Most cyclist jack fraser has the green light. The fire truck driven by the firefighter has emergency lights and siren on but doesnt slow down that make sure the intersection is clear. The 32foot ladder truck slams into him. I talked with his attorney by phone. Im extremely disappointed and angry. Jeff is a lawyer who specializes in motorcycle accident cases. Hes currently suing the city of San Francisco and michael quinn, who has since quit the Fire Department. Quinn had been facing felony dui charges but there was problems with the evidence. The judge dismissed breathalyzer tests given by his fellow firefighters after the crash because their equipment was not properly calibrated. And that meant Police Officers had no probable cause to arrest quinn and administrator a blood test which itself was not useful in this case because blood was not drawn until six hours after the crash. Frasers attorney quickly questioned why quinn didnt face different charges. They never charged him with felony hitandrun which to me was a slamdunk. Afterwards they told our iteam the better and pub has surveillance of him being given lots of water inside the business possibly by fellow fire firings. He didnt return to talk to San Francisco police for two hours. The San Francisco District Attorneys Office issued a statement we disagree with the decision and are exploring all options. Quinn had been out on bail and walked out a free man. Abc7 news. The bicyclist who was robbed after being hit by a truck in west oakland two months ago is out of a coma and speaking. 25yearold greg lowry suffered severe head trauma and has been comatose since the accident happened on january 13ing. He emerged from the coma three weeks ago and thursday began talking again. These photo show him awake with his mother. The story attracted widespread attention when he was pickpocketted while lying in the street critically injured. The 80yearold driver who hit him was also robbed. No arrests have been made. An uber driver was wheaten and robbed in the Richmond District this week. He was standing outside his car early wednesday morning at 10th and gearry. He was surrounded by four men one of them punched the driver in the face. The men stole his toyota and crashed it a block away. The suspect who hit the uber was later arrested while waiting for another uber drive. Two additional suspects have also been arrested. Come bell Police Believe a man was drunk and he hit and killed their own step daughter in the driveway. He is now under arrest as the family mourns the loss of a woman who would have been celebrating her 42nd birthday. I keep thinking i will wake up and its a nightmare. She is not only reeling from the death of her daughter. Shes forced to see it over and over again in her mind because she witnessed it. Right there i saw her face. It was like, dad, what are you doing . It just haunts me. Francis said her husband phillip, had been drinking all day when he left to go to a liquor store around the corner. When he got home just before 5 00 thursday evening, leslie was in the driveway trying to guide him into a parking spot. He hit the gas instead of the brakes and ran over her. She died on the driveway at the hands of the man who raised her. He never intended to do it, but it cant be taken back. I lost my daughter. The police say he was drunk. He they arrested him on suspicion of Second Degree murder. Based on the investigation and his statements it became very apparent he understood the potential consequences of driving drunk. The only reason im doing this if someone thinks they can have one or two beers and drive down the street and pull into their driveway without any consequence, think again. Think again. Her family is now planning a funeral instead of a birthday party. Abc7 news. Our time is 5 05. An east bay school on lock down following a shooting. One person shot at el cerrito high school. We have the story. Out of nowhere we heard the pow, pow pow. It happened just as classes let out at el cerrito high. A man what is shot twice right in front of the school. This man heard the police responding. I got more and more scared. And they said we are on lock down. Two High School Students were there when the gunfire erupted. Both were detained for questioning. They are in a position to give us information about exactly what did occur because our victim has been unwilling to provide us information as to how this altercation started. The victim refused aid and took himself to the hospital where police followed up with him. They are also looking for two to four other young men believed to be involved. Nervous kids were reunited with their kids. Abc7 news. Police in palo alto are working to find a motive this morning into an apparent murdersuicide in an apartment complex. The victims have not been identified. But police said a man in his 60 was found shot had to death. And another man in his 60s was found in the elevators. Police said they both lived in the low income senior apartments, and neighbors say one of the men was the manager. Palo alto police say crimes in this complex are highly unusual. A shocking discovery at a south Bay High School after students found a body in an outdoor swimming pool. Had morning investigators still trying to figure out what happened. In east san jose, a community in disbelieve at piedmont hills high school. The first thing that went through my head was, was it a murder was it an accident . Many students with lots of questions after a body was discovered on campus. As students and staff were taking off the pool covers, a body was found at the bottom of the deep end of the diving pool. San jose Police Responded just before 9 00. The superintendent of the east Side Union High School District tells abc7 news the pool is locked up after swim practice and before Second Period physical education classes came in it was an intentional effort for someone to climb over the fence and get into the pool. A look from sky 7hd shows the scene from below. First responders said the body was found fully clothed and weighted down. They had to use specialized urban search and rescue equipment to raise the body of an adult male out of the water. They try to determine if it is suspicious in nature. Students puzzled by what they saw. It is very shocking. I was a little bit scared because i thought this would be a student that i knew. District leaders have confirmed it was not a student or staff member. Kids were sent home early but not before grief counselors were brought in to comfort. We didnt know how long it would take to come and remove the body and do their investigation so we felt we wanted to give the police department, Fire Department and corn norse Office Plenty of space and time to take care of business. The corn norse office has yet to release the mans identity. Surveillance video has been turned over to police for processing. As regular commuters on the bay bridge have been noticing big changes are happening to the eastern span of the bridge. This is a view from the end of the pedestrian walkway on the new stand. A 1400 footpath. Most of the upper portion of the old bridge will be gone by 2018. Caltrans awarded a 69 million demolition contract to an Engineering Firm to take down most of the steal structure. Once its gone, it will allow for the extension of the pedestrian walkway and next year will connect Treasure Island with the east bay. Im sure a lot of people are excited for that to happen. Yes. Good morning to the friends in the north bay and the viewing area. We are taking a live look at the Golden Gate Bridge this morning. We will see how hot it will get today in terms of temperatures. Lisa argen is coming up with the full accuweather forecast. Authorities in Brooklyn New York say seven children are dead following an Early Morning house fire. It broke out around is 12 30 this morning eastern time. The children are between 5 and 15 years old who died and are believed to be family members. Two others critically injured. 100 firefighters were called to respond. Hundreds of gang members of now behind bars following a major arrest in san jose. The arrests reveal how gang members in prison were profiting from crime on the streets. We have the story. The crimes are appearing here in the streets of san jose but the orders are coming from 400 miles to the north from behind the walls at pelican bay state prison. Thats where three socalled generals of the Nuestra Familia gang were calling the shots. The directions were written in code and smuggled out in the body cavities of people leaving on parole. We recovered hundreds of written communication that is had really never been seen on this level and in this depth. It was so exitsity that we have the three generals behind the walls at pelican bay in writing and with their signature on very specific gang directives that were in the possession of one of out arrested suspects. The gang members each had nicknames such as pistol monster and bam bam. Six are still at large. There was an organized chain of command. Drug task force steams seized drugs and guns and money during the arrests. A percentage of crime proceeds arks long with protection money paid to the gang made it to the Nuestra Familia leadership behind bars. We had so many cooperatetors and source documents and history with this gang that we hopefully are deterring them from putting down a foothold in this city ever again. The gang members go on trial in san jose starting april 13th. In san jose, david louie, abc7 news. A San Francisco judge says he will consider a a change of venue request in an effort to move a sexually predator out of a walnut creek neighborhood. The 71yearold was placed into a home in january by a San Francisco court. The decision upset neighbors and the Contra Costa County District Attorney who claimed they were not notified about the move. Yesterday a judge agreed with them and granted a hearing that would allow the challenge to be decided in a Contra Costa County court. That hearing is scheduled for tuesday. No questions asked. That is the promise this morning for from one city leader and the San Francisco police in the buy back program. They will pay 100 for returned guns and an assault weapon you will receive 200. Concerned about protecting the agriculture lands. We are famous for the Wine Industry here but at the end of the day its still agriculturer and farming. They received an anonymous tip between the band and a las vegas developer to build a casino in one of three counties, serrano napa or this is a quiet town. We cater to wine and small business. Napa county supervisor says it is not about trying to preserve an image, but rather its primary designation as an agricultural preserve. Napa county there could be a casino . I think thats a conversation people want to have but it needs to be done in an environment everyone understands, we have to have the same goals. The tribal leaders say they plan to build a casino in the north bay, the plans are very preliminary. However, the groups are going to put up 100,000 to head off the effort. Fog has been a problem at the coast. Fog and six mile visibility from the coast to napa and petaluma. A weak front is with us today. And a stronger front will head in over say tomorrow night into monday. But, you know, both systems very, very weak. If we see anything at all, it will be a couple hundreds. Heres live doppler 7hd. You see the cloud cover off the shoreline and you pick up a few areas of sprinkles and light snow into the Sierra Nevada in south lake. Maybe an inch or so there. Nothing really to write home about. But we will be cooler today. From the sutro tower camera there are clouds around San Francisco. Its 56 there. 54 at san carlos. 49 in morgan hill and Half Moon Bay a balmy 57 degrees. You see all the clouds from our exploratorium camera. And i did run into plenty of low clouds along the coast this morning. Be careful if you are headed out early. 48 degrees right now in santa rosa. Thats the cooler spot. 53 fairfield with 56 in concord. It is milder with all the clouds acting like a blank he will, insulating us this first full day of spring. A. 15 degrees milder this morning in santa rosa. Anywhere from 2 to 14, 15 degrees warmer especially at the coast. So from our emeryville camera. You cant make out the bridge because of the clouds. We have coastal clouds, a few sprinkles, a system offshore. And partly to mostly cloudy skies today. A stronger system for tomorrow, bringing increasing clouds and another chance of rain right through monday. But then after that we do have strong High Pressure building in and more 70s and 80s are likely around the bay. So starting with this weak front offshore, you can see it there. Not much to it. Its going to fall apart and we will be looking at some sunshine today and still some mild numbers. So the first system allowing for the clouds maybe a few drops. This is what we get into come tomorrow into monday. So you notice a little bit more impressive, but still rainfall amounts ranging from a couple hundredth, maybe a tenth to. 2. So as we go through the next couple of hours, you will notice by 2 00 in the afternoon we have a coastal fog, Marin San Mateo and overall we get into sunday. Here come the next system come sunday, sunday night. A chance of light rain. Cloverdale and ukiah. Temperatures are milder with the cloud cover. Fog is a problem at the coast. Petaluma napa, 5 to 6 mill visibility. You could is he a few sprinkles around the bay. You have the milder numbers to start but by the afternoon things could be cooler. The cloud cover will thin out but it could be partly to mostly cloudy today with the possibility of a few sprinkles here and there. But a better chance comes your way later on tomorrow. Community activists will hold a Prayer Service and walk tonight to mark the shooting of a man by San Francisco police. He died after officers confronted him while responding to a call about a man with a gun in Bernal Heights park. Police say he pointed a taser at the officers. They have yet to file criminal charges against the officers. It set off a series of protests over the past year. Tonights activities there include a screening of the film called a morgue or alex. Its been a year since four officers were shot and killed by a parolely. They were shot and killed by 26yearold man during a traffic spot. Man barricaded himself inside an apartment and opened fired on s. W. A. T. Team members Sergeant Irvin romance and dan. He was later killed in a shootout. Its the last time four officers were killed on the same day in california since 1970. A woman tries to get her possessions back after her apartment was burglarized over the holidays. She has done a lot of digging but at every stop there are obstacles. Vic lee has the story. Im incredibly frustrated. I dont know what to do. It was christmas eve. A jolly time for all except kimberly. Her apartment was burglarized while she was out of town. Tv, Laptops Electronics jewelry, gifts. The burglars stole 15,000 worth of her possessions. Even this. Toothpaste. Toothpaste . Yeah. The burglar climbed five floors on a scaffolding, came through a door on the roof and broke into her apartment. She called police. The investigators were able to get a fingerprint off her front door mirror and they were able to match it to a prolific burglar, wanted for other burglaries but hes still on the loose. I feel terrible if others are getting burglarize bid the similar person. She found someone was watching her stolen tv set. She has a netflix app with a saved password. All of a sudden my tv was back on line and they were watching movies on any netflix account. She captured a screen shot to track down where her stolen tv was. She asked her courier to give her that as. The answer, no, because of privacy laws. It was shocking to me. Its do i not have the right to go after my own property . Its stolen property, it belongs to me. She said the investigator told her they didnt have the resource to go after the tv. So she went to court to try to get a subpoena forcing at t to give up the address. This came in the mail yesterday. Motion denied. So kimberly knows who the burglar is. The trouble is hes still on the loose. She also noise that someone in San Francisco is watching her tv set, but she doesnt know where he or she lives. So while she waits for good news well you know that old adage, justice delayed is justice denied. Vic lee, abc7 news. Californias surging economy keeps rolling along. The Unemployment Rate fell last month dropping to 6. 7 . Thats the lowest rate in california since june of 2008. They have added 1. 8 million jobs since the recovery began in 2010. No place reflects that growth better than in the bay area. We added 23,000 jobs last month dropping the Unemployment Rate in every county below that figure. San mateo is the lowest at 3. 5 unemployment. Governor jerry brown is pushing for employment for former convicts. Brown spoke about the idea at merit college in oakland yesterday. Nearly 3,000 in meats had been paroled since california prisons sinces proposition 47 was approved last november. Governor brown says offering inmates jobs gives them a Second Chance at life and reduces crime. And the world of people in prison changes and it can change for the better if they are working and they earn some respect. So this work i see is yes about public safety. Governor brown had programs from the california industry that teaches them job skills earn degrees and provide Mental Health support. A data breach for hundreds of people. A maine woman requested her Credit Report from equifax, but instead of just her Credit Report she received hundreds of reports for people across the country. More than 300 pieces of mail came to her house. Each includes Social Security numbers, birth dates and banking information. I checked my Credit Report the other day online with equifax and this was it. The next thing i know i have 300 pieces of mail sitting in my mailbox. I am not supposed to have this information. This is unbelievable. Somebody has messed up. Equifax says it doesnt yet know if this is a widespread problem or how it happened. They say they are still investigating. 5 37 our time. Hundreds of bay area High School Students are set to make a difference this summer by traveling to latin america where they will participate in service programs. This powerful educational experience will help them become ledders in their own communities. Abc7 News Reporter Lyanne Melendez spoke to some of those students. They spent more than 2 weeks working at a school with disabled kids. To do so they traveled all the way to nicaragua. Having an opportunity to see how people outside of my comfort zone live daytoday lives. We painted murals and put carpet in and tried to give it a brighter tone. Seemed like they were lacking a lot of resources and their building wasnt in good condition. It was all possible thanks to an oaklandbased Organization Called global glimpse. They come back really with a sense of responsibility of confidence bus they have proven to themselves they can do something that they never thought was possible, of leadership. Because of private donations, global glimpse is able to take students from underserved communities in the bay area to impoverished areas of countries like ecuador and the Dominican Republic and nicaragua. Since it started they have taken 1900 students to latin america. The hope is they come home to be Civic Leaders in their own community. They understand everything they do here impacts the lives of people next door people across the community and people around the world. This woman volunteered at a school in the Dominican Republic encourages other oakland students to do the same. I like to give back to my community. Thats one thing i learned out there, how we are giving back to their community. I brought it back here. This summer they will take 509 students from 40 bay area high schools. In oakland Lyanne Melendez, abc7 news. The iconic embarcadero restaurant sinbads is expected to close for good today. They will leave pier2 to make which for a few ferry terminal. They said they were late paying rent and bounced checks. They have also issued warnings about food safety issues. Something new has popped up near at t park. The tax is due whether or not you file an extension on april 15th. The extension gives you time to file your return but the tax dollars are due. Consumer reports said another big mistake, not filing at all bus you cant afford to pay your entire bill on tax day. No matter what, you have to file your tax return. Usually you can set up an installment plan with the Internal Revenue service and avoid a stiff penalty but you are still going to have to pay interest. You can find the forms on irs. Gov by typing installment into the search box. Another tax mistake, not claiming everything you are allowed. For instance the federal tax credit for Energy Efficient upgrades to your home. If you made improvements that qualify, be sure to include those. And heres something regarding your parents you may not know. If you paid more than 50 of your parents Living Expenses you may be able to claim them as dependents even if they dont live with you. When it comes to charitable deductions, dont assume a cancelled check is enough to prove your generosity. Charitable contributions of 250 or more you will need a receipt from the organization showing the amount you dont natured. If you claim business deductions like meals, keep the credit card receipt but you should also note who attended and why. If you you make an error on your tax return, all is not lost. We could see a few sprinkles here and there. The atmosphere really in the low levels is too dry to see any sort of rain. This first system kind of a primer. Pushes on through later on today. And then the next system will bring more clouds our way in advance of it tomorrow. Cooler conditions again. And we will lack for a chance of rain tomorrow into the early part of monday. But then by the middle of next week we will be turning much warmer and much sunnier. Weve had some clouds around throughout the past several days. And today really no different. Theres the front. Its going to sit offshore. It will bring us a good dose of cloud cover. It will thin out from time to time. So today be slightly sunnier and milder day with a few drops possible. Then this is the next slightly stronger system that could bring us a few light showers. The focus up in the north bay. Sonoma county, petaluma, perhaps marin a couple hundredths and berkeley. Overall it looks pretty dry for most of you in the south bay over the weekend. We will look for this afternoon to be partly cloudy. Monday maybe showers toward the north. Here we are monday, 5 00.
