Prosecutors requested a protective order, which is essentially a restraining order to stay 100 yards away from the victim. The judge did grant that. Two grad students happened to pass by the alleged attack january 18th outside a fraternity house. They chased after him as turner fled tackled him, and held him until police arrived. The Deputy District Attorney for the Sex Crimes Unit says that this case is unique and called the two men who stopped the assault heroes. These types of sexual assaults happen on campuses at parties all across the country. Sadly, they often go unreported or worse were not able to proceed on these cases. Luckily for the victim in this case, there were two Good Samaritans who were at the right place at the right time and more importantly they did the right thing. And thats the message that needs to be sent to the community. Dont just stand by if you see something inappropriate. If you see something, say something. Reporter neither turner nor his attorney spoke to reporters afterwards but in a report by the Santa Clara County Sheriffs Office turner admits to sexually fondling the woman but denies raping her. In fact he says he had his pants on. Now, in that same report the woman and turner both admitted to deputies that they both were heavily drinking that night. Turner is out on bail 150,000 bail. We start with Cyber Attacks and the damage they can cause us especially here in Silicon Valley. Our chief Investigative Reporter joins us. This is far beyond the recent attacks on Companies Like target and home depot. Good morning, kris. Its a concern that hits home here in Silicon Valley and echoes around the globe. Were talking about threats to our transportation centers, our nuclear and electric power supplies, our chemical plants and our water supplies. Theyre all controlled by computers. All at risk to attacks from anywhere on the globe. Hackers broke into the computers at sony entertainment. The concern over Cyber Security has made headlines. No foreign nation no hacker should be able to shut down our networks. And its made its way into this years state of the union address. So were making sure our government intergrates intelligence. To the ability to hack into Computer Systems that control our vital infrastructure. Youre looking at a 2007 gamechanging government test. Video provided to cnn by the government. The department of Homeland Security used keyboards and computers as weapons. It caused this generator inside an electric power plant to selfdestruct selfdestruct. It ultimately proved and demonstrated on video that you can destroy physical equipment with a cyber attack. Perry peterson worked for the department of Homeland Security. He helped design what is now known as project aurora. His resume also includes time at department of defense and the Nuclear Regulatory commission. Hes an expert on Cyber Security and the risks to our countrys Critical Infrastructure. Its those systems that if we lose them its going to have a serious impact on our way of life. And thats part of why many question the governments recent decision to release these documents. What that did is it now put all of that information in the hands of the bad guys who never had it. Joe weiss specializes in control systems security. His concern centers on what he and others believe is a mistake by the government to release details of the aurora project. Nearly 1,000 pages of previously classified documents including potential targets here in the bay area. This is a road map for a bad guy. And this is what dhs put out. Our investigation is drawing attention to the governments decision and intentionally not including specific details in those documents. Dhs has defended the decision in an email saying quote, the documents were reviewed for sensitive and classified information prior to their release to ensure Critical Infrastructure security would not be compromised. Weiss has testified on capitol hill about his tracking of a growing number of cyber events targeting Critical Infrastructure overseas and on u. S. Soil. Ive been able to document almost 400 actual incidents. And while most of the recent headlines in the United States have focused on the successful cyber breach of sony experts point to serious concerns from two other incidents just in december. Hackers successfully accessed Computer Systems at a Nuclear Power plant in korea and a steel mill in germany. Some people worry about were on the brink of a cyber arms race. I would say, no, were not on the brink of it. Were in the thick of it. Were in it. The successful Cyber Attacks of sony target and home depot have certainly resonated with lawmakers here in washington, d. C. On capitol hill. But so far, significant change to Cyber Security has run into a bit of a government roadblock with lawmakers struggling to understand how much change private industry and the American People are willing to accept. This lends itself to this kind of environment where were all waiting for something to happen and then well get serious. This is a matter that we should be very concerned about. This congresswoman represents Silicon Valley and the south bay and was a member of the security committee. Technology moves faster than legislation. Most recently a california bill by senator Diane Feinstein stalled on capitol hill. It was designed to improve the detection of Cyber Attacks and slow the work of hackers. But pressure for government change continues to grow on capitol hill. Theres a lot of things the private sector should do without the government. Since theyre not, were going to have to put some requirements into law to move them along. But wanting and producing change dont always intersect in washington, d. C. Back in 1998 president clinton issued a directive, warning of the dangers of potential Cyber Attacks. And then 15 years later in 2013 president obama issued another president ial directive calling for stronger Cyber Security to protect the countrys infrastructure. And now two years later washington continues to struggle to identify solutions and reach a consensus on how to handle hackers and improve Cyber Security. If we dont act, well leave our nation and our economy vulnerable. Sony in the grand scheme of things didnt affect anybodys physical well being. What were talking about affects peoples physical well being. And there are countries that want to do this. The bad guys are getting much more sophisticated. And theyre moving faster. Theyre in a dead run and were kind of shuffling along and taking baby steps. So what will it take to improve Cyber Security in our country . Many fear the catalyst for change will come from a significant disaster or a catastrophic loss. Experts believe it may take one of those before we will accept the cost and the loss of convenience that real Cyber Security requires. Scott . Thank you, tony. Thousands of miles of levees help carry water across our state. More than half of those are considered to be high risk of collapsing if and when a major earthquake hits. Expensive clothes lavish dinners, and even lottery tickets. We investigate a former High School Principal accused of stealing from students. Have you heard of the new dialing procedure for for the 415 and 628 area codes . No what is it . Starting february 21, 2015 if you have a 415 or 628 number youll need to dial. 1 plus the area code plus the phone number for all calls. Okay, but what if i have a 415 number, and im calling a 415 number . Youll still need to dial. 1 plus the area code plus the phone number. So when in doubt, dial it out well, if youre a parent, you do a lot of fundraising for school, so this is not a story youll want to hear. Missing money at school all signs point to the principal. The Investigative Unit has been looking into allegations that a former south bay High School Principal set up a private slush fund. And a lot more. Guys this is the second Oldest Public School in the state. Former transportation secretary norm manetta graduated from san jose high. Now the former principal is accused by staff of stealing money from the school. And weve learned thousands of dollars simply disappeared during her tenure. Its a rite of passage. High school. And its not just what students learn in class. Its the extra curriculum. From sports to study abroad programs activities supported by donations and fundraisers. We fight for every single dollar. Its what drives this mother to volunteer at san jose high school. And its why shes questioning how san jose unified responded after concerns were raised about the principal stealing money from her own students. You cannot be in education and working for children and taking away money which other people have donated for programs for the kids. It started in 2010 when kerry catching was transferred from gunderson high to san jose high almost immediately opening a bank account linked to the parentstudent association. But parents didnt run this account. Records show catching controlled the money. Insiders say it was the principals piggy bank. In an email provided to the Investigative Unit catching writes, i actually went to the bank and did all this today, in reference to opening up the account. Problem is, thats against the rules. District policy says School Personnel are not to sign on banking accounts. We obtained an audit the district conducted of this account, never made public until now. Records show catching spent thousands of dollars on things like pricey meals at original joes even 160 check to the National Kidney foundation. She also spent hundreds on clothing and massages for staff, even lotto tickets. In all, the district found 7300 worth of expenses without any receipts or explanations including this check made to cash for more than 1700, and several checks catching wrote to herself for hundreds more. Its unclear how the principal funded the account, but insiders have theories. Money came from the cash box after Football Games or dances. She would take it and count it and some was taken out some was left in. She asked us to disguise her face and voice, but she suspects catching took money directly from cash boxes at games and snack bars. Youd have money disappear that can be helping our community and our students and staff. Its appalling to me. How much money was missing . So it was about exactly 500. This math teacher spent four years at san jose high. He remembers he and another teacher gave the principal cash from a student fundraiser, but he says catching didnt deposit all of it. We were both kind of incredulous. We didnt know what had happened. We double counted the money ourselves. We never made a mistake like that before. If it was 20, maybe 40, you can understand why a bill got stuck or something. But 500 is a stack of 20s. Somewhere, something was missing. Then theres this. A Police Report from december 2013. The district called police and questioned catching and others after 1600 went missing from the school safe. Police didnt make any arrests. Hey, dr. Matthews. Superintendent Vincent Matthews declined our request for an interview, so we caught up with him at a school board meeting, where he answered our questions, sort of. Youre the superintendent. Did you hold the principal accountable . Thats all were asking. Weve already given you that opportunity to sit down. What did your investigation find . As i said we did what we were supposed to do. Jorge quintana is the district officer. Thats when the employee resigned. He says the district stopped investigating once catching quit, and it didnt try to recoup the money because that was up the to ptsa. The group declined to comment. Catching was hired as the director of safe schools after resigning. Thats where we found her. Where did the money go . What happened to the 7,000 in expenses that had missing receipts . We also wanted to ask the former principal what happened to rental fees tied to san jose high. Week after week this man kevin blunt, is named on the School Calendar for renting the gym. He runs crossover elite. The groups website boasts pictures of tournaments featuring stars like former 49ers Delaney Walker but the district has no records of any payments from blunt. So we did the math. At a cost of 40 an hour plus fees that, adds up to 10,000 the district was never paid just in 2012. Never mentioned the facility paid someone, and it didnt go to the district or the school. Was he allowed to use the gym for free . I highly doubt it. People said he paid the principal directly for use of the gym. Okay. Is that possible . That could be so. Blunt told us on the phone he paid the district but when we asked if he would show us any invoices, he said hed have to ask his attorney. He later emailed to say hed have no further comment. Did she steal money from the district . That would be a question for her. You have a record of events being held on her campus that you as the district were not paid for. Why didnt you ask the police to investigate where that money went . Again, we did what we were supposed to do. That was to question the employee. As for this mother shes now the president of the schools new parentteach organization, the pto. The group severed ties with the ptsa. She wants families at san jose high to know money donated for students will go to students. Its a fantastic school one of the oldest. But we dont have that many extra resources like a lot of the other schools. The district says it has reminded all principals of rules regarding ptsa accounts and has strengthening the process for renting School Facilities so principals cant accept payment without the districts knowledge. As for the money for those gym fees, the district still adding up just how much money it never received. No charges have been filed against the principal. Guys . Homeowners will have to register with the city when they want to offer their homes for rent. Theyll also be allowed to rent their homes up to 90 days a year but only 30 days at a time and permits are valid for two years. Todays san leandro city leaders will vote on a plan to equip San Leandro Police with a new state of the art vehicle. The city was recently awarded a 200,000 grant from Homeland Security to buys a bear cat armored personnel carrier. Police say the car would serve many purposes like streamlining medical treatment of people in highrisk situations, but critics say this vehicle will increase the militarization of the police force. It does not look like a medical unit. It doesnt, but if you were on the ground and there were bad guys, youd be welcome to see it, i suppose. Workers at tesoro refinery not showing up to work this morning as part of a nationwide strike. Theyre joining workers from eight other refineries across the nation. Workers and management have not worked out a contract yet. The union represents workers at 63 plants and that include the shell refinery in martinez and the chevron refinery in richmond. The tesoro plant will continue to operate as a terminal during the strike. That means itll take in product, ship them out, but it wont be producing thinking. The new Ucsf Medical Center at mission bay is now open for business. 40 ambulances spent the day transporting about 125 patients from the Childrens Hospital and mt. Reporter in the tangled shores of the lagoon trees and shrubs are alive with song. Deep in these layers of green, delicate work is under way. So were here today netting and banding song birds. You can see how tightly this bird is hanging on to the net. Reporter a series of long nets are tucked into the trees. Theyre a fine mesh net strung up sort of like a volleyball net. Reporter every once in a while, those nets become occupied by unsuspecting song birds. They fly in and get caught. We safely remove the bird. This one is an individual weve caught before. Reporter for two decades, researchers from point blue conservation have studied song birds in this vast open space preserve in marin county catching and banding hundreds of birds each year. Were primarily interested in tracking song bird populations and seeing how theyre doing. Reporter its a careful task with fragile subjects. Winter will be back but even this next system coming through is a very warm system. And with that we might actually get very generous rainfall totals. Lets focus in on the right here, right now. Temperatures at lunchtime right after this broadcast in the mid60s across the board. Really great day to get out there and enjoy lunch maybe on the water if you have that luxury. At 3 00 our highs typically come in. Thats 72 degrees in the south bay for today. 71 degrees on the peninsula and 69 degrees on the east shore. So let me kind of walk you through this forecast. The changes are going to start to arrive day by day. By tomorrow we lose a couple degrees of that warmth. By wednesday, even more so. Then the wind is going to pick up overnight wednesday into thursday. Showers first start up in San Francisco. Were looking at that thursday at around lurchnchtime. Friday, really heavy rainfall on the way for the entire bay area. But this is a slowmoving storm system. Looks like its going to be with us all weekend long. Look at your temperatures. With rainfall still getting close to the 70s. In the south bay and on sunday in the south bay, even when we get that cold blast behind the area of low pressure still only going to see the temperatures fall into the mid60s. Heres the thing. Whenever we get coldcore systems, they dont pack as much of this rainfall we desperately need. Were also looking towards an Atmospheric River tap. Here we go. I stop that clock for you thursday at 12 00 p. M. Were going to be tracking some pretty good rainfall. Were expecting the heaviest totals in the north bay as per usual. I continue stop that clock. Friday at 4 00 p. M. Thats when we start to get our heavy stuff in the south bay. It will be light for the most part throughout the early portion of your friday down here in the south bay. Meanwhile, were talking about 24 hours of moderate to heavy rainfall at that point on friday up in the north bay. As to be expected with rain rates like this and our highways not equipped to receive this kind of rainfall all at once looks like well see localized flooding. We could see some very very heavy downpours come through, even with some thunderstorms. I want to give you a little idea of how the models are now in better agreement. Last week we talked about this. At this point, this is the latest from the european model. 2 inches in san jose. 3 inches in santa rosa. The gfs, the one i usually go with, lets let this thing run. Through thursday into sunday 2. 5 inches. Theyre becoming a little more in agreement. For me, that gives me a little bit more confidence that were going to get at least an inch and a half to maybe 2 1 2 inches in the south bay. Almost 5 inches certainly possible in San Francisco. Same for santa rosa. We need this rain. We dont need it all at once. We saw what happened in december when we had a system similar to this. So were just going to keep watching it for you, optimistically cautious when it comes to this rain. Snow levels associated with this guy, 7,000 feet and above because it is so warm.
