Lecardo certainly acted like and was treated like the winner of the election. He declared himself the winner this morning and called dave, who as we said, politely refused to concede out of respect to his supporters. We know this community has been a very contentious political battle. And its time for us to put all that behind us. I want to get to work right away. On doing the important work of the city. That starts with building bridges and bringing people together. I think we neat to do that right away. Reporter he said hes already built some of those bridges when he addressed supporters last night. He declined to concede the election because he sincerely believes there are still too many votes to be counted. We owe it to them, especially since weve been saying over and over again for the last month, every vote counts. You need to get to the polls. I know hes anxious, you know, to move along and call this a day. But from my perspective, after a year and a half of campaigning, a little bit of patience is in order. Reporter as you heard both candidates acknowledge, whoever wins, will have to repair damage from the campaign. Another race too close to call, the 17th congressional district. No official winner yet between congressman mike honda, and ro khanna. Scott budman is at the Voters Office in san jose. Still a lot of ballots to be counted. Reporter youre right, janel. Some candidates are claiming victory, neither mike honda nor rokonna will wait until more votes are counted. Why were waiting so long to find out who won. The 17th district congressional race between mike honda and challenger ro khanna is still too close to call. And heres the reason. Its because theres so many ballots to be counted. Reporter inside the Santa Clara County registrar of voters, a mix of several dozen human hands and hightech machines are still counting, as many as 150,000 ballots sent by mail. But we do by hand remove the ballots from the envelopes. And then again were back to technology where were scanning in the ballots to do the actual counting. Reporter then, and only then, can they get to more than 10,000 provisional ballots that also have to be counted. In other words, were in for a long haul. Voters, candidates, the public should just be patient. Because we have a process that we need to follow. Reporter its a process that even in this age of instant results, makes us wait a little longer. The registrar of voters tells us it will likely be well into the weekend before they finish counting those mailin ballots, and only then will they be able to count the provisional ballots. After dozens of failed attempts across the country, berkeley becomes the first place in america to approve a soda tax. Essentially drinks like coke, pepsi and red bull. Reporter well, as you can imagine, supporters here in berkeley consider this a huge victory. They got a soda tax passed by an overwhelming majority. This goes into effect january 1st, 2015. They want to make sure that moving forward, they use the absolute best practices. Berkeley is always doing things that you never really count on, right . Reporter in a city known for social activism, berkeley Resident David kaiser said he understands the reasoning behind the soda tax measure. I dont want to tell people what they can do with their lives, and i get that whole argument. But by the same token, you know, theres a lot of unhealthy kids. Reporter the citys voters passed it overwhelmingly. The first time such a tax has ever passed anywhere in the u. S. In fact, more than two dozen communities have previously tried and failed. The effort was costly. The soda industry spent an estimated 2. 4 million opposing berkeleys soda tax. Supporters, more than 1 million. To get the simple majority needed to pass the measure. It is a tax on distributors, not on consumers. Whether they pass it on is a choice that they make. But we think over time, there will be a drop in diabetes among children. Reporter the bill means an extra penny in tax on each ounce of sugary drinks. Supporters say they expect this groundbreaking victory to lead to others, but opponents say berkeley isnt the start of a trend, just a unique situation. We think its foolhardy to think that what happened in berkeley can happen anywhere else. Its kind of a little bit of an anomaly. Reporter so what happens next . Well, the city of berkeley is going to go ahead and establish a panel of experts to advise them on how to proceed. There is a meeting coming up on november 18th. San francisco the minimum wage is 10. 74 an hour, voters increased it gradually to 15 an hour over the next four years. Lunchtime customers say the increase is good for cities. Restaurant workers fear it will result in higher prices. I think its a good thing. I think it should be going up everywhere. Jurors yesterday found joy jeffries not guilty of battery and violating a restraining order, after seeing this video. It shows jeffries wasnt the attacker. Instead, was defending herself. I feel like i need sunglasses tonight. We do have areas of high clouds moving across. And that really is a sign of some larger changes to come our way as we head throughout tomorrow. The area of High Pressure that brought the heat today, temperatures in the 70s to also low 80s. That will be dropping off towards the south. As we get a cold front moving across. Its a rather weak cold front. So, yeah, were going to see temperatures drop. I dont think it will be a 20 to 30degree drop, it will be in the 5 to 10degree range. As it sweeps across, the air quality will improve a little bit. But its not going to get a whole lot better. I still think it will be hazy over the next three days with moderate levels of air quality. Lets take you to the forecast where we can see what the cold front is going to do to the temperatures. South bay, 74 degrees. Looking good in downtown. Morgan hill at 80 degrees. Los gatos 73. For the peninsula, the big difference after sunny skies at the coastline, well drop down to 66. Patchy fog. San francisco, also out of the 70s today. It was a warm opening of that ice rink out at union square. By tomorrow, its going to feel a lot more like ice skating weather in downtown with 67 degrees. For the north bay, east bay and trivalley, well also drop out of the 80s, and napa to 78 degrees. For the east bay, also some changes here, 69 degrees in oakland. A typical warmup back here to the interior valleys of the east bay. Walnut creek looking at 78. For the trivalley, 78 also in danville. Pleasanton expecting 76. Lets take you to the next fiveday trend. What youll see is some beautiful weather as we head throughout thursday, friday and saturday. San jose staying in the 70s. A little bit of a warmup by sunday with low 80s. We go back down again for monday. In San Francisco, well also stay with a very comfortable trend of upper 60s and low 70s. San Francisco Police are trying to find a driver of a fuel tanker who killed a man who was hanging on to his truck. It happened in San Franciscos tenderloin district last night. Police believe the driver might not even know that he had killed this man. Investigators still want to talk to this driver. An oakland man will spend the rest of his life in prison after killing a millionaire during a robbery. A jury convicted drummer of firstdegree murder with a gang enhancement. That carries a life sentence without the possibility of parole. Prosecutors say drummer and three other men broke into comras mansion two years ago, and gagged him with duct tape.
