You spoke to sierra lamars mother marlene shortly after that verdict was handed down. Reporter right. Good morning to you, sam and laura. The interesting contrast today was the speed with which this jury reached that guilty verdict and the months of time that this case spent in courtrooms and the five long years since sierra lamar disappeared on her way to that bus stop back in 2012. When i talked with Marlene Lamar about half an hour ago as she was leaving the courthouse to go home, i heard in her voice the same emotion that i heard five years ago had she was talking about her daughter having disappeared. Pretty much we had to relive this nightmare. It was pretty bad. It was actually more detailed and difficult to hear in the details. It was horrific to hear it. Reporter i remember the day they had to play your 911 call and i felt like i was going to cry with you. Yeah. That just helped me realize that the pain the angst is still there. Reporter this never goes away. Ive not lost a child, but i can only imagine that your family is never going to be the same. Never be the same, but it does end a chapter that has been long. Its been a long journey, and it gifts some finality having justice. Reporter im thinking of your other daughter, sierras sister and she can grow up. She will never be able to move on. She suffers. Every day, every minute. Theres reminders everywhere of sierra. Its been a hardship for us. Reporter i think i heard you tell somebody earlier that you didnt want to comment on whether it would be a Death Penalty or life sentence, and we want to respect that, but do you feel some relief . Yes. I feel that the process works, and this is just the beginning to make sure that somebody dangerous is not going to be released and harm another child. Reporter many of the searchers who looked for sierra lamar for years after she disappeared in 2012, they were here. They filed into the courthouse about two hours early to be here to hear that verdict for themselves in person. Also, to lend support to this slam hear family. Marc klaas of the Polly Klaas Foundation was also here. He had a message for antolin garciatorres who was found guilty. Wont say that on tv, but you can look on my twitter feed to find out what he had to say. Coming up in the next half hour, i have Marlene Lamar, talking about the importance of serving on a jury and has a message for any one of us who get one of the jury sumons and the impact that it has for family. Thank you very much, kris. That jury that youre speaking of, six men and six women decided the fate of antolin garciatorres. It was very emotional inside that courtroom. Cameras were not allowed inside when that guilty verdict came down. But nbc bay areas bob redell was there and saw it firsthand. As we get also our first glimpse of the artist renderings just coming in from this mornings verdict, bob. What was it like . Good morning, laura. The best way to describe the courtroom in the moments before the verdicts were read is still, quiet and tense. Supporters of sierra lamars family lined up here outside the hall of justice in downtown san jose at around 7 00 this morning. A full two hours before the verdicts were read at 9 00. The new courtroom sketches give you a slight sense of what the atmosphere was like in department 40. The gallery was full. All 66 seats taken. Antolin garciatorres family sat in the front row on the left side of the courtroom. Before court started garciatorres turned towards his family, his eyes lit up and he gave them a nod. On the right side of the courtroom District Attorney jeff rosen and his colleagues in the front row, sierra lamars father, mother and sister in the second row. At one point steve lamar passeded a box of tissues back to all the supporters behind him. The majority of the galbury were part of team sierra, people who have been searching for her since she disappeared five years ago and then also members of the media. There was extra security inside the courtroom. Six bailiff deputies instead of the usual two to three including one who stood behind garciatorres seat the entire time. When the court read the jury, the unanimously found garciatorres guilty in her murder and kidnapping, a male member of garciatorres family nodded his head apparently in disagreement while the other side of the courtroom, the side supporting sierra gasped and broke into tears and at that point the judge admonished them to maintain order and heres one of sierras friends after this mornings guilty verdict. I mean, yes, it is like a weight lifted off of our shoulders and all we want to know is where is she, honestly . Reporter we did try to speak to antolin garciatorres family as they left the courthouse with security this morning. They remained silent as they got into a car that had been waiting for him. His defense team also refused to make any comment, especially when we asked if they had planned to appeal this mornings verdict. They are not allowed to speak, not until the penalty phase, next tuesday at 10 00 a. M. Lets bring in legal analyst dean johnson for more insight on the case. Dean has been here with us since this morning. Youve been here a long time. A verdict came in very quickly. What the does that mean moving forward into the penalty phase . Thats really bad news for the defendant, because when a verdict comes back this quickly the jury is in a way sending a message. They are saying that we dont have any doubt, and one factor thats considered in the penalty phase is there some lingering doubt about guilt . This jury was quite sure of what it was doing and what it was saying, and this jury has now found that garciatorres is a serial killer. Right now i would say unless something changes hes looking at a Death Penalty verdicting. If something changes, theres something that could wipe away the Death Penalty. The bargaining table is always there, and its not uncommon for prosecutors to sit down and say, look, well take the Death Penalty off the table. Just tell us where sierra is and give this family a little more closure. Not to say that they will do that, but they certainly could. Assuming that theres not a deal and they move forward on tuesday, can you talk about the power of victim impact during this process. Oh, its extraordinary. The victim the victims family now becomes witnesses, and they get to look this man in the eye and tell him and the jury how this has impacted them. Its one of the most powerful things that happens in the american judiciary. I have been there. Ive heard that, and there have been times, for instance, in the Scott Peterson case, when most of the people whole were there couldnt speak for the next 10 or 20 minutes after hearing the family testify about what this had done to them. Because as youve mentioned that case right there, you hear the mother in and wish describing, these five years of horror that shes gone through and still not knowing where her daughter is. Exactly, and you hear that same emotion in the voice of mrs. Lamar, and im sure shes not going to have a hard time expressing that to the jury. No doubt. Do you think that theres a chance that there could be cameras in the courtroom for the victim impact . Certainly a possibility. Already in the jim eats discretion. We had cameras in the courtroom for part of the peterson penalty phase, and im a strong believer in the First Amendment. I believe the trials should be public and the people should hear and see what goes on in these cases. Thanks very much, dean johnson, for giving us this legal insight this morning. The mother, when she asked marlene if she wants the Death Penalty, she had no comment, and friends of sierra lamar saying its a good feeling to know that the Justice System works. Marianne favro, as you know, theres no cameras allowed into the courtroom and shes tweeting pictures by the sketch artist. She spoke to the family oneonone and spoke to Marlene Lamar saying nothing will take away the sorrow well feel the rest of our lives. Steve lamar saying its bittersweet, we dont have sierra. The defense left without commenting. They are now getting ready for the penalty phase of this trial, and as kris sanchez mentioned, polly klaas, the daughter who was kill, she was 12 years old back in 1993, her father marc klaas was in the courtroom and has supported the lamar family. She went missing in 2012 on the way to a bus stop in morgan hill when she was just 15 years old. Her body was never found. We now move immediately into the next phase, the penalty phase, where the jury will decide whether the defendant gets the Death Penalty or life without the possibility of parole. Along the coast you wont notice much of a different. Heres a look at some of the temperatures now in the trivalley. Starting to warm up and were at 70 degrees and 72 degrees in the south bay and looking at the peninsula camera from pacifica. Its 69 degrees. 67 degrees now in San Francisco. Almost rat the high temperature, and you can see the high thin cloud over the north bay. It is 72 degrees. Were going to see the high temperatures in the south bay reaching 84 degrees in los gatos and milipitas up to 82 degrees. For the east bay its also going to be very warm for spots like antioch and concord. Youve got the air conditioner on, but in oakland not too bad. Its going to be 78 degrees today. For the peninsula, Half Moon Bay 64 degrees and 880 in belmont and in San Francisco 68 degrees on the embarcadero. 84 in novato, and santa rosa will see a high today of 85 degrees. As we take a live look outside at san jose and the temperature for santa clara, well be in the low 70s and then going to continue to see the temperatures rising into the low 80s. Eventually peaking at about 821 degrees and quickly starting to cool down once again later on this evening once the ocean breeze kicks in. And for the a eades later tonight at the coliseum at 7 05, well be at 63 degrees and definitely a night to once again have to put on the long sleeves and some extra layers as our temperatures dip back into the mid50s with clear skies. We see all the clear skies along the coast now, but heres the fog and our marine layer just offshore. That will be moving back in as we go into tomorrow, and then we see this large swirl of clouds well offshore and the cold front that will be here as we go into the next couple of days, so some changes in the forecast after some fairly warm temperatures today. There will be a chance of rain in the forecast on thursday, and thats mostly for the north bay. This system will kind of fizzle out before it gets into the bay area and then well have some better chances of rain in the forecast for the beginning of next week. Well be watching that and also ninetuning those changes. Temperaturewise in San Francisco. Were up to 68 degrees. 61 degrees on wednesday and then it continues to cool off with highs only in the upper 50s to lower 60s. Our chance of rain once again back in the forecast early next week. It will see huge changes for the inland area as well. We go from 83 degrees inland to 75 tomorrow, and then by the weekend well only see the high temperatures in the upper 60s with some gusty winds, and well be seeing those showers moving into the bay area by monday. A lot of folks in marin county say that they are in shock following the arrest of the countys deputy chief coroner on sexual abuse charges. 46yearold Darrell Harris was arrested last week. Thats when San Rafael Police asked Santa Rosa Police to take over the case against harris. Hes accused of committing offenses that range from continued sexual abuse to lewd acts involving an underaged girl in marin over the covers several years. Harris appeared in Marin County Court yesterday. Investigators are handling this case carefully because harris knows so many people in marin county law enforcement. They relate to sexual assaultrelated charges that span over eight years. Ive spoken to a lot of people here in this system. As you know, mr. Harris is very well known in the civic center. The unanimous reaction is shock, and no one believes it to be true. Reality is sinking in now. Harris is being held without bail. Ntsb investigators are asking what went wrong in a Small Plane Crash in the north bay . Two people on board were killed. The a5 amphibious aircraft built by a Company Called icon crashed yesterday near berryessa lake. Jon murray karkow and cagri sever were victims. Its a devastating event for the company today. I guess the next question here is whats next for the defense here, dean . Well, of course, the defense faces an uphill battle. When we try the guilt phase, thats the act thats being tried. In the penalty phase its the man thats being tried, and the secret to winning in the penalty phase, find one good saving grace about your client, about your defendant. Find one selfless act that hes performed. Oftentimes that sort of thing will stick in the minds of the jury and that will save your clients life. Do they have to come up with that and present it to them and try to convince them, i guess, to have a little mercy . Thats exactly the point here, saying that even though this man has done something thats consummate evil, theres something in there, theres still a soul in there thats worth saving. Thats thats the trick to winning at the penalty phase. The prosecution, as you mentioned, chose to use these three accusations of kidnapping which he was then convicted of as part of this case. Does that strengthen the likelihood that hell be found guilty for the Death Penalty . Absolutely, because one of the questions the jury has to consider is future dangerousness. They have found beyond a reasonable doubt that this man is a serial offender, somebody who plots and plans his actions before he actually goes forward. They are going to say this man is very, very dangerous and he never should get out. Whether that translates into life without possibility of parole or a Death Penalty, well see. Even if he gets the Death Penalty though because of the appeals process, it can go on for so long. The most frequent cause of death on death row, old age. These cases take decades and decades. Haul coming as the coroner was trying to find the body from the location where her truck was discovered last month. Investigators could identify that body as early as today. Anything less than a melee, Spirit Airlines cancelled a flight in florida and it leads to chaos. Take a look. This brawl breaking out at the Fort Lauderdale airport last night after passengers were yanked off their flight because there was no pilot on the plane to fly the plane. Police intercepts which led to mayhem and three people wound up getting arrested. Laura crane had a unique situation joining 24hour fitness in walnut creek and her employer started paying her dues as a perk which was great until she decided to leave the gym. Cancelling her membership required a 170 early termination fee. Heres why. When her Company Started paying her dues, she says the gym created a new account for her. Her original account was just frozen which meant cancelling it triggered a 170 penalty. Lauren argued the club never should have created a new account in the first place but she couldnt get anywhere so she reached out to us. We contacted 24hour fitness and it dropped the 110 fee. The company didnt explain why it created a new membership but said it cares deeply about its members and providing them with an Excellent Customer Service experience is its main goal. Youll get out there and enjoy a nice little long walk, and then for the evening, after the sun sets, well be in the upper 60s, and looking live at lake tahoe from our heavenly camera so nice to see all that have snow, but it will be melting. Its been melting at a rate of 9 inches. More of the warm weather in the sierra reaching 69 degrees on wednesday, and then hon thursday with mostly sunny skies up to 64 degrees, and for the mothers day weekend for the coast, bay and inland areas expect it to be in the 60s as you go ahead and make plans for mothers day. Its going to be a little bit cooler than what youre feeling right now. Looking at that temperature trend, were going to go from the upper 60s in San Francisco today to the lower 60s in time for the weekend. There will be a slight chance of rain in the forecast during next monday in the afternoon and until then it looks to stay pretty dry and we do have a chance for some showers on the north bay on thursday as high temperatures reach the low 70s. It will be windy on friday and that leads us into the weekend with some cooler air and upper 60s which is not bad but at times you may need the jacket or long sleeves especially if youre out early in the morning or late in the evening.
