time in more than a century, there is a new grade level in california schools. it is transitional kindergarten, preschool and kindergarten. this morning, the man behind the new law visited parents and teachers in san jose's oak grove school district. stephanie chuang spoke with him and some parents who say they couldn't be happier. stephanie, good morning. >> reporter: marla, good morning to you. that's right. the state senator came to this elementary school in san jose visiting a transitional kindergarten class that has 23 4-year-olds, very cute little ones, in their first day of class. both he and parents say this is a huge win academically for the kid and financially for the state and for parents. >> let's go find a bed. >> reporter: it's 4-year-old dylan's first day of school at george minor elementary, but this wouldn't have happened if it hadn't been for transitional kindergarten. >> we've been, you know, able to put him in this program and at no cost to us, and so it's just another opportunity for him to get an early start on that education. >> any type of jump-start you can give your i can is a good thing. it can't be bad. they can never learn too much. >> reporter: there's a new kindergarten cutoff age. you have to be 5 by september 2nd starting the 2014-2015 school year. the state has started the transitional kindergarten classes in more than 700 school districts. democratic state senator of palo alto says this will not only help academics for an estimated 125,000 kids each year but will save california money. >> that not only put an extra burden on the classroom teacher, it was a real cost to the system and to the public. it meant if there was remedial help, we had to pay for that. if a youngster was held back a year, we had to pay for that. if a youngster was placed in special education, we had to pay for that. >> reporter: he says with money saved there will be no extra cost to run the program. it gives chris more control in his life after he's been out of work for the last four years. >> this is a great opportunity for us. this will give us more freedom, especially myself, because i'm a stay at home dad, to go out and find a job and be the role model i think my kid want me to be. >> reporter: this transitional program kicks off in phases. next year it will be october 2nd you have to be 5 years old. the permanent date starts in two years, and that cutoff will be september 2nd. stephanie chuang, nbc bay area news. >> stephanie, thank you very much. crews in saratoga working on fixing a sinkhole there. dispatchers telling us the sinkholes ripped through pierce road in saratoga close to pike road. for a reference here, that's about a mile north of the mountain winery. so far no word yet of any injuries or damage to any cars. well, san jose state leaders say they are troubled by a recent wave of crime in the south bay. in just six days, four people have been killed, a number of others injure. nbc bay area's bob redell takes a look at how city leaders plan to deal with the escalating problem. >> reporter: within the past several hours another person has been shot in san jose. officers found this man with at least one gunshot wound around 9:00 last night on the 1600 block of east san antonio street. last report from police, his injuries are possibly life-threatening. no arrests yet. if you look at what's happened in san jose since monday, there have be has been a lot of violence. this map shows the locations of where four people were murdered last week. monday a man was shot to death in his car at charles creek and oakland road. late they're day, a man killed a woman using a samurai sword outside a wallgreens, a vigil for her tonight. a 21-year-old man was also shot that day. he ended up dying wednesday. and then yesterday morning, another man was shot and killed. that taking place near south winchester. that is four homicides. doesn't include other crimes in which people were seriously hurt. >> the gangs are just getting ridiculous out here. that's all there is to it. >> i just don't want to be walking around wearing the wrong colors. i threw away my blue and red shirts. i don't want to take the risk. >> reporter: police are looking into whether some of the homicides are gang related. they don't see it as an trend in upward trend in violence. mayor chuck reed says, and the chief agree, the city needs more officers on the street. mayor argued that pension reform would help pay for that, but that's not popular with a lot of the police department's rank and file. here in san jose outside the police department, bob redell, nbc bay area news. a man in the east bay is dead after being hit by an ambulance at 65 miles an hour. the chp says it happened in antioch. the man stopped his car on the shoulder of highway 4 east of a street about 11:30 last night. officers say he left the car running and then walked out into traffic where he was hit by that ambulance. officers shut down the left lane during the investigation overnight. the chp says it's not sure why the man wandered out onto that road. happening right now, some good news to report. the coast guard announcing it's just located a los gatos man missing after a weekend trip to the bethell island. friend of the 29-year-old calling for help last night after they lost sight of him out jet skiing. coast guard crews had been looking for him since then, and a chp helicopter joined in on that search. his waverunner ran out of gas and he slammed into the shore and slept there overnight. he's in good condition. a man accused of breaking into steve jobs' home in palo alto was set to face a judge this morning but it's delayed. the 35-year-old stole apple gadgets, tiffany jewelry and jobs' wallet. he reportedly gave stolen ipad to a friend who allegedly used it to play music during a street performance in san francisco. that friend is kenny the clown. he says he had no idea the ipad belonged to the late apple co-founder or that it was even stolen until police showed up at his door. the next court dade for mcfarlin is set for september 19th. we're learning more about the extreme steroid scandal surrounding suspended giants star melky cabrera. "the new york daily news" report wung of the all-star's associates created a fake website to try to explain the alleged steroid use. this plan was, according to the paper, to try and fool major league baseball by suggesting cabrera ordered the supplement from that website and showed that supplement was fraudulently spiked with testosterone. the "daily news" says that story quickly unraveled last month during the investigation into cabrera's positive test. cabrera's agent says they knew nothing or had no knowledge or dealings with anybody associated with that website. a state of emergency is under way in parts of northern california as a fast-moving wildfire rages out of control. this is burning east of redding near the rural town of manton. the santa rosa fire, which began saturday morning, destroyed seven homes and forced almost 4,000 people out of their homes. about a thousand firefighters are battling the flame, including several crews from the bay area. about 23 square miles have burned and it's only about 5% contained. investigators say it could have been sparked by lightning. the fire is just one of 14 major wildfires that are burning across the state right now. time now to check in with meteorologist christina loren. looks like a smooth week ahead. today kind of the warmest, then we taper down? >> a man who listens to his woman. i appreciate that. i love it when a man is listening. you know what? as we he throughout the week, you'll probably want to stay tuned to the weather forecast if you have any sort of interest in the preliminary rounds of the america's cup, which happen tomorrow right here on this very bay. san francisco bay looking a little choppy. they want the wind for that event, and it looks like we're going to see some pretty gusty conditions develop tomorrow. i want to point out that fog bank is starting to lift. it's clearing very quickly. we'll get a lot of sunshine this afternoon. but because it hell on for so long in san francisco, you're still at 59 degrees. that's jacket weather. however, you're peeling off that coat in livermore, concord, even san jose with the sloefts and upper 60s. weather headlines tell the story as we head through the next 24 hour, today will be warmer than yesterday, plentiful afternoon sun, then tomorrow we'll get an even thicker marine layer, morning drizzle, not as hot, and the wind pick up. average temps this week, but we have a little something to talk about when it comes to the weekend and your weekend outdoor plans. stay tuned for that. >> teasing it ahead. i like that. >> always. >> thank you very much. still to come, beating their very own record. how apple entered the record books all over again today. >> also, a health warning. the details on a recall from the california-based company straight ahead. and history nearly a century in the making. yes, the historic first for women on the course coming up next. a big operation. this anchor is going from the homitis had here. it's been here since about the '80s, is what i'm told. they picked it up from over there and put it on a crane. it's going to its new home at the museum in alameda, a much more fitting location, but this process is slow, takes a few hours. it weighs 30,000 pounds, as you just said. they had to lift it straight up with a huge crane this morning, lock it down on a truck, and then drive it over again to alameda. the anchor was actually from a sister ship to the "uss hornet" that was decommissioned in 1976. now, the hornet is actually missing its starboard anchor. it was removed before being towed to the bay area. it has one and needs too. the aircraft carrier saw fierce action in the pacific. about a year ago the head of museum operations realized the sister anchor was right here in oakland. >> it just kind of got lost in the shuffle of things over there and as jack lemmon has been expanding and so forth over there, it's been -- apparently it's been i think moved from what i understand. but there's been taggings on it and so forth so we want to try and bring it back and show a little bit more reverence towards it. >> reporter: he tells me he had to work with the navy, the port, and the city to make this big move happen, and he says that much of the cost of this whole move was actually donate. what's going to happen is the anchor will sit on the dock over in alameda. it will take about three or four months to be restored. then it will actually be installed back on the hornet. they're about to take off soon. wanted to mention if you either want to see it or avoid the slow-moving truck, i'm told they're going to leave here and head right down the webster 2, be there maybe in an hour. christie smith, nbc bay area news. moving now to decision 2012, the campaign is coming down to the wire, and that means a flurry of visits across the country this week to key battleground states. new hampshire is one of 13 hotly contested states that will decide the 2012 election. that's why both sides are campaigning hard there with just 11 weeks to go. today, mitt romney and paul ryan pair up again there for a joint town hall meeting. this comes a full week before they were supposed to appear together again at the republican convention in tampa. >> at one point they were split up in the week before the convention, but now they're going to be together. the dynamic duo out in new hampshire. >> president obama returns to come paining tomorrow with a battleground double-header. he'll be in ohio before heading to nevada on wednesday. turning to business and tech now, that patent battle between apple and samsung heading to a jury this week unless, scott mcgrew says, the two sides can first reach some sort of settlement. well, good morning. that's what the judge in the case wants. she wants a settlement, and bloomberg reports this morning she's pushed the two sides to talk. once again by phone, ceo to ceo. now, if that's going to happen, it probably won't happen until later this afternoon california time because of the time difference with seoul, south korea, where samsung is. either that or the phone call happened early this morning already. right now it's just past 4:00 in the morning there. the judge has warned she doesn't think either side will be satisfied with the outcome. shares of apple hit new highs this morning. facebook hit new lows. facebook shares now under $19. mondays are generally tough on markets. today's no exception. broader markets trading lower. and video from stanford engineers there unleashed their latest robotic car, an auti tt over the weekend, stanford students took biofeedback measurements from real race car drivers so they could get a better idea as to where the stressful parts of a racetrack are so they can teach their robot car how to take the turns even better, though it looks like it's doing just fine. already the robot audi can hit the track at 120 miles per hour. back to you. >> not bad. okay, scott. thanks. soaring summer temperatures are prompting state lawmakers to consider new laws to protect farm workers from the heat. a bill circulating the state capital would require water to be available at all times within ten feet of all employees and shade within 200 feet. the bill would let farm workers sue employers if they break those rules. another bill would make it a crime if employers did not provide adequate water or shade. at least 14 farm workers have died of heat-related causes in california since '05. two deaths this summer are currently being investigated. well, before you make your next salad or sandwich you'll want to check that lettuce in your refrigerator because there's a recall warning for romaine lettuce with fears of contamination with the supplier, tanimura & antle are recalling romaine. there have been no reports of illness, but the supplier is concerned the lettuce could be contaminated with e. coli. the heads were shipped to 19 states, including california, puerto rico, and also those shipped to canada. a little league team from petaluma has one more chance today to stay in the running for the world series championship. yesterday, hundreds of fans packed the movie theater in petaluma to watch them play in a second-round game in williamsport, pennsylvania. the all-stars rallied twice during the game against the southeast champion from tennessee. in the en, though, petaluma lost the game 9-6. but there's still hope if the team wins every game forward. they still have a chance at that championship. the petaluma team plays at 1:00 this afternoon. it's an elimination game against a team from new jersey. >> you can probably hear in her voice she was smiling during that entire francisco, even up in napa at 59 degrees. and that's courtesy of a very thick formation of that marine layer. it will be even thicker tomorrow. but i wanted to show you on the visible satellite imagery we are starting to get some clearing. the rich texture is over the pacific and the bay is getting a little more sunshine. that will be the case through the next couple hours. highs today, this is the hottest day of the week, 8 to in san jose, 76 in freem, 90s today in concord, fairfield, and livermore. just 67 degrees in san francisco. couple later days this week, wednesday into thursday, in particular, probably won't break out of the 50s in san francisco as this area of low pressure deepens and gets closer and closer to the california coastline. for us, that means drizzle on the way to work, not just tomorrow. it looks like wednesday as well. that cooldown will continue all the way through thursday of this week. we'll get some comfortable conditions inland, probably able to give your amt c. a break. even in livermore and the extreme east bay as we head into wednesday and thursday, which is really good news after the heat wave we just got through. 85 degrees by thursday. that's the coolest day of the week. then we hit that seasonal stride, keep your temperatures in the 80s, no extreme swings upward or in the town direction either as we head through the next few days.
