Madsen says the 23yearold woman was pulled over and arrested during the dui stop on highway 680 back in august. But while in custody, he says officer Shawn Harrington accessed the womans private photos from her cell phone, then transmitted them to his own cell. Theyre personal, private photos that she meant to keep private on her own cell phone and werent meant for anybody elses eyes. Search warrants detail the six photos, photos investigators say they retrieved on the officers personal devices during a search of his martinez home. The d. A. Investigator concluding felony Computer Data theft charges are warranted. The cph says the officer has been assigned to desk duties while the investigation moves forward. The extent to which theyve been transmitted either to other individuals, perhaps other Law Enforcement officers, perhaps on social media, were unsure at this time. Now, the deputy d. A. Handling the case says prosecutors met this afternoon and dee vied that they needed more time to evaluate and investigate this matter. Investigators found an external hard drive with pornographic videos of children inside his car. He is currently out on bail. A new twist on a story we broke earlier this week. Tonight, several people are sick after drinking tap water contaminated with e. Coli. San Jose Water Company says its still not safe to drink water in hundreds of homes in this neighborhood. Michelle roberts joins us from sidney drive in East San Jose where crews have been testing the water. Michelle, whats the delay . Reporter theyre making sure its safe before they give the all clear. The earliest that will happen on sunday. Theyre going around to neighborhood hoses and taking samples from that and from hydrants in the area, making sure that this is safe to drink. San Jose Water Company is flushing out the pipes on sidney drive to clear out the water contaminated with e. Coli. I will never drink city water. His entire family got sick after drinking from their own sink. Diarrhea, headaches and nausea and dizziness. Thats what i went to the hospital for because it kept getting worse. On friday, the san Jose Water Company issued a boiling water notice for 300 homes in East San Jose. Several people were already exposed to the contaminated water. The experience has been that an animal might have gotten into the pipe. The Water Company says crews will work 24 7 until the water is safe. It could be days before the all clear is given. Its frustrating. Its very disappointing. She runs an inhome daycare. She and some of the children have been feeling ill. Until the water is clean, she can only care for two kids. Its costing her 300 a day in lost business. It would have been too difficult to flush the toilet and wash their hands and keep them clean without getting sick. Reporter 300 families have received free water because of this. But Officials Say thats really out of the abundance of caution and really only 50 homes have been affected by this contaminated water. The woman in her 60s was walking in the crosswalk. Thats when the trolley type of tour bus hit her. Its unknown if the driver will face any charges. Now, a former san jose cop says mayor reeds adviser called him over the weekend and asked him to lie about the cadets claim. Damien trujillo broke the news earlier tonight. That political adviser denied the allegations to nbc bay area. But the police union lawyer says the mayors fingerprints are all over this as well. Former San Jose Police officer Aaron Edinger sat next to the police union lawyer claiming the political adviser asked him to lie. He advised me that he wanted me to collaborate with him and the female recruit, specifically about the Police Officers association trying to get officers to quit. The allegations stems from the accusations by elise revis. She said he told them to quit for the betterment of the union in the case against the city. I became appalled and outraged that he would ask me to lie about mr. Und lands telling officers and recruits to quit. Its simply untrue. In sworn testimony, edinger claims that in return add loan would help him get his job back. If its true, would you associate yourself with him and should he be investigated it. A peninsula man has been arrested for a rash of burglaries. This man, eric gam boa was a Maintenance Worker at a senior complex with spare keys. He used them to enter locked apartments while people were gone. The Senior Housing facility is located off el camino real. Theres a zero tolerance policy for such crimes. He faces felony, burglary and elder abuse charges. Picture this, not just worth a thousand words but 2500 bucks. The cell phones were seized at a prison near the border. The phones are in san jose where a battered woman support group is refurbishing them. They can sell the lot of phones for more than 2,000. Spokesperson says its an appropriate gift since some of the phones were seized from inmates serving time for domestic violence. Its an important part of the holiday season. This afternoon Royal Canadian mounted Police Confirmed michael zehafbibeau carried out the attack alone in canada. We have information that he may have had dual libyan canadian citizenship. According to some accounts, he was an individual who held extremist beliefs. His parents released a written apologies to the victims and their families. Theyve often been the subject of myths rarely the top trending topic of twitter. Lots of tools, old and new, were being used to take in spectacle. They watched the partial Solar Eclipse with big telescopes and small telescopes. Where the moon is taking a bite out of the sun. Biggest bite will be about 3 15 today. Gathering around the observatory at foothill college, some with special glasses, all with a sense of wonder. I didnt even know it was a Solar Eclipse today was going to happen. They would get pots and pans and implements and make a lot of noise and that would scare away the monster. You know what, it always worked. For a while, the moon got between the earth and its star and people used whatever they had to be a part of it. Thats what happens when the sun, moon and earth align and the moon blocks part of the sun creating that partial eclipse. The maximum of that eclipse ee kurd at 3 17 this afternoon. The reason theres a danger of hurting your eyes is no other reason than the fact that you would never look at the sun for 30 seconds to a minute at a time. So if you were to look at the sun for that long without any kind of protective eye wear, you can suffer some damage. When that total Lunar Eclipse happens again as we mentioned a few years from now, wear the eye protection. Looking at the stationary front across california, its staying in the same exact spot.
