Reporter terry, the ninth Circuit Court of appeals has asked for both sides to file legal briefs before the court makes its final decision. This after a federal judge halted the program friday. Legal analysts say the ninth Circuit Court is considered the most liberal court in the u. S. The u. S. Justice department is asking to pause the decision by u. S. District court judge james robart who suspended trumps executive order. As you know, that order barred citizens of seven muslim majority countries from entering the u. S. For 90 days. Legal experts we talked to say the burden of proof is now with the Justice Department. They have to show there is good reason to think that this order is constitutional. And they would also have to show that the states are not going to suffer irreparable harm while were awaiting a final decision by the trial court. Reporter attorney dean johnson says a threejudge panel from the ninth circuit will be selected randomly to make this decision. He says if that panel ends up being comprised of liberal judges and they uphold the judges decision, then the travel ban would be over. Since the Appeals Court rejected a request to immediately reinstate the travel ban, lawyers for Washington State and minnesota have until 3 59 a. M. Eastern time on monday to file legal papers. Castro valley and dublin beginning to see the rain from the northwest. A lot of the rain has been falling on the west side of the santa cruz mountains. Youre getting gusty winds in the santa clara valley. Were probably about two hours away from the strongest winds associated with this storm that we think later on along the coast by half moon bay, by 9 30. Now the stronger winds are beginning to shift into the tri valley and south bay. Tomorrow morning, not as gusty as what were about to see tonight. The intense rain associated with storm one, 6 00 p. M. , 8 30 to 11 00. As we head towards tomorrow mornings commute, looking at some rain at times. So once we get past thursday, scattered showers continue into friday.
