thanks for joining us i'm kristen sze. i'm eric thomas. an early morning accident has sent several people to the hospital. all of them were under the age of 18. >> amy hollyfield has arrived on the scene. >> reporter: we just got here and i've got to show you this car it is still here. it is really mangled. six teenagers inside that car. basing -- it is facing the wrong way that road travels the other direction than that car is facing. it did hit a tree. all six inside were taken to the hospital and they are all under the age of 18. i asked the officers if they suspect speed or alcohol or drugs were factors? they say it is too early to say. they did point out this is a single vehicle accident, no indication that any other car was involved. this happened on island drive at robert davie, jr. here in alameda. this happened at about 1:45 this morning. a section of island drive is closed and it will be for a while. they are predicting until at least 10:00 this morning. the accident investigation team is on its way and has work to do. they are going to keep the section closed as they try to figure out why this happened. we will keep you posted throughout the morning on what that team finds and on the conditions of the teenagers working on getting those for you stay with us as we continue to follow this developing story. amy hollyfield, abc7 news. authorities in santa clara county are this morning investigating a tragedy that hit one of their own. the toddler son of a san jose police officer is dead apparently shot by accident in his own home in gilroy. terry mcsweeney is live at the gilroy police department. >> reporter: the investigation underway. the first comes to mind might it have been the police officer's revolver used, another gun, where was it? not a lot of information being given. we talked to an officer he did not have anything to add. this is from last night. the incident happened 5:00 last evening, 3-year-old boy shot. the child of a san jose police officer emergency crews came to the house here in gilroy try to save his life unable to do so. the family members were in the house at the time when the shooting happened. it did happen inside the house on the 7500 block of kentwood court. gilroy pd investigating the investigation continues into how he was shot. they are not saying who shot him or if it in fact was the san jose police officer's service revolver that killed him. we are not getting a lot of information. investigators look into the firearms and how they are stored in that house. again, a 3-year-old boy the son of a san jose police officer shot and killed at a house in gilroy last evening. terry mcsweeney, abc7 news. in the south bay, five members of the same family are accused of neglecting residents of the care home they ran. they are all free on became the home operated without a state -- free on bail. the home operated without a state license. the residents were nonenglish speaking immigrants who were beaten animal newered and -- malnurished and forbidden from using toilet paper. 50 dogs wandered the home. >> the victims stayed in three or more in a bedroom. no bed, on the floor with mattresses. they bathed once a month before they were taken to the doctors. and it is pretty terrible. >> adult protective services has found other care arrangements for the victims. police are asking peep in the community to come forward if they have information -- >> jeeping news, horse racing industry mourning the loss of a jockey killed during a race yesterday at the alameda county fairgrounds. 33-year-old hooray herrera was thrown from his mount during the 8th and final race, 30 seconds into the race. this is video courtesy of the california authority of racing fairs. herrera's horse morito clipped heels with another horse and stumbled causing the jockey to fall. he was taken to the hospital with massive head injuries where he died less than two hours later. fair organizers say this is the first time a jockey has died at the track since 1975. the questions about possible perjury involving sworn testimony by san francisco mayor lee are intensifying. the examiner reports former supervisor contradict the story the mayor presented last week. lee testified that he never offered mirkarimi another job if he resigned and did not authorize a third party to do so. the supervisor says was asked by to tell mirkarimi an alternative job would be offered as a willingness to resign. saying he was acting on behalf of the mayor. mirkarimi's wife will testify on his be half in person -- on his behalf in person. mirkarimi's defense team told us lopez will testify before the ethics commission july 18th or 19th and a group of private donors will pay for her flight to san francisco. santa clara prosecutors will have to rethink his case after a jury acquitted a san francisco man of beating a priest on all felony counts. will lynch was smiling as he left the courthouse yesterday he was on trial accused of beating father jerry lindner two years ago. lynch says the priest raped him when he was a child. prosecutors say they have no doubt lynch was molested but say beating him was felony assault and vigilante justice was not the way to handle it. >> just punishment is delivered to our justice system -- is delivered through our justice system not through the acts of one traumatized and troubled man with >> i think he's criminally insane i think he's a sociopath and a very dangerous person and needs to be put away. >> the jury also acquitted lynch on misdemeanor elder abuse. but could not agree on the charge of misdemeanor assault, leading to a mistrial on that count. it is unlikely prosecutors will want to retry him on that in an unusual move the state senate has approved a one-time bill temporarily freeing a death row prisoner would it allow so-called speed freak killer wesley shermantine to help search for the remains of his victims police believe there are dozens of them. searchers found hundreds of bone s in a well after shermantine drew a map for a bounty hunter who paid him $30,000. the family of a hayward man murdered in west oakland is asking the community to help find his killer. the 30-year-old had just left his mother's house early sunday morning when he was shot to death in his car on market street his devastated family gathered near the crime scene yesterday. they canvassed the neighborhood, handing out fliers asking for any information on the shooting. he was a married father of two on his way home from his job as an event planner when he was killed. >> the family of a man who face charges in connection with a shooting and accident on the lower deck of the bay bridge is denying he had a weapon. 29-year-old antonio robertson is on parole for human trafficking. investigators say erased his car past officers 1:30 yesterday morning and crashed east of yerba buena island. officers fired at the vehicle after the man flashed a weapon nobody was hit by the gun fire. the incident caused a massive traffic back up for hours on the lower deck of the span. san francisco police are investigating a frightening crash in the city and out of -- an out of control driver smashed through the front door of a restaurant last night then took off. you can see from the video the police tape around the roadside barbecue in richmond. nobody was hurt, the workers and customers were sent running. police are looking into a car found abandoned a block away to see if it connected to the crash. this morning an east san jose parish asking for help after thieves stole $25,000 worth of musical he equipment. ♪ ♪ -- >> the thieves stole the strums tuesday. the church's youth group use them every weekend. the pastor says the kids spent endless hours into a tree with teenagers inside. >> reporter: i just got an update. the driver of the car is 15 suffering from life-threatening injuries. he's in critical condition. four of his passengers were 15-years-old and one of his passengers was 13. the accident investigation team has asked us to turn off our lights you can't see the car behind me. let's get to the video. the car is mangled, facing the wrong way, it hit a tree this happened at 1:45 this morning. an investigation team got here 30 minutes ago to try and fix out why this car crashed into a tree. i asked investigation -- i asked investigators if they suspect drugs, alcohol or speeding, they say it is too early to say. no other&w cars involved, obviously an inexperienced driver was at the wheel, unlicensed one he was only 15. this section will be closed for a while. as they investigate this crash and try to figure out what happened. do anticipate this area will be roped off until athlete 10:00 this morning. amy hollyfield, abc7 news. police in santa clara county are investigating the shooting death of a 3-year-old boy in what they say appears to be an the shooting happened inside the boy's home around 6:00 last night. the boy either accidentally shot himself with a handgun or was accidentally shot by a friend playing with the gun police confirm the boy was the son of a san jose police officer. terry mcsweeney will valley city of 300,000 filed for chapter 9 protection last week after failing to reap a deal with creditors on a 26 million dollar deficit. stockton officials want the judge to approve a 2013 budget that allows the city to default on payments cut employee wages and stop paying for retiree health insurance. one creditor says it we will fight the bankruptcy. antioch officials will consider reopening city offices fridays. antioch's fiscal situation has improved slightly and some city lawmakers want to end friday furloughs that started three years ago to satisfy money. the city manager is peeling the guilty verdict and death sentence he received for the murder of his pregnant wife laci and their unborn child. he was sentenced in march of 2005. his attorney filed the appeal with the state supreme court yesterday. he argues the trial should have been moved from san mateo county after 95% of the prospective jurors said they had been exposed to publicity about the case. peterson who lived in modesto, claims the overwhelming publicity, incorrect court rulings and over mistakes deprived him of a fair trial. a mother being held on child abuse charges after putting something unusual in her 2-year-old's sippy cup. witnesses say a mother in arizona poured beer in her son's cup and the boy drank some of it. they called police who determined the liquid was consistent with beer. the boy checked out unharmed at the hospital and now in his father's care. officers say the mother admits to having given him beer she says because he kept reaching for the pitcher. florida lifeguard fired after leaving his post to rescue a swimmer is being offered his job back. tommy lopez was let go a few days ago he broke a company rule by leaving his section of the beach. the 21-year-old says the man was droning -- drowning outside the zone his company was hired to what the head of the company says firing lopez was wrong. what will he do? >> i humbly declined the invitation to get my job traveling southbound there's minor slowing at the scene because the accident is in the left lane and so it is a little bit of a causing distraction for drivers in the opposite direction. you heard amy
