Reporter San FranciscoPolice Walked the hilltop area popular with residents and tourists after reports of a shooting at 2 00 a. M. In a statement, police said officers found three men shot. A 20yearold was dead at the scene. Two others taken to the hospital where a 22yearold man died. While an 18yearold suffered life threatening injuries. Yeah, its pretty shocking. Because i its so uncharacteristic of our city. You know the way our city is. Reporter investigators say it appears the male suspects targeted these victims and fled after the shooting there are cameras in the area, but its unclear what they may have captured. Tonight visitors were surprised that such a Violent Crime happened here. Because there are so many people around. So definitely seems a little unusual. Reporter now officers working here this evening tell me that its not unusual to see people coming and going at 2 00 in the morning. And theyre still asking for anyone who may have seen anything to come forward. Reporting live in San Francisco, christie smith, nbc bay area news. Thank you, christie. Many questions still unanswered after a Traffic Accident in san jose turns into a homicide investigation. Police say a car crashed into a pole in an alley. When officers got to the scene, the driver was dead with a bullet wound to the window shot out. The car was found about four thank morning on via monte near pioneer high school. We talk to the man who owns the vehicle. He did not want to be identified. But shared some important insight into the case. It is my car. My son got home from work. His roommate went out to park the car for him. Rolled up back here to find a parking space. Somebody shot him. His roommate . Yeah. Reporter someone shot his roommate . Right. Nobody was chasing him. It was somebody out looking to do some damage. Reporter witnesses say they saw four people in dark colored clothing roaming the neighborhood very early this morning. They say at least one person was armed with a gun. So far no suspects have been captured. Members of a Peninsula Church came together today to remember their spiritual leader. Their pastor allegedly killed by his own son. The 54yearold toman bostick. Officers found him on friday stabbed to death inside his san leandro apartment. He was the pastor of mt. Olive Apostolic Original Holy Church of god, the church that his parents started. During the service, members remembered his dedication to god. Pastors from other churches also spoke in his honor. Now bosticks son, Isaiah Bostick is now in jail, accused of murder. Police say they found isaiah also at the san leandro apartment, blood on his hands and clothes. Well, you certainly dont see this every day. A van just hanging off of a bridge, feet from toppling over. This happened in gilroy on highway 101. Take a look at the pictures sent into our newsroom. They hoed this van hanging off the edge of the bridge here. Very precarious. This is near the bloomfield road exit. It happened around 4 00 this afternoon. Crews tell thus is a 15person passenger van. Several people inthe van were injured. The cause of the whole crash is still under investigation. And winds very interesting tonight. Beginning to turn slightly offshore. And that is the sign that were going to have a mild start to the morning. Were talking mostly 50s and 60s to start the day in the hills. And then as we move into the afternoon, well have the temperatures in the 50s and 60s tomorrow morning starting off in the 60s. And then by the afternoon, the record highs you see there could be in reach. Santa cruz climbing above 80 degrees. Thats the strong possibility tomorrow. And even around oakland, you may see highs closing in on 80 degrees. Well talk more about the potential for records to start the week. Well, a group of experts arrived in palo alto this week to help the Community Deal with a years old teen suicide problem. Ten palo alto teenagers have committed suicide on caltrain tracks in the past six years. They called on the centers for Disease Control and prevention for help. On tuesday a fivemember team will study how they can strengthen Suicide Prevention efforts locally. This team will be in the bay area for about two weeks. Theyll have several meetings with local leaders and doctors. This visit follows three months of research. More than 200 people came together tonight to remember thousands of japanese americans forced to live in internment camps during world war ii. On this day of remembrance, that san jose state also pledged not to repeat history. Jimmy was just 19 years old when he and his family were forced to leave her san jose home and live in an internment camp in pomona. He remembers the day a president ial order required him to register at san jose state. Coming to the gymnasium here to sign up, we had notice to come here. And thats when we received our number. A family number. And we go outside, didnt see as a person. Reporter from then he was known as 32420. He spent the next four years in three different internment camps. While he was able to stay with his family, he says they were forced to abandon their farm and livelihood in south san jose and were no longer considered american citizens. Tonight more than 200 people came together at san jose state to remember what jimmy and thousands of other japanese americans endured, and continue to beat the drum of change. Some fear now more than 70 years later, its the Muslim Community that is the target of discrimination. Japanese americans have been a helping hand in combatting a lot of islamophobia. Reporter during the ceremony, the names of 11 internment camps were read. Representing where more than 120,000 japanese americans were forced to live. The day of remembrance ended with people grabbing tea lights and walking to the gym for a candlelight vigil. The same gym where jimmy was forced to register before he was taken to an internment camp. Jimmy is now 93 years old. And while he says he is not bitter, he does have a strong message for the next generation. Dont let it happen again. We ought to make the 2016 election a referendum on the Supreme Court. Reporter republican candidate ted cruz had been a law clerk for chief justice rehnquist. Now as a senator, he intends to block any obama nominee. Were advising that a lame duck president in an Election Year is not going to be able to tip the balance of the Supreme Court. Reporter democrats are already calling out cruz. Ted cruz holds the constitution when he walkthroughs the halls of congress. Let him show me the clause that says the president s only president for three years. Reporter with fewer senate votes, democrats may have to take their fight for an Obama Court Pick to the campaign trail as well. I just dont think it looks good that for very other overtly political reasons that the republicans would deny this president the right to exercise his constitutional responsibility, which is to appoint members to the Supreme Court. Justice scalias form colleagues on the court gave their praises. Ruth Bader Ginsburg said, quote, we were best buddies and added that Justice Scalia had a rare talent to make even the most sober judge laugh. Clarence thomas said it is hard to imagine the Court Without my friend. I will miss him beyond all measure. It leaves just eight justices now and the possibility of tie votes for the four. New at 11 00, an mba or a law degree from cal coming at a hefty price for instate students. Tuition at Berkeley School of law and the school of business has risen sharply over the last decade. School Officials Say a cut in support by the state gave them no choice but to eliminate most of the price breaks for instate students. Bring your pets in at night. A great geography lesson. We have clear skies you. Still see the cities around the bay area. San francisco very interesting. Been seeing the flag here showing a bit of an offshore breeze. Instead of the sea breeze, which typically brings in the low clouds. 57 degrees right now. But surprisingly warm temperatures around tiburon heading up towards santa rosa. 66 degrees after 11 00. This is the reason why we have some offshore winds, bringing more mild air aloft as it descends in elevation. The air begins to dry out and warm up. Which youll see a lot more of that during the day tomorrow. Notice the wind direction offshore through the day tomorrow. Thats going allow some of the coastal areas down towards santa cruz to make a run at the low 80s for tomorrow afternoon. Now we have some high clouds. But thats about it. Storm track still way off to the north. This is a complete reversal of fortune from what we had late january, where the jet stream was aimed in across Southern California right now, this blocking pattern, which is set up, is picking up the rain and sending it towards the Pacific Northwest where theyll have flooding rains in western washington. Around here, though, as this high strengths. And now you see the winds beginning to turn offshore. Thats going bring the temperatures to the 70s and 80s inland. For the morning, hilltop locations may start out in the 60s. But most of the bay area 40s and 50s to start. And then as early as noon tomorrow. Low to mid70s. And by the time we get towards mid afternoon, some of the temperatures records we could break. Santa cruz expecting a high of 82 degrees tomorrow. Oakland airport Current Record is about 73 tomorrow. Expecting 78 degrees that too should break a record for monday. Around the south bay tomorrow, upper 70s. Close to 80 in the warmest spots. San francisco seeing temperatures in the low 70s. From the north bay to the trivalley, highs in the mid to upper 70s. Well see another day we could break some records. That will be tuesday. Well see a few more clouds late afternoon. Notice the big change wednesday into thursday. A big drop in temperatures. But the rain coming back into the picture for wednesday and thursday. Packing a pretty good punch. Its going to displace that ridge of High Pressure. And well see the rain coming in. Especially for the second half of the day, a quarter inch to 3 4 inch of rain. You see how the models have brought up the rainfall projections now. Maybe close to a half an inch given how dry its been so far this month that would be great news. And perhaps about a foot of snow in the sierra. As the system moves on out, well see showers in the thursday, friday maybe a slight chance of showers for the north bay. As we move towards next weekend, the high should hold off most of the rain towards friday. Saturday and sunday temperatures in the upper 60s to low 70s. So a potential for some recordbreaking temperatures next couple of days. Midweek storm on the way. And then well have to see if were going to get a pattern change out of this very dry pattern, which looks like it could hold up through the end of the month. Back to a more energetic and rainy pattern for california as we move into march. We certainly hope thats the case as we saw that video of the snow melt taking place in the sierra. The good news is by the middle part of the week we should add more fresh snow to the high country. The agency says it is dealing with an onslaught of fraudulent tax returns. Now this is the second year in a row that this is happening. Millions of Social Security numbers were stolen by identity thieves who used numbers to file a fake return so they could secure your tax return. Unfortunately for consumers, tax return fraud is not going to go away any time soon. In most cases, were hearing that theyre efiling, and theyre just doing this in bulk. Now the irs is catching more fraud this year and also more security measures are now in place to detect the real return versus a fake one. But it did not show what led up to the confrontation. We investigate the reason why Bay Area Police cameras are not always rolling when officers use force. But how often are the cameras actually turned on and recording . We investigate which local departments track this information and which dont. Here is vicky nguyen. Hang on. No, no, no. Sir we have a 417 just occurred. We got one detained. Rolling on the ground. Reporter youre watching cell phone video recorded by a Mountain ViewPolice Officer during the arrest of doug huff. Sir stop resisting. Im not resisting. Reporter huff shared this video with us admitting it doesnt show him at his best. But he says what this officers video also doesnt show, the Moment Police tased him in the chest and neck. He never moved his hands. Reporter huff says he and his wife were waiting at a doctors appointment when they got into an argument with another patient. He turned his his phone off and said he should learn to [ bleep ] his own business. Reporter huff says he pulled out his pocket knife. Thats when office staff called 911. He has the knife . What kind of knife is it . A pocket knife. Reporter what happened next is in dispute. Officers say huff ran out of the building and continued to run after they told him to of the. They say huff reached toward his waistline where an officer saw a knife clip. That officer tased him. Thats when a fourth officer ran up and just immediately tased me. Reporter huff was arrested for charges including brandishing a weapon and resisting arrest to which he played pled no contest. But he wants to know why there is no video of what happened before being tased. My husbands head was going straight into the curb. Reporter mountainview police declined to speak on camera because huff has filed a complaint against the department. But said none of the four officers on scene had a body camera because the incident took place during the voluntary phase of the body cam program. This is my tax dollars at work. Reporter its encounters like this where the police and civilian accounts conflict that are prompting a nationwide push for cops and cameras. I think the trend, frankly, is going to be towards greater and greater openness. Reporter chris just took the top cop job in tucson but served as chief of the richmond pd for the past decade. He is widely credited with Building Trust between police and community members. Do you think all Police Departments oshould move in the direction of getting body cameras . I do. Not only should they do it. But i think the public is going to expect that that they do it. Reporter magnus oversaw the implementation of richmonds body camera policy. It feels like a real gun. Reporter and training. For its 188 officers last year. Just so you know, we have body camera incident being reported. Reporter officers go through drills like this every three months to keep their skills sharp, skills that now include turning on their cameras at the beginning of any call for service. Keep your hands right where i can see them. Dont move. Dont move. Reporter data from richmond pd showed in the first two months officers were equipped with cameras, 28 use of force incidents. Anything from an officer displaying a taser to firing a weapon. But none of the incidents was reported. Over time the numbers steadily improved to 48 in the first six months, and most recently 92 of use of force incidents were caught on camera. Youre expected to have the camera on. Reporter magnus says there are times officers can turn off their cameras, including when theyre dealing with victims of sex assault or juveniles, but repeatedly not rolling during a use of force will result in discipline. There have to be consequences if you dont turn on your body camera. And we have in fact disciplined some folks for that. Reporter the Investigative Unit requested similar data from all Bay Area Police departments with body cams. We found most track when officers are recording during use of force incidents. But here at oakland pd, there is no way to know how often the cameras are turned on, recording or broken during use of force incidents. Even though the department has had more body cameras and for longer than almost any other bay area department. The Pilot Program started in 2010 and became official in 2013. A spokesperson for opd says the association doesnt have a tracking mechanism to show when cameras are rolling. We requested multiple rue interviews with the chief to ask why, but were told he could not accommodate our request. You cant have some officers turning on their cameras sometimes and some officers turning cameras on other times. Reporter seth morris is a deputy public defender in alameda county. His office represents 40,000 people a year. Why do you think its so important to have that data . Because this the use of force you have a Police Officer that is taking one of the weapons that theyre armed with and deciding to deploy it against the civilian. Whats wrong . Reporter and in those moments, thats when the community is most concerned about an officer acting correctly. There also was a real learning curve for officers turning on the camera. It seems like a very simple thing. And its not difficult to do. Its just do you remember to do it under high stress. Reporter morris says not only is it troubling if the department doesnt track whether its officers are recording during use of force incidents drop the gun, drop the gun reporter he is also seeing another change at opd. Theyll say to the other officer, i think we need to have an administrative conversation. Reporter is that code for turn off your body camera, well talk about this later . It is. It is. Its an unwritten code. Reporter opd says its policy allows officers to turn off the cameras when theyre talking administrative, tactical or Law Enforcement sensitive information. Reporter what do you think of that . I think its bs, to be honest. There should be ultimate transparency. My question to the chief when i spoke to him most recently, what is there to hide . Reporter as for doug huff, a judge ultimately sentenced him to one day in county jail and anger management classes. Some people might say you were taunting the officers. I was more overcome just with the situation. Reporter but he says he wishes the officers were wearing body cameras and rolling from the start. I thought i had the right to remain silent to capture the good, bad and ultimately as get as close to the truth as possible for both sides. Cameras might be a starting point. Reporter that was viky nguyen reporting. Body cameras became mandatory for mountainview Police Officers in december. Since that time there have been siskiyous of force incidents and 33 were caught on camera. As for other local departments, we have the data at nbcbayarea. Com. Reporter it was snowy valentines day in indiana. It was a huge pileup near indianapolis, at least ten people were taken to hospitals with injuries. We know that a squall came through here and the visibility was almost zero. And it just turned icy very quickly. So it is what it is. We deal with this. But in 32 years this is probably one of the worst crashes that ive ever seen. Reporter it was the coldest valentines day on record in the northeast. And frigid temperatures caused problems for firefighters in new jersey. They lost water in the beginning. Due to one of the lines freezing. Thats typical when you have this kind of weather. Reporter in new york the icy air almost scared off a tourist from london. We got off the plane yesterday. And i nearly run back into the airport. Ive never cold like that ever. Reporter the temperature kept many people at home in philadelphia. But not everyone. The revellers turned out for a Chinese New Years celebration. One woman said it wasnt so bad. Im not actually that cold. I lived in chicago for a while. So this this is cool. Reporter there is good news. Forecasters predict a warmup later in the week. Dan scheinman, nbc news. Across the congratulation in the northeast, but out west, its a different story. Weve got 50s right now. It feels relatively warm compared to those temperatures. Upper 50s and low 60s outside. Very interesting tonight. The areas in orange on the map here out towards contra costa and napa and solano counties. Thats mid 60degree temperatures outside right now, which is close to the average high this time of year. A 24hour temperature change. Starting to show 5 to 10 degrees of warming approaching midnight. And it has everything to do with the winds now that are offshore. And they will strengthen as we head towards tomorrow morning. Might get a little breezy from the hilltops of the north by and east bay. But the wind direction will take the air, force it down to sea level, warm it up and dry it out. And our temperatures are going to climb quickly. In fact, theyll start the day pretty mild with mostly 40s and 50s. 60s in on the hill tops. Around 12 00, already starting to see some 70s. So we could be breaking records tomorrow. Santa cruz and i think oakland airport, a couple of sights that will have a chance of doing that. Temperatures in the upper 70s to near 80 degrees. Some of the warmest spots around the south bay. San francisco low to mid70s possible. Average highs closer to 60 degrees. You can see around the north bay and trivalley, mid to upper 70s. And the pattern should hold on probably for another day. Tuesday looks like more 70s. And for the south bay, we could see temperatures close to 80 for one more day. And then things beginning to change wednesday and thursday. This is great news. This is normally one of the wetter months of the year. So far things in the middle, thats what weve done so far. Nearly two weeks of dry weather. The driest february for san jose going back to 1893. Nowhere near the el nino numbers we had in 1998. But we should see some changes to the numbers in the middle as the system comes in for wednesday. And it will be wednesday afternoon. Probably through thursday morning, about a quarter inch to 3 4 of an inch of rain for the bay area. This will be a goodlooking little system that comes through wednesday into thursday for the sierra, it looks like well get at least a foot of snow coming down for thursday. Could have some Winter Weather advisories for the second half of the week. And by the end of the week, unfortunately looks like High Pressure is going to be just Strong Enough to take the rain off to the north bay and a little further north as we move into next weekend. So weve got a couple of days of potential record breaking temperatures. Wednesday, thursday storm. A few north bay showers. And saturday and into sunday, not as warm as this weekend. But 60s, close to 70 as we head towards next saturday and sunday. So lets hope we can get all we can out of that wednesdaythursday system.
