dont be surprised if the race gets more crowded between now and the march 16th public filing date because theres an awful lot of time between now and then. We continue to follow that breaking news near Southern California a Major Oil Spill near Santa Barbara. That oil slick about four miles long. The coast guard estimating within the last hour theres 21,000 gallons of oil spilled when a pipeline broke. The oil then gushed down the bluffs of the beach. Workers discovered the leaking pipeline just before noon today so its been several hours. In fact it took about four hours just to seal that ruptured pipeline but now the cleanup. We mentioned 21,000 gallons of spilled oil. In comparison a few years ago the oil spill here in the bay area had 53,000 gallons of spilled oil, so you can kind of get some perspective here of how major this is for the Santa Barbara area. Well that Mountain Lion that had a san mateo neighborhood on lockdown is back safely in the hills. Wildlife experts think the animal wandered down from the Crystal Springs reservoir area yesterday and ended up near ninth and el camino real. Thats where Michelle Roberts is live with more on the questions still swirling about the big cat and obviously the big thing, it was probably looking for food or water. Reporter yeah, thats right. They can only speculate why it would wander down here but they say it was healthy so likely it was looking for food possibly even following a deer and during a drought they say deer are more likely to come into neighborhoods like this looking for water. 1200 people in san mateo received an alert from Police Yesterday because of this 90pound Mountain Lion. The best guess was that it could have got pushed out of its habitat by a more dominant male. Reporter after several sightings near downtown san mateo, police set up a perimeter and asked homeowners to shelter in place. Long tail. He just jumped over the fence through the trees. Reporter ruth said her dog was just feet away from the Mountain Lion on the patio. Just before 6 00 last night a gunshot rang out. Soon after officers were seen running toward the prices home where ruth says her husband accidentally fired a shot into the ground. I guess he thought if it came back again, he probably would have shot at it you know because its running around. You know you have the park over here with little kids and little dogs. Reporter police confiscated his gun and said they would submit the case to the district attorneys office. In light of the circumstances, it was probably poor judgment. Reporter wildlife experts say Mountain Lions prefer to live in isolation. They can travel up to 15 miles a night in search for food. As a deer moves into human habitation, Mountain Lions are following. Reporter the fish and Wildlife Department released the 2yearold cat into the hills, describing the capture and release has a textbook operation. It lives to fight another day. Reporter the fish and Wildlife Department says that they didnt tag the Mountain Lion because they didnt have enough time and they say its unlikely that it will return to this neighborhood. Takata has agreed to recall 34 million air bags. Its estimated that one in every four cars on the road is affected. Those cars all different kinds, nearly a dozen automakers on the list. Toyota cars hit the hardest but others include honda, nissan bmw and, as you can see, many more. Exploding air bags that can launch bits of metal and shrapnel into the car, potentially killing you. The national Highway Traffic Safety Administration says defective takata air bags can do that. Theyre being blamed for at least five deaths in the u. S. And dozens of serious injuries. Automakers and manufacturers have a safety responsibility that they must live up to. There are no excuses. Reporter for the past year the Japanese Company would only agree to a smaller recall saying the defect appears to only show up in places of high humidity. Inspectors did find that in those weather conditions the chemical propellant used to inflate the air bags could degrade, causing the air bags to explode with too much force, but the federal government doesnt want to take any chances and after consistent pressure takata agreed to a nationwide recall, 34 million vehicles. Youre going to need the jacket all the way down to the south bay with low clouds returning to the Silicon Valley with 52 to start. Its going to be another morning in the peninsula, east bay and also San Francisco where you may need the windshield wipers a little bit with some mist and also drizzle at times. Well show you this phenomenal amount of cloungd cover thats going to be stuck right across the bay area. June gloom that typically rolls in right around may and june obviously the fog pattern in San Francisco is thick but this has been a little thicker than normal. But check this out, the average high for this time of the year in san jose is 76 degrees. So we are still well off point from getting that but if you like this 76 were going to get you closer there as we head through the memorial day weekend. For the north bay, east bay and trivalley where we have increased sunshine tomorrow well finding the warmest temperatures in napa and santa rosa. Upper 60s to 70 degrees. Oakland stays on the cool side at 63. Throughout the trivalley well have 69 at danville and likely one of the warmest will be livermore at 70. We have that possibility of showers in the forecast. Its not a big storm system but we had this trough of low pressure. Its going to be rotating in a little bit of moisture as we head again through thursday and friday. We might see a tenth of an inch to maybe just trace amounts here throughout the bay area so well continue to keep our eye on that. How about what happens after friday .
