I know that these apartment complexes, it takes ten minutes for the water to get warm if you want to take a shower and do dishes and you have to waste that water. He crafted prop 47 that will appear on the state ballot in november. It would convert many low level crimes from felonies to misdemeanors. Crimes like drug possession for personal use along with other crimes that normally go along with drug addiction and Mental Health issues. Were looking at shoplifting and petty theft. Reporter prop 47 would save the state as much as 250 million a year by reducing jail and prison populations. The savings would go toward Mental Health services, substance treatment and schools. We need to deal with the addiction and addiction cannot be cured by incarceration. If 47 were to pass, its difficult if not impossible to undo the unintended consequences. The Morgan Hill Police chief who serves on the California Police Chiefs Association says prop 47 has serious flaws. Tonight we take you behind the scenes of a system that leaves some high tech workers trapped like servants. They call themselves highly educated Foreign Workers being paid pennies on the dollars. Theres a dark secret in the Silicon Valley. Workers flown in from other countries like india and being mistreated by the companies that brought him here. A yearlong investigation worked to bring light to that system. Companies involved are almost all consulting firms. Thirdparty businesses that contract out Foreign Workers to major high tech firms. We discovered that some of those companies are not playing by the rules. Those companies are often called body shops. Body shops that leave highly educated employees without work, little money, trapped in pursuit of the american dream. Reporter what drives technology are thousands of Foreign Workers who come here every year contributing labor to a 197 billion economy. They can make profit only by paying less to their employees. Reporter this man left his home in india a decade ago to follow his dream here in the Silicon Valley. I will work for them for probably seven or eight. Reporter seven or eight consulting firms. What he called body shops. Body shops have a specific business model. They make profit by having a cheap labor. Reporter he fears for his safety and his future. Thats why he asked that we change his appearance and give him a false name. At his request, we will call him regeesh. Do you feel trapped . I feel im trapped. Reporter under the law, a company can bring highly educated, highly specialized Foreign Workers to the United States by using an h1b visa. 1. 3 million visas have been given out since 2008. In 2012, 59 of those visa petitions went to computer related occupations. While Many Companies play by the rules, a yearlong joint investigation by nbc bay area and center for investigative reporting uncovered examples of Companies Taking advantage of these Foreign Workers and breaking federal law in the process. Its a pretty accurate term because in many cases thats exactly whats going on. Reporter phillip and his law partner have heard stories and represented workers from body shops for years. They may not have a job which is misrepresentation of the visa. Federal law requires that companies that bring workers over on visas have jobs lined up for them and requires that the attorney and document fees. But we found dozens of cases where those rules were ignored or broken leaving Foreign Workers who thought they had jobs now in the u. S. Illegally broke and unemployed. We tracked various criminal and civil cases involving Consulting Companies or their executives in u. S. District court and state courts around the country. In total, these Court Filings involve more than 600 fraudulent visas and petitions. In the case we looked into which is an outfit. Reporter a lawsuit alleging a Santa Clara Company refused to pay them and didnt have jobs for those workers when they arrived here. Court filings show the company denied these allegations but midway through the lawsuit, Silicon Valley went out of business and workers left with nothing. When they got here, there was nothing for them. Reporter its called benching workers. Once workers get here, they find theres no work and often they are told to go find their own jobs. Under visa rules, its illegal. We found it happens again and again. They didnt have jobs lined up for any of their employees. Certainly nothing at the levels they had promised them and they dumped them into the guest house. Reporter a guest house. What this lawsuit, interviews with former workers and this research describes as a small apartment or house where as many as eight to ten workers live at once. Sometimes those workers pay the body shop rent to live there and are told never to leave except to go to work. This worker asked to remain unanimous because he fears for his future job prospects by speaking out now. He stayed in guest houses for months. So this body shop could cancel your visa and send you back to india at any time and that scares you . That scares me. Reporter the body shop he works for kept up to 30 of his 60 an hour contract salary for expenses and taxes a loss in salary of 35,000 a year. They did charge you . How much did they charge you . 2,300. Reporter you paid the company to get you a visa. Yes. Room for abuse is there definitely. Reporter a researcher at the university of wisconsin milwaukee studied h1b visas and body shops for years.
