Ed here are tonight especially on what lies ahead for her client, Sidney Powell, the attorney for general michael flynn. Sidney, welcome. Thank you. I think a lot of people have this over the weekend had a simple question, why is the federal judge hiring a defense attorney . I dont know the answer to that. Ive never seen that happen before. Ive been practicing more years than i want to admit publicly and ive never seen anything like this despite having gotten [inaudible] against any number of federal judges throughout my career. It sounds like a telltale heart to me. It raises a lot of questions because there are ethics issues with respect to ex parte communications. Is he going to talk to her about his decisionmaking process . And the court may not even allow her to appear because they ordered him directly to respond and of course he has law clerks that can do that preparation of briefing for him. Ed quickly when you mention ethics issues, do you think the judge could be worried about potential disciplinary action for his handling of the case . Is that why hes hired an attorney . I really dont know. Ed what about who is going to pay for his attorney . Ive gotten a lot of questions about that today. Are our viewers are taxpayers going to have to pay for a federal judge having his own attorney . Is he going to be out of his own pocket . Those are additional ethics questions that are raised too because judges have to report all kinds of things and i think any gift over 25 they have to report, so is she giving him a reduced fee or is somebody else paying for it . It just raises far more questions than it provides answers and its bizarre to say the least. Ed bizarre, certainly it seems like a good word to describe it. Lets move forward to what you expect on june 1st. So he has his attorney now, presumed with the judge will craft some sort of explanation to the federal Appeals Court, which has demanded an answer. What are you expecting over the next week or so to happen . Well, this wicket will be pretty quiet i think. Although we never know with this case. Yes. And i would expect the department of justice to weigh in on the issue, considering the ones who filed the motion to dismiss and in the existence of any case or controversy under the constitution and the Supreme Court decision that applies here as well as the Services Case from the d. C. Circuit. So given the fact that judge sullivan really doesnt have a leg to stand on, i would expect him to simply make the arguments that are going to fail that they have made on his behalf already and the circuit i can imagine it would take very long to issue a decision after the june 1 filing. Ed we talked about how unusual it is for a judge to hire an attorney, but you would admit its also unusual for the Justice Department after already getting a guilty plea to say where dropping the charges. No, actually its not. Guilty pleas had to be withdrawn in several of the cases back in the Enron Task Force days, including christopher and Arthur Andersen his partner david duncan, who had even testified against him. He and his compadres have a gift for bludgeoning people into pleading guilty for things that are crimes and we also attach to our petition or our filing of judge sullivans court, i dont number which, three instances of guilty pleas that were withdrawn and the convictions vacated on motion of the attorney general eric holder in the d. C. Court just a few years ago. Ed a few years ago go ahead. It happens with unfortunate fairmont of regularity and probably should have been even more than it does because if you look at the article, why the innocently guilty, from 2014, clinton appointee. Unfortunately, innocent people are compelled by the conviction machine on which harvey silva i just wrote a new book to complete guilty frequently. Ed i hear you. Happens far too often. Ed on the question of why the innocent will plead guilty, david ignatius, who wrote the column in the Washington Post that started all this about general flynns conversation, he had a column earlier this month saying its useful to go back to base with them i fell my face a question, nothing wrong in december of 2016, the day president obama imposed sanctions on russia for interfering in the president ial election 2016, why did he conceal it . How do you answer the question is an attorney . If there was nothing wrong, why didnt he tell the truth . He did tell the truth. Its the fbi agents who made up the lights in the 302. The added things that werent supported by the notes. They did not write down things he did say. The completely manufactured the purported case against him. They manufactured the false fair statement. The general was honest with the fbi agents when he interviewed them. If you remember everywhere that was set on the phone call . No, who does . But he was honest with them and they knew it and they came back and briefed three different hourlong sessions of the Upper Echelon of the fbi and the doj on that very fact. Ed you know that in february 2017 Resignation Letter, he admitted that he had given quote unquote incomplete information to the Vice President when asked about it, so no matter how you phrase it, just as a last question, why did you even say that Resignation Letter that he did not give complete information . Like i said, he may not have reported recorded everything that was said that the law requires intent to deceive and there was absolutely none of that as the fbi agents themselves admitted in writing in their notes and otherwise and in their briefing and the 302 several months later also. And they briefed everybody on varied spirit of 300 to form about the interview with general flynn that apparently the fbi cant find, which is yet another question about what really happened here. Last thought. There are so any questions about what happened here. The government is still hiding evidence. Obviously Christopher Wray has finally started an investigation of this inside the fbi, which should have happened years ago, theyve been hiding evidence that shows hes been innocent for three years and the fact that they made it up all along. Ed chris, want to give you the first shot at what Sidney Powell just said. Why do you think this federal judge is hiring an attorney . That is unusual to me to see a federal judge hire an attorney to represent him here. He has perfectly good law clerks. I worked in the federal court at one point in my career, that could help them make this case. If the federal judge could have at the time the Justice Department withdrew the plea, he could have said no, im not letting you withdraw this case. I find him guilty, we are going to move to sentencing. Once the judge has the case, once the plea has been accepted by the court, the judge is fully within his right to sentence at that point in time. They could have appealed that to the district court, see what happened there, but this is a very unusual case, but flynn behaved very badly, sidney was spinning like a never seen anybody spin. He lied to the president , thats why the president fired him. He lied to the fbi, which is why he pled guilty. Ed obviously has chris just said, the judge could have set im going to go to sentencing but what the Justice Department said we are no longer pushing this case, there was no prosecution over and forward going on here . Thats correct. Its inexplicable, because when the government withdrew the case if anybody wants to read why, there is a 20 page filing with the court that is available online. It is jawdropping. The fbi concluded in december of 2016 that there was no reason whatsoever to continue the investigation of flynn. They found no collusion. The right of the paperwork just before the Christmas Holidays and an investigation. Somebody didnt but the paperwork through an arm and peter strzok writes an email to lisa page saying our competence is saving us. The paperwork was not turned in and i got permission from the seventh floor, meaning comeys office ed the leadership. To go forward with the interview. I mean, this is whether you like flynn or you dont like flynn, you look at that filing and it is a real problem. Ed he just let out some facts, why are you sighing . General flynn when he was dismissed by obama for incompetence behave like a bond villain. He sold his services to the russians and the dictator did not report that he was acting did not report that he was acting [inaudible] did not report a very he could have been indicted for that, that is so outrageous chris, free to talk about hold on a minute. Here we have governors who are just simply denying the evidence and ignoring the fact that keeping schools closed, theres no rationale for that. When you look at the 46 pediatric hospitals in north america that reported last week, the bottom line of the article was the risk of Critical Illness from covid19s far less than seasonal influenza. Anyone who keeps schools closed is not prioritizing the help of children. Ed i understand the rate, you understand that this has been deadlier in general than the common flu, that this has been extreme a dangerous and weve made that point again and again. He said in truth there is no good reason to reopen when the pandemic is still raging. Not getting the economy moving again, workers clamoring returning to work for the cost of extended income support because workers should be free to endanger themselves. How do you answer that . Theres no data there in that statement whatsoever and in fa fact, its ignoring the clear harms and this is what the piece i just wrote with my colleagues, we quantified the fact that the policy itself is killing people. Theres no rational reason that covid19 must stop at all costs. When you realize that the total cost quantified in terms of lives lost, every month of the lockdown is almost the same of the total amount of life loss from the pandemic itself. Ed fleshed out. If you mean suicides, you may drug overdoses. Give us an idea of what youre talking about. Sure, theres two categories that we analyze, one is the harm from locking down health care. Ive said before about 650,000 people with cancer on chemo, half of them didnt come in. 40 of acute strokes didnt call up emergency care. And twothirds of people are not getting cancer screening. More than half of children are not getting vaccinations. These can be quantified in terms of lives lost in the second category is the economic impact. The greatest economic disruption really in the history that weve ever seen in this stuff is translating into things like unemployment, suicide, alcohol. So we took just the suicide related loss from the unemployment. I mean im sorry, we just took the losses from the unemployment and we combined that for the health care loss, using all the actuarial tables, cdc tables, data from the literature and what we find is that the overall quantified lives lost, almost every month almost equals, in one month, with the pandemic costs, so into months, weve essentially tripled the damage. That means one times the pandemic plus two times the pandemic from the two months equals three for the governors out there, one plus two equals three. Ed it very simple math that you are trying to remind people of. Its some shocking numbers. Dr. Scott atlas, we certainly appreciate your insights tonight. Thank you. Ed dr. In the last few months, more americans have died from coronavirus that have died in the korean and vietnam wars combined. Soon, within the next week it will be more americans that have died of covid then died in world war i. This is unprecedented. I completely agree with the doctor that this has had an astounding toll not just on the economy but on our families and everyone that has died. I also worry. However, whats being presented is this false dichotomy between opening and Public Health. It cannot be an either or. Thats where we fail. No one is at odds with the lockdown. We think that they must work in sink of public professionals. And of the economic reality, my family has been impacted, many in my family have lost their jobs. These are unfortunate reality is that we need to live with right now but quite frankly as a neuroradiologist i expect his expertise but as an emergency medicine doctor that stood by and all the hands of someone people that died, i cant agree with this idea that we should just willynilly open things up and hope for the best. Ed so then my question is, hitters two different opinions from two respected doctors. Lets hear from governor andrew cuomo. Yes, not everyone is going to wear one and guest coming out of one feels like they are susceptible. I have seen 80yearolds died of coffee. I have seen 30yearold sty of covid good susceptible and right now so few americans, a small percentage have been infected with any type of immunity that we are almost all nearly susceptible. If people arent going to wear a mask, its a personal decision that has Public Health consequences. On the models. Yes, a lot of the models were wrong. Every epidemiologist will tell you do not trust the model, but look at what all of models are saying. Yes, a lot of the models were based on the fact that if we didnt do social distancing, if we didnt do lockdowns, we would have hundreds of thousands, one, 2 million deaths. We did those things and we did them while here, especially in new york city. What the models are going to tell you is we have a lot of deaths, that we are going to have a lot of deaths, we reacted to those, we kept them down but still had an unbelievable and really incalculable number of deaths and what we know now is that Going Forward unless we do the breadandbutter Public Health needs to be done right now, increasing our testing, looking at how we safely open in places because some places can safely open. Thinking about novel ways of providing care, especially telemedicine. If we dont focus on those things right now, we will have more cases throughout the summer. How did i find the ability to take off afraid . I have to reach back to other times in my life where i learned at a young age to take a little boat to my first job at 14 in the dark and go through some tough waters and get on the plane with combat boots to go off to basic training at the air force academy. And the people around me who encouraged me so that i learned how to take off afraid and its that kind of strength that really we need right now. Ed how do you give veterans hope who may come back from battle and, you know, already have scars and now amid the pandemic we are seeing people lose their jobs, may be losing their help, whats your message to them tonight . So, when men and women serve in uniform, ed, they have purpose, they have motivation, they have direction. They are hear part of high perfg teams. They are doing our nations work in combat and deployment around the world. They are engaged in hardships with men and women on the left and right and build bonds that last forever. And they come back home and as they transition on the military, they are still looking for that same kind of purpose, motivation and direction they are still looking to be part of the highperforming teams and theyre still trying to get that adrenaline rush that they would get in combat or on deployment buried and sometimes when that doesnt happen, that leads to issues that can drive them down a destructive path. My message to veterans, we are all in this together. We all share the same kind of hardships. Brothers and sisters, we understand whats going on through your mind and when time gets tough, we understand that you may need help, and its okay to reach out and seek help and thats why im so excited to be part of fit ops, to be part of the solution. Ed you know, james mattis of course, retired, president s defense secretary, he had an oped in the Washington Post reset among other things on this memorial day we may be keeping social distancing from one another, but that cannot detract from the sense of closeness, the sense of community, the sense of shared sacrifice that we build for one another on a day where we come facetoface with the human cost of freedom. I just what we need veterans that have served in combat and come home and may be challenged with ptsd or depression, theyre not looking for sympathy, understanding, but more broadly theyre looking to be utilized and have that same purpose and direction, so we, more and more, have to look for ways across Corporate America to continue to enlist veteran workers into our businesses and our corporations and thats why im so excited to be here at fit ops, where when you talk about troops and people being physically, mentally, and emotionally tough or hard, it starts with a physical foundation and thats why am happy that at fit ops, we train veterans as elite fitness trainers and get them out with some of our partners.
