For those who do, rescuers are urging caution. Around the usually cool city, people soaked up the warm fall sun in San Francisco today. Here we are enjoying the weather. And just feeling really great that were getting ready for a great heatwave. When it does get warm out here, we can expect a Pretty Healthy crowd. Reporter battalion chief rudy castellanos. There are no lifeguard stands. And were not trying to promote recreational swimming out here. We want people to realize that there isnt a tremendous amount of professional protection for swimmers. Reporter just last week, four rescues, two fatalities at ocean beach, signs warn of the rip currents. San francisco fire says they responded to 28 surf rescues in 2014. So far in 2013 there were 22. The majority of the rescues or assists that we do here of swimmers are of people who didnt intend to be swimming. They thought they would wade in to their knees. Reporter beach rescue constantly reminds people of the conditions. Today most stayed on the sand, enjoying the breeze. An equally popular spot, dolores park, where some like this man from boston are glad to say they now call San Francisco home. Right now it is probably like 50 degrees and chilly. It is now in the hands of prosecutors. Police today handed the case over to the Santa Clara County district attorneys office. It will now be up to prosecutors to decide whether to charge mcdonald. Police arrested mcdonald at his san jose home on august 31st. He is accused of Domestic Abuse against his girlfriend. 49ers have kept mcdonald on the roster ever since that arrest, and have not announced any plans to change it. Developing news reporting the enterovirus outbreak. It has reached the bay area. Late this afternoon, Solano County reported its first case. Alameda county also revealing two children there have been diagnosed. Nbc bay areass Nannette Miranda is in oakland with the latest and with what families can do to protect themselves. Nanette . Reporter well, enterovirus d68 was bound to get here in the bay area. The nusa little unsettling because in some of the colorado case, kids felt paralysis in their limbs. The cdc is investigating whether the strain here and there are related. We want to try and get out in front of it. Reporter oaklands Unified School District confirms the two enterovirus d68 cases in Alameda County do not attend school there. But it sent out letters to parents today asking that they take extra precautions like they would in flu season turkey, the extent that we can be proactive and be sure that were spreading positive Health Information about how to prevent or slow down the spread of the disease. Reporter this after Alameda CountyHealth Officials announced two confirmed cases in children of evd68. They wont say which hospitals or schools theyre located, but the bay area cases were hardly a surprise since six cases were confirmed in Southern California and about 500 in 42 states. It seems like theyre not responding to usual antibiotics for pneumonia and they have ruled out other viruses. Reporter in california, the state lab is only testing people under 18 who have been hospitalized and have an unexplained respiratory illness, which means there could be more cases out there. Wash your hands, cover your cough with your arm, not your hand. Stay home when ill. Reporter hand washing with soap and water is far more effective than using hand sanitizers for this virus. No vaccines or Antiviral Medicines are available at this time. Alameda county public Health Officials point out that kids die from the flu every year, and that no confirmed deaths have been associated with evd68, at least not yet. In midaugust, hospitals in missouri and illinois noticed an increase in children with severe respiratory illness. It was later identified as ev68. By the first week of september, it had spread to nine neighboring states. From there it spread to each coast. This week california became the 43rd state to report cases. This just in. A photographer working for nbc news in liberia has tested positive for the ebola virus. He was hired to work with chief medical correspondent dr. Snyderman. Doctors are examined him and now are having plans to fly him back to the United States for treatment. Coming up at 6 30, well have a live report and why bay area doctors are joining the fight against ebola, and why they say we may be seeing more scattered cases on u. S. Soil in the coming months. Well, he is credited with revolutionizing police work. And today the men and women in blue came out to honor the man affectionately known as joe mack. Joseph mcnamara died from cancer last week. Nbc bay areas Damian Trujillo was at todays service and he joins us with more. Reporter well, jessica, joe mcnamara was credited with advancing the concept of community policing, a concept where the Community Input matters, an idea where you cant run a Good Department if the community is not on your team. [ bagpipes playing ] morning tom, how are you . Reporter friends filled the auditorium of the california heater in san jose. A gathering in honor of man known to many simply as joe mack. To say he was a cops cop is an understatement. Reporter junior gamez is now chief in redwood city. Mcnamara was chief in san jose from 1976 to 91. He survived a vote of no confidence by the police union and went on to build arguably the best police force in the nation. All i can do is add to the praise that he has received. He was a wonderful chief. He was a great leader in law enforcement. Reporter a cop who walked the beat in harlem before coming to san jose, a chief who often carried oneway conversations with people he was debating, including former mayor tom mchenry. Joe mcnamara knew who he worked for. He didnt work for mayors. He didnt work for city managers. He worked for that much higher principle. And it was always with joe the department, the department, the department. A department that today is going through one of its toughest challenges. Beat cops hope the legacy of joe mack will help bring back the shine in the badge. Thanks, joe. You were always certain. You were quite often right. Well miss you. We investigate. A santa clara man is recovering tonight after he was violently attacked in his own home. In the middle of the night, he confronted a burglar. It happened on cabrillo avenue in santa clara. Michelle roberts is live at the scene of this Home Invasion with some new information. Michelle . Reporter yeah, raj, i just spoke to the family that live in the home behind me. They say their brother is home from the hospital. He is doing okay after being stabbed by an intruder. They say theyre thankful an arrest was made, and now police are saying that suspect may have also attacked woman about an hour before he made it to this neighborhood. A santa clara family is trying to pick up the pieces after a brutal attack in the middle of the night. And thank god my mom wasnt here. Reporter diane irvin wasnt home at the time, but says her sister came facetoface with an intruder in the kitchen. Police say Ignacio Maldonado broke in through a side window and made enough noise to wake the entire family. And then my brother heard something going on. And was and came downstairs. And thats where he turned around and just sliced him. Started hitting him and slicing him. Reporter diane says her sister tried to stop the man and screamed for help while her brother was being stabbed. He was cut in his neck, his back. He had multiple. Its a lot of stab wounds. Reporter investigators say the suspect ran away after the attack. Maldonado was found hiding behind a neighbors bush early this morning. Thats rare for santa clara, rare to this area. Reporter lieutenant kurt clark with the Santa Clara PoliceDepartment Says maldonado may also be responsible for another stabbing that happened 45 minutes earlier, only a half mile away. Police say a woman was sleeping in her car near calbasabasas anl camino real when a man matching his description knocked on her window. She rolled down the window to see what the problem was and someone assaulted her with the knife. Reporter the woman was able to drive herself to the er and is expected to survive. As for the irvin family, theyre hoping for a full recovery. Its been a rough year for everybody. But hell be okay. He is strong. Reporter such an awful situation. As i mentioned, both victims are expected to be okay. As for the suspect, he is facing multiple charges, including assault with a deadly weapon. Pg e today made its objections to the billion dollar fine imposed for the san bruno pipeline explosion official. The utility giant filed an appeal with regulators. Today was the deadline for contesting the 1. 4 billion penalty. The record fine was imposed by state regulators last month for the utilitys thousands of violations of Pipeline Safety laws. The 2010 pipeline explosion killed eight people and destroyed nearly 40 homes. In a separate appeal, rate payer groups say they want more of the penalty to go toward pipeline improvements instead of the states general fund. Looks like a scene from mission impossible. Our nbc chopper on the scene today. But it wasnt hollywood. This was oakland. Two window washers rescued 20 stories up. Down below a lot of nervous people gathering to watch the highrise drama unfield. Lets bring in nbc bay areas jodi hernandez. Reporter oakland firefighters say they have rescued people from hillsides before, but nothing quite like this. You can see the window washers basket is still stuck between the 19th and 20th floor. This is where that dramatic jawdropping rescue took place. Of course you get a little bit of anxiety and a little bit of stress. Reporter thats how oakland firefighter brian says he felt as he rappelled down the face of a highrise building to rescue two stranded window washers. Making sure that everything that were doing is safe and that we need to do this in a very timely manner, because they had been out there for such a long period of time. Reporter fukuhara double harnessed the first window washer to a hoist line. Minutes later, the man was making his way up the building, pulled by firefighters on the rooftop. As onlookers nervously watched from below. That looked scary as hell. Reporter an attorney who works in the building snapped this photo from the inside. It was kind of interesting watching the guy being pulled past the 24th floor. I mean i dont know if you have seen the pictures. He seemed very happy to be getting out of there. Reporter with one man safe and a sigh of relief on the ground, rescuers began hoisted up window washer number two. Firefighters say while dangerous, plan b would have been even more risky. Which would have been cutting a window at great cost to the owner of the building. And great danger to the citizens on the ground just in case we lose a panel and it does break. Reporter but both men made it out safely, followed by their rescuer, the last of the three to get back to safety. They are really pretty far up. And im afraid. And im glad, again, the window washers basket is still stuck up there. Firefighters say they may have to lend a hand again to help get it down. Now the window washers were a bit dehydrated and hungry, but other than that, were told theyre in good shape tonight. In oakland, im jodi hernandez, nbc bay area news. Pretty scary up there. Yeah. Typical warm spot here across the bay area. But oakland is also at 87 degrees. We have these dry offshore winds. Thats helping to funnel a lot of the heat right here across the bay as well. No matter where you go across the east bay tonight, its going to continue to remain a warm evening. As you get a look at the rest of the Sky Camera Network, blue sky in the north bay currently checking in with 89 degrees. And 89 across the south bay. For tomorrows forecast, it is going to get hotter. Dangerous levels of heat here. Not only for the trivalley, which typically gets hot. Well have 98 degrees there. Its been a year since the university of california hired its high profile chief, Janet Napolitano. She is in charge of all ten uc campuses, which make up one of the most highly regarded Public University systems in the world. I sat down with napolitano to talk about her first year on the job. In tonights class action, oneonone with the uc president. As an outsider coming in, the breadth and depth of the university of california is almost impossible to comprehend until youre sitting in a chair like mine. Reporter Janet Napolitano says her role at the university of california is like being a ceo. Its a job that requires hard choices. Like the decision by regents to admit a Record Number of outofstate students. Ive heard the figure somewhere that says for each International Student or out of state student, they pay for themselves and another student in california. That factual . Thats pretty true, yeah. Thats pretty much how it works. There is a perception, though, and i want you to clarify this. When i talk to parents, there is always a perception from parents who say one of those kids from out of town or from an International Place is taking the place of my kid. Yeah. But thats a misperception . That is a misperception. I mean, i totally understand how that happens. Reporter while there has been an increase in the number of out of state and International Students, napolitano insists that californians are not losing coveted spots. Even so, she believes it is time to reexamine outofstate enrollment. We dont actually have a policy. We dont have a cap. We dont have anything like that. And its become such a sensitive issue and important issue that i think we need some rules of the road moving forward. Reporter another sensitive issue, the ban on affirmative action put in place by voters in 1996. Which resulted in admissions dropping for African Americans and latinos at top tier campuses like uc berkeley and ucla. Napolitano has pledged to increase enrollment for low income and underrepresented students, but says the university cannot consider race or ethnicity. We educate, for example, half of the physicians in california. Theyre going to come out of the university of california. And yet with the ban of being able to take any kind of race or ethnicity into account, we find it very difficult to maintain as diverse a student body there as we would like. Thats a concern. All right. Explain in laymans terms to parents out there that want to know why does it cost so much to go to college these days . Where is the big expense in the university . I think several reasons. First of all, its not as expensive as you think. And this is where we get to i call it the myth of the Sticker Price. Everybody thinks its the Sticker Price plus this, this, and this. Reporter most uc students graduate with no debt. And among those who do have debt, its less than 20,000. Total. Not per year, total. Good. And thats an investment. And, you know, thats not even thats a car, you know. Think about it in terms like that. That will pay itself off and off and off over a persons lifetime. Reporter most of the uc budget goes to paying for people and facilities. Costs napolitano will continue to fight for at the state capitol. I think our chief challenge remains and is sacramento and the budget. And i just know it. I see it. Im not sure i quite understand why. But we have to keep working it. Thats a very public nudge at the governor to make a bigger commitment to the uc system for sure. Tuition has been frozen for the last three years now. And we asked napolitano if a tuition increase is on the horizon. And she said that without a significantly bigger financial pot of money from the state, it will be difficult to maintain that freeze. Well, still ahead here at 6 00, the key to fighting the spread of ebola. Why local doctors say there will soon be more cases on u. S. Soil. Well, they were brought up to be respectful and keep quiet. But all that changed when they went to cal. The leaders of the Free Speech Movement find their voices, next. And a big surge in tesla stock because of a twitter tease. The tesla ceo hints that the not so distant future and what is in store. Right now at 6 30, facing criminal charges. The texas man diagnosed with ebola is accused of lying on his Departure Health form before lying on his form before departing to the United States. An nbc cameraman has tested positive for ebola in liberia. There are plans now to fly him back here to the u. S. For treatment. As for the case in texas, the country of liberia says Thomas Duncan denied he was in contact with the ebola infected person during his visit. But we learned today that he did indeed help a sick woman into a taxi to get her treatment. In texas now, duncans family in dallas has been ordered not to leave their home for 21 days. This as the white house and president obama is closely monitoring the case. So is the u. S. Really at risk in all this . Mark matthews joins us from the Health Symposium in San Francisco. Mark . Reporter well, raj, in the world of Infectious Disease experts, some of the real rock stars showed up at a meeting here today at ucsf. And with the worldwide attention on ebola, the place was packed. In terms of Health Systems reporter looking around the room, there is paul farmer, who transformed Health Clinics in some of the poorest countries in the world. Larry brilliant, epidemiologist who helped eradicate smallpox and ran googles philanthropic arm. Dan kelly who flew into sierra leone as some other doctors and nurses are fleeing. He is going back in another couple of weeks, and says the attention over a single case in texas is understandable, but way out of proportion. We need to just be open to the idea that there may be scattered cases that well see over the course of this epidemic. But really, our attention needs to be turned to west africa and there should be a call to action to rebuild that celt system better and stronger. Its a terrible disease. But it doesnt spread like wildfire. Reporter Larry Brilliant says diseases like polio and smallpox spread more easily and theyve theyre all but wiped out the cavalry is arrivaling. Reporter the vice chair of epidemiology agrees with the quarantines ordered for the family of the ebola patient in texas. Yes, i think thats quite reasonable. We did that in this country a lot for diseases like scarlet fever and measles and smallpox in the 1950s and even into the 1960s. Reporter but the fear that the disease will spread in the United States, no one here is warning of that. Ebola is not going to be a problem in the United States under any circumstances. He accurately points out that the outbreak in west africa first started six months ago. He says if you wait six months to respond to an outbreak, youre going to wind up dealing with an epidemic. At the Global Health and Sciences Center here at ucsfs campus, mark matthew, nbc bay news. Good information. As for air travel, Health Experts say the risk of infection is low. A passenger who is coming down with ebola is not contagious unless they have a fever. And even if they are sick during the flight, the virus is only spread through blood, vomit, or sweat. Ebola is not transmitted like the flu through droplets in the air. To keep sick patients off of the planes, passengers are currently being screened before departing west africa. A change of plans for next weeks president ial visit. President obamas fundraiser will no longer be at San Franciscos city hall. Nbc bay area has confirmed that the event is now at the w hotel on third near the moscone center. That october 10th fundraiser will be the president s 19th visit since taking office in 2009. So far democrats have raised about 32 million for the 2014 elections in the bay area. Republicans have raised a third of that, some 11 million. 50 years ago this week, thousands of people protested, but four voices really stood out. The berkeley Free Speech Movement captured the attention of the nation. Tonight we continue our look back on that historic time by going behind the scenes with the students at the center of that storm. Here is nbc bay areas diane dwyer. He at some point thought he would be a priest. There was so little. Very socially conservative time, and i lived in a very narrow world. My parents were both members of the u. S. Communist party. I was raised in a system that you lived within your means, you dont borrow money. Everything was conservative. And father knows best. Reporter the collection of students was eclectic, the daughter of a communist, the son of a navy man raised on discipline, a boy from queens who had been raised to become a priest, and the son of jewish emigrants who was taught not to question the status quo. We begin with the young man who was to become a priest, but instead became the name synonymous with the Free Speech Movement. That im sure his fist communion. The one thing he took from his early upbringing as catholic was the maxim to resist evil. Reporter savio died in 1996 of heart failure. But his wife and one of his sons had distinct memories of the man who according to the chronicle was the nations most prominent student leader of the 1960s. There is a time when the operation of the machine becomes so odious, makes you so sick at heart that you cant take part. You cant even passively take part. And youve got to put your bodies upon the gears and upon the wheels. Reporter he was also a gifted speaker. But that wasnt always the case. He had this terrible stutter. They chose the valedictorian by grades. And he was had the highest grade point average in the school. But the principal said to him, you know, you dont have to give the speech. And he said i want to give the speech. He had a really bad stammer. And it could take him minutes to get one word out. Reporter despite being raised in a conservative family, his parents supported his efforts to fight what he saw as inequality. Basically, they were scared, but they were also proud of him. Reporter after college, he went on the eventually teach logic and math at sonoma state. But would step back into the headlines occasionally to bring attention to issues ranging from apartheid to immigration. But it was the Free Speech Movement he was still most proud of because of what they accomplished. He saw it as a really shining moment. You know, the main lesson i was taught is dont stand out. Reporter that may have been the lesson, but make waves is exactly what jack weinberg, the man in the car ended up doing. John steinbeck once said that the United States is on a tilt within a novel, and all the loose nuts roll to california. And i was one of those loose nuts. I think i just wanted to get away. And that was the farthest i could go. Reporter weinbergs arrest made him a star in the movement and made national headlines. But back home in buffalo, that news went over not well. Yeah. It was a total embarrassment and humiliation for my family. And i really severed relationships with them for a period of a couple of years where i couldnt deal with them and they couldnt deal with me. We subsequently healed all that. Reporter today weinberg works to help protect the environment. My parents were both members of the u. S. Communist party. Reporter and that upbringing may be why bettina apdecker was attracted to berkeley by a piece of news footage that probably didnt make the universitys recruiting material. Well, i was very political. And the students at cal had organized a big protest in the 61, i think it was, against the House Committee on unamerican activities. The students were outside up on the steps of city hall. And they were washed down the steps by the fire department. Turning on very heavy hoses. And i was very inspired by that. And so cal became a place i thought oh, i would like to go there. Reporter as one of the few female leaders of the movement, she found her voice one night on top of the police car. And then that night was the first time i had ever made a speech, a public speech. And it was from the top of the police car. The only thing i remember saying, i remember quoting fredrick douglass, the great abolitionist who said power concedes nothing without a demand. I remember i quoted that, and the crowd roared back its affirmation. Reporter but not everyone on campus was enthusiastic about what was happening. On graduation night, i sat on the hall steps and said Something Like the Free Speech Movement screwed my university. I went to a school that i assumed was an ivy league school. I literally came with button down shirts and threepiece suits. And i had no idea what to expect. I just assumed that is the way it was going to be. For the first week, it was. But by the second or third week of school, by the middle to end of september, it really got crazy. So the students were protesting. They were in large numbers up at sproul hall steps giving speaks. And then of course one of the big turning events was the arrest of jack weinberg. At berkeley in those days, the accounting was 8 of us and 10,000 of them. The socalled law and order group of which i was a number were very small in number. And our job was to go on television to go on around the campus and talk about trying to calm the situation down, trying to find a civil way of dealing with the issue. In retrospect, i have to say that what i think the students achieved was very important. As ive grown older, as ive become a little more politically involved, as i can vote, as i have seen life develop, i think it was important thing at the time. Bruce works in san jose as an attorney, and he is now working with other cal alum in the hopes of improving political discourse. In berkeley, diane dwyer, nbc bay area news. But we certainly felt the heat, even up against the immediate coastline. We had those offshore winds with us. And thats what catapulted pacifica up to 94 degrees. Were typically at 69 this time of the year. So the normal airflow is winds coming from the west. Its a cooling pacific wind. And again, a lot of the winds today coming from the east. A lot hotter for us. Well get you outside of the Sky Camera Network. Not only a brilliant sunset in San Francisco. Check it out in woodside. Now 90 degrees. And here across San Francisco, weve got currently clear skies. Our heat advisory stays in effect as we continue throughout our friday forecast, all the way up until 9 00 p. M. As were looking at another hot day for tomorrow. In fact, temperatures do look like theyll go about 3 to 5 degrees warmer. So in san jose, with this expected 98 degrees and sunny skies, it could be some of the hottest weather since july of 2012. So get ready for that heat.
