escape gunfire at his birthday -- homecoming party. he is paralyzed and critically injured after two bullets shattered his spine. they say his brother got into an argument with another party-goer in san bernardino. soldier was shot when he tried to brake up the fight. he was home on leave and planned to go to college of a completing his army service. >> explosions ripped through nigeria this christmas day. a suicide bomber targeted four churches in the northeastern part of the african country. at least 25 people died in one attack where a bomber detonated his car. many others are said tore dead or hut. last christmas eve bombs rocked the country. a militant group is believed to be behind the latest incidents. a bay area family is turning tragedy into the gift of life. 23-year-old charles butler, jr buttly junior was shot and his car set on fire in west oakland lasts week. today surgeons will transplant his organs to help six other people survive. >> i'm 23 years old. >> recently graduating from a merchant marine training program is one of charles butler's proudest moments. >> he's the baby and the only son. >> his oldest sister, valerie, said that pride extended throughout the family, but especially for their father, who was a marine in his younger days. >> you can imagine the joy and pride my dad had knowing his son was going to follow in his footsteps. >> i'm closest to him in age and i feel in general. >> his youngest sister, ann, is the last of the family to see him alive. he was shot to death just yards from their house. she heard gunshots and her dad asked her to see what happened. >> everyone talking around you, and i looked and to my surprise it's actually my brother's car was the shock of my life. he was coming right down the street. they were chasing. boom, boom, boom, six bullets. they weren't happy with that. drove up by them, put the last bullet in his head over nothing. he didn't know these guys. >> where do you see yourself in three years? >> traveling the world, meet ago -- meeting a lot of new people. >> charles had just been issued his merchant marine passport full of pages that will remain unmarked, world travels that will never be. >> explain. he was supposed to get his stamp. he was on his way. >> a friend of my cousin's informed her that her husband is dying. he needed a liver. >> on this holiday weekend the buttlers are calling for justice but they are also celebrating because charles is an organ donor. >> the best christmas gift would have been to have my brother with me for christmas but the fact that he gave his organs to someone else is the most wonderful christmas gift of. my brother was giving life to other people. >> abc7 news. >> the gift of life for a little girl in oakland has inspired her family to give back to the community. the ten-year-old provided food and good cheer this weekend to homeless people in oakland. the mayor jean quan also took part and helped serve food yesterday. she received a liver transplant when she was just five years old -- five months old and the donation inspired the family. a local restaurant is making sure victims of thursday's apartment fire don't go without for the holidays. yesterday lefty odooles gathered food and toys for the victims. the five-alarm fire left 40 homeless and without holiday gifts tonight. >> the police department is giving over 2500 toys to the fire victims and also giving food as well to take care of the victims. >> the fire started in the bottom of the a trash shoot in an alleyway. officials say the flames burned undetected for a significant amount of time before firefighters arrived. >> 28 people had their san francisco bay tour interrupted when their boat caught fire yesterday afternoon. shortly after 4:00 the coast guard received notice of a boat on fire in mccovey cove. they say the engine overheated. >> there's been a huge response to the last minute lefty odoole's toy drive. next we will show you lefty o'dooles which is at union square. police and firefighters loaded a mountain of donated toys into black garbage bags and loaded them onto a big truck. all of those toys will be delivered to the city's underprivileged children starting this morning. san francisco supervisor mark ferrell and his family will ride along on a fire engine from station 1 located near sixth and howard street downtown. the salvation army got a couple large cash donations in the little red kettles this week. somebody dropped a $10,000 check into a bell ringer's kettle on friday, and that doner wishes to remain anonymous. last tuesday another donor slipped a $5,000 check into a kettle in redwood city. the salvation army said the donations will go a long way to help people in need. that's wonderful we talked about little moisture in the air, just enough to bring the visibility down to spots, especially up in this county. and five mile visibility for concord. livermore a little better than that, as well as oakland with better visibility down around san jose. and along the short line. so clear and cold again. mild this afternoon. we are talking once again upper 50s to near 60 but with the haze and the very little mixing, another spare the air day, chance of rain moves into sonoma county, perhaps marin county tuesday, into wednesday. maybe a tenth of an inch. really not looking for it to press south of san francisco. the poor air quality once again in the east bay. santa clara, north bay, and at our coast not the best. but the winds today out of the northeast. they are switching to an on shore component tonight and that's why the front here is edging just a little bit closer. we've got a huge dome of high pressure over the eastern pacific. that remains strong, although it is beginning to inch off to the east. as it does, it's allowing for some higher clouds. that wind shift today. tonight the relative humidity comes up, the flow continues to be from the ocean. that's why the temperatures should perhaps get out of the upper 20s, maybe around freezing. napa, santa rosa, and into the upper 30s peninsula in south bay. here's the outlook then. as the ridge slides to the east of the first incoming system makes it as far south as about marijuana county come tuesday night into wednesday. between now and then we are still in the 40s and 50s. northern and southern sierra, 75 los angeles today. low 60s campbell, cupertino, and 63 men low park with upper 50s at the coast. 58 sunset direct. san francisco coming in at 59. a little more mild with the north winds in the north bay. low 60s there. near east bay, we are talking 68 in hayward today. a nice sunny afternoon. a few higher clouds, 60 dublin and down by the monterey bay. can you believe it, 64 in watsonville. tree decorated with beach ball size ornaments. hard to believe that 30 years ago it started as a simple houseplant. they began decorating it a few years after they got it, adding to the display each over the service at a packed church and it will test the 84-year-old, and signs of fatigue is slowing him down. >> two people are dead and one hurt after a small plane crashed in rural ohio on christmas eve. the pilot somehow missed the runway about 50 miles southeast of columbus. two women passengers were killed. the pilot is in the hospital with serious injuries. no word on exactly what went wrong. police in richmond, virginia spent christmas eve searching for a 2-year-old boy who was kidnapped after inside of a running car that was carjacked. he was sleeping and the suspect got behind the wheel and took off. the suspect abandoned the car after finding the boy inside strapped in his car seat. he was found safe and sound and still sleeping in the back seat. police are still looking for the suspect. it's not looking like such a merry christmas for newt gingrich. the virginia state republican party said gingrich failed to submit the required ten thousand signatures to appear on the march 6th republican primary ballot, but this morning gingrich is blaming virginia's system, calling it faulty. he lives in virginia and his campaign has said it would mount a write-in campaign, but that's against state law. only two of the seven major republican candidates will be on virginia's ballot, mitt romney and ron paul. president obama is back in his childhood home for winter vacation. the first family is spending the holidays in hawaii again this year. as usual the white house press corps is spending it there with him. >> it's been a while since we've seen the president smile like this. who can blame him? he's in paradise. 5,000 miles away from wintry washington with a legs laytive victory over the republicans on the payroll tax cut under his belt. his reward more than a week of golf, sand and surf ahead. this morning the obamas woke up in this $8 million, 6,000 square foot luxury vacation rental that boasts five bedrooms and a swimming pool nestled largest show of public outrage since the protests in 1991 that brought down the soviet union >> a new survey shows smartphones and tablets are becoming a beggar part of the way people shop for the holidays. abc7's jonathan bloom has more on how the devices are helping bargain hunters and potentially hurting retailers. >> along with the hustle and bus -- bustle and all the shopping bags, something else has become part of holiday landscape, your phone. >> more people are doing mobile shopping on line for sure. >> they surveyed users and found out more than half of them have bought something this holiday season use their phones. using tablets, three quarters have bought something with them. the beggar screen makes buying easier. >> if you of tried to purchase something on a regular website by your phone, it's nearly impossible some new apps are changing things. >> their number one eastern was ease of use, apps on the iphone make is easier to purchase. >> it isn't just an find it cheaper, they have to match the price nine times out of ten. >> it's not like the consumers are going to unlearn the new tricks. they have them, they will keep using them. >> abc7 news. the most popular gift for christmas, especially on the last day of shopping, is a gift card. but because people usually spend more than the card amount or leave a balance, many believe gift cards are a scam to benefit retailers. an economist says that's not the case. >> what people don't understand is the retailers don't count them as a sale until the gift card is redeemed so they aren't actually look for people to not spend the guest cards, they want people in the stores to spend the gift cards and then some. it's not like a crazy retail scam where retailers are hoping retailers won't spend them. >> estimates are consumers leave up to $5 billion on unused gift cards each year. christmas eve shopping was anything but jolly in one community near san diego. police in san marcos took the opportunity to check on mall parking lots for license plate tags that were long expired. eight cars were not only ticketed but towed away. his officers were toll to keep busy on a day when there was little criminal activity. >> hardly anyone wants to fly on christmas day but bargain hunters know they can save a bundle by booking a holiday flight. at sfo travelers are flying in and out in record numbers. the airport had a record 134,000 people passing through at sfo's gates yes. between last friday and a week from tomorrow 2 million people are expected to pass through the airport. a five percent increase over 2010. travelers should double check their flight status before heading to the airport. >> be grateful if you don't have to fly anywhere. >> you said on the bay bridge you saw two cars? >> are we up to four now? >> maybe. i was pretty loin out there this morning. we are beginning to see the temperatures stabilize. the sun is coming up, 7:23 to be exact, but we are looking still soul stirring on this christmas morning. a 27-year-old tradition continues in north hollywood. ♪ >> hope everyone is tapping their foot at home. you are looking at the magical christmas carol truck. it's an 18-wheeler decked-out with elaborate deck rags and a big sound system. the performers are from the neighborhood. they spend a month rehearsing their holiday song and dance routine. >> give me a matt and i could get on there, right? >> i could do that. >> you know, we are starting out coal so definitely you have to move around this morning if youu are going out for a jog or run, but you know the routine. it's been this way the past several days. and tahoe airport, 10 degrees. blue canyon at 46 degrees. we will see temperatures today in the mid-and upper 40s in the northern sierra. and low 50s in the southern sierra. so the snow, the rain, well, we don't have to chalk up another week because we have a few in our forecast. here's a beautiful shot with the sun up in another 35 minutes or so. we are starting out still with that freeze warning in effect until 9:00. 20s widespread in the north bay or east bay valleys, and the hard freeze from the delta and also san way queen valley looking at freezing temperatures, the salinas valley, santa clara. last day of that because the winds will shift and there will be more of an onshore component holding more moisture. 28 in novato right now, 26 napa, also 27 in santa rosa with 28 in livermore. freezing in fremont at 32. 31 in redwood city and only 30 mountain view and in san jose just 33 degrees but we are holding in the low 40s from half moon bay. 44 san francisco, and the fog has been a problem for marin county, novato, oakland and livermore. reduced visibility from time to time but looking pretty good at sfo, six-mile visibility. clear and cold again with a mild day today. chance of showers comes into the north bay tuesday night into wednesday. maybe a tenth. and maybe a half-inch here throughout the week and that's way north. here is where we silt so far. 46% of normal in oakland with just over three inches of rain so far for the season. 42% of normal san francisco, about three one-third and we are hoping for more in the new year. right now we have a spare the air day again today for poor air quality to the east of us and the south. you can see a sold front. it's trying to push into the golden state. not going to happen because we have strong high pressure still in control. it is sliding to the east and weakening, so the return flow is going to be more of an onshore push tonight and this front is going to just fall apart. there's another one coming down from the north tuesday night. that promises a little bit more rain to the north coast. as i said, maybe a quarter to half an inch, to the extreme north coast of california and then down to san francisco it is going to wash out. doesn't look like we will see any in san francisco throughout the rest of the year. back home we are talking 50s in the southern sierra, 59 in fresno. how about 75 los angeles, with 60 in vegas. so bone dry there. and back home upper 50s again to low 60ths. a nice afternoon in san jose. enjoy it, 61. checking out the new bike all around the bay area or the skateboard, temperatures in the low 60s. nice day today with the numbers not quite as cold tonight. we will see a few upper 20s. don't think we will see the freeze warning. and then by tuesday increasing clouds in the north bay lead to go a chance of rain, maybe sonoma county. into wednesday marin county could see a few raindrops but more than anything else we will see clouds around san francisco and the east bay. still a chance on thursday. and then we are talking the new year. >> yes. a whole new start. thank you, lisa. >> we are about to enter a brand new year and with 2012 comes a new set of state laws, affecting everything from applying for a knob to shopping at the drugstore. abc7's capital correspondent nannette miranda has a preview. >> good news for the 2 million californians out of work. employers can no longer consider your credit report when you apply for a job where credit or finances are not involved. not goodnous if you are a fan of shark fin soup. while the restaurant is allowed to finish out its current supply, california joins many west coast sports in banning the importation of the delicacy to stands. those not old enough to drink typically scan soda threw but puts alcohol in the game. >> melanoma survivor, lisa, helped push through the nation's first tanning bed ban for anyone under 18. after religiously using the machines a few times a week for years, they developed cancer. >> i'm hoping this will help prevent other people from having to face that kind of diagnosis which can be a
