Of them, nearly 581,000 sent out, 75,000 are already in, but its election day thats got election leaders worried. They still need some 500 poll workers to be on standby to work next tuesday. We have people who are signed up now, but they call and cancel due to illness or things that come up, then we have what we call no shows on election day, where election officers who were signed up, just dont make it to the polls. Foreign workers treated like indentured servants. This is a year long investigation, and they exposed this reality that few people know exist. Investigative reporter Stephen Stock reveals the system of underground labor. The Companies Involved are almost all consulting firms. Third Party Businesses that contract out Foreign Workers to major hightech firms. We discovered that some of these companies are not playing by the rules. Those companies are often called body shops. Body shops that leave highly educated employees without work, little money, trapped in their pursuit of the american dream. Technology is one of the things thats driving the economy around the world. Reporter what drives that technology are thousands of Foreign Workers who come here every year, contributing labor to a 197 billion economy. They can make profit only by paying less to their employees. Reporter this man left his home in india a decade ago to follow his dream here in the Silicon Valley. I work for seven or eight of them. Reporter seven or eight consulting firms, what he calls body shops. The body shops have a specific business model. They make profits by having cheap labor. Reporter he fears for his safety and future. Thats why he asked we change his appearance and give him a false name. At his request. Do you feel trapped . There are times when im trapped and there are times when, yeah, yes, i feel im trapped. Reporter under the law, a company can bring highly educated, highly specialized Foreign Workers to the United States by using an h1b visa. Since 2008, more than 1. 3 million have been given out. In 2012, according to the federal government, 59 of those visa petitions went to computerrelated occupations. While Many Companies play by the rules, a year long joint investigation by nbc bay area and the center for investigative reporting, uncovered numerous examples of Companies Taking advantage of these Foreign Workers and breaking federal law in the process. Indentured servant is a pretty accurate term, because in many cases thats exactly whats going on. Reporter philip and his law partner have heard stories and represented workers from body shops for years. They may not even have a job, which is a misrepresentation on an h1b visa. Reporter the law requires Companies Already have jobs lined up for them. It also requires that the companies foot the bill for visa, attorney, and document fees, but we found dozens of cases where those rules were ignored or broken, leaving Foreign Workers who thought they had jobs now in the u. S. Still legally, broke and unemployed. We tracked various criminal and civil cases involving Consulting Companies or their executives in u. S. District court and state courts around the country. In total, these Court Filings involved more than 600 fraudulent h1b visas and petitions. The case we looked into, an outfit called Silicon Valley tech. A lawsuit alleging a Santa Clara Company refused to pay them and did not have jobs for those workers when they arrived here. Court filings show the company denied these allegations, but midway through the lawsuit, Silicon Valley systech went out of business, the workers left with nothing. Essentially when they got here, there was nothing for them. Its called benching workers. Once the workers get here, they find there is no work and often they are told to find their own jobs. Under h1b rules, thats illegal, but we found it happens again and again. They didnt have jobs lined up for any of their employees. Certainly nothing at the levels they had promised them, and essentially, they dumped them into a guest house. Reporter a guest house, what this lawsuit interviewed with former workers and this research all describe as a small apartment or house, where as many as eight to ten workers live at once. Sometimes those workers pay the body shop rent to live there and are told never to leave except to go to work. We are placing you in the guest house. Until you get the job you have to stay in the guest house. You cannot go out, even for a walk. Reporter this worker asked to be anonymous because he fears for future job prospects by speaking out now. He stayed in guest houses for several months. My familys in india. I have a 6monthold baby. My family is in india. I curiously want to see my son. Reporter this body shop could send you back at any time . Yeah, the rights are for the employers. Reporter and that scares you . That scares me. Reporter the worker said the body shop he worked for kept up to 30 of his 60 an hour contract salary for expenses and taxes. Thats a loss in his salary of about 35,000 a year, but they did charge you. How much . Around 2,300. Reporter 2,300, you pay the company to get you an h1b visa . Yes, i do not have any money. Reporter a sociology researcher at the university of wisconsinmilwaukee has studied h1b visas and body shops for years. He says as long as consulting firms play by the rules, their existence is critical for large hightech companies to operate efficiently. Its a very flexible kind of labor regime. Much of the time they are placing very skilled people with the needy firms in the u. S. Reporter as for workers like him, he says he just wants a fair Playing Field for all courageous enough to pursue their american dreams. How widespread is this . Its all over the country.
