searching for the man who fell into the water. the search has been going on all night. the helicopter hovered above the bay with searchlights while coast guard, police and fire looked below trying to locate the 27-year-old man. it started 11:00 last night. two baseball fans in their car parked here. one was on his cell phone the other got out of the car and never came back he disappeared. it is presumed that he fell into the water. that began the search. >> challenges are many, if the current is running fast then he could have been pulled out quite a ways. when it is dark, very difficult to locate anybody. now that they are going in the water they may be able to get a better idea if he could have gotten snagged on something. >> reporter: they are searching from the bay bridge to alcatraz. they've found nothing so far. family members are here. the victim is described as a 27-year-old hispanic male, wearing a blue jacket, blue jeans and a white shirt. they just simply have not found anything yet. they looked under the java house and pier so far no body or nothing indicating he is nearby. the search is turning to what they are calling a rescue. don sanchez, abc7 news. speaking of the game, san francisco police will be undercover again tonight wearing dodger blue to root out troublesome fans at the game against the dodgers and -- last night 40 fans were thrown out for misconduct, no arrests. the increased police enforcement is in response to the severe beating of brian stow during last year's opener. we are learning more about a house fire that killed a man in oakland today. it happened 4:30 this morning. katie marzullo is there. another man was injured, how is he doing? >> reporter: i talked with the battalion chief a few minutes ago she said that second man remains in critical. he was rescued from this burning home at the same time in the same location as the man who died. fire investigators are still looking into what caused this fire. neighbors have their theories. hours after the flames are out oakland firefighters are still working to keep it that way. >> our first units arrived and found heavy smoke and flames from the front of the house. >> reporter: their first priority, look for anyone inside. they found two men. >> they found them on the second floor in bedrooms at which point they were brought out unconscious in critical. >> reporter: neighbors say they are not surprised. they tell me the elderly woman who used to live here died a year ago the house had been foreclosed on and the power off but family members were still coming and going. >> one of her sons stayed here, i haven't seen him in sometime. >> if the utilities were off i wouldn't be surprised if they had candles. >> reporter: some believe they were using drugs in the house. this man claims he was inside at the time of the fire. investigators couldn't confirm his story if true he's lucky he got out alive. >> when we arrived the house was fully engulfed in flames my thought it was going for a while before anyone called the fire in. >> reporter: investigators did fan a working smoke detector in the home. -- did find a working smoke detector in the home. fires were able to put this fire out in 10 minutes the home is a total loss, the homes on either side were not damaged. katie marzullo, abc7 news. san francisco firefighters are look into what caused a fire that broke out in stern grove 2:00 this morning, flames raced along the ground crews were able to keep the fire to one acre by keeping it out of the eucalyptus trees it starred in a canyon area, nobody was hurt, -- fire is not expected to expect the stern grove festival kicking off its 75th season this sunday the fire did not cause structural damage to the stage or festival areas. new legal setback for the man charged with assaulting a priest he claims molested him and his brother as children. this follows yesterday's bombshell in the trial of william lynch accused of beating the priest gerald lindner. amy hollyfield is live at the court in san jose. >> reporter: good morning. the defense asked for a mistrial today it was denied. the parents of the defendants let out a sigh when the decision was an . i didn't hear the sigh i was three rows behind them. but the bailiff did and scolded them for reacting in court. here's video of the defendant and his defense attorney heading into court this is before the announcement was made. lynch is on trial, william lynch on trial for felony assault accused of beating a priest who he says molested him in court the defense argued the entire defense is based on the credibility of the priest without him on the stand he says the case is blown because he can't test that credibility he says with the priest invoking his fifth amendment right and the judge throwing out the priest's testimony the case should be thrown out the judge disagreed. lindner insisted he did not sexually molest his attacker. the jury was told to disregard that testimony so the trial is continuing. the first witness today was a paramedic who responded to help lindner in 2010. he testified that lindner was not actively bleeding. he was aware. he did have injuries to his face and bandagedded -- band aged by the nurses at the retirement center where the priest as attacked. most jurors swept a straight face when they were told the testimony was going to be thrown out some did show surprise. they were told to not consider that testimony and not speculate as to why it is being thrown out. amy hollyfield, abc7 news. stockton could vote to file for bankruptcy. stockton has the nation highest foreclosure rate it dried up property taxes and other fees city council sim -- expected to vote tonight. payments on debts and legal claimses would be suspended formal bankruptcy filing could come as early as tomorrow. happening right now the san francisco company behind farmville and words for friends unveiling next generation of games. zynga giving a sneak peek of releases. the company will give analysts more information about its business model which relies heavily on facebook games. the stock has tan a hit recently. zynga is expected to focus more on mobile devices and its own platform called zynga.com. >> new revelation from rielle hunter. >> up until last week you were saying you were a couple?
