and will try again tomorrow. there are some crimes whereby department policy you cannot file that online. home burglaries for one. we've been told all yearlong you have to file that report online. now we're told by the department policy, any home burglaries, an officer has to respond to your home. this new technology should go into effect by the beginning of next week. we're live in san jose. i'm damian trujillo, nbc bay area news. >> damian, thank you. it's a long list of felonies, eight to be exact. that's how many charges a bay area father is facing after police say he kidnapped his two young children from their grandmother's home, then swept them on to a stolen yacht. christopher maffei made his first court appearance today. he did not enter a plea, but he did speak. maffei claimed he was simply taking his children from a home where they had been abused. the judge quickly cut him off for legal purposes. today's arraignment comes three davis the coast guard rescued the children from that stolen yacht off the coast of monterey, and maffei was placed under arrest. the children have been reunited with their mother. busted for buying booze for teens. gilroy's interim fire chief resigned today after he was caught buying alcohol for a minor during a sting operation last friday. the teen was acting as a decoy outside liquor stores in santa cruz county, offering $10 to any adult who would buy him beer. chief roger bloom was one of seven people nabbed in the operation. he was a 22-year firefighting veteran. former alameda county supervisor nadia lockyer will be allowed to see her 9-year-old son, as long as the boy's father is there, state treasurer bill lockyer. lockyer is facing drug and child endangerment charges following her arrest on august 29th. she has pleaded not guilty. police say lockyer was found to be under the influence of methamphetamine in the presence of her young son. she is out of jail on the condition that she remains in a drug treatment plan. lockyer and her husband are going through a divorce. we're learning more tonight about the driver who hit and killed a woman as she walked with her family along a walnut creek sidewalk over the weekend. 53-year-old hossein tabrizi, who is being held on a vehicular manslaughter charge, has three convictions already under his belt, including driving under the influence. court records show tabrizi was convicted of dwi in 2005 and of being drunk in public that same year. he was also convicted of petty theft in 2007. police say tabrizi drove on to the sidewalk on saturday, killing 52-year-old santa barbara woman and critically injuring the woman's 23-year-old daughter-in-law. nbc bay area's jodi hernandez talked with the victim's son, who has some harsh words for that driver. we'll tell you and bring you that emotional interview at 6:00. a public memorial for a chp officer killed in the line of duty will be held on thursday in vacaville. officer kenyon youngstrom was killed during a traffic stop on 680 last week. the mefrls will take place at the mission church at 10:00 a.m. in vacaville on thursday and is expected to be attended by law enforcement officers across the state. today his body was taken from the medical examiner's office to a funeral home. it was escorted by dozens of vehicles in a hero's procession. meanwhile, the fairfield community is continuing to raise funds in support of the fallen officer's family who lives nearby. a trampoline park named jump highway held a silent auction and donated all sunday's profits to youngstrom's wife and four kids. jump highway will continue to accept donations for youngstrom's family in the coming weeks. more bitter feelings surrounding that chevron refinery fire in richmond. today community groups were told about mistakes that were made by air quality officials in notifying the public about the dangerous pollution. all five agencies investigate last month's fire at the chevron refinery gave updates at today's meeting. a spokesperson for the quality management district says they initially reported that all air samples were below state exposure levels. it turns out, though, that one was above, but within the normal range of what they see in the bay area. the system is set up for everyday testing. >> it's not set up to measure emergency or incidents like the chevron fire. we are looking at increasing our monitoring capabilities not only around chevron, but around other refineries, making sure that we've got consistent level of monitoring. >> we're also looking at new technology. activist says more real-time information would help residents react quicker in the event of an emergency. federal inspectors are set to address the richmond city council tomorrow. a father and son are safe tonight after their single engine cessna crash landed into the ocean just off the coast of big sur yesterday afternoon. this is amazing footage of the rescue caught on camera by the u.s. coast guard crew that made that daring rescue. one of the pilots says it's only the second time he has taken part in that kind of downed aircraft rescue mission. lieutenant chris courtney says the crew was running out of fuel and had just three minutes to save the man in his 70s and his adult son. and that wasn't the only risk they were facing. >> just as we pulled him off the aircraft, it rolled over to the left and sank just thereafter. >> so had you been any later? >> had we been any later it's very possible that those two would have died last night. >> courtney also gives credit to the two men, who activated their high-tech distress beacon, which helped the coast guard locate them quickly. the two men were also wearing life jackets. as for the cause, the pilot says their engine stalled, causing them to crash into the ocean. one day before the painful anniversary, a new piece of september 11th memorial is being unveiled in napa. four glass panels will bear the names of the people killed during the attacks in 2001. they will ultimately be part of a larger memorial on main street in nap pal. that tribute will include a garden and a sculpture made from steel, recovered from the world trade center. meanwhile, across the country, in pennsylvania, the secretary of defense, leon panetta, is visiting the flight 93 memorial, the national memorial. park officials say they're still adding to the site, and will break ground on a visitor's center next spring. united flight 93 was flying from new jersey to san francisco when it was hijacked. passengers on board, fought back, forcing the hijackers to crash the plane in a rural field. many of the passengers were from the bay area or had family here. september 11th also a part of decision 2012. both president obama and mitt romney will suspend their campaigns tomorrow in honor of the 9/11 anniversary. tomorrow also marks eight weeks before election day, and the president now holds a five-point lead over governor romney in the latest gallup poll, a poll which some romney advisers are trying to downplay. nbc bay area's steve handelsman joins us from washington tonight. the race for the white house is contributing even more so in terms of gridlock in congress, correct? >> reporter: they've got their eye on election day, raj, and that's causing more gridlock here, you are correct. whether they're right or wrong, whether it's good for the country or not, politicians in both parties up here believe if it looks like they're compromising on the big issues facing congress now, it could cost their party a win on november 6th. lawmakers in the house and the senate are back after a month-long break with a pile of urgent business. but they're focused first on the elections. >> both parties are looking at public opinion polls, looking at which parts of their agenda are popular, and which part of the other side's are unpopular and dramatize those with floor votes that don't result in any bills. >> reporter: so democrats want a new vote on the paul ryan budget to drive home to voters that he would change medicare. republicans want the vote to phase out solar and wind power subsidies to drive home to voters that president obama lost a half billion on solyndra. a far bigger, the impasse over hiking taxes on the rich that have not settled could raise everyone's rates january 1st, and trigger huge defense in social service cuts. the fiscal cliff is getting put off until after election day. the farm bill will help with the drought is partially postponed because republicans are pushing for a cut in food stamps. >> the american people are asking to balance this budget. >> reporter: each side blames the other. >> for people that are outside and out of work, they're astonished by the fact that this congress won't do anything and seems content to kick the can down the road. >> reporter: so what might get passed before the election? merely one of those short-term stopgap spending bills to keep government going past september 30th. way before then, at the end of this week, house lawmakers will adjourn so they can go back home and run for reelection. live from capitol hill, i'm steve handelsman, nbc bay area news. >> steve, thank you. closer to home, a sharp decline in popularity for san francisco mayor ed lee. the chronicle reporting that ten months after his election victory, 49% of voters approve of the job he is doing that. is in sharp contrast to the 60% favorable rating he enjoyed last summer when he was still interim mayor and a new face to most voters. the power of wind. a new study out of stanford university says there is more than enough to power the world's electricity. r the clean energy study contradicts previous reports that say wind power wouldn't be feasible. according to this study, about four million turbines could provide half of the world's power demands without a significant negative effect on the climate. right now the world is only forecast, temperatures in the 60s and 70s by the noon hour. we'll talk about big-time warming in the seven-day forecast, coming up. . and it's the season opener for the oakland raiders. and there are some new things at the stadium this year, especially when it comes to stadium security. i'm arturo santiago. i'll have the latest details coming up in a live report. and the risks of marijuana. new information out today shows how smoking pot could double your risk for a certain type of cancer. in health matters, men who occasionally smoke marijuana may have an increased risk for testicular cancer. a new study from usc compared pot use between testicular cancer patients and a second group of healthy men. researchers found men who had a history of smoking pot were two times more likely to have types of testicular cancer that are more likely to be fatal. testicular cancer is the most common found of cancer diagnosed in young men. the study from the university of north carolina says that overweight teenagers actually consume fewer calories on average than their peers, but they still weigh more. this may be because obese children generally are less active and burn fewer calories teach day. these results suggest intervention programs should focus on healthy eating for younger children, while older kids should understand the importance of physical activity. parents who send their children to private schools are much less likely to immunize their kids than public school parents. an associated press analysis found the percentage of unvaccinated kids in california's private schools is more than twice that of public schools. the rate of children entering private schools without of their shots jumped by 10% last year. parents cite religious values among the reasons for not vaccinating. facebook is now a big part of a new nationwide strategy to prevent suicides. the new campaign is targeting teens and military veterans. the new facebook service will allow users to report suicidal comments they see online from friends. the site will then send potential victims an e-mail which will push them to call a hotline or talk to a counselor online. about 100 americans commit suicide each day. and another reminder to be careful about what you post on social networking sites. more and more colleges are looking at your profile. a new study by caplan shows 10% of colleges admit to using social media as part of their acceptance review. to keep your profile clean, be sure to limit the ability for others to tag you, and monitor photos that are uploaded by others. also, set accounts to private so only the people you want seeing your information can. are you ready for some football? new season, new coach, new security. the raiders kicking off their season on monday night football in just a couple of hours from now. but it's not all fun and games. there are serious concerns about safety and fan violence. let's bring in nbc bay area's arturo santiago who joins us from the coliseum with the raider nation this evening. it's always been an issue at the coliseum with security. what is happening this season, arturo? >> reporter: well, the party started as soon as the gates opened out here, raj. take a look behind me. you can see there is a sea of tailgating tents behind us. and right next to the tailgaters is the police force watching over them. even with all of that going on, the emphasis is on getting fans into the stadium early. they even have an early in and you may win contest going on, and it's all in the name of fan safety and security. >> yeah! >> reporter: it usually doesn't take much to get raider nation in an uproar. but throw in the fact it's the first game of the season, it's on monday night football, celebrity raider fan ice cube is performing during the pregame, and gene simmons of kiss is singing the national anthem, and you have a recipe for a wild night. >> i haven't heard how he is going to come out. but if he comes out in gear, i tell you something, this stadium is going to erupt out here. >> i love monday night football. ice cube is my favorite rapper. i love him. >> reporter: for some fans, this is the calm before at all the tailgating, but across the nfl and here at the coliseum, the push is to get fans into the stadium early. and as they enter, stadiums have installed magnetometers to make the process faster oakland. temperatures in the upper 60s and low 70s. right now this northwesterly wind from 10 to 20 miles per hour. that's really what helped to provide not only the sunshine, but numbers that warmed up 10 degrees from this past weekend. some of the hottest numbers, livermore at 90 degrees. south san jose at 88, and santa rosa at 88. we started to drop a little bit across the bay, but for this time of the year, very comfortable. 70 degrees in oakland. 70 in san francisco. and an incredible night expected back in the east bay with fog-free conditions. we'll take you out to live hd sky camera network. we do have the fog here in san francisco, but that marine layer is getting squashed by a lot of hotter air aloft. so it's not going to build up, at least too high over the next two to three hours. if you're headed to the raiders game or anywhere in san francisco. let's get you into the next 48 hours. we do have this weaker cold front passing on by. it's not going to mean any rainfall for us, just provide this cooler breeze over the next 24 hours. then as you head throughout the next 48 through 72 hours, on a wednesday, thursday, and friday, high pressure is going to build offshore, and that should give us a decent surge coming in that seven-day forecast with some of the hottest weather we've seen in quite some time. let's bring you into the morning hours. we'll find fog up here against the coastline with generally 50s and 60s. by the afternoon hours, 70s and 80s for the east and also for the south bay. as we head into wednesday, we'll be looking ahead towards that much hotter trend that looks to begin as we head into thursday and also friday's forecast. we will have some low clouds and fog for tomorrow, but it's not going to be too widespread or extensive. low clouds up into marine, also napa counties. and for the immediate coastline. then as we head throughout the afternoon, we're expecting a decent amount of clearing here for your tuesday. so looking
