They got a paycheck last week, it was 60 . If they dont go back to work friday, theyll have to wait a month for payday. Many workers have sought out Short Term Loans to pay the bills until they get back to work and get back pay. Even though the bill the house is set to vote on will only guarantee funding through january 15th, workers say they will take it because at this point something is better than nothing. A Late Breaking Development to keep a crv transit buses in service. The governor intervened negating a strike tomorrow and a 60day cooling off period. Transit workers threatened to walk off the job as early as tomorrow morning. Jodi hernandez joins us with more. This is exactly what many riders, raj, have been praying for, for the governor to step in and help keep the buses rolling. Now, until just a couple of hours ago, bus riders, ac bus riders didnt know if they would have a bus to catch at the bus stop tomorrow morning. Thanks to the governor, the strike fears have been put on hold. We havent heard anything from the governor at this point. Were moving ahead as if there will be a strike. That was ac transit just two hours ago. But the threat of a strike tomorrow is now off the table. As governor jerry brown takes action to keep buses rolling at least for now. The governor is calling for a sevenday investigation into the unions strike notice. A move that could lead to a 60day cooling off period. I think the timing is probably the determining factor here. Having both of these two big transit systems go out would substantially inconvenience people on the east of the bay area and getting into San Francisco. The metropolitan Transportation Commission says theyre not surprised the governor has stepped in. With a possible b. A. R. T. Strike looming, having buses potentially stop too would mean gridlock. For us, who want people to take public transit, this sense of uncertainty and insecurity, you build your life around some sense that you can get around in the bay area really matters and to have this happen to people is deeply frustrating. Ac transit and the union resumed negotiations tonight. The union says it will abide by the governors decision. But they say their rising cost of medical benefits and safety concerns must still be addres d addressed. Just imagine yourself driving a bus down the street and you get shot at and it comes through the front windshield. How would you feel . Youre traumatized. Riders are glad to know buses will roll tomorrow. But realize the threat of a future strike isnt over. I feel distraught that im going to have to figure out how to get to work all the way from Contra Costa County to alameda county. With everybody on strike, they need to get it together. Reporter were back live at the oakland transit center. The buses will continue to roll for seven days. Once again, the governor has ordered a threemember board to launch a sevenday investigation. That could lead to a 60day cooling off period. Meanwhile, hes urging both sides to take this matter seriously and continue to work toward a fair solution. The press corps got a good morning from federal mediator, george cohen as he walked into the cal trans building around 10 00. Cohen could be seen shaking hands with union members, giving an indication things might be going well. We are not trying to disrupt the service. We never have been from day one. Weve been trying to get a deal. Mediator cohen has come in and he and his team are trying to get that deal in order. It was never our intent to just go out on strike. The unions did strike in july, causing commuter chaos. And some b. A. R. T. Riders havent gotten over that. B. A. R. T. Officials added up the numbers from friday, monday and tuesday. They say ridership is down by 85,000 trips compared to last year. Both b. A. R. T. Officials and the unions are getting complaints from riders saying they need to know early if there will be a strike. The union made a promise to the public tonight. I guarantee you today that the riding public and the commuters at large in this community will know no later than 10 00 what they can experience tomorrow. Both sides are continuing to negotiate. As you can see, anything can happen. As you just heard, the union is promising to let the riding public know by 10 00 tonight whether or not they will strike. Senator feinstein, its pretty clear the Tea Party Led all of this or much of this in terms of what happened the last few weeks or months. Is there any blame on president obama and the democratic side of this . Well, theres blame on everybody for somehow, some way, allowing it to happen. I dont want to cast blame. I think people know where this came from and its clear. It came from the Tea Party Republicans in the house. I think this kind of politics, which is essentially if i dont get my way, im happy to hold the people hostage until i do, is just plain deadbang wrong. Youve been around the block for quite some time. I mean that with all due respect. Here in San Francisco as mayor and in washington. Is this the worst climate youve seen politically in your career in this country . Yes. Ive never seen a time when even under the most difficult circumstances people couldnt come together and houses couldnt work together. Tonights agreement will really just extend us for a few more months until next february. Whats to say were not in this exact same boat when we talk three months from now . We could be right where we are in three months. And we must not let it happen. And the American People must not let it happen. So a lot of this, i think, depends on Tea Party People who are, after all, elected not just to espouse a specific ideology, but to do the right thing for the people of their greater constituency, which is the United States of america. One last question. Any input of whats happening in the bay area with the b. A. R. T. Negotiations. Would you tell the unions to accept the offer thats on the table . I think its a very bad time for a big transportation strike. I think it hurts a lot of people, and you know, i was mayor of San Francisco for nine years and nine years at county supervisor. I saw in those days the 70s and partially in the 80s, a large number of Public Employee strikes. They dont work. They leave deep scar tissue, and i would hope that b. A. R. T. Employees would vote to approve this package. In this day and age, with deficits, with debts, with shortfalls, i thought it was a very generous package. Earlier this evening, the Senate Passed the measure, which would extend the deadlines for another couple of months until january and february. In tonights reality check, sam brock joins us on whether the president can end the shutdowns if he wants to. Thats the claim. The president can bypass this legislative circus by raising the debt ceiling himself. Can he do that . Its a constitutional violation either way. This is the 14th amendment of the dons constitution. Nothing says the president is raise the debt ceiling. Its kind of the best choice of two bad options. Finally, a congressional deal takes flight hours before a deadline to raise the debt ceiling or suffer the first default in u. S. History. But in the end, political adversaries set aside their differences and disagreements. Before we go patting ourselves on the back, these principal players are likely going to be riding the same political carousel in a few months. Its a difficult situation. Its hard to see how were going to git out of this moving forward in a way thats healthy and constructive. All were talking about now is lets kick the can down the road for two months. Some u. S. Policy think tankers like saul jack man of the Brookings Institution say the president should raise the debt ceiling himself next time should it come to that. Has this ever happened in the history of our government, has the president ever unilaterally raised the debt ceiling . Never to raise it directly. Theres no precedent of the Emergency Powers being used for this explicit purpose. But extraordinary measures to preserve the country have been taken before, jackman says like when Abraham Lincoln suspended habeas corpus, fearing the release could create lawlessness or fdr banning labor strikes to keep a struggling economy afloat. He says the precedent is there. If we believe theres a state of emergency such that the greater good is in peril, it makes sense to allow the president to allow a state of emergency to protect that greater good. Im not aware of any modern historical precedent for the situation were seeing today. Political science Professor James cattrall appreciates the complexity of the situation, a congress that will violate the constitution with a default or a president who could violate with a debt ceiling raise. But hes not buying the lincoln comparison. It was an existential challenge to the nation. If we allow the states to secede, it basically makes the contracts between the states and people and government null and void. Thats a different crisis than a crisis of Economic Disaster. An Economic Disaster is all but certain with the default. Say economists of all political persuasions. Now, the president has said he wont raise the debt ceiling on his own. But if he did, jackman points out it would be tough to reverse. Congress would either have to vote to overturn the action and send the government into default or the Supreme Court would have to show standing that someone was harmed by the president preventing economic catastrophe. The reality is the president probably could do this but its also pretty clear that he doesnt want to set that precedent. Im sam brock. Thats the todays reality check. News of a potential deal sent stocks surging on wall street today. The dow jones average jumped 205 points. The nasdaq up by 45. Investors mostly stayed calm during the 16day Government Shutdown. But that reserve, erupted the day into a buying frenzy. Tech rivalry that could last well into the next decade. It wont be fought overseas. Instead in our own backyard. It appears the house of representatives will pass this sudden turn around or strategizing. Republican speaker john boehner, he gave up trying to get an agreement from the two sides of his own majority. The Tea Party Folks and the conservative republicans dont get along very much anyway. Some thought the government and their party could not afford massive reductions in such expenditures. The Tea Party Types thought they were too few. Boehner wanted a majority of republicans because of the hastert rule, the decree, the famous decree from former speaker Denny Hastert that said republican backed shouldless always be republican majority. Hes had to count on democrats for the majority. A lot of experts are wondering whether this weakens his Party Standing once and for all. Given that were going to be back in this position in january, did anybody come out on top of this and what happens next with boehner . We have long results, short results, you name it. Short term, we can start with the following. What happens boehner and his speakership. Is he going to be able to keep it. Doesnt seem to be anybody else in the republican majority who has enough votes to overturn boehner. Medium term. It means a doover on both the budgets and the debt early next year. All over again.
