The Republican Senate majority leader just reiterated that its a nogo for president Obamas Supreme Court nominee, even though federal judge Merrick Garland is a nominee republicans have voted for before. Senator Mitch Mcconnell is holding his stance it should be up to the next president to fill the vacancy left by justice antonin skacalia. President obama reiterated the senate just give him a fair hearing and up or down vote. Garland is 63 years old and like the president from chicago. He is currently the chief judge for the u. S. Court of appeals for the district of columbia circuit. The Senate Confirmed him to that circuit back in 1997 with a vote of 7623 with 30 republican senators supporting him. Prior to that he was a federal prosecutor who oversaw the unabomber and Oklahoma City bombing trials. His experience in places like Oklahoma City informs his view that the law is more than an intellectual exercise. He understands the way law affects the daily reality of peoples lives in a big, complicated democracy and in rapidly changing times. And throughout his jurisprudence runs a common thread, a dedication to protecting the basic rights of every american. Trust that justice will be done in our courts without prejudice or partisanship is what in a large part distinguishes this country from others. People must be confident that a judges decisions are determined by the law and only the law. For a judge to be worthy of such trust, he or she must be faithful to the constitution and to those statutes passed by the congress. He or she must put aside his personal views or preferences and follow the law, not make it. Reporter we reached out to Nora Freeman Engstrom who clerked for the judge and said chief judge Merrick Garland is brilliant, fair, and impartial. He also has an abiding faith in law and how law can better the lives of americans. With Merrick Garland on the Supreme Court, our country would be a fairer, more just, more tolerant place. This nomination is so controversial because the court is evenly split with four liberals and four conservatives. Senate republicans are refusing a hearing for garland citing comments Vice President joe biden made 25 years ago when he was head of the Senate JudiciaryCommittee Regarding the nomination of a Supreme Court justice during an election year. President obama and his allies may now try to pretend this disagreement is about a person. But as i just noted, his own Vice President made it clear its not. The biden rule reminds us that the decision the senate announced weeks ago remains about a principle and not a person. This just in. Chp officers say they have arrested the car thief who hit a 6yearold boy and then drove away. 29yearold Daniel Morris of Castro Valley now behind bars. Investigators believe that he was driving the car that struck that boy while he was walking with his grandmother last week. The boys injuries were so bad that he might lose his leg. Officers say that the car morris was allegedly driving was one of five stolen from the livermore dealership. The chp is planning to release more information at a 2 00 News Conference today and our Elise Kirschner is going to that press conference and will bring us the very latest at 5 00 and 6 00. The search continues for at least two gunmen after two shootings in berkeley and they happened less than 24 hours apart. Police wrapped up the very latest on that scene just a couple of hours ago only a block away from the ashby b. A. R. T. Station. Stephanie chuang is live there now. Steph, this was not a random attack and now theres talk of possible patrol changes. Reporter yeah, this is very preliminary but Berkeley Police say the numbers and the trends are troubling. All of last year you had 13 shootings in berkeley. This year were just at midmarch, nine already, and this the latest. You see the broken glass here in south berkeley. This is bringing questions as to who these people are and what led up to this but its enough to unnerve the people who live around here. Berkeley investigators believe the young man and woman were sitting in this white sedan when at least one gunman targeted them. Neighbor tony hill lives about 100 feet from that double shooting and said he was woken up by the sound of five or six gunshots. Thats when he saw the victim. He was pretty young. He had been shot. He managed to limp his way up to the house across the street and then lie down, but he was clearly not in good shape. Reporter police spent several hours trying to learn as much as they could in the dark canvassing the crime scene. Marking nearly a dozen places they found evidence, mostly bullet casings. Finally with daylight, crime scene investigators dug deeper, scouring the car for more evidence. Bagging things like this orange purse and what appears to be a black cable. On the windshield itself, lyft and uber stickers. The victims connection to the companies is unclear. My gosh, thats pretty scary. It seems so quiet around here, but we are close to b. A. R. T. And this place can be pretty dark at night. Reporter as Police Continue to search for the gunman, they are also looking for the gunmen in a different shooting near san pablo avenue and delaware street. That forced one neighborhood into a shelter in place for several hours. Its uncharacteristic of berkeley to have two shootings in such close proximity. Of course were going to look at the information and see if its going to change what strategies were going to use to approach deployment of our officers. Reporter neighbors are also considering changes for themselves, including different routes to and from home. I never expected Something Like that to happen here. Reporter now, police dont believe that yesterdays and todays shootings are connected. We do know that the three victims are at last check in critical condition. As for lyft and uber, the Companies Say they were not contacted by police or the possible driver but are actively reaching out to the people involved to see what they can do to help. To mark this anniversary, many of the people who looked for sierra lamar then will try again this weekend to bring her home. On saturday they will search the area of eastman canyon road in morgan hill. They still hope that sierra lamar will come home alive but Police Believe the teenager was kidnapped and killed by this man. Garciatorrez was indicted by a regular grand jury after police found dna evidence in his car. His capital murder trial is scheduled to begin next month. We now know what a man accused of flashing a 13yearold girl in palo alto might look like. Heres the sketch that police put out based on the victims description. The 13yearold told police that the man exposed himself monday night in the professorville neighborhood. Police admit they have recently heard several reports of people being approached on the streets, but neighbors say they feel pretty safe in this area. I mean my kids walk the dog by themselves and we feel pretty comfortable and safe here. One time i fell off my bicycle and someone who was driving by just on the other side of this road pulled over and helped me. I feel like its that kind of neighborhood. Police are asking neighbors to give them a call if they see anyone who looks like this man or see anything else that is suspicious. An east bay freeway continues to be the site of gun violence and roadside shootings. Shots fired again on interstate 80 and it has some drivers on edge. This time it happened yesterday about 5 15 in the afternoon or early evening on i80 near richmond parkway. The chp says that a woman was driving eastbound when a green toyota pulled up right next to her. Our nbc chopper flew over that area last night, did not see any signs of police activity. The victim says the shooter rolled down his window, pointed a gun into the air after point it at her first and fired multiple shots. The green toyota then took off. At least seven other shootings have happened on i80 since november. Sheriff lori smith is laying out a new 13step plan to make sweeping changes to santa clara countys troubled jail system. Smith represented her recommendation yesterday and today shell talk about the board of supervisors. Those come in the wake of last years death of an inmate who had mental illness. Three guards are now facing charges in his murder. The proposed changes include boosting access to medical care, providing new outside oversight and the appointment of a civilian board. An american tourist is sentenced to 15 years of hard labor in a north korean prison. The 21yearold university of virginia undergrad allegedly attempted to steal what the government is calling a propaganda banner from a restricted area of his hotel. He was convicted and sentenced in a onehour trial this morning and charged with subversion. No further details were immediately available. He was arrested in early january as he was trying to leave the country after visiting as a tourist with a new years tour group. A crackdown for people driving without the proper license or steering an illegal rig. It is an issue that puts all drivers in danger. Jodi hernandez is in richmond with an exclusive look at that operation. Jodi . Officers had their eye on every commercial Truck Driving down richmond parkway earlier today. Theyre zeroing in on dangerous rigs. Youll have cracked frames, bald tires, lows that arent properly loaded. Reporter thats what Richmond Police and chp officers are looking for. Youre dealing with a lot of inertia, and the regular occupants wont have a chance. Reporter earlier this month a big rig lost its container in richmond. And last month a motorcycle rider died after a collision with a dump truck. He had a rake that was protruding out from the back more than four feet. Reporter we watched as officers pulled over truck after truck today, finding everything from cracked windshields to overweight loads. Police say these cars werent tied down properly. They have to have four straps for each individual car and he only had a total of three straps altogether. Obviously very dangerous. Reporter and this truck had a slew of problems. Not only did the driver run a red light, he didnt even have a commercial license to drive the truck. Im not a driver, im a laborer. Reporter today youre driving . Yeah, i just well, all the other laborers were busy so they had me drive. Reporter you got caught. Yeah, i guess so. Reporter that truck got impounded. Officers hope their crackdown will convince drivers to shape up or face the consequences. In richmond, Jodi Hernandez, nbc bay area news. All right. Thats got to be a heavy ticket for that driver. Im wondering how much money that will set him back. Well, it is time to look at the forecast and what a day for it. Its beautiful out there. It is beautiful and hopefully youre enjoying it, having a chance to get outside and take in some sunshine because we had all of those clouds and the rain over the weekend. Now take a look at this view from mt. Tam. One of those spots got quite a bit of rain and now were getting a chance to dry out. Now the temperatures at 58 degrees in San Francisco, 59 in the peninsula, in the north bay, and 63 degrees in the east bay. We have even warmer temperatures. Check out pleasanton now at 71 degrees. So some spots warming up a lot more quickly than others. In livermore its 62 degrees and we also see some 60s widespread across the east bay. Going hour by hour in palo alto, well be up to 70 degrees as we go into the middle of the afternoon. Well be at 69 during the evening commute, in the upper 60s with mostly sunny skies and then as the sun sets, our skies stay clear and well see those lows dropping back into the 50s, eventually down into the 40s. Today in san jose were up to 72 degrees. 72 in palo alto. The embarcadero at 69 degrees. 68 in napa. Oakland 72 and livermore today will be seeing those highs in the upper 60s to lower 70s. We will stay above average. This is a look at the south bay. And the average high for this time of year, here we are in the middle of march. We should be at 67 degrees. Look at where were heading today, up to 74 degrees, the warmest day of the week will be tomorrow, 76 degrees, and then back down to 74 degrees on friday, which is still above average. Even this weekend as we get a few more clouds moving in, it will still be warmer than where we should be for the end of march. As we go into the next several days, we still will have this High Pressure that is keeping the storm systems and all of that rain farther to the north, but then there will be a slow shift in that pattern as we go into the end of the weekend. Until then well have that ridge blocking any chance of rain well have and also some mostly clear skies with some warming temperatures. So spring officially begins on saturday at 9 30 in the evening. Hard to believe, but yes well, its not that hard to believe when you go outside because our temperatures are in the 70s and we will still have those 70s heading into saturday as well as sunday. One of its advantages, convenience. I used it to talk to my friends, went to study abroad. You text your dude and then your boyfriend doesnt know about it or girlfriend. Reporter everything you type is instantly encrypted and is not decrypted or made readable again until the person on the receiving end opens it up. That means facebook, the company that owns it, cannot read those messages while theyre being sent or afterward. It means when police come with a court order to tap into the messages, they cannot respond by decoding them. The fbi has been calling that part of the going dark problem, and now president obama is adding his voice. That i think does not strike the kind of balance that we have lived with for 200, 300 years. Meantime our nbc wall street journal poll, the latest one, found that more americans than not think that there should be a vote this year and most, 55 , say that they would be disappointed if republicans tried to block it. During statewide elections in 2014, only 4 of the voters were between the ages of 18 and 24. 4 . A carjacking suspect now stopped in his tracks after a terrifying ordeal for a south bay woman. The suspect was trying to take off. The two kids were yelling and saying, you know, stop. He just stole my moms car is what they were saying. Reporter that man taking off was carjacking suspect, john lamb. Police say he stole a work van parked on South Willard in san jose last night. One worker was inside who pleaded with lamb to let her out but was ignored. Translator i didnt know what was happening, i was really scared. Reporter the worker eventually jumped out safely when the van slowed down. Police say lamb kept going before crashing that van right across the street from the coffee shop, where perales was attending the meeting. The two kids chased the suspect down. The former san jose Police Officer says while this picture shows him pinning down the suspect before police arrived, the kids deserve a lot of credit. My part was just at the very end. I was able to come in, help out, help restrain and calm the situation. Took that oath to serve and protect. That suspect had reported injuries considered to be nonlifethreatening. Hes booked on three felony counts and that includes the charge of kidnapping. A homeless man is also being rewarded for doing the right thing, for helping to catch three wanted prison escapees. A San Francisco homeless man will get the bulk of that 150,000 reward up for grabs. Hes going to get 100,000. Matthew h. Chapman recognized two inmates and followed them into a Mcdonalds Restaurant in San Francisco back in january. The 55yearold then flagged down some Police Officers. Three convicted felons escaped from a santa ana prison in Southern California and fled up here to the bay area. One inmate drove back to Orange County and turned himself in but the other two are behind bars because of that man. 11 36 right now. An east bay city has a new plan to help out the homeless. San leandros mayor has brokered the san leandro homeless compact. It promises to make 25 Housing Units available for the chronically homeless. That brings together the rental Housing Association and a local nonprofit called building futures, which is women and children. 49 Homeless People in san jose will have new homes of their own by the end of the year. The City Council Approved turning the plaza hotel in downtown san jose into housing for the homeless. Those plans are also in the works to turn the santa clara inn into another Homeless Hotel as well. Not everyone made money when super bowl 50 came to the bay area, so now San Francisco supervisor aaron peskin wants to help out local businesses that were hardhit during two weeks of street closures. That includes street vendors. Todays finance committee will consider his plan. City leaders have not announced the amount of tax revenues that were generated from so many super bowl visitors, though. B. A. R. T. Now getting the green light for the expansion into the south bay. The federal Transit Administration has now approved the second leg of b. A. R. T. s planned extension to sng. That means phase two can move to the development phase, even though the funding has not yet been fully worked out. That second leg would extend to santa clara. B. A. R. T. s first extension to berryessa is ahead of schedule. Decades before google moved into mountain view, redwood trees were rooted all over. Now the tech giant wants to cut them down. Specifically the company submitted a plan for a new campus near its current headquarters. Theyre asking to chop down more than 100 redwood trees. Google claims they have become damaged by the drought. Many neighbors disagree with that notion. Leave some of the trees and compromise. In the end there will be more vegetation in general on the site. The city council has not approved the plan yet but says google would be required to replant trees native to mountain view. The final decision will be made later this month. Siding with their fourlegged friends, San Francisco leaders are fighting a plan to cut down on dog friendly areas. Supervisors yesterday voted 101 to oppose plans now in the works boy the National Park service to limit dog access in all Golden Gate NationalRecreation Area locations. That would include ocean beach, crissy field, lands end and port funston. This morning in deweyville, texas, many are waking up to catastrophic damage after floodwaters overnight, hundreds of homes in one town are water logged. 1200 people ordered to evacuate. One family tried to save their home and was lucky to walk away with their cat. Water destroyed everything . Oh, yeah. Reporter homes along highway 112 have been swamped with up to eight feet of water. Churches here for decades will need prayers for their own salvation. Even the only Grocery Store in town has seen historic flooding. The cemetery is nearly all under water. The top of headstones barely visible. The center of town in deweyville appears to have the most damage, but water is everywhere. Its reaching homes even miles away. Authorities know not everyone has evacuated. This water, they say, is dangerous in more ways than one. Definitely. Its got contaminants in it from the ground and from all these oils and sewers and all that. Reporter with many waking up in shelters and others fishing in the street, in the coming days the water here will slowly recede. But as it does, it promises to reveal a town thats lost so much and may never be the same. Its so hard to see those little kids waking up on a cot. Also the fish, wouldnt touch that. Our biggest complaint has been that its cold outside but thats about all and thats only in the morning, kari. Yeah, that definitely puts things into perspective and you dont want to complain about it being cold here when its in the 40s to start out the day. Were warming it up now to 58 degrees in the east bay, 59 in the peninsula and highs reaching into the upper 60s in San Francisco, the east bay and the peninsula. The south bay today up to 74 degrees. Well also see 74 in the north bay. Looking hour by hour in livermore, well be at 66 degrees at 1 00 and then making it into the low 70s today. That sevenday forecast at the bottom of the screen, you see that we will have more 70s over the next several days and then it will be mostly clear tonight in livermore. At 9 00 were at 56 degrees as you take the dog out one last time. Into the sierra, weve had a lot of snow over the weekend. Weve really increased these numbers at squaw valley. At the summit, we are at 164 inches of snow, at the base 70 inches. Then when you look at these temperatures, quite a bit of that snow will be melting over the next few days, unfortunately. Well have some warm temperatures here too. Once again keeping in mind in the south bay, the average High Temperature is 67 degrees. Were up to 76 degrees on thursday and on friday, 74 degrees. Some more 60s and 70s for the peninsula. San francisco up to 69 degrees on tomorrow. More clouds in the mix on friday. That will bring our temperatures down in a few spots, but still staying dry with High Temperatures in the low 70s. This is the way it looks as we go through today with widespread 70s for those inland areas, 60s along the immediate coast. Then well start to see more 70s tomorrow once again. As that High Pressure builds, well have more of this warm weather and a lot of rain staying well to the north. Some 60s around San Francisco and more widespread 60s as we get a bit of a change in that pattern with more clouds mixing in. So this weekend as you go ahead and make some plans, well be at 69 degrees in the north bay on saturday. On sunday 64 degrees and San Francisco will be in the mid60s. The peninsula looking at 70s there, overall very nice. And we wont see any rain in the forecast until monday, and even now it looks like a lot of computer models backing off on that chase of rain. We may continue on with dry weather here in the bay area but at least well get a cooldown for the next of next week. Up next at 11 00, many Homeless People are untiebl go to shelters because their pets cant go with them. Ive been calling it my pet project for a year. The project happening in the south bay meant to change that. It is a story to make you bay area proud. Lonely, dangerous w of life. Or b living on the streets can be a lonely, dangerous way of life. For many Homeless People, keeping a pet can feel like a life saver. But at the same time the animal can be a barrier to getting some critical services. One south bay shelter has come up with a creative solution. Garvin thomas joins us now with this mornings bay area proud. Reporter with the exception of service and companion animals, dogs are not allowed in homeless shelters for obvious reasons. All those animals in the dormitories could be a recipe for disaster. So home first decided to give them their own place to sleep with a little help from the neighbors. 4monthold gummy has good reason to be a happy puppy. Not all that long ago his owner gave him his first forever home. He actually went through a couple different owners before he found his way back to me. Reporter what neither of them knew at the time, though, was that james would soon be losing that home without money for another. When we found ourselves out on the street for a couple of days, he really got me through it. Reporter so like many homeless pet owners, james and gunny faced a dilemma. Shelters, not an option for those with pets, and parting with the dog, well, thats not an option either. This is what really keeps me going. Reporter lucky for the pair, then, a plan had been in the works at Home First Boccardo Reception Center in san jose, thanks to ceo and dog lover, andrea urdin. Im really excited about that. Ive been calling it my pet project for a year. Reporter all andrea needed to carry itcxlo out was a gener donation of supplies and labor which came courtesy of the staff at the home depot across the street. Volunteers spent an entire day turning an outdoor patio at this shelter for humans into one for their animals. Half a dozen kennels were assembled and secured. A patch of ground nearby cleared out for them as well. Now, how am i going to get out . Reporter steven vogel led the team of volunteers. We can give back to two different classes, helping out both people and animals in their times of need. It looks beautiful. Reporter this does more than just allow pet owners and their animals a temporary roof over their heads. By giving the homeless a safe, secure place to leave their animals during the day, it frees them up to pursue the jobs and services that may hopefully one day lead to something more permanent. A forever home, if you will, for more than just gunny. Staff at the shelter estimate that the materials alone that home depot donated were worth about 3,000. Garvin thomas, nbc bay area news. And go out and get a job so you can have a forever home. Well be right back. San jose teen and olpia Polina Edmunds is ready forenex championships. San jose teen and olympian Helena Edmonds is ready for her next championship. She represented team usa at the 2014 Olympic Games in sochi. Edmonds says the experience definitely made her a better skater. Just competing on such a huge stage with so many amazing skaters. Ive really learned how to feed off of their energy and just stay in the moment, and so the worlds are easier than the olympics. The World Championships begin march 28th. Edmonds also has another big life event to prepare for. Believe it or not, shes headed for college. Shes received some acceptance letters but would not reveal which school she is going to choose, though we did try very hard to get her to spill the beans. She says she does hope to stay in the bay area so we can narrow it down just a little bit. Isnt that amazing that she could be that accomplished in her life and shes still in high school. And we met her before the olympics. I got to meet her and my little girls got to meet her too. Shes just the sweetest thing. Its so funny to see her all grown up. Shes very graceful, beautiful and obviously very talented. Not exactly ice skating weather right now, but its very nice. It is very nice. Well have some sunshine, highs today in the low 70s.
