Video. A traffic stop turned into a pursuit with this suspect chasing into this garage with police behind him. Police say they used a taser and he was unaffected by it. Police say the 32yearold martinez struggled with officers. He was able to break free of the officers and run into the kitchen where they were able to get ahold of him. Both had their arms around his neck and then they drug him inside of the house and shut the door. This man in the garage and a friend of martinez gives a different account. They drug him inside of the house and closed the door and i could hear them tasering him and beating on him the whole time. I heard three or four more tasers. Reporter police say he resisted arrest and bit a officer and backup officers arrived. As he was handcuffed, they realized he was not responsive. All of the officers have aeds in cars and we immediately started providing lifesaving measures, including cpr. Reporter police say martinez d died at the hospital. And his mother said he was murdered. He didnt die in the hospital. What do you think happened . They beat him up. They murdered him there in my living room. And he said his 6yearold daughter watched it all. He had convictions for assault and drugs and other Violent Crimes and his family said he was trying to get his life together and had a job and leaves behind a 15yearold son and 8yearold daughter. Three officers are on leave as the d. A. Investigates the death and results of an autopsy are expected to reveal why martinez died. In pittsburg, leslie brinkley, abc 7 news. Well the soberanes fire burning near big sur has turned deadly. A bulldozer operator was killed overnight working the fire line in Monterey County. The fire has scorched nearly 24,000 acres. It is only 10 contained so there is a long way to go. It has destroyed 20 homes since it broke out on friday. Cal fire estimates another 2000 are still threatened. Tic the Highway Patrol is investigating what caused this fiery accident early this morning along 880 in san leandro. A truck hauling motor oil burst into the flames and the driver was killed. Why the driver crashed is still a mystery. Amy hollyfield has the story. Reporter the aftermath is tough to look at. A man died in this crash. The big rig he was driving is hardly recognizable. There was so much damage, investigators didnt even know what he was hauling. It spilled and could be dangerous. Initially we didnt know what it was carrying. Any markings or placards burned up. Reporter here is a look at fire that broke out when his truck hit the concrete divider. The driver was not able to escape and was killed. Investigators havent found any skid marks. There is no indicators of another vehicle being involved yet and there is no vehicle indicators of a brake application or anything being applied before the collision. Often when this occurs, it could be someone falling asleep or having a medical issue. Reporter it happened at 4 00 a. M. On northbound 880 in san leandro. Investigators had to shut down one lane and the davis offramp. They got the debris cleared out and the lane open by 8 00 a. M. But the backup by then was extensive. This is i880 through the east bay so even on a good day traffic is miserable through here. Reporter they estimate that about 1,000 gallons of motor oil spilled here so the hazmat team has to remove and replace all of the soil that absorbed that oil and also flush out the sewer system since some of it spilled down the drain. Reporter this is a man who pulled out of the race for superintendent of los angeles schools back at the beginning of the year. Well, he told me houston on the other hand is a good fit. In between meetings, the superintendent of San FranciscoPublic Schools, richard car anza sat down to discuss the reasons for accepting the houston offer. Besides raising salaries for teachers by 12 over three years, he agreed with the union on how teachers are evaluated. Although it is comfortable where i stand here near the coast as we have the cooling low clouds at the coast as you could see here at the golden gate bridge. The forecast features tomorrow. The fourth consecutive spare the air day. Air quality is declining in some parts of the bay area throughout the week. Wide range of temperatures could be expected through saturday and this intense heat will ease by sunday. Overnight, look for a fog at the coast moving over the bay but not very far inland and low temperatures in a mild range of upper 50s near the bay and low 60s low to mid60s in the inland east bay. So mild and perhaps uncomfortable overnight. Here is the fog forecast animation. Just limited fog around the bay early tomorrow morning, about 7 00. A lot of low clouds and fog at the coastline of course. And so then after 8 00, well see the fog that is out over the bay pulling back to the coastline, giving us another hot day inland. Hazy conditions in the south bay as more smoke from the fires to the south move up into our region. And of course fog will linger at the coastline. High temperatures tomorrow in the south bay will be in the mid to upper 80s down to san jose with a high of 88 and then upper 90s in morgan hill and gilroy and low to mid90s in the los gatos area. On the peninsula, highs of 82 at redwood city and 84 mountain view, upper 50 toss around 60 on the coast and downtown San Francisco a high of 67 tomorrow. Up in the north bay, 91, 87 napa and 76 at oakland. 64 at Castro Valley and the inland will have numerous tripledigits from fairfield to antioch to livermore. San franciscos acting police chief has been on the job for 60 days and now hes already have success in implementing changes his predecessor put into motion. Vic lee sat down with acting chief chaplain and joins us now with that. It was a very candid and wideranging interview in his office. He said he is satisfied with the progress of the reforms hes making but he also said he still has a lot of work ahead. And of course, i started with the obvious question. It has been two months, what has it been like . Busy. Dealing with the budget issues zblfrm reporter acting chief chaplain is about 80 through the use of force policies and the creation of time and distance in deescalation. In the two months since he has been chief, three incidents have been diffused without using lethal force. A man with a gun barricaded in a chinatown apartment after a daylong standoff. Another man with a gun earlier this month taken into custody in the tenderloin district after another tense standoff. And just yesterday, police using less lethal force to take down a teen armed with a knife. I think it is the Guiding Principles for the new use of force policy was a huge part of it. Weve been talking about how these things are going to help us out. But now you have actual factbased situations to show that these things are working. Reporter when the mayor appointed chaplain, the use of body cams was already becoming a reality and now they, too, are being implemented. Getting the body cameras rolled out. One of the things im looking at is a way to get the Publics Trust in the process of officerinvolved shootings and subsequent investigations. Chaplain would not comment on it but he did seem to embrace the concept. One of the complaints i consistently hear in the community is they dont want us investigating ourselves. Right now, in baltimore where the state attorney dropped charges against three remaining officers involved in the death of freddie gray. An unarmed black man. Ray raimundi has the latest developments. In the shadow of memorials, a gag order lifted and baltimore state attorney now sharing her thoughts. We do not believe that freddie gray killed himself. We stand by the medical examiners determination that the death was a homicide. Her officer charges against the three remaining Police Officers charged in the death and marking the bitter end to one of the most closelywatched Police Prosecutions in america. We could try this case a hundred times in cases just like it and we would still end up with the same result. Reporter she charged six officers last year after 25yearold gray suffered a fatal spinal injury while being transported in the back of a police transport. We stand behind her prosecuting team. Were pleased that the criminal charges against officer miller, porter, Sergeant White have been dismissed. The Baltimore StatesAttorney Office had an opportunity to do an in depth investigation and they did not. The man who attempted to assassin ate Ronald Reagan will be allowed to leave a Mental Hospital and live with his mother. The ruling on John Hinckley jr. Comes 35 years after he shot and wounded president reagan and james brady outside of a washington hotel. Hinckley was found not guilty by reason of in sanity. Doctors have said for years that the now 61yearold is no longer plagued by the Mental Illness that drove him to shoot reagan. The suspect in the mass stabbing attack at a facility for the disabled in japan is asking to be judged innocent on grounds of insanity. Police transferred the man to the Prosecution Office today. The 26yearold made the plea in a letter he sent prior to yesterdays attack that left 19 people dead and 25 others injured. Authorities released the Surveillance Video of a man driving up in a car and carrying several knives to the facility. The letter that he sent to the parliament in february outlines the plan and said disabled people should be put to death. An investigation by French Police has concluded that security measures in nice were appropriate on the night of the deadly bastille day attack. 84 people were killed, hundreds injured. The interior minister faced accusations that his office tried to cover up the lack of security. The city of orlando wants to turn the site of the pulse nightclub massacre into a permanent memorial. The vouchers are good for 50 off a future domestic flight. There is a lot of fine print. Make sure you read it. All of this comes with an apology from the airline ceo for the Technical Glitch that snarled traffic for four days and forced cancelation of 2300 flights. Thousands more were delayed. And many passengers were stranded in long airport lines. Southwest would not say exactly who qualified for the half off coupon or how many will receive them. The airline is sending them out right now. What if you get on the plane and your baggage doesnt. It could be annoying. Especially when you paid a hefty fee to check the bag. And now there is a remedy. A new federal law said Airlines Must refund your baggage fee if your luggage is lost or delayed by more than 12 hours. It will be up to you to make a claim for that refund and the faa has one year to put that rule into effect. If your kids play video games, you know the danger, they could inadvertently spend money on inapp purchases. But parents are entitled to refunds by kids made on facebook. The ruling came against the social network and claims children didnt realize they were spending real money when they used fake money playing games like farmville or be jewelled. San jose firefighters were on the scene of a grass fire this afternoon near yorba bena high school. The fire burned less than two acres and no homes were threatened. It is now under control. In san rafael, fire officials are asking for 100 feet of clearance between brush and structures. They need it for the offense space in this high danger fire season. Sky 7 hd is over the onramp to check the ramp. That is a key entrance to the bridge for San Francisco commuters heading to the east bay. So it does have the potential to cause severe backups but we are getting word from our viewers that the motorcycle officers have made their way there and traffic is just now starting to move again. As you could see from the picture as well. And they are also telling me via twitter that it appears to be janitors out there doing some protesting for the group but that, once again, it is now flowing. Fighting the soberanes fire on the ground and from the air. We are finally getting the first good look at this fire from sky 7 hd and you could see it is massive. Tonight mandatory evacuation orders are in place in the areas closest to the massive fire burning in Monterey County north of big sur. Here is another stunning look at the smoke as seen by sky 7 hd. Look at that. So far the flames have killed one person and destroyed 20 structures, 2,000 more are threatened. The soberanes fire is currently 36 square miles or a little more than twothirds the size of San Francisco to give you a real perspective on that. The fire is only at 10 containment.
