>> some say the clerks violated the trust in the judicial system. >> if you can't trust the court clerk, i'm sure it can happen on all different levels. >> by the way, hernandez was caught in the sheriff sting after a woman with a ticket told deputies he offered her the bribe. we're told that the court will install new software sometime early next year designed to close that loophole in the computer system. vic lee, abc7 news. >> all right, vic. thanks very much. a strange scene in oakland today when the police chief denied allegations about something that's not even public yet, about a crime lab scandal similar to the ones involving san francisco. laura anthony joins us from police headquarters. >> reporter: hi, cheryl. this was a highly unusual move. police chief anthony batts called a press conference at headquarters this afternoon to say anonymous allegation of misconduct against a crime lab technician is unfounded. now batts called this press conference this afternoon. he would not say whether the accusation has to do with the testing of drugs, d.n.a. or something else at the lab, which is on the sixth floor here. but he did say he wanted to nip a rumor in the bud before he leaks out. batts say the allegation came in as an anonymous phone call on december 22. >> we are look closely to the va lilty of all accusations. at this point in time, through the investigation over the last two weeks we have no reason to believe the accusations are true or have validity at this point. but we will continue our investigation. >> there tends to be a problem keeping information within the city of oakland. i thought it was an opportune time to get this out. we had nothing to hide. it's good for to us be transparent as on organization. >> reporter: the chief went on to say he wanted to get out ahead of any rumors or possible news stories about the matters to maintain the public's trust in his department. batts went on to say there had been several audits of the crime lab here in the past year, since batts arrived. and in his words, the chief said the lab had " perfect scores" in all of the audits. live in oakland, laura anthony, abc7 news. >> thanks a lot. an investigation is underway why a boat sank in the oakland estuary today. the 37-foot recreational boat went down before 8:30 this morning causing a small fuel spill. crews arrived and found a sheen on the wert and put out containment boom. the owner said there was about 300 to,000 gallons on board. there have been no report of wildlife affected by the spill. governor schwarzenegger filed an appeal the fema today, second attempt to get disaster aid for san bruno. fema denied a request for aid last might month saying pg&e and the state should be able to cover recovery cost of september 9 pipeline explosion. though pg&e provide $8 million, the estimated damage is $15 million. that's half the city's general fund or $374 for every resident of san bruno and more than six times fema's threshold needed to qualify for aid. this may or may not be a surprise but california may be minutes away from having a budget. 99 days late. within the past hour, the assembly passed a compromise budget plan and it's now before the senate for final approval. abc7 capitol correspondent nannette miranda joins us. >> reporter: it got the bare minimum vote to pass with eight republicans crossing over. the senate should pick it up shortly. even if a budget does pass tonight, california will likely head to another fiscal mess. maybe before the ink dries from governor schwarzenegger's signature. >> this is very best we can do. >> is this really going to work? is the tape going to work? >> we'll have a deficit next year. no question about it. >> reporter: as the legislature works its way through a massive $87.5 billion budget plan held together partly with band aids almost everyone knows it will only temporarily end the state's financial woes. revenue projection appear to be too optimistic. such as $5 billion in federal aid that typically falls short every year. and many budget solutions are one-time remedy rather than permanent fixes. >> i'm very clear. this budget does not address california structural imbalance. i don't say it with any great pride. >> reporter: so why approve this flimsy budget plan? california is embarrassingly approaching 100 days to the fiscal year with no state budget in place. plus, the state needs to do some boar erowing very soon for infrastructure projects and needs proof it's good for the money. >> what is bottom line important is the treasurer and the comptroller told us they think it's solid enough they can go to wall street. >> reporter: in a few short month, lawmakers might have to go back and rework the budget. it could mean more cuts and/or more payment withholding. people who depend on state funding like adult daycare provider jim mcdonald has had it not knowing one day to the next if he will get any money on any given month. >> we have already had the budget cut we had and budget impasse that affected us dramatically and it's hard for to us keep our doors open. it's getting to the point i don't want to do it anymore. >> reporter: it's frustrating, too, for rank and file lawmakers who are not part of the leadership that negotiates the final budget compromise. >> taxpayers should be upset. we need to get the job done. that's what we were elected to do. we continue to fail step after step. >> reporter: there are measures in this budget package that could help future leaders but not provide immediate help. if approved, it will be tougher to be eligible for some social services program, the rainy day fund will be a lot big and the state pension liability will be a lot smaller. live in sacramento, nannette miranda, abc7 news. >> thanks very much. one of the more controversial provisions of the state budget is a tax break for the wealthy fischer family in san francisco, founder of the gap. two years ago fischer bought pacific lumber company in humboldt county. weeks later, the legislature eliminated a tax write-off that was a key part of the bankruptcy negotiations. and that let the fischer familiar -- left fischer family with unexpected $20 million tax bill. backer of the budget deal say the fischer tax break writes a wrong created by the state. even though the state budget actually increases funding to california's two university systems, several hundred students still walked out of their classes today at u.c. berkeley. they protested last year's fee hike that led to 32% increase in tuition. similar protests were held around the state. spokesperson said some of the additional funds will be used to hire back teachers and bring back some of the courses that were cut. spokesperson says there are no plans at this time to raise tuition again. in cupertino, students at de anza college protested in the main quad where a tent city has been set up since sunday. 30 members of a student group called "dare" which stands for de anza restoring education, has been camping out in the tents as part of the protest. >> some people believe, some people if they can't afford education, they don't deserve it. that's outrageous. we believe education is a birthright. >> de anza has been forced to cut some engineering, math and science classes. turn away thousands of would-be students this year. budget cut at caltrain means higher fare and fewer trains next year. caltrain board approved price increase of 25 cents per zone. fare from san francisco to san jose will go up by 75 cents. the cost of a monthly pass increases $20. the board also voted to eliminate four weekday trains from the schedule between 9:00 in the morning and 3:00 in the afternoon. all of those change goes in effect january 1. well, still ahead here tonight on abc7 news -- the beginning of fleet week in san francisco. the blue angels, of course. plus the military role in responding to a bay area disaster. >> are the giants jinxed? suspect is gonzalez who pushed the little girl on the street after that. he took off and was eventually arrested by the police. the conservative liberty and freedom foundation today launched a major publicity blitz to announce sarah palin is coming to the bay area next week. they made at it point to tell us about this particular sign in san francisco's castro district. not exactly a conservative stronghold. spokesman said it was to encourage dialogue. palin will bring her tea party message to the san jose center for performing arts next thursday afternoon. race for california lieutenant governor took center stage today in silicon valley. incumbent abel maldonado and challenger gavin newsom faced each other in an hour-long debate, carried live on the website. in sunnyvale, here is troops killed in afghanistan. expert with the marine mammal center in saucelito believe the blue whale that washed ashore in san mateo county was hit and killed by a ship. so now an environmental group is proposing a ten-knot speed limit within the national marine sanction ware. pacific environment marine sanction ware says the whale's death highlights the need to protect whales from the ship. and imposing a speed limit will protect whales that migrate along the coast. >> money scope headlines. mortgage interest rates have fall on the the lowest level in decades. the ninth new low in 12 weeks. 30-year fixed rate mortgages now average 4.27%. 15-year loans go for 3.72%. new signs tonight that the job market is picking up. the first-time unemployment claims fell to the lowest level in three months. and job openings rose in august for the second time in a row. now despite all that positive news, the dow jones average dropped 19 points refusing to close above 11,000. the nasdaq went up slightly. the s&p 500 went down slightly. >> east bay company unveiled a device today that claims can help paralyzed people walk again. e-legs. the latest generation exoskeleton developed. take a look at that. company says it's wearable, artificially intelligent device and powers those with paralysis to stand and walk again in speeds of excess of 2k miles per hour. this is video on the website at a public demonstration today in san francisco. clinical trials begin next year at a handful of national rehab clinic with limited release next year. stem cells also represent the cutting edge for people but perhaps also for pets. a new high-tech veterinary hospital in the bay area is using stem cells to treat common conditions in animals. abc7's health and science reporter carolyn johnson has
