Murder charges against the doctor. We spoke with the deputy d. A. By phone earlier this morning. She tells us that her office first had doubts about their case against the doctor back in july, which is why they released him then with the understanding they wanted to reexamine certain aspects of the case before this afternoons hearing. This morning she said they reached a decision to drop the charges against the doctor, in quote, the interest of justice, unquote. His friend, galvez, still stands accused of stabbing to death the doctors wife. This happened inside their gilroy home on april 1st. She showed the d. A. Documents that proved galvez is a con man. Those are her words, who was trying to swindle the two out of their condo located in ecuador. When galvez went to close the door on the sale of property, he killed her on his own without being hired to do so by the doctor as the District Attorneys Office first alleged. I represent an innocent client. I mean, hes 100 innocent in my opinion, and so i was just able to assist them by pointing out things i dont think theyd seen initially in their investigation. One of the great things about being a Deputy District Attorney is you have this amazing power, and that includes the power not just to prosecute, but the power to dismiss, so im very grateful to the Santa Clara County District Attorneys Office. The d. A. s office believes that david galvez fled to ecuador and getting him back for trial will be difficult, if not impossible, since that country does not extradite its nationals. The chief and his chief officers are reviewing that as we speak, and again, theres really no time table.
