They are going to march for justice and accountability, the march here at San Jose Police headquarters with roughly 15,000 signatures in hand, demanding the Department Fire San Jose Police officer philip white for the inflammatory tweets he posted in which he allegedly threatened those surrounding the Michael Brown and eric garner cases. Hes been placed on administrative leave and his actions denounced by the department. The protest organizer tells us that the chief of police has agreed to physically accept the petition, though police wont confirm with us whether thats the case. This is a different era after mike brown and eric garner. There are possibilities in the fight for justice that, quite frankly, werent opened up before, so we fully expect for this new movement to generate the new calls for justice that can make some real significant and substantiative change. Reporter the marchers will be starting at the santa clara District Attorneys office, asking the d. A. To review officer whites past arrests and to look into the death of the man killed last february by two San Jose State University Police Officers for allegedly coming after them with a saw. We spoke with the d. A. s office, who tells us the d. A. Has every intention of physically accepting the protesters letter of demand but wouldnt comment whether he would take any action, only to say that the d. A. Is looking forward to seeing whats in their letter. Now this right here was the scene a couple hours ago in oakland, about 30 to 40 people, led by the Alameda County public defender, pausing for a moment of silence in honor of brown and garner, the two unarmed black men killed by white officers. The crowd upset by the fact grand juries did not indict either officer. On a daily basis we see what happens and we want to make sure that things are conveyed and justice be kept in mind. The family lost all of their food when the flood waters knocked out her power. Water also destroyed all of the blankets and the electronics that are stored under the home. When the principal at the Elementary School in belmont found out, they and other students families had been forced out, she said she had to act. When youre a principal of a school, you run a school, but you also love the school. You love the teachers, you love the parents, you love the community, you love the children. Youre like the mom. The principal reached out to the School Community and the District Community hoping to raise about 500, but as of last night, the Belmont Redwood Shores School district had collected close to 20,000 in money and goods. Some of it left by the tooth fairy and it was allowance donated by students, as well. She says she is thankful for the communitys support. Today the south bay teachers aide accused of assaulting girls, he was arrested last year, two hearings to set a trial date have been postponed, but he is back in court today. He is accused of sexually assaulting four girls aged 3, 5, 6, and 7 while he worked at a ymca Childcare Center in morgan hill. He has pleaded not guilty. If convicted, he could face life in prison. Union city police need your help finding a man they say shot video of women inside a womens restroom inside a local walmart. This man was hiding inside the stall ten minutes before he was discovered. He ran off before police arrived. White, tall, 64, and about 45 years old with curly salt and pepper hair. The woman accused of running a pill mill out of her los gatos clinic is expected in court today. She is expected for a preliminary hearing. Prosecutors say she prescribed large quantities of powerful prescription drugs without performing exams or even reviewing medical records. Well, the state Public Utilities commission will talk about pg es Smart Meter Program today. The commission will decide whether to approve pg es plan to charge customers who choose to opt out of the Smart Meter Program. Under the plan, customers would be charged an initial fee of 75, followed then by a 10 monthly fee. Low income users who choose to opt out would be charged less. Wall nut creek is expanding the ban on plastic bags. Any food related businesses are also now banned from using plastic shopping bags. Earlier this year the city required Department Stores and pharmacies to stop using them, but many businesses have stopped using the bags and are offering paper bags at ten cents a piece. Mountain view could get a Shopping Center like santana row. The marylandbased Reality Company is close to buying the san antonio Shopping Center near the intersection of El Camino Real and san antonio, the one with the walmart. Well, thousands of low income families in the south bay are getting a much needed boost this morning just in time for the holidays. Sacred Heart Community Services Plans to pass out 3,300 boxes of food today and tomorrow. Next week theyll pass out more than 17,000 toys and books to south bay children. Each child will get two toys and one book. They let the parents pick them so that the parents know exactly what. What they are getting the kids, yeah. The city of oakland wants to know what its residents think of new plans to develop the area around the coliseum. In august San Jose Police arrested mcdonald after his fiance accused him of Domestic Violence. The District Attorney did not file charges. Now sources say another woman went to a local hospital claiming mcdonald sexually assaulted her at his home this week. Investigators searched his house. They perhaps seized the bedding that where the incident allegedly occurred, clothing, perhaps the cell phone and perhaps surveillance information at Ray Mcdonalds house to show that she was there. Reporter former prosecutor steven clark says physical evidence was key. Theyll also take her dna and compare it to dna samples at the mcdonald home, so that is a critical part of this case, if they have to establish that a physical encounter occurred. Reporter if proven it was not consensual can be challenging. The prospect of another lengthy investigation may have been a factor in the 49ers decision to let mcdonald go. Well, stores made promises back then and with hidden cameras rolling, hes keeping them honest. Reporter our rossen reports Team Shopping for underwear at some of the countrys biggest brand name stores. And what our hidden cameras find this time is enough to gross you out. In 2010, our nbc news investigation uncovered a dirty little secret about new underwear. Id like to return this stuff. Reporter major retail chains taking back used underwear and putting them back on the shelves as new. We found them doing it at victorias secret, nordstrom, walmart, macys, bloomingdale, gap, and marshalls. At the time when we caught them, the stores told us theyd reeducate their staffs, so today, four years later, were buying underwear and swim suits at those same chains. And putting them to the test again. Did they learn their lesson . Were doing the exact same thing as last time, ripping off the tags and using this marker to put two little black dots right on the label, that way we know its ours. Right away, good news, we returned to macys and they end up in a clear plastic bag with other damaged items. Thank you. Reporter at bloomingdales, the clerk takes the underwear to the back room, never to be seen again. Nordstrom and the gap both come out clean, too. But things are about to get gross all over again. At victorias secret, we returned two pairs of underwear. Thank you. Reporter the sales clerk quickly tosses them behind her and it doesnt take long to find them right back on the table for sale as new. Remember, we know its our underwear from those two little black dots on the tag. Now on to marshalls and things get even worse. Hi, how are you . Reporter we buy a set of underwear and a swim suit. Dont forget, all the tags are off. We even removed the protective liner from the bathing suit so it looks used. When we return them, the saleswoman wastes no time putting on new tags. We watch our bikini and underwear carted out and put right back on the rack as if they were brand new, but the saleswoman assures our producer that never happens. No. Never. So if it looks like its been used, you wont sell it, right . Reporter think again. But what we found at walmart could be the most blatant. Heres our producer returning the underwear, and watch this. The sales clerk staples new tags on right in front of us. She tosses the used underwear into a cart full of returns. The associate going through them seems to realize theyve been used. But the very next day, guess where we find our underwear, right back on the rack for sale. We buy them again so you dont. Those are brand new . Reporter in a statement to nbc news, walmart acknowledging our results are absolutely unacceptable. Victorias secret telling us what we found on hidden camera is a clear violation of their policy. Marshalls says they are disappointed their procedures were not followed, and all three companies again promising to reeducate their staffs, but weve heard that before. So they are im going to point out, mens underwear is sold in big plastic bags you had to open. I didnt know you could return them. Now we know. Mystery solved. After 911 dispatchers received thousands of hangup calls, they searched for the culprit. What they found may surprise you. Nadine whimmer reports. Reporter 911 dispatchers are there when we need help the most. And they dont like taking time away from real emergencies to deal with hangups or accidental dials. It ties up all your 911 operators that we have to answer every call, we have to try and track down every call. Reporter so when one number started calling over and over. We got over 4,000 calls from one number in less than a week. Reporter they got police involved. I will admit it, we were pretty mad. We had to try and find a way to track down the person. Reporter but when they heard the story behind the thousands of calls, her feelings changed. We found out it was somebody with a disability who was just trying to listen to music. There was no intent to call 911. It wasnt some kid trying to cause us problems. Reporter officers tracked the man to this man, david. Hes a kid in an adult body. Reporter 30 years old physically, david is more like 8 years old mentally. Music is something thats always been a part of his life, something that creates a lot for him. Reporter afraid david would no longer be able to listen to music on the disconnected cell phone, they came up with a plan. We wanted to find a way to let him do that without causing a problem for any other 911 agencies. Reporter with a little fundraising. In 20 minutes i had 40. Reporter david was made an official junior Police Officer and dispatcher for the day. His parents were brought to tears. To see this kind of an outreach, that touches my son and touches our family, its just incredible. Well, new yorkers who want to own pet rabbits are going to have to leave the city limits to get one. Last night the new York City Council voted to ban bunnies from being sold in pet stores. They say shelters are flooded by people who have second thoughts after getting the rabbit and the rabbits are multiplying. The bunny population is getting out of control and this is their solution. Makes a certain amount of sense. I am excited that it looks like the weekend is going to be reasonably rain free. You know, our first one so far this month. Its been so active. And you know what, all that activity is now quantifiable. And i can tell you, we just got this Drought Monitor back this morning, and everybody in the newsroom let out a big hoorah because were so happy to see this improvement. Okay, it was me and mike, but it happened. 23 of this state is now out of exceptional drought, and that is phenomenal because it includes the entire bay area. Now the central valley, down through southern california, they have big problems. Were all in it together as a state, but the good news is, as a state, 6 to 10 increase to our major reservoirs, and that is fantastic, but really when it comes to getting out of the drought, this is what we need, that snow pack, because 60 of the water that fills those reservoirs in california come from melting snow pack. Its like our frozen reservoir in the middle of the summertime. Thats what continues to release that water. When you hit the highway, come 7 00 a. M. Tomorrow, if thats your drill, we are going to have slick conditions, potential flooding, because there are heavy pockets within this. Whole thing high tails it out by 3 00 tomorrow, maybe some residual activity for saturday, but overall looking really good for your outdoor plans on saturday and sunday. On tuesday someone from the transportation security administration, or tsa lost and found, called her up. Well, its a handwritten note, with my note to my address of 20 years ago. Reporter because of this sheet of paper inside her bag, her art supplies from a trade show in las vegas were returned. When i looked at this note, it was dated it dated me as 20 years ago. And i was just absolutely blown away. This is product, art product, very, very valuable stuff. I think our agency, our interesting, but i understand we just did some shuffling of equipment and shuffling of stuff at the airport, so its quite possible we came across something that somebody had left unattended for a long period of time. Reporter with the tsa enjoyed the use of plastic baggies, a modern day requirement for liquids. Still very creamy and usable. Reporter the price tags on the items at 3. 80, not so modern. Southern california photographer set up a handful of cameras and santa dolls with the hopes of recording mountain lions and sort of a santa doll picture, but they caught a regular black bear on video playing with the little pompom. I dont think thats play. The bear goes into smackdown mode there on the santa doll, plays with him for awhile, lost interest, though, after realizing, you know what, theres no food inside the santa, no Stocking Stuffer either.
