top of us. that is an area of rising air. we get some sunshine. aggravate the atmosphere. put moisture in it as it evaporates moisture from the grounds. then you have clouds. clouds get bigger and you have storms. you can see the wrap-around here in north bay. while it's quiet right now, still have to keep a chance of isolated shower in the forecast. once we get past that, heat wave for the weekend. kristen and terry has news. >> mike, a very busy morning already for coast guard. one of the men rescued is in bad shape. amy hollyfield has that story. >> the boat is still out there. they are going to wait until daylight before they go out there and try to recover it. the coastguard plans to get out and take a look at it. the three fishermen are okay. they' they're -- their boat capsized this morning and three fishermen went in the water. they had a life raft on board and the coast guard found them floating safely in the raft. they had about 270 crab pots on board. 80 of those were full. the fishermen believe the load shifted and it caused them to tip. >> the boat rolled over and wouldn't come back. >> they don't think weather was an issue. it was clear at the time. they think it was a shift in their load. all the men are from arcadia. they are okay and resting and waiting for the wife of one men to come pick them up. they are looking into recovering things from the boat, including the crab. 80 pots of crab. the boat is 600 yards offshore from here. it might be stuck on something. coast guard is not sure. it's dark and the main concern is getting people rescue and getting them shore. once they get daylight, they will check it out and see what they can recover. make sure there isn't fuel leaking in the water. amy hollyfield, abc7 news. >> thank you. governor brown is expected to sign the state budget soon. it passed the legislature late last night. because there is no tax increase, simple majority vote was enough to pass so not a republican vote was needed. but there is something in the budget for each party to dislike. >> the budget will devastate public education, schools and children. $3 billion worth of cuts. >> this budget right now doesn't go far enough to really correcting the things that are wrong here in california. of course, it's going to be a release to taxpayers, if the actual tax, if the taxes go back to what they were before 2009. temporary taxes are set to expire on friday. the state sales tax would drop by 1% and vehicle lie sense tax would drop by half. governor released a statement saying that the legislature made tough choices and delivered an honest, balanced and on-time budget with painful cuts. if he signs it, as expected, it will be only the fifth time since 1991 that california has had a budget in place before the start of the fiscal year. oakland city council members have until friday to approve a budget that is facing a $58 million shortfall. the council met after announcing early they're the police officers association, firefighters union and three other employee groups agreed to concessions. they include asking members to pay 9% of their pension costs. councilmembers also considered a proposal to rehire 44 laid off police officers. but it wasn't clear if the money to do that would come from sale of the henry j. kaiser convention center, which was also discusseded. in san francisco, mayor's office announced tentative agreement with police and fire unions over wage give-back requested by mayor ed lee. the "san francisco examiner" report both are entitled to wage hikes in the next fiscal year. the tentative agreement is expected to have a 3% raise july 1. in return, they would increase pension contribution by 3%. they would still get 1% raise in the middle of the year. union members have to approve the agreement. the city is facing $306 million deficit. 5:06. settlement hearings between bart and the father and friends of oscar grant continue today. grant was shot and killed in 2009 by the bart police officer johannes mehserle. his mother received a seven-figure settlement from bart yesterday. abc7's lisa amin gulezian reports. >> reporter: bart paid oscar grant's mother wanda johnson $1.3 million in the wrongful death lawsuit she filed against the transit agency and its officers. >> no amount of money can replace oscar. if i got a dollar, or $100 million, it still wouldn't bring oscar back. >> what we're here for today and this goes on is to hold bart accountable for the wrong that the employees brought on our family. >> a jury found johannes mehserle guilty of invol involuntary manslaughter. he was released from jail earlier in month. the settlement means johnson cannot seek further damages from bart, mehserle, other officers or their families. >> regardless of the settlement, it leaves the mother -- [ inaudible ] >> none of this stops other suits from moving forward. including one filed by other meven who were on the bart platform during the confrontation. >> we feel strongly that the department and the officers didn'ted do anything wrong with those men. >> bart and the officers have not admitted wrongdoing. >> you can say i admit it or not. payment of the substantial amount of money is acknowledgment that the officer conduct, itself, was wrong, inappropriate and against the law. >> last year, oscar grant's daughter tatiana received a settlement of $1.5 million. in the newsroom, lisa amin gulezian, abc7 news. amtrack train attendant filed the first lawsuit over crash of emeryville bound train that killed six people. woman from illinois filed the suit that alleges negligence on part of the truck driver lawrence valley and his employer john davis trucking. she is seeking excess of $10,000 for the general damages. the truck overnight rescue off the san francisco coast. the coast guard saved three men whose boat capsized. amy hollyfield is live at's beach with their story. >> the fishermen are okay. they say the load shifted and that's why the boat capsized. the men are all from arcadia according to the coast guard. the boat capsized at 12:30 this morning. it had 270 crab pots on board and 80 were full. they say the load moved at the last minute. it was very quick, that's why think all ended up in the water. they were well prepared, though. when the coast guard found them, they were all okay. >> they had survival suits and they had a life raft. i'm not sure if it automatically deployed or they deployed it themselves but they're lucky it had it. >> the fishermen said it all happened very fast. they're not resting at the coast guard station, waiting for the wife of one of the men to come and pick them up. here is a live picture, you can see what is left of the boat. you have can't see much of it. it is mostly submerged. it's 600 yards off the shore. next to the cliffhouse restaurant. here at ocean beach. the coast guard's plan is to get in there as soon as the sun comes up and see what they can recover. a lot of property on board. the fishermen are interested in the pots full of crab. just to see what they can salvage. the coast guard wants to make sure that no fuel is leaking. middle of the night, it was dark and they were focussed on saving the people. as soon as the sun comes up, the focus will turn to the boat. live in san francisco, amy hollyfield, abc7 news. >> thank you, amy. governor jerry brown is expected to sipe the state's budget soon. after months of frustration and negotiation, the budget passed the legislature late last night toousing approval of -- to the rousing approval of no one. abc7's john alston reports. >> aye. >> reporter: so it went. virtually every vote along party lines. one of the democrats that broke ranks and voted no on the budget is senator leland yee of san francisco. >> the budget is going to devastate further public education in the schools, the children. another $3 billion worth of cuts. in addition to that, you know, we're going to be looking at higher student fees. >> the u.c. and c.s.u. system would each lose $150 million. the state anticipates extra $4 billion in tax revenues but it has pitfalls, too. >> the anticipated revenue does not show up and turn up, we'll have additional, very severe cuts. >> after vetoing the budget two weeks ago, governor brown negotiated the deal with democrats because there is no tax increase. simple majority vote was enough. not a single republican vote was needed. >> this budget doesn't go far enough to correct what is wrong in california. this will be a relief to taxpayers if francisco had a budget in place before the start of the fiscal year. john alston, abc7 news. the richmond city council passed budget for fiscal year that begins on friday. the "contra costa times" report the budget approved last night calls for 10% spending reductions across all city departments, except for police. it also cuts vacant positions and reduces the street paving funds. property tax revenue continues to fall. the city manager bill lindsay says he expects richmond to maintain the a-plus credit rating next year. settlement talks continue between bart and friends and father of oscar grant. the unarmed man shot and killed by the bart police officer in 2009. grant's mother wanda johnson accepted a $1.3 million settlement from bart yesterday. his daughter tatiana was awarded $1.5 million last year. johnson claimed bart and the officers wrongfully killed her son, violated her civil rights and used deadly force. >> no amount of money, you know, is going to bring oscar back. you can't pay, you know, for the loss of a loved one. >> it's a fair amount. it's expencive from the average passenger point of view, but a gentleman died because of bart's actions. but bart attorneys insist this is not an admission of fault by bart or any of the officers involved. >> former bart police officer johannes mehserle was released from jail earlier in month after being found guilty last year of involuntary manslaughter. the san francisco unified school district is under fire for throwing away brand new school books at a time of teacher layoff and large class sizes. the "chronicle" reports hundreds of never-used english and math workbooks valued up to $24 each were found at recycling bin in burnal heights on friday. the district says if they choose not to use the book or switch to newer textbook it's standard practice to donate or repsychothe -- recycle the workbook. expert on the pipeline is discounting sewer work as probable cause of disaster. in an interview with "san francisco chronicle" said robert nichols that were released to the state made him reconsider the theory of who is to blame. they show the utility greatly fluctuated the pressure in the gas papeline and he says that alope could have created enough stress for pipeline to fail. city of san bruno and sewer contractor claimed that the sewer work was done safely. a private company will return to lake merritt to continue cleaning up a fuel spill. the oakland fire department says 30 to 50 gallons of diesel spread across the lake yesterday afternoon. rein flushed the dees from the storm drain to the lake. trying to determine where it came from. it produced a pungent smell. the clean-up crews spread a boom across the lake to contain the fuel. members of the department of fish and game are watching are cooler this morning in most areas until you get to napa and santa rosa. one and two degrees warmer because the clouds are thickener the neighborhood. break down today. here we have the female in the wal-mart parking lot on story road on may 19. police say the men forced her in to a vehicle and drove her to nearby wells fargo bank where she was forced to withdrawal money from her account. it's believed the suspects were involved in a similar incident the following week in north las vegas. safeway and costco say they're reconsidering the purchase from midwest pork supplier after i-team report on animal abuse allegation at the facility. they made the decision after seeing graphic video taken from undercover animal rights activist. the activist worked for two months at the iowa select farms in iowa. use a hidden camera to document conditions there. sows can be seen in gestation grates. 7-by-2-foot cages where they spend most of their lives and they can't even turn around. costco and safway sell iowa select farms pork. safeway says it's halted purchases pending the investigation. costco says its auditors are investigating and it will continue pushing for all country's security as planned, despite a deadly assault on a hotel in the capital city of kabul. that attack at the intercontinental hotel yesterday left 19 people dead, including all eight attackers. the strike is one of the biggest and most complex to have occurred within kabul. it appeared desipe -- it asered to have been de -- it appears to have been designed to show insurgents can strike even in the city of power. it comes after a week after president obama announced the beginning of an american withdrawal in afghanistan and transfer of security. >> in greece today, members of parliament vote on a critical austerity bill. take a look, a live picture of the greek voters, lawmakers, making the decision right now in athens. and what they are voting on. not popular with a lot of people in greece. demonstrators have been trying to stop the lawmakers from getting in the building. obviously they did not succeed but it did lead to several injuries, mostly police officers. today's vote comes on the second day of a general strike that shut down most of the country. they're fighting for proposed austerity measures, combination of severe spending cut and tax increases which must pass this week if greece hopes to avoid defaults on the debt. worries of radioactive spoke in new mexico as the firefighters bat a monster brush -- battle a monster brush fire closing in on the los alamos nuclear laboratory. abc's john hendren has more. >> reporter: a wildfire is threatening a dump site with 20,000 barrels of waste contaminated with plutonium. >> we are worried about what happens when the fire goes right in the building and pop open many of the 55-gallon drums. >> laboratories say they are taking every precaution. >> we removed fuels from near the buildings. we have done the analysis to understand what would happen to our buildings if the fire occurred. we have made plans to deal with that. >> the blaze has torched 30 buildings in the new mexico countryside and evacuated los alamos, town of 11,000. even for the evacuated, the danger isn't over. now the fear is plutonium-tainted dust. of course, there is the rest of the nuclear lab. lab authorities say the waste is stored on cement, away from grass and trees. and the drums are designed to withstand wildfires, but if that fire gets much closer, we may get a white-knuckle test of whether they hold up. john with the bloomberg business report. a new landmark study on breast cancer screenings indicate the procedure can dramatically cut the number of breast cancer deaths. researchers in sweden followed 130,000 women for 30 years and found regular screenings cut breast cancer death by 30%. experts say a 30% reduction would translate in to 15 to 20,000 lives saved each year if all women were screened. the study result confirm previous findings linking screenings to a reduction in deaths. researchers hope the finding will end controversy over whether regular mammograms are worth the cost. tiny moth is forcing agriculture officials to declare quarantine zone in santa cruz and santa clara county. the european grapevine moth is a serious threat to the state $18 billion wine industry. state and federal agricultural officials declared the quaran tepe after two moths were caught in traps in aptos area last month. growers will have to follow strict procedures in handling and shipping produce. the bill passed the first test in the legislature. assembly committee sent to full assembly a bill that would require drivers to give cyclists a three-foot buffer zone. drivers would be allowed to
