this next hour is all about you as we get you informed as to what's happening in the world. thanks for keeping me company here. i want to show you some of the pictures we're getting in. this could be a preview of what's heading for the midwest. please be careful out there. the storm system that sent tornadoes ripping across the great plains is moving toward the great lakes and new england now. looks pretty ominous there. twisters killed five people in central oklahoma. the storms devastated large areas in that state and north into kansas where carla westerman captured this image. this is not it. there it is. the hardest hit area in kansas was east of topeka. boy, what would you finishing that was coming at you? several homes were damaged. thankfully no one was hurt. but in oklahoma, dozens of people were injured. >> it was really scary. i mean, the wind was like trying to pull the door off the latch. >> it quit hailing and then the wind hit and it just went dark and here went everything. trucks went rocking. there's one truck that shoved against another truck back in the back. and next thing we know, the whole roof and everything was gone. me and my partner just sat in the truck and rolled it out. it even blowed a window out. the truck in the back got windows blowed out of them and everything. >> the storms dumped huge hail stones on moore, just south of oklahoma city. ireporter rebecca barbato collected some as big as tennis balls as you see right there. we'll keep our eye on that for you. we want to get to the casey anthony situation here. she's going to face the possibility of the death penalty in her murder trial in spite of her attorney's attempts today to get it taken off the table. her lawyers claimed prosecutors had a gender bias when they requested the death penalty against her. brought her to tears. chief judge belvin perry ruled the defense failed to prove it. a defense expert testified when a jury considers a mother deviant, she faces a difficult time defending herself against criminal charges and one of anthony's attorneys says she has seen the bias against her client firsthand. >> people don't say, you know, she is -- it's an impolite word, but she's a whore so she should die. they don't say that out loud. they do in blogs. in some of the blogs, they suggest i should die with her. but that's neither here nor there. >> let's talk about this with "in sessiono" vinnie politan. you watched this whole thing unfold. let's touch on this bias thing. if you are a mom of a child and accused of killing that child you are more likely to face the death penalty than, say, a man. it's interesting, but is it valid? >> it's difficult to prove. and one of the reasons it's difficult to prove is because so few women end up on death row and are charged. and that was the problem that the defense had this morning. they brought this expert in from new mexico. she knows more about this than anyone else in the country. she has studied it for years. but she came in and said the evidence is sparse because there just aren't a lot of cases. so it's difficult to come up with trends and to say for sure that this happens. now this is an important part of the case. it's twofold. one, are women dealt with differently, moms dealt with differently than dads and men? are people going for the death penalty, prosecutors in this case because of the notoriety of the case and the lifestyle evidence that's out there. that casey anthony is out there partying for the 30 days while her daughter is missing instead of looking for her. she's in the orlando nightclubs at fusion dancing up on stage. and they are saying if that was a guy, it would be different. society would look at that person differently. and the judge at the end of the day said there wasn't enough evidence to show this bias. >> what does make her eligible for the death penalty? i say eligible because -- >> i am glad you asked that question because that's the same question the defense had for the prosecution. and they kept asking him and the prosecution would not give them the basis. today, the judge ordered that the prosecution within ten days must allow the defense to know what those aggravating factors are, those stat torly aggravating factors that make this case a death penalty case. so some time within the next ten days, i'll be able to answer that question for you. not right now, though. >> obviously. but let me ask you this, too. if she's convicted, let's say, and facing the death penalty, doesn't this just prolong the process because doesn't it -- in a way, default to an appeal? >> oh, there will be. oh, yeah. there will be an appeal. if she's sent to death row, absolutely. that's automatic. let me tell you if she's found guilty there will be an appeal of that. so this case is going to take a couple of months to try in a courtroom. if there's a finding of guilt, there will be appeals down the road. for criminal defendants, it's very difficult to win appeals. very difficult. if you were sentenced to death row, that's how you have your greatest chance of success on appeal. >> that's what i thought. vinnie politan, we'll be talking to you throughout the day. thank you for walking us through that legal process. okay. right now, delaware police are looking for a 3-year-old boy allegedly taken from his father's home at gun point. so i want to ask you to please, whatever you are doing if you'll take a look at your screen. here is a picture of brian kenney. he's blond hair, blue eyes. he was wearing blue and yellow pajamas at the time he was taken. three men woke his father up this morning by allegedly beating him with the butt of a gun. investigators say they believe the boy's mother may have been involved with this somehow. both she and the boy are missing, but again, there's brian kenney, 3 feet tall. please keep your eyes out there in delaware. speaking of delaware, the vice president's son is in the hospital there. the white house isn't providing a lot of information on beau biden's symptoms or possible illness. the 41 attorney general for delaware is said to be awake and alert and communicating with his parents and his wife. now last year, biden returned from a year-long deployment to iraq with his army national guard unit. as soon as we get more information on what's wrong, we'll certainly pass it along to you. a father is walking on a sidewalk, holding his infant son when, out of nowhere, he's hit and pinned by a car. we're going to show you more of this remarkable surveillance video and wait until you hear the outcome. >> caller: i'm doing good, chuck. how about you? >> what do you think? >> caller: i think this nation deserves better leadership. when it comes to the supreme court we need somebody who has made these hard decisions before. the retired marine. we expect our marines to be highly trained professionals to protect our policies and rights and freedoms. they do it for 14 grand a year. and when i come home and i have to make my life judged by somebody that's never made a hard decision, you know, i want better leadership. lead by example, mr. president. let's get the right people in there to do this job. >> she headed the harvard law school? that's not a good testing ground? >> caller: i've had harvard law students, too. they are battalion commanders that keep our values alive. >> do you agree? >> caller: no, i feel elena is definitely qualified. she's had an extensive background in legal education. she is the dean of harvard law school. she's now the solicitor general. she's been appointed. she argued against the case that the supreme court recently made that made corporations equal rights as people who are now the -- these large corporations can dump large amounts of money into these political campaigns. i think we need to get too much of the politics out of the supreme court. after all, senator kyl of arizona voted for her and recommended that she be appointed to supreme court. >> and now has reservations about -- i understand. i mean she, was, as solicitor general, advocating positions for the obama administration. if some of those cases come up while she's on the high court is there a problem there? she's advocated one side. she may be judging it as a justice in one instance. >> caller: that's true, but on the other hand, there needs to be a balance of opinions in the supreme court that reflect the interest of the common people, rather than people with money and stature and -- >> and people who have been sitting on the bench. i get it. thanks, roberta. more facebook comments. tiffany says i don't think a supreme court justice who has to make judgments on very important things should be just anybody. even if she taught law and has a good understanding of it, there's not just room for someone who isn't qualified in my eyes, and that's just what she is. john says it seems very odd to watch the critics complain that a law school dean who helped shape the careers of numerous attorneys and judges isn't qualified? photos of oil on the chandelier islands. the forecast for today shows it's moving past the barrier islands now to louisiana's main coast. and here on this map you can see the ially affected areas. a restaurant owner on the mississippi coast says he is angry that it's ruining his way of life. but two brothers say they still don't want drilling to stop in the gulf coast. >> just because something of this nature happens in the oil industry, it's not a black eye on the whole industry. it's not a black eye on bp. it was an unfortunate accident, and we're going to have to learn from it. >> we have to drill. there's no way we can get off of oil in this country within the next 25, 30, 50 years. green is great. but we can't just turn off the spigot. we have to have the oil. >> they all stressed, though, bp, they believe, should pick up the tab for a thorough cleanup. a new york assemblyman is proposing a measure that would automatically make everyone an organ donor. basically, you have to opt out if you don't want to donate. it's known as presumed consent. and organ donation already works this way in several european countries, including spain, france and the netherlands. so assemblyman richard bronsky's life was saved by two kidney transplants. he says every year 500 new yorkers die waiting for an organ transplant and he believes his legislation could help change that. opponents say presumed consent infringes on other rights and would violate some people's religious beliefs. so we want your views on this one today. should organ donation operate on an opt-out policy of sorts? residents about the violent storms moving into the area. while he was shooting this video, his wife was telling him to get inside. i don't doubt it. dalman says he grabbed the kids, the dog and a few prove it. the defense pointed out how the state fails -- basically it doesn't seek the death penalty against many men accused of killing children, but prosecutors said the circumstances are often different with fathers who murder their kids. >> unfortunately, mothers killing their children are not rare. it occurs. more frequently than any of us would like to say. sometimes fathers kill their children as well. that occurs as well. the court from its own experience can, i think, observe that generally when fathers kill their children, it's in the form of a unintentional felony murder. the rage kind of killing. generally, anecdotaanecdotally, court in its experience can find most of the time when women kill their children it's a more premeditated act but usually accompanied by some significant mental disorder. depression, schizophrenia, things of that sort. >> all right. let's talk about this further with "in session's" vinnie politan from trutv. he brought up the point that when it's connected to women, there's usually a mental disorder. but that's not going to come into play in the casey anthony trial. >> it's not part of the case. where we've seen it in cases like andrea yates and other cases like that where there's an ads mission that, yes, the mother killed the child or children. in this case, the defense is not concedesing that, not by any stretch of the imagination. they are saying casey anthony did not do it so you won't see any mental or insanity defense. what you are going to see is, hey, casey anthony did not do it. >> now the defense was also charging today that the prosecution's strategy here is to bankrupt basica le aally the defense. >> there was a hering. this was done under seal at the time where the prosecution learned about the finances of casey anthony and her defense team, how much money she had access to. and they argued today in court that it was about one month to the date after learning that evidence, finding out how much money she had that they then filed the notice that this -- they were going to seek the death penalty in this case. and their argument was, listen. it was a trial strategy. it was done in bad faith. they went for the death penalty because they know it will be more expensive and they are trying to bankrupt her, use up all her money so she can no longer use the counsel of her choice, which is jose baez. >> you said last half hour the judge gave the prosecution ten days to prove to him why the death penalty or prove to the defense why the death penalty is relevant in this case and why she's eligible for it. but i'm wondering, you've been watching this case. is there any element that you see in the casey anthony trial here that would make her eligible for the death penalty? >> may very well be the second count of the indictment, which is aggravated child abuse. and when did they learn of all of this. when they discover eed caylee's remains. remember the duct tape on her mouth. how does it end up there? is that the child abuse taking place? and then little caylee dies as well. so they may make an argument that that may be one of the aggravating factors. they have ten days to let the judge know and let the defense know what they are alleging is, in fact, the aggravating factors in this case. and there may be more than one. but many people believe, myself included, that may be the aggravated child abuse that's alleged. >> but that's aggravated child abuse. it's still not murder. >> but in conjunction with the murder it elevates it to a status where, hey, you can seek the always opt out if you oppose it for religious or any other reasons. cindy doesn't quite agree with that. she's joining us on the line from texas. thanks for your call. what is detrimental about this proposed law? >> caller: i think it's a terrible, terrible law. i think at the moment, we are losing so many of our rights and freedoms that it's really disgusting. i am a donor. i believe -- but it was my choice. not someone else's. and i think our body is the last freedom we should have to deal with to decide for ourselves. >> now, cindy, let me play devil's advocate here. you still have the choice. you just have to be cognizant about that choice in terms of opting out. they aren't saying you have to do this. they are just saying you can -- you can opt out of this program if you choose to do so. so what do you say to that? >> caller: i know, but you have to fill out if you want to be a donor. so we already have that. why should we have to fill something else out to opt out of something producer. >> he did not grant all of their motions but he did end up granting one. let's talk about the death penalty motions. the first one is the gender bias. what the defense was trying to say is that other cases where men are accused of killing their children, they are not treated the same way as women are. you can look where they cited some cases in their motion where previous women who have been treated differently, and we talked about yesterday the party pictures for example, those have been at the forefront of the case while it has been in the media. because she is a woman, they are saying that's the only reason why. it's irrelevant to the criminal case. they were trying to get the death penalty thrown out on those grounds. the judge did deny that motion. there was another motion that came forward that had to do with the prosecutions intentions as to why they were seeking the death penalty. what the defense is saying that initially the prosecution did not seek the death penalty. the remains of caylee were found. they had an in-chamber hearing with the judge. and they revealed what the defense's financial status was, and they are claiming the prosecution knew what their status was and because they knew they did not have the funds to support a death penalty case they went after the death penalty. >> it's a lot more expensive, as the standard of proof is higher? is that the case? >> absolutely. on average the state will spend about $1 million on the death penalty case, and so flying in the experts for the defense, the cost is much higher. $200,000 is not enough to cover a death penalty case. >> does the state have to say why it changed its mind? >> well, that is what the defense is asking. there was another motion today as to why they did seek the death penalty. they want to know the aggravating factors or the legal reasons as to why they went after the death penalty. the judge did grant that motion. they have ten days to turn over the defense the aggravating factors as to why they are seeking a death penalty. a small victory. >> in ten day's time we will hear why they did this. >> does it have to please the judge? does he rule on whether they are sufficient? >> no, not at this point anyway, but it's why they are shaping their case to be this way and it helps the defense to help shape their defense better. >> i had no idea the differential in cost is huge? >> yeah, absolutely. take into account, it's somebody's life at stake so you want to fight as much as you can for it. right now, delaware police are looking for a >> reporter: the prosecution was targeting casey anthony because of her gender because it was a female and led a lifestyle counter to traditional norms, and that's why they were bringing this case to the death penalty. one witness testified when the prosecution in the case filed the charges for first-degree murder and seeking the death, they laid the ground work for the attention this case would receive. take a listen. >> when the accused is a mother, and in particular a white middle class mother, the press coverage is far more expensive than it would be in other kinds of configurations of the relationship of the accused to the victim. >> reporter: the prosecutor countered that by looking at the facts of the previous prosecutions in this jurisdiction. take a listen. >> unfortunately mother killing their children is not rare, and sometimes fathers kill their children as well. that occurs as well. the court, from its own experience can observe generally when fathers kill their children it's in the form of a non-intentional felony murder, the rage kind of killing, and generally the court can find that most of the time when women kill their children it's more of a premeditated act, usually because of some mental disorder. >> reporter: he said in his 30 years with the state attorney's office here that he had never seen a case with the evidence like this that has led to them seeking death. in this case there is no mental defense at all. he went on to say that normally mother's have a mental defense when they kill their children. here there is not one. >> could they assert it later? >> reporter: they can assert things at different times. we are ayear away. they filed a mitigation form to the prosecution not noting a mental defense. i guess anything could change. but since they have not already, most likely they wouldn't. >> is there a higher standard of proof in a capital case than in a regular, first-degree murder case? >> what they are saying here is she is getting treated differently because she is a woman than a man. we were talking about the party pictures yesterday, and in the private image of casey anthony and the way she carried herself having a tattoo and going to the parties, and now that is becoming part of the criminal case where the defense is saying it's irrelevant to the criminal case and does not matter whatsoever. and another motion that went forward today was about the financial situation and the motives of the prosecution seeking the death penalty. what the defense is saying the prosecution sought the death penalty in bad faith, and because of that initially they did not seek the death penal tea and the remains were found and that changed the case. and four months after the remains were found is when they sought the death penalty. in between that time they had a hearing in chambers, and at that point they found out the financial status of the defense, and because of knowing their financial status they knew they would not be able to afford a death penalty case and that's why they went forward and sought the death penalty according to the defense. >> they are basically trying to bankrupt the defense? we will talk to him in about an hour. when you have pictures, stay safe. that's our main concern. casey anthony will face the death penalty in spite of her attorney's attempts to get it taken off the table. they say prosecution has a gender bias. the judge ruled the defense failed to prove that. the defense pointed out how the state does not seek the death penalty against many men accused of killing children, but the circumstances are different with fathers that murder their kids. >> unfortunately mothers killing their children are not rare. it occurs all -- more frequently than any of us would like to say. sometimes fathers kill their children as well, and that occurs as well. and the court from its own experience can i think observe generally when fathers kill their children in in the form of a non-intentional felony murder, usually aggravated circumstances leading to death, and jurors find most of the time when women kill their children it's more premedicated act, and usually accompanied by some significant mental disorder, depression or schizophrenia, things of that sort. >> we want to go to "in session"'s jean. some things don't apply to casey anthony, does it? >> reporter: that's what makes this case so unusual. the defense is not alleging any kind of mental mitigation. that's what it's called in the law. and the prosecution is bringing the case as a death penalty case because casey anthony is a young mother that has a lifestyle does not conform with what is traditional for the society. when you have a case like this, the public and ultimately the jury does not look at the evidence, in fact they look at everything but the evidence. listen to andrea lyon? >> they say caylee was happy and healthy. women are tried and punished not only for the crime they committed, but also because of their nonconformity to gender types. and the evidence in fact is deficient. the reliance upon prejudice is enormous. >> reporter: that motion was also denied. the defense went on to say we want the prosecution to tell us exactly why they are bringing the case as a death penalty case. that would be listing the aggravating factors. we don't know and we deserve to know. there was a response from a prosecutor, jeff ashton. take a listen. >> counsel stands before the court and says she cannot figure out what happened between early december of 2008 and april of 2009. that change this case, what was different? >> caller: my nephew got a heart transplant two months ago, and march 3rd. he is 3 years old. he had a heart condition since birth. we knew he would eventually need this, but we were hoping to do other means first. and he was on the brink of death. the doctor said when he opened up his chest to put the newhart in, his heart was not beating at that moment. he could have died at anytime. and when we found out about this, i was doing research, and checking into it. i found out that among children who need hearts, 15% of them die on the waiting list, and that completely is needless. i think that everything that gets people thinking about this, and making those decisions for themselves and for their families and children ahead of time is a great idea. this is something that would be -- it's perfect. if you don't want to do it you opt out of it and you are still given that choice and that choice is respected for whatever reason. >> teresa, how is your nephew doing? [ male announcer ] have a heart to heart with your doctor about your risk. here comes one right there. look at them, they're all over. it was really scary. the wind was like trying to pull the door off. whether it's an irritant or whether it ends up a devastating glob of something. we take a whipping every once in a while here and you just have to brush yourself off and come back and hit it again. the imposition of the death penalty they're trying to preclude it because of gender bias. they're saying because of her lifestyle they're saying a man who was similarly situated would not be subject to the death penalty. this is devastating. we're going to have to bury our 25-year-old daughter. compelling stories every single one. hi, everybody. thanks for looking in. this is hln "news and views" on a tuesday. i'm chuck roberts. let's get right to it. first of all, breaking news, of course, from london. that is british prime minister gordon brown who has just submitted his resignation to her majesty the queen which allows the opposition conservative party chief david cameron to take office at number 10 downing street. there was no clear winner in the national elections five days ago, but cameron struck a deal with the liberal democrats creating a coalition with enough seats in parliament for him to take over. these pictures could be a preview of what's heading for the middle west. the storm system sent tornadoes ripping across the great plains is moving to the great lakes and new england. twisters killed five people in central oklahoma. the storm has devastated large areas in the state and north in kansas an ireporter captured this image. the hardest hit areas just east of topeka. in oklahoma dozens of people were injured. >> it was really scary. i mean, the wind was like trying to pull the door off the latch. >> it quit hailing and then just all of a sudden the wind hit and it just went dark and here went everything. trucks want to rocking. one truck shoved against another truck back in the back and next thing we know the whole roof and everything was gon. me and my partner sat in the truck and roede it out. >> the storm has also dumped huge hailstones outside of oklahoma city. casey anthony will face the possibility of death penalty in her murder trial in spite of her attorney's best attempts to get it taken off the table. the lawyers claim prosecutors had a gender bias when they requested the death penalty against her. the chief judge belvin perry, jr. today ruled the defense had failed to prove that. earlier a defense expert testified that when a jury considers a mother deviant, she faces a difficult time in defending herself against criminal charges. and one of anthony's attorneys says she's seen the bias against her client firsthand. >> people don't say, you know, she's -- it's an impolite word, she's a whore so she should die. they don't say that out loud. in blogs they do, in some they suggest i should die with her. >> ryan smith is host of "in session." he's been watching all the courtroom in orlando. what is the gender bias in a nutshell? is it the case that men charged with killinging the their own l girls if that's the case in florida, they don't have the death penalty for that? >> that's very similar to the argument. what they're saying is people in similar circumstances, men in similar circumstances, would not have been subject to the death penalty. so that was the argument. they had an expert get up and talk about well i have talked to prosecutors and i have seen some of these situations, and in these cases a woman who leads the kind of lifestyle casey was leading, that people are saying she was leading, you look at that person and you say, oh, there should be the death penalty here because that's not what a woman should do in these cases. that's the kind of argument they were making. the judge didn't buy it. >> why is the state not compelled to tell the judge why it waited four months after the discovery of caylee anthony's body to change its mind? >> because -- that's a good one. because the state at any time can change the charges. they can say we found new evidence, something else came in that we didn't see. we have gotten more information. >> and they don't need to say what the evidence is. >> not necessarily. >> the argument that the prosecution knew a death penalty case would financially cripple the defense. is that germane here? >> the judge threw that argument out. the defense said once you found out we got that extra money coming from a media outlet, abc, you said that's the money we have, we'll put a death penalty case on you which will cost millions of dollars so you have to get rid of your lawyers. they're saying that's the motive. the judge threw that one out, too, saying i don't buy that. >> so there aren't enough aggravating -- there are enough aggravating circumstances that the death penalty can survive for now. >> the defense can come back at any time and put forth other motions, try to get things off the table. they didn't have such a bad day. they lost a lot of motions, but in the end they preserved a lot of things for appeal. so if she is found guilty and there's a death penalty phase, they have appealable issues. >> the next session is late june? >> it's going to be a status hearing. judge belvin perry is all about timing. he's going to make sure the lawyers are immediating deadlines. >> does the evidence have to rise to a higher standard of proof? >> i think you can look at it like this. once you get to the capital phase, if she's guilty, that's going to be the same no matter if there's a capital case or not. what's going to be critical here is the stuff that comes out, the victim impact statements, everything we hear about the defendant when it gets to the death -- >> but that's after it's adjudicated, after the jury rules on innocence or guilt. >> exactly. >> thank you. police in nevada are running blood tests to find out what killed a 25-year-old pro woman golfer. erica died sunday at her home. details of her death have not been released. it isn't clear if there was foul play. police responded to a 911 call from her home. the investigation should take four to six weeks. a spokesman from the lpga say the death is a tough hit for woman's golf. a cross disappears from the mojave desert. why? i guess i should quit my job as a motel clerk. then i must be a shoo-in for ceo for microsoft or something. oh, wait, i don't know bill gates. herb, what do you think about this whole thing? >> caller: well, 40 past supreme court justices were not judges prior to being appointed, including judge -- chief justice rehnquist. clarence thomas is an example who was a judge for one year prior to his appointment and the current chief justice roberts served two years on the bench prior to his appointment. i think most of the immediate objections i figure come from identify logs ideo ideologues. let's listen to her answers before we start making this rush to judgment. >> you're absolutely right, historically this has not been a problem for others, including william rehnquist, who of course jumped into the chief chair, but do you think that maybe at this point in time people think let's change it, let's make this a qualification? >> caller: well, i think there are qualifications other than -- there should be those kind of qualificatio qualifications, being a person who can judge the constitution and make a judgment on the basis of each case as it comes up. >> i understand. herb, thank you so much for taking the time to give us a call. i want to go to the other side of the country now. dale is in california. dale, thank you so much. how do you see it? >> caller: i feel that this woman is more than qualified to be a supreme court justice. i do not feel, as the last gentleman caller said, 41 out of 111 supreme court justices were not judges. i do not feel it is a prerequisite. i feel this woman has a profound knowledge of the law. >> and that's enough for you. >> caller: she is -- yes. and she is a consensus maker, and she made harvard number one again and she did this guy kby consensus building. i think this is her strong point. i do not believe any prerequisite of judgeship proves anything. >> okay. hey, dale, from california, dale, thank you so much for sharing your thoughts with us. want to go to christina now who wrote in saying, i think he should give me the job. i'm a stay at home mom. i could so be a supreme court judge. laugh out loud. i guess he feel that is if he had lack of experience and became president, then why should she not be a justice? "in session's" jean casarez from trutv joins us now to discuss the latest developments. what was it, 90 minutes today? a lot happened though. >> reporter: it was fascinating, chuck. all of the arguments today were really constitutionally based, but i think the one that was most unique had to do with the gender of casey anthony being a female. here is what the defense is really saying. they're saying there was a domino effect, that when the prosecution suspected casey anthony of premeditating and murdering her daughter, caylee, they charged her but then they looked at her lifestyle, what may be counter to traditional norms to make it even harsher and seek the death penalty. well, they had one witness today, elizabeth rappaport, a professor of law, and specializes in females murdering their own children. >> when the accused is a mother and in particular a white middle class mother, the press coverage is far more extensive than it would be in other kinds of configurations of relationship of the accused to the victim. >> reporter: and that's because the public and thereby the juries are going to look at things that are not relevant, not the evidence in the case but just the lifestyle of the defendant. well, there was a rebuttal to that. it was jeff astin, state tos attorney, he stood up to look at the facts. >> unfortunately, mothers killing their children are not rare. it occurs, more frequently than any of us would like to say. sometimes fathers kill their children as well. that occurs as well. the court from its own experience can, i think, observe that generally when fathers kill their children, it's in the form of a nonintentional felony murder. generally it's aggravated child abuse leading to death. the rage kind of killing. generally anecdotally the court in its experience can find that most of the time when women kill their children, it's in a more premeditated act but usually accompanied by some significant mental disorder, a depression, schizophrenia, things of that north. >> reporter: he also said in his 30 years as a prosecutor that never have they had the facts such as they are with this case to not only charge a young mother with killing her own child, caylee anthony, but then seeking the judge and the jury to find death, and that is this case, they say. >> and they've never found a cause of death, have they? >> reporter: no, no cause of death. that's what gives the defense a lot of ammunition here. >> can you think of a capital case where the cause of death has not been determined? i can't think of one. >> reporter: no, because when the medical examiner gets on the stand and says there's no cause of death, but here is the counter to that. because the killer actually hid the body so no one would find it and allowed it to decompose so no one would find it, they're responsible for not having a cause of death in this case. >> going back to her state of mind and fitness as a mother, was there evidence that she attempted a male strip show? was that presented today? >> reporter: apparently the defense in regard to some of the photos at the nightclub on june 20th, four days after caylee was last seen alive, the defense referred to them in their motion of casey anthony being at a club with a bisexual dancing and male strippers at the club that night. that's how they referred to them. that was brought out by the prosecution today. >> next up is -- what is it, a status hearing in june? >> the dow down 36, the nasdaq up just slightly. the s&p 500 in the red also today, though. as you see, an up and down day on wall street. coming up, the best day for the dow, that was yesterday. it's interesting, gold had a record day today. investors fleeing to that as a safe commodity the way they see. over $1,270 an ounce today. the big question remains about the dead crisis in greece and across europe. how far is it spreading? and is that $1 trillion package presented on sunday, christi, is that enough to stabilize the market. the dow down at the close. >> i hear, poppy, there may be signs of recovery in the housing market, specifically? a new report shows housing prices are picking up in some cities. i know people are going what city? is it mine? >> there's a big story on cnn money talking about some of the home prices are actually up as much as 100% from last year. if you look nationwide, the home prices fell slightly in the first quarter. prices are actually up from a year ago in 60% of great cities. especially in the marred-hit midwest. saginaw, michigan, they're median home price up 100% from a year ago. it went from an average of $30,000 to $60,000. akron, ohio, up 90%. cleveland up 54%. san francisco, up 29% from a year ago. you've got a lot of places searches in the midwest because last year, most of the sales that we saw, especially in the hard-hit areas, foreclosures. mortgage rates pretty low, an average of 5%. those first-time home buyer tax credits those were in effect until recently disbanded. you look at the hard-hit pocketings, that's what really is important. they're doing better than last year. >> let's hope that the up arrow is the trend from here on out. thank you so much, poppy. >> you got it. pro golfers are mourning one of their own today. the investigation into the death of the will lpga's eric california blasberg. wow, is this... fiber one honey clusters? >> you're exactly right. because what the judge is saying, that the prosecution, they have great latitude in bringing a case in seeking death. and the only way a judge can change that if bad faith has been found. and although the defense is alleging that today, the judge said i want specifics. specifically, what are they doing in bad faith. they didn't assert that until the judge denied their motions. you know, sitting behind smeet orange county courthouse, it's quiet now, but, boy, was it bustling early today. so many media and attorneys were present because this was death penalty day. and beside the judge discerning that the death penalty was valid in this case for prosecutions to seek, the defense still mounted an aggressive argument for the record at this point, saying that casey anthony was targeted by the prosecution, first they sought charges of first degree murder. then they looked at her lifestyle which may be count tore traditional norms. and because of that lifestyle, they then decided to seek death. in the end, it didn't work, but they preserved the record. and, christi, they really spoke to a potential jury pool out there right now that may be listening to everything when they said, you need to look at the evidence, not the lifestyle of casey anthony. >> hmm, all right, jean, thank you so much. we appreciate you breaking that down for us, what happened in court today. did you see betty white? or does it go too far, considering individual's preferences and even religious conflicts. we're hearing from gian and others. tell us your story here. >> caller: well, i received my heart 18 months ago. i had been battling cardio my jop passenger since 1988, and it finally came to the point where they could no longer fix my heart. and if it wasn't for the wonderful gift of organ donation, i would not be here. so i think this is a wonderful idea for presumed consent. and i say it's about time that the united states join the rest of the western nation who had implied consent because you have thousands of people in this country who are dying needlessly because of a lack of an organ. and i think that is just a shame in a country like ours, where we have the technology, we have the experts. we have the medications. we have everything that we need to save a person's life except the organ. and i just think it's shameful. and i feel that people need to look beyond oh, i me what to do because it's not about that. it's about lives being saved. i mean are a lot of things the government tells us what to do helmets on motorcycles, seat belts, you know what i'm saying?
