Those free foods are Fringe Benefits that should be taxed. Derek shore is live in Mountain View with the affect it could have moth on not just the tech giants but Smaller Companies. Reporter thats right, jessica. Here in silicon valley, there are a number of smaller firms, and they actually use local eateries to feed their employees. The irs apparently saying buying the food is not a problem. But then giving it out for free is. For many its hard to even fathom, but for silicon valley, it has become commonplace. Tech Companies Like google and facebook offering up free eats for employees. But the gratis gourmet grub is starting to become something of a food fight. A lot of companies in silicon valley, google, twitter are giving their employees lunch every day. Reporter and it appears the tax man has taken notice that the free lunch was actually free, something the irs has a problem with, according to tax attorney. In the past you didnt have employers gives their employees free meals all day long. So this is a whole new area for the irs to clamp down on. Reporter in fact, published reports indicate the irs is designating the meals as taxable Fringe Benefits, and has been coming after companies when audits show the firm didnt pony up the tax for the meals. While some Companies Like google may be able to afford it, some Smaller Companies without the huge budgets could choose to do away with the free meals altogether which could trickle down to local restaurants, worrying some here in silicon valley. Its already regulated and taxed enough as it is. And if employers want to give their employees benefits like that, they should be allowed to. Reporter others say the bite of taxes is simply reality. Youre paying the employees theyre not spending on food. I mean, they have taxes for other things as well. Obviously they dont want to pay the extra tax and they dont want to have employees pay tax on the free lunch theyre providing. So theyre going to fight the irs on this. Reporter so the Tech Companies could do a couple of things. That includes pick up the bill to the tax cost or passing it along to the employees, or the employee could have their cafeterias turn into Something Like a restaurant where they actually pay for each item they get. Much of the money is going to the state, but locals arent happy with that. Reporter jessica, the locals out here are frustrated about a lot of things. Nearly four years after that deadly explosion, people here are still rebuilding, and recovering. Thats not a new home across the street, thats the Construction Office sitting right next to a vacant lot. For people out here, no matter how high the penalty, it will never be enough. This is absurd. Why should they be allowed to even continue . I dont understand that. So 1. 4 billion is not fine. Reporter glenview fire survivor rick says a 1. 4 billion fine for pg e is nowhere near enough. The utilities Gas Transmission line exploded in his neighborhood on september 9th of 2010, eight people died. 66 were hurt. Survivors are still rebuilding. I think about the people that died.
